<!-- image --> ## BYLAW # 2023-04 OF THE VILLAGE OF LINDEN IN THE PROVINCE OF ALBERTA TRAFFIC SAFETY BYLAW ## A BYLAW OF THE VILLAGE OF LINDEN, IN THE PROVINCE OF ALBERTA to regulate the traffic within the Village of Linden WHEREAS, pursuant to the Municipal Government Act, RSA 2000, c M-26, and amendments thereto (the "Act"), a council may pass bylaws for municipal purposes respecting the safety, health and welfare of people and the protection of people and property; and WHEREAS, the Traffic Safety Act, RSA 2000, c T-6, authorizes a Municipality to regulate and control Vehicle, animal and Pedestrian traffic and parking on the Streets and on other property within the Municipality; WHEREAS, pursuant to the Dangerous Goods Transportation and Handling Act, a Municipality may make bylaws with respect to Highways under its direction, control and management to designate a Dangerous Goods route, prohibit the carrying of Dangerous Goods on certain Highways, and establish restrictions or conditions necessary for public safety; and NOW THEREFORE, the Council of the Village of Linden, in the Province of Alberta, duly assembled, hereby enacts as follows: ## PART 1 - TITLE - 1.0 This Bylaw may be cited as the "Traffic Safety Bylaw". ## PART 2 - DEFINITIONS - 2.0 Except where otherwise defined in this Bylaw or in a context otherwise required by this Bylaw, all defined terms shall have the same meaning as is ascribed to them in the Traffic Safety Act, R.S.A. 2000, Chapter T-6, and all amendments and regulations thereto. - a. "Act" means the Traffic Safety Act, R.S.A. 2000, c. T-6, as amended or replaced from time to time; - b. "Alley" means a narrow highway intended chiefly to give access to the rear of buildings and parcels of land and is a Street for the purposes of this bylaw; - C. "Boulevard" means that part of a highway in an urban area that: - i. is not a roadway, and - ii. is that part of the Sidewalk that is not especially adapted to the use of or ordinarily used by Pedestrians; - d. "Chief Administrative Officer" means a Municipal Official in the responsible role of Chief Administrative Officer of the Village of Linden, or anyone authorized to act on their behalf; - e. "Commercial Vehicle" means a Vehicle operated on a highway by or on behalf of a person for the purpose of providing transportation but does not include a private passenger Vehicle; - f. "Council" shall mean the municipal Council of the Village of Linden, duly assembled and acting as such; - g. "Crosswalk" means: - i. that part of a Roadway at an Intersection included with the connection of the lateral lines of the Sidewalks on opposite sides of the Highway measured from the Curbs or, in the absence of Curbs, from the edges of the Roadway, or - ii. any part of a Roadway at any Intersection or elsewhere distinctly indicated for Pedestrian crossing by signs or by lines or other markings <!-- image --> ## on the road surface; - h. "Curb" means the concrete or asphalt edge of a Roadway or the division point between the Roadway and a Boulevard or Sidewalk; - i. "Cycle" means a bicycle or power bicycle, as those terms are defined the Use of the Highway and Rules of the Road Regulation, AR 304/2022; - j. "Disabled Persons Parking Zone" means a space or portion of a highway or parking lot set apart and designated exclusively for the parking of vehicles bearing a valid disabled placard or license plate issued or recognized by the Registrar of Motor Vehicle Services, and so marked with a sign or other marking authorized by the Chief Administrative Officer; - K. "Emergency Vehicle" means: - i. a Vehicle operated by a police service as defined in the Police Act: - ili. an ambulance operated by a person authorized to provide ambulance service in the Municipality; - ii. a fire fighting or other type of Vehicle operated by the fire protection service of a Municipality; - iv. a Vehicle operated as a gas disconnection unit of a public utility; - V. a Vehicle designated by regulation as an emergency response unit; 10. "Enforcement Officer" shall mean any member of the Royal Canadian Mounted Police (RCMP), Community Peace Officer, Bylaw Enforcement Officer or designate. Including, but not limited to, a person hired or contracted by the Village of Linden to enforce the provisions of this Bylaw; - m. "Fire Lane" means an access route for Fire Department Vehicles required by the Alberta Building Code for fire fighting purposes and marked by signage as a Fire - n. "Heavy Vehicle" means a Motor Vehicle, alone or together with any Trailer, semitrailer or other Vehicle being towed by the Motor Vehicle, with a registered gross weight of five (5) tonnes (5000 kg) or more or exceeding ten (10) meters in total length. A public passenger Vehicle, when engaged in the transport of passengers, shall be deemed to be excluded form the definition of a Heavy Vehicle for the purposes of this Bylaw; 13. "Highway or "Roadway" means any thoroughfare, Street, road, trail, avenue, parkway, driveway, viaduct, lane, alley, square, bridge, causeway, trestle way or other place or any part of any of them, whether publicly or privately owned, that the public is ordinarily entitled or permitted to use for the passage or parking of Vehicles and - i. a Sidewalk, including a Boulevard adjacent to the Sidewalk, - ii. if a ditch lies adjacent to and parallel with the Roadway, the ditch, and 16. ence and one side of the roadway, all the land between the fences, o all the land between the fence and the edge of the roadway, as th case may be, - iii. if a highway right of way is contained between fences or between a but does not include a place declared by regulation not to be a highway; - p. "Intersection" means the area embraced within the prolongation or connection of: - i. The lateral Curb lines; or 3. If there are not any lateral cub lines, the exterior edges of the Highways, of two or more Highways which join one another at an angle whether or not one Highway crosses the other; 9. "Loading Zone" means a portion of the Street adjacent to the Curb designated by Traffic Control Device for the exclusive use of Vehicles loading or unloading passengers or materials; - r. "Mobility Aid" means a device used to facilitate the transport, in a normal seated orientation, of a person with a physical disability. <!-- image --> - S. "Motor Vehicle" as defined in the Act means: 2. a Vehicle propelled by any power other than muscular power; - ii. or a moped, but does not include a bicycle, a power bicycle, an aircraft, an implement of husbandry or a Motor Vehicle that runs only on rails; - t. "Municipality" means the Village of Linden; - u. "Objectionable Noise" means any sound caused by or emanating from a Motor Vehicle that annoys or disturbs humans or endangers the health and safety of humans and includes: - i. The squeal of a tire made by a Motor Vehicle which is accelerating or changing direction, - ii. a roaring or explosive sound - ili. the sound of a radio, stereo, television or other device or amplification equipment, - iv. the sound from Vehicle-mounted amplification equipment, a bullhorn or other device used to amplify voices, which is continuously made for more than two minutes at the same location, - V. the sound of a Motor Vehicle security system which is made, - a. for a period exceeding one minute, or - b. more than three times in one 24 hour period, except for the Motor Vehicle security system's activation status signal, - vi. noise measured at 96 decibels (dBA) or more as measured by a sound pressure level meter at any point of reception; - V. "Operator" means the registered owner thereof, or if not the registered owner, the person operating or responsible for any motorized Vehicle or portable appurtenance; - w. "Parade or Procession" with the exception of a military Parade or funeral Procession shall mean any group of: 16. more than twenty (20) Pedestrians and/or, - ili. any combination of Pedestrians and vehicles which together exceed twenty (20) in number on a highway that is likely to block, obstruct, impede, hinder or otherwise interfere with Pedestrian or vehicular traffic on the Highway. - ii. more than 10(10 vehicles; and/or, - x. "Park," "Parked" and "Parking" or any word or expression of similar connotation or import shall mean a Vehicle remaining stationary in one place whether or not the Vehicle is occupied, except: - ii. when complying with a direction given by an Enforcement Officer or Traffic Control Device. 21. while actually engaged in loading or unloading passengers; or - y. "Pedestrian" means: 23. a person on foot, or - ii. a person in or on a Mobility Aid, and includes those persons designated by regulation as Pedestrians; - "Person" means any individual, corporation, society, association, partnership, trustee, executor, administrator, firm or other legal representative; - aa. "Private Road" (driveway) means an entrance from a roadway to private property or a road or space on private property designed for vehicular traffic that is not open to the general public; - bb. "Public Place" means any highway, parkland, public bridge, road, lane, footway, square, court, alley or passage, whether a thoroughfare or not, and includes any open space to which the public may have or are permitted to have access whether or bayment or otherwise, that is owned by the Village. - cC. "Recreational Pathway" means a path or trail that is not part of a highway, and which is designed primarily for the exclusive use of Pedestrians, cycles, rollerblades and skateboards. <!-- image --> - dd. "Recreational Vehicle" means a Vehicle or Trailer that is designed, constructed and equipped, either temporarily or permanently, as a dwelling place, living abode or sleeping place, but does not include a Vehicle so equipped if the Vehicle, without such equipment, is or was also manufactured as a passenger car. This shall include travel trailers, fifth-wheel trailers, motor homes, tent trailers, van conversions and truck campers. This shall not include a truck camper that is mounted to and used as daily transportation, utility trailers, snow mobiles, all terrain Vehicles, jet skis, motorcycles, or Trailers designed to carry the aforementioned 2. ee. "Sidewalk" means that part of a highway especially adapted to the use of or ordinarily used by Pedestrians, and includes that part of a highway between - i. the Curb line, or - ii. where there is no Curb line, the edge of the roadway, and the adjacent property line, whether or not it is paved or improved; 5. ff. "Specified Penalty" means a penalty for specific offences in this Bylaw as provided for in Schedule A of this Bylaw; 6. gg. "Stop" "Stopped" or "Stopping" means: - i. When required, a complete cessation from vehicular movement, and - ii. When prohibited, any halting, even momentarily, of a Vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with a direction given by an Enforcement Officer or Traffic Control Device. 9. hh. "Street" means any public thoroughfare for movement of Vehicles and Pedestrians and where the context so requires include the whole of the place between the boundaries of the Street as recorded in the Land Titles Office and includes an alley but does not include a parking lot. 10. "Street Furniture" means every Curb, Sidewalk, pole, traffic sign, waste receptacle, bench, enclosure, tree, plant, grass, hydrant, fence, utility, utility service or any other property belonging to the Municipality capable of being marked, defaced or damaged; 11. jj. "Track" means to allow, cause or permit any dirt, soil, mud, gravel, sand, clay, lime, fertilizer, manure, substance or material of any nature or kind whatsoever to become loose or detached or blow, drop, spill or fall from any Vehicle, appurtenances, or tires onto any highway; and the adjacent property line, whether or not it is paved or improved. This excludes snow or ice clinging to Vehicles due to winter conditions; 12. kk. "Traffic Control Device" means any sign, signal, marking or device placed, marked or erected under the authority of the Act or authorized by the Village or of this Bylaw for the purpose of regulating, warning or guiding traffic; - II. "Traffic Control Signal" means a Traffic Control Device, whether manually, electrically or mechanically operated, by which traffic is directed to Stop and to proceed; - mm. "Trailer" means a Vehicle so designed that it - i. may be attached to or drawn by a Motor Vehicle or tractor, and - ii. is intended to transport property or persons, and includes any Vehicle defined by regulation as a Trailer but does not include machinery or equipment solely used in the construction or maintenance of highways; 17. nn. "Truck Route" means a highway within the Village upon which the operation o Heavy Vehicles is permitted, and which has been designated as such in this Bylaw 00. "Vehicle" means (other than an Off Highway Vehicle) a device in, on or by which a person or thing may be transported or drawn on a highway and includes a combination of Vehicles but does not include a Mobility Aid; 19. pp. "Violation Tag" means a tag or similar documents issued by the Municipality pursuant to the Municipal Government Act, R.S.A. 2000, c.M-26, and amendments thereto; <!-- image --> 99. "Violation Ticket" means a ticket issued pursuant to the Provincial Offences Procedure Act, R.S.A. 2000, c. P-34, as amended and the regulations there under; 2. rr. "Work Zone" means an area designated by Traffic Control Devices as a Work Zone for the purpose of maintenance, construction, or repairs on or near a roadway. ## INTERPRETATION The following rules apply to interpretation of this Bylaw: - a. headings, titles, and margin notes in this Bylaw are for ease or reference only; - c. every provision in this Bylaw is independent of all other provisions and if any provision of this Bylaw is declared invalid by a Court, all other provisions of this Bylaw remain valid and enforceable; and - b. gender-specific words, phrases, and references are intended to be gender-neutral, and the singular includes the plural as the context requires; - d. references to bylaws and enactments in this bylaw include amendments and replacement bylaws and enactment, and regulations and orders thereunder. ## PART 3 - PARKING | Sidewalk and Boulevard | 3.1 | Unless a Traffic Control Device permits or requires, a Vehicle shall not be parked on a Sidewalk or Boulevard or any part of a Sidewalk or Boulevard. | |--------------------------|-------|---------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------| | Crosswalks | 3.2 | Unless a Traffic Control Device permits or requires, a Vehicle shall not be parked: a. An RV cannot be Parked on landscaped front yards, on Person's property | | Unattached Trailer | 3.19 | A Trailer shall not be Parked on a Highway unless attached to a Vehicle by which it may be drawn. | | Unattached Trailer | 3.20 | No Person shall occupy any Trailer parked on a Highway. | | Parallel Parking | 3.21 | Except where angle parking is permitted or required, a Vehicle Parked on a Highway shall be Parked: a. with: i. the sides of the Vehicle parallel to the Curb or edge of the Roadway, and ii. the right wheels of the Vehicle not more than 50( millimeters (19.7 inches) from the right Curb or edge of the Roadway, or | <!-- image --> Angle Parking Idling Vehicle - b. in the case of a one-way Highway where Parking on either side is permitted, with 2. the sides of the Vehicle parallel to the Curb or edge of i. - il. the wheels that are the closest to a Curb or edge of the Roadway not more than 500 millimeters (19.7 inches) - ili. the Vehicle facing in the direction of travel authorized for the Highway; 5. 3.22 Notwithstanding anything else in this bylaw a motorcycle may be Parked; - b. with: - a. at an angle, other than perpendicular, to the Curb or edge of the Roadway, and - i. a wheel of the motorcycle not more than 500 millimeters (19.7 inches) from the Curb or edge of the Roadway, and - ii. the motorcycle angled in the direction of travel authorized for the traffic lane that is adjacent to the lane on which the motorcycle is Parked 10. 3.23 parallel to any two of the guidelines, and - b. in the case of a motorcycle, with - a. in the case of a Vehicle other than a motorcycle, with one front wheel not more than 500 millimeters (19.7 inches) from the Curb or edge of the Roadway, or - i. a wheel of the motorcycle not more than 500 millimeters (19.7 inches) from the Curb or edge of the Roadway, - il. the motorcycle angled in the direction of travel authorized of the traffic lane that is adjacent to the lane on which the motorcycle is Parked 15. 3.24 When a sign indicates that angle Parking is permitted he Roadway; and - b. in the case of a motorcycle with: - a. in the case of a Vehicle other than a motorcycle, with on front wheel not more than 500 millimeters from the Curb or edge of the Roadway, or 18. a wheel of the motorcycle not more than 500 millimeters from the Curb or edge of the Roadway, and 19. the motorcycle angled in the direction of travel authorized for the traffic lane that is adjacent to the lane on which the motorcycle is Parked. 20. 3.25 A Vehicle with a total length exceeding 5.8 meters (19 feet shall not be Parked at an angle on a Highway unless: - a. a sign specifically permits such Parking; o 0. the Vehicle displays a valid Permit issued by the Village authorizing such Parking. 23. 3.26 No person shall Park any Vehicle with a motor running for more than 30 consecutive minutes. 24. 3.27 A Vehicle is not idling in contravention of this Bylaw if the Vehicle is: - b. an armored Vehicle engaged in the secure delivery or pick ip of goods; - a. idling due to traffic, an emergency or mechanical difficulty 27. . an Emergency Vehicl - d. a Vehicle that must remain idling to power a heating or refrigeration system required for the preservation of - e. a Vehicle that must remain idling to power any tools or equipment required for or incidental to the provision of services by the Village or a public utility; or - f. a Vehicle operated by agents or contractors engaged in the performance of duties authorized by the Village. | Vehicle on Jack | 3.28 | A Vehicle shall not be Parked and left unattended on a Highway if the Vehicle is on a jack or a similar device, and: a. one or more wheels have been removed from the Vehicle; b. part of the Vehicle is raised. | |-------------------------------|--------|-------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------| | Abandoned Vehicle | 3.29 | A Vehicle shall not be abandoned on a Highway. Emergency Vehicles; b. public utility Vehicles; c. Vehicles operated by agents or contractors engaged in the performance of duties authorized by the Village; d. Municipal or other government public works Vehicles; and e. Towing service Vehicles. | | Emergency Access | 3.38 | A Vehicle shall not be parked on a Highway in any location identified as a Fire Lane, emergency access zone or otherwise being for the use of Emergency Vehicles. | | Disabled Persons Parking 3.39 | | A Vehicle shall not be Parked on a Highway in any location identified as being for the use of Persons with disabilities unless the Vehicle: 2. disorized by the Province of lori cense plate issued or | - b. is being used for the transportation of a Person with a disability. | Private Property with Public Access | 3.40 | A Vehicle shall not be Parked on privately owned property which has been clearly marked by a Traffic Control Device, to which members of the public generally have access, unless permission or authorization of the owner of the property or Person having possession or control of the property has been given for such Parking. | act contrary to any Traffic Control Device, whether on public or private property. | merchandise across a Sidewalk or Boulevard where loading and unloading facilities are provided on the property to which the goods or merchandise are being delivered or from which they are being taken. | | Temporary Restricted Area 4.18 | | No Person shall pass beyond a control point as designated by an Enforcement Officer, a Village employee or a Traffic Control Device. | | Other Activities | 4.19 | A Person shall not ice skate upon a Roadway. | | | 4.20 | A Person shall not ride any sled, ski, toy Vehicle, tricycle, or other similar device on any Roadway, except for the purpose of crossing at a Crosswalk or Intersection. | | | 4.21 | A Person riding a bicycle, skateboard, sled roller skates, inline skates, skis, toy Vehicle or similar device shall not cling to or attach themselves or the device to a Vehicle on the Roadway. | | Street Furniture | 4.22 | No Person shall climb upon, deface, damage or otherwise nterfere with any Street Furniture, protection system, utilit ystem or public work of the Village | | Graffiti | 4.23 | No Person shall paint, chalk, stencil or mark any advertisement, legend or sign of any kind on any Highway, alley, pavement or Traffic Control Device within the Village. | | Sidewalk or Boulevard Crossing | 4.24 | Every owner or occupant of any land who, for the purpose o entering the land, is required to drive a Vehicle across Sidewalk or Boulevard, shall cause a crossing of such design | as approved by the Village to be constructed in place of the Sidewalk or Boulevard. | Damage to Painted Lines | 4.25 | No Person shall drive or walk on or over a newly painted wet line on any Roadway where the wet paint is indicated by signs, flags or other warning device. | |--------------------------------------|--------|-----------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------| | Distracting Lights | 4.26 | No Person shall place or allow to be placed, any light, or object that reflects light, in such a manner as to distract or interfere with the vision of any Person operating a Vehicle on a Highway. | | Gates | 4.27 | No owner or occupant of any property shall allow any gate located on the property swing or project over any portion ot ublic Highway. | | Highway Construction and Maintenance | 4.28 | No Person shall perform any construction or maintenance work on a Highway without a valid Permit issued by the Village. | | | 4.29 | No Person shall erect any temporary construction barricade without a valid Permit issued by the Village. | | Events, Parades and Processions | 4.30 | No Person shall organize, lead or participate in any event Parade or Procession on a Highway without a valid Permit issued by the Village. | - 4.31 An application for a Permit to hold an event, Parade or Procession on a Highway must be submitted to the Village at least 10 days prior to the date of the intended event, Parade or Procession and must provide at least the following information: - a. the purpose of the event, Parade or Procession; - b. the day, date and hours during which the event, Parade or Procession will be held; - c. the intended route and any Roadways to be closed; - d. the estimated number of Persons and Vehicles expected to participate; - e. the signatures and addresses of the Persons who will be in control of the event, Parade or Procession and who undertake to be responsible for the good order and conduct of the event, Parade or Procession and the participants therein; - f. proof of liability insurance and an indemnification to the Village in a form and amount satisfactory to the Chief Administrative Officer; - h. any other information reasonably required by the Chief Administrative Officer for the purpose of deciding to issue the Permit. - g. a traffic bypass plan developed by the applicant for review and approval; and Washing of Vehicles - 4.32 No Person shall wash, repair, or service a Vehicle on any Highway, Sidewalk, Boulevard, Median or Public Place within the Village in a manner that allows soap suds, mud, cement refuse, debris, tar, oil, grease, antifreeze or other vehicle fluids to flow onto or enter upon the Roadway, Sidewalk, Boulevard or Median or enter any storm water system. Vehicle Debris on Highway 4.33 No Person shall park a Vehicle on a Roadway or Public Place within the Village, that due to the state of the vehicle, results in mud, cement, refuse, debris, tar, oil, grease, antifreeze or other Vehicle fluids being deposit upon the roadway or Public Place lot or enter a storm water sewer system. ## PART 5 - VEHICLE OPERATION Speed Zones - 5.1 Subject to any lesser speed set out in this Bylaw, no Person shall operate a Vehicle on any Highway at a speed more than 50 kilometers per hour unless otherwise specified by a Traffic Control Device governing the Highway. Bicycles Mobility Aids ## Roller Skates, Roller or Blades, Skateboards Seizure of Items Animal Drawn Vehicle - 5.2 No Person shall operate a Vehicle in any Alley at a speed more than 20 kilometers per hours. - 5.3 No Person shall operate a Vehicle in any residential district ir excess of 30 kilometers per hour - 5.4 No Person shall operate a Vehicle at a speed more than 30 kilometers per hour within a posted Playground or School Zone between. - 5.5 Playground /School Zone speed limits: - greater rate of speed or the end of the Playground Zone. - a. begin at the point, where a Traffic Control Device indicates b. elat trepoint where a Trafic Control Device indicates a - 5.6 A Person may operate a bicycle on a Sidewalk if the bicycle has a wheelbase of less than 50 centimeters (19.6 inches) and if the Person is under the age of 18 years. - 5.7 Every Person operating a bicycle on a Sidewalk shall - b. when passing any Pedestrian, use all due care, attention and control required to ensure the safety of the Pedestrian; - a. yield the right of way to any Pedestrian - c. give an audible signal a reasonable amount of time before overtaking any Pedestrian by voice, bell or other audible warning device. - 5.8 Every Person operating a bicycie on a Highway shall - b. have an attached bell or other audible warning device; and - a. wear a helmet if under the age of 18 years - c. use an attached headlight and taillight if operating in the - 5.9 Mobility Aids may be driven on any Highway so long as they do not exceed twenty (20) kilometers per hour. - 5.10 Mobility Aids may also be driven on Recreational Pathways and Sidewalks so long as they yield the right of way to Pedestrians. - 5.11 Every Person shall roller skate, roller blade, ride a skateboard scooter, or operate any other similar device, with due care and attention having control of said device with regard to the nature, condition and use of the Roadway or Sidewalk and the amount and kind of Pedestrian traffic that is or might reasonably be expected to be upon the Roadway or Sidewalk - 5.12 No Person shall roller skate, roller blade, ride a skateboard or scooter, or operate any other similar device on any Highway where prohibited by a Traffic Control Device, or operate in any manner that interferes with the safety of any other Person or interferes with any other Person's use of a Highway for its intended purpose. - 5.13 Notwithstanding any other penalty, an Enforcement Officer may seize and confiscate any bicycle, skateboard, roller skates, roller blades, scooter or other similar device used or operated in contravention of this Bylaw, for a period not exceeding 30 days. - 5.14 Any item seized pursuant to this Part that is not claimed by its owner within 60 days of the last day of the period of seizure may be disposed of in accordance with any applicable legislation. - 5.15 The Person riding an animal or operating an animal drawn Vehicle on a Highway: Funeral Processions Engine Retarder Brakes Off Highway Vehicles Heavy Vehicles Vehicle Length and Weight Restrictions - a. shall be in control of the animal and any Vehicle at all times, and; - b. shall gather and dispose of any waste material. 3. 5.16 A Person driving a Vehicle in a funeral procession, other than the lead Vehicle in the funeral procession, may, during daytime hours, drive the Vehicle into an Intersection without Stopping the Vehicle if: - b. the Vehicle is travelling immediately behind the Vehicle in front of it in the funeral procession to form a continuous line of traffic; and - a. the Vehicle's headlights are on; - c. the passage into the Intersection can be made safely. 7. 5.17 No Person shall operate a Vehicle to break through the ranks 8. . a funeral procession; o 9. . any other authorized Parade or Processior 10. 5.18 No Person operating a Motor Vehicle shall use engine retarder brakes within the Village. 11. 5.19 Off Highway Vehicles are addressed in the Off Highway Vehicle Bylaw. 12. 5.20 No Person shall operate a Heavy Vehicle on any Highway that is not designated by the Chief Administrative Officer as a Truck Route. 13. 5.21 Notwithstanding anything else in this Bylaw, a Person may operate a Heavy Vehicle other than on a Truck Route only if the Heavy Vehicle is being operated on the most direct and practicable route between the destination premises or location and the nearest Truck Route for one of the following reasons: - a. delivering or collecting goods or merchandise or providing services at the premises of a customer - b. travellina to or from the business premises of the owner of the Heavy Vehicle pursuant to a valid Road Use Agreement; - d. travelling to or from commercial premises servicing or repairing Heavy Vehicles; - c. operating a Heavy Vehicle engaged in the moving of a structure or building for which a valid Permit has been issued; - e. towing or pulling a disabled Vehicle from a Highway; - g. operating any bus while picking up, transporting, or depositing passengers; or - f. travelling to or from the location of properly authorized construction, maintenance or repair work on a Highway; - h. travelling pursuant to a valid Permit issued by the Village or the Province of Alberta. 22. 5.22 A Vehicle, or a Vehicle with a Trailer attached, with a total length exceeding 10 meters (32 feet) shall not be Parked on a Highway: - b. in a location not adjoining residential property at any time after 7:00 p.m. and before 7:00 a.m. - a. in a location adjoining a residential property at any time; or 25. 5.23 A Vehicle, or a Vehicle with a Trailer attached, having a gross vehicle weight exceeding 4,500 or that weighs more than 4,500 kilograms, shall not be Parked on a Highway: - b. in a location not adjoining residential property at any time after 7:00 p.m. and before 7:00 a.m. - a. in a location adjoining residential property at any time; or 28. 5.24 In the absence of evidence to the contrary, a school bus is presumed to have a gross vehicle weight exceeding 5,500 kilograms. <!-- image --> | | 5.25 | Sections 5.21 and 5.22 do not apply if the Vehicle is: a. a Recreational Vehicle; or b. a Commercial Vehicle with hazard warning lights on, and in the process of loading or unloading goods. | |------------------------------|--------|--------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------| | Over Dimensional Vehicles | 5.26 | No Person shall operate an Over Dimensional Vehicle on a Highway without a valid Permit as per the Traffic Safety Act., RSA 2000, c T-6. | | Road Use Agreements | 5.27 | A Vehicle will not be considered in contravention of this Bylaw if the activity is permitted pursuant to a valid Road Use Agreement. | | Road Use Agreements | 5.28 | A Road Use Agreement permitting a contravention of this Bylaw, and any supporting documentation, shall be produced orthwith upon request by an Enforcement Officer or the Chie dministrative Officer | | Tracking | 5.29 | No Person shall operate a Vehicle in such a manner as to Track any material upon a Highway. | | Vehicle Without Rubber Tires | 5.30 | No Person shall operate a Vehicle having metal spikes, lugs, Tracks, cleats, skids, or bands projecting from the surface o he wheel or tire of the Vehicle, upon a Highway unless a vali Permit has been issued by the Village. This Section does not apply to the use of studded tires. | | Securing Loads | 5.31 | No Person shall operate a Vehicle containing a load on a Highway unless the load is completely covered by a tarpaulin or other device and secured in such a manner that no portion of the load can escape, blow, drop, spill or fall from the Vehicle onto a Highway or land adjacent thereto. | | Securing Loads | 5.32 | If any portion of a load being carried by a Vehicle becomes loose, detached, blows, drops, spills or falls from any Vehicle onto any Highway, the Operator of that vehicle shall immediately take all reasonable steps to warn others using the Highway to the presence of any material or obstruction and shall remove any material or obstruction from the Highway as soon as safely possible. | | Objectionable Noise | 5.33 | Person must not make, continue, or allow to be made ( ontinued any Objectionable Noise from a Motor Vehic | | Objectionable Noise | 5.34 | In determining what constitutes Objectionable Noise from withir or outside a Motor Vehicle consideration may be given, but are not limited to: a. a Motor Vehicle engine or exhaust system when such noises or sounds are loud, roaring or explosive; b. a Motor Vehicle horn or other warning device except when authorized by law, c. a Motor Vehicle operated in such a manner that the tires squeal, d. a load or tow of a Motor Vehicle which causes a banging, clanking, squealing, or other like noise or sound due to improperly secured load or equipment, or inadequate maintenance, e. a radio, television, CD player or other sound playback device, amplification equipment, or a musical instrument which can easily be heard by6 a Person outside the Motor Vehicle. If Objectionable Noise is caused by or emanates from a Motor | | Objectionable Noise | 5.35 | Vehicle parked on a Highway, that Motor Vehicle is illegally Parked and an owner of a Motor Vehicle may be liable for an! contravention of this section | 5.36 Section 5.34 does not apply to Persons participating in a properly authorized Parade or operating Emergency Vehicles. ## PART 6 - FIRE AND FIRE LANES | Fire Lines | 6.1 | In case of a fire within the Village, any Enforcement Officer or member of the Fire Department of the Village of Linden may designate in any manner a line or lines near the location of the fire beyond which no member of the public shall pass, and no authorized Person, whether on foot, on horse or in a Vehicle shall cross such line or lines. | |------------------------|-------|----------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------| | Moving of Vehicle | 6.2 | The Village of Linden Fire Chief or any Person acting under their direction is hereby empowered to move or cause to be moved any vehicle which they may deem necessary for the urpose of carrying out any duty, work or undertaking of tr illage of Linden Fire Departmen | | Traffic Control Device | 6.3 | No Person shall fail or refuse to comply with any Traffic Control Device or direction of an Enforcement Officer or of any Officer of the Fire Department at the scene of a fire or other emergency. | ## PART 7 - ENFORCEMENT | Offence | 7.1 | A Person who contravenes this Bylaw is guilty of an offence. | |-------------------------------|-------|------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------| | Owner Liable | 7.2 | In this Part, "owner" includes any Person registered as an owner of a Vehicle at the Motor Vehicle Registry. | | | 7.3 | If a Vehicle is involved in an offence under this Bylaw, the owner of that Vehicle is guilty of that offence. Persons with disabilities; designate Crosswalks upon any Highway and cause same to be marked; m. designate where Traffic Control Devices, either permanent or temporary, are to be erected; n. designate distances from any Intersection within which no Parking is allowed; o. designate any Intersection or place on a Highway, as a place at which no left hand turn or no right hand turn o both shall be made; p. designate any Intersection or place on a Highway, as a place at which only a left hand turn or a right hand turn shall be made; a. designate any Intersection or place on a Highway as a place where U-turns are prohibited; r. designate any Highway or portion thereof for one-way traffic s. designate any Roadway as one to be divided into traffic lanes of such number as is proper; designate Playground Zones as appropriate; designate Highways or any portion thereof as passenger or Commercial Vehicle loading and unloading spaces for such time limits as appropriate; v. designate transit bus stops and school bus loading or unloading w. designate portions of any Highway as no Parking or no Stopping as appropriate; x. designate angle Parking, or parallel Parking on any Highway or portion thereof as appropriate; prohibit or restrict the movement of Vehicles from a private |
