## SUMMER VILLAGE OF SEBA BEACH IN THE PROVINCE OF ABERTA BY-LAW NO. 3-2021
## BEING A BY-LAW TO AMEND BY-LAW NO. 378 RELATING TO THE PREVENTION AND REGULATION OF FIRES AND FIREWORKS
WHEREAS it is deemed necessary and expedient to amend Fire By-law No. 378 by replacing Bylaw 2-09 of the Summer Village of Seba Beach;
NOW THEREFORE, the Municipal Council of the Summer Village of Seba Beach in the Province of Alberta duly assembled under the powers of the Municipal Government Act RSA 2000 enacts the following amendments;
THAT By-law # 378 will be amended by the addition of Sections 10 (Penalty Listing) and 11 as follows:
## 11. FIREWORKS

- 11.b No person shall sell Consumer "low hazard" fireworks within the Summer Village of Seba Beach except on the 7 days immediately preceding New Years Day, Canada Day and Heritage Day.
- 11.c No person shall sell Consumer "low hazard" recreational fireworks within the Summer Village of Seba Beach to any person under the age of 18 years.
- No person shall discharge Consumer "low hazard" recreational fireworks within the Summer Village of Seba Beach, except as follows:
- Permits will be issued for the discharge of "high hazard" fireworks and discharged by professional pyrotechnicians from appropriate Federal or Provincial Authorities and those permits will be recognized as approval by Seba Beach.

20:00 hours July 1
Heritage Day 20:00 hours Sunday prior
to 00:30 hours January 1
to 00:30 hours July 2
to 00:30 hours Heritage Day
## By-law No. 3-2021
11.f All fireworks shall be stored, used and ignited in accordance with provisions of the Explosives Act (Canada) and Alberta Fire Code and their regulations and in accordance with those conditions determined solely by the Summer Village of Seba Beach.
11.g Any person who lights a fire or discharges fireworks for the purposes described in this bylaw is responsible to ensure it is conducted in a safe manner.
FURTHER THAT This Bylaw, Bylaw 3-2021, repeals and replaced Bylaw 2-09 upon Third Reading.

## SECTION 10 - Penalties
- A person who fails to comply with any provision contained in this Bylaw is guilty of an offence and is liable on a conviction to a fine of not more than $ 10,000 or to imprisonment to a term of not more than one year, or both.
- Where a person contravenes this Bylaw, the specified penalty payable is prescribed as follows
