.r I "'- '-/ '-.J A BYLAW OF THE SUMMER VILLAGE OF POPLAR BAY RESPECTING ROAD USE AND PARKING RESTRICTIONS BYLAW NO. 197 WHEREAS, the Municipal Government Act being Chapter M-26 of the Revised Statutes of Alberta, 2000, Part 2, section 7 and 8 and amendments thereto, authorizes the Council of a municipality to pass bylaws pertaining to the protection of people, property and transportation systems, and WHEREAS, it has been found necessary to limit speed of traffic and to restrict parking within the boundaries of the Summer Village of Poplar Bay; and NOW THEREFORE, be it resolved that the Council of the Summer Village of Poplar Bay in the province of Alberta, duly assembled, enacts as follows: 1.1 Section 1 - Name Thisby-lawshallbeknownasthe"RoadUseandParkingRestrictionBylaw". 2.1 Section 2 - Definitions In this Bylawthefollowingterms(unlessthe contextspecificallyrequiresotherwise)shall havethefollowingmeanings: (a) "Chief Constable" means the Chief Constable of the bylaw enforcement service. (b) "Council" means the Council of the Summer Village of Poplar Bay. (c) "Highway", including road allowance, means any thoroughfare, street, highway, road, lane, trail, avenue, parkway, driveway, viaduct, lane, alley, square, bridge, causeway, trestle way or other place, developed or undeveloped, whether publicly or privately owned, any part of which the public is ordinarily entitled or permitted to use for the passage or parking of vehicles. (d) "Peace Officer" means a member of the Royal Canadian Mounted Police, a Special Constable, or a Bylaw Enforcement Officer, as defined in the Alberta Traffic Safety Act Sec 3d 190. (e) "Person" means any individual, corporation, society, association, partnership or firm. (f) "Public Vehicle" means a vehicle operated on a highway by or on behalf of a person for the transportation of: a. passengers, b. goods, or c. the vehicle itself, but does not include a private passenger vehicle. (g) "Summer Village" means the Summer Village of Poplar Bay. (h) "Vehicle" means a device in, on, or by, which a person or thing may be transported or drawn on a highway. Section 3 - Regulations 3.1 Speed: The maximum speed limit on any highway within the boundaries of the Summer Village of Poplar Bay shall be either 30 or 50 kilometers per hour on a seasonal basis as determined by policy #11-2005. 3.2 Off Highway Vehicle/ATV's: An off-highway vehicle may be operated on all roads within the municipal boundaries of the Summer Village, in accordance with this bylaw, provided that the owner and operator are licenced and the off-highway vehicle is registered and insured as provided for in the Alberta Traffic Safety Act. (Also subject to provisions of the bylaw to control the use of reserves, parks and pathways #201) Off-highway vehicles in the Summer Village are prohibited from operating between the hours of 11:00 p.m. and 8:00 a.m. ""'. '" '-' SUMMER VI~GE OF POPLAR BAY Road Use and Parking Restrictions bylaw #197 PAGE 2 Operators of all vehicles and off-highway vehicles shall be responsible for all damage incurred by operation of their vehicles in any reserve or park. 3.3 Parking: No motor vehicle or combination of vehicles shall park: . In such a manner as to obstruct a private driveway, or . On the travel portion of the highway within the boundaries qf the Summer Village, or . In any part of the Summer Village of Poplar Bay posted "NO PARKING", or . On any reserve. (Also subject to provisions of the bylaw to control the use of reserves, parks and pathways#201) Section 4 - Permits, Offenses and Penalties 4.1 Thepenaltiesfor violationsof thisbylawareasfollows: . Speed:as setbytheAlbertaTrafficSafetyAct. . Parking: (a) obstructing a private driveway, a fine of $50.00 (b) on the travel portion of the highway within the boundaries of the summer village a fine of $50.00 (c) in any area posted :NO PARKING a fine of $50.00 . Operation: (a) outside allowable hours fine (see Noise Bylaw #191) (b) damage (Also subject to provisions of the bylaw to control the use of reserves, parks and pathways#201) (c) unlicensed or not registered as per the Alberta Traffic Safety Act 4.2 Vehicles contravening any of the parking provisions of this bylaw are also liable to be towed away at the expense of the registered owner. Section 5 - Severability of Bylaw Provisions 5.1 Each separate provision of this Bylaw shall be deemed independent of all other provisions, and if any provisions of this Bylaw be declared invalid, all other provisions shall remain valid and enforceable. Section 6 - Repeal 6.1 This Bylaw repeals bylaw #96. Section 7 - Effective Date 7.1 This Bylaw shall come into force on the date of the final reading. Read a first time 10th,day of May 2006, AD.
