## A BYLAW OF THE TOWN OF STAVELY, IN THE PROVINCE OF ALBERTA, TO CONTROL AND REGULATE VEHICLE, ANIMAL AND PEDESTRIAN TRAFFIC.
WHEREAS the Traffic Safety Act, and the Dangerous Goods Transportation Handling Act authorizes a municipality to regulate and control vehicle, animal and pedestrian traffic and parking on the highways and on other property within the municipality;
AND WHEREAS the Municipal Government Act allows a municipality to pass bylaws and delegate authority with respect to highways under its direction, control and management and transport thereon;
NOW THEREFORE, the Council of the Town of Stavely, in the Province of Alberta, enacts as follows:
1. This Bylaw may be referred to as the "Stavely Traffic Bylaw".
## EFFECTIVE DATE AND READINGS:
- 1.1 This Bylaw comes into full force and effect upon third and final Reading.
- 1.2 Bylaw No. #734, #808 & #766 is hereby repealed.
## 2. DEFINITIONS
The use of nouns and pronouns within this Bylaw are gender neutral and, accordingly, any reterence to one gender includes the other. Also, words in the singular include the plural and conversely, words in plural include the singular.
In this Bylaw, words shall have the same meaning as in the Traffic Safety Act and Regulations thereunder except as otherwise defined below.
- a. "ALLEY" means a narrow highway intended chiefly to give access to the rear of buildings and parcels of land;
- b. "BICYCLE" means a cycle which a person can ride regardless of the number of wheels it has, and includes a vehicle that;
1. may be propelled by muscular or mechanical power,
2. is fitted with pedals that are continually operable to propel it,
3. weighs not more than 35 kilograms,
4. has a motor that produces not more than 750 watts and that is driven by electricity or has an engine displacement of not more than 50 cubic centimeters,
5. has no hand-operated or foot-operated clutch or gearbox driven by the motor that transfers power to the driven wheel, and,
6. does not have sufficient power to enable it to attain a speed greater than 35 kilometers per hour on level ground within a distance of two kilometers from a standing start;
- c. "BOULEVARD" means, in an urban area, that part of a highway that:
1. is not roadway, and
2. is that part of a Sidewalk that is not especially adapted to the use of, or ordinarily used by pedestrians;
- d. "CAO" means the Chief Administrative Officer (CAO) of the Town of Stavely;
13. е. "COUNCIL" means the elected officials forming the municipal council of the Town;

1. that part of a roadway at an intersection included within the connection of the lateral line of the Sidewalks on opposite sides of the highway measured from the curbs, or, in the absence of curbs, from the edges of the roadway, or
2. any part of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by signs or by lines or by other markings on the road surface;
- g. "CURB" means that actual curb if there be one or, if there be no curb in existence, shall mean the diversion of a highway between that part thereof intended for the use of pedestrians;
- h. "DANGEROUS GOODS" means any product, substance, or organism specified in the regulations pursuant of the Dangerous Goods Transportation Handling Act, RSA 2000, Chapter D-4, or included by its nature in any of the classes listed in said regulations;
- i. "ENGINE BRAKE" means a device used in a truck or truck tractor to slow or brake the said vehicles by means of closing the exhaust valves on the engine of the said vehicles or other similar vehicles;
- j. "FIRE CHIEF" means the Fire Chief for the Town of Stavely and/or his designate;
- k. "HEAVY VEHICLE" means a motor vehicle, alone or together with any trailer, semi-trailer, or other vehicle being towed by the motor vehicle with a registration gross weight of 5,000 kilograms or more and/or exceeding 11meters in total length.
8. "HIGHWAY" means any thoroughfare, street, road, trail, avenue, parkway, driveway, lane, alley, square, or other place, whether publicly or privately owned, any part of which the public is ordinarily entitled or permitted to use for the passage or parking of vehicles and includes:
1. a sidewalk including a boulevard portion there,
10. where a ditch lies adjacent to and parallel with the roadway, the ditch, and
3. where the highway right of way is contained within fences or between a fence and one side of the roadway, all the land between the fences and edge of the roadway as the case may be, but does not include a place, declared within the said By-Law not to be a highway;
- m. "INTERSECTION" means the area embraced within the prolongation or connection of;
1. the lateral curb lines; if none,
2. the exterior edges of the roadway of two or more highways which join one another at an angle whether or not one highway crosses the other;
- n. "MOTOR VEHICLE" means
1. a vehicle propelled by any power, other than muscular power, but does not include a bicycle, an aircraft, a tractor, whether equipped with rubber tires or not, an implement or husbandry or a motor vehicle that runs only on rails;
- o. "OFF-HIGHWAY VEHICLE" means any motorized mode of transportation built for crosscountry travel on land, water, snow, ice or marsh/swampland or on other natural terrain and, without limiting the generality of the foregoing, includes, when specifically designed for such travel;
18. р. "OWNER" means the person who owns a vehicle and includes any person renting a motor vehicle or having the exclusive use thereof under a lease or otherwise for a period of more than ten days and is deemed to include a person to whom a Certificate of Registration for a vehicle has been issued;
- q. "PARADE OR PROCESSION" means the assembly of more than 10 (ten) persons or 10 (ten) vehicles utilizing a highway but does not include funeral processions or military exercise provided such federal processions or military exercise are being carried out pursuant to the provisions of the Traffic Safety Act;
- r. "PEACE OFFICER" means a member of the Royal Canadian Mounted Police, CPO, or ByLaw Enforcement Officer;
- s. "PEDESTRIAN" means a person afoot or a person in a wheelchair or a person operating a motorized scooter designed for mobility-challenged persons;

- t. "PLAYGROUND ZONE" means the portion of the highway identified as a playground zone by a traffic control device in the manner prescribed by regulations which;
2. begins at the point where there is a traffic control device indicating the playground zone or the commencement playground zone; and
2. it ends where there is a traffic control device indicating a greater rate of speed or the end of the zone;
- u. "PUBLIC VEHICLE" means a vehicle operated on the highway for the transportation of:
1. passengers,
2. goods, or
3. the vehicle itself but does not include private passenger vehicle;
- v. "ROADWAY" means that portion of a highway intended for vehicular traffic within the Town;
- w. "SIDEWALK" means that part of a highway primarily intended for the use of pedestrians and includes the part lying between the curb line or edge of the roadway, and the adjacent property line, whether or not paved or improved;
- x. "SIGN" means any sign outlines in the Land Use Bylaw #769;
- y. "TOWN" means the municipal corporation of the Town of Stavely;
- Z. "TRAILER" means a vehicle so designated that it may be attached to or drawn by a vehicle and intended to transport property or persons and includes any trailer that is designed, constructed and equipped as a dwelling place, living adobe or sleeping place, either permanently or temporarily, but does not include machinery or equipment used in construction or maintenance of highways;
13. aa. "TRAFFIC CONTROL DEVICE" means any sign, signage, marking, or device whether manually, electrically, or mechanically operated placed, marked, or erected under the authority of this bylaw for the purpose of regulating, warning or guiding traffic.
14. bb. "VEHICLE" means a device in, on or by which a person or thing may be transported or drawn on a highway and includes a combination of vehicles but does not include a mobility aid.
## 3. SPEED LIMITS
- 3.1 Unless otherwise provided by this bylaw, the speed limit within the Town of Stavely shall be 50 (fifty) kilometers per hour.
- 3.2 On any day no driver shall drive a vehicle within a Playground Zone at a greater rate of speed than 30 (thirty) kilometers per hour.
- 3.3 No person shall drive a vehicle in an alley at a greater speed than 20 (twenty) kilometers per hour.
- 3.4 The Town may post signs along the highway under construction or repair in state of disrepair to fix a maximum speed limit applicable to all vehicles or to any class or classes of vehicles traveling over any part of the highway.
## 4. TRAFFIC CONTROL DEVICES
- 4.1 The Town may prescribe where traffic control devices are to be located, including traffic control devices restricting the speeds of vehicles.
- 4.2 The Town shall place traffic control devices at such locations that may alter location for the following purposes;
- 4.2.1 to prohibit left-hand or right-hand turns;
- 4.2.2 to designate a roadway or portion thereof as a one-way street;

- 4.2.3 to control entry to a highway by the means of a "Stop" Sign or "Yield" Sign;
- 4.2.4 to designate a crosswalk;
- 4.2.5 to designate parking stands for the use of any particular class of vehicle;
- 4.2.6 to close or restrict the use of any highway to the full width;
- 4.2.7 to prohibit, restrict, or regulate the parking of vehicles or any particular class of vehicles on any highway;
- 4.2.8 to designate and mark guidelines for angles or parallel parking on any highway.
- 4.3 The Town shall keep a record of the location of all Traffic Control Devices within a policy.
## 5 SPECIAL EVENTS, PARADES AND PROCESSIONS
- 5.1 Any person desiring to hold a special event, parade or procession within the Town on public lands shall at least thirty (30) days prior to the time they desire to hold same shall formally inform the CAO via written letter or email and await approval from Council.
- 5.2 The Town may approve of a special event or, for any reason which appears to be proper, may refuse to allow a special event. In the case of a refusal, an applicant has the right to appeal to the Town.
- 5.3 No person shall hold or take in any parade or procession unless approval via Council has been issued for said special event, parade or procession.
- 5.4 Where a special event has been approved by Council pursuant to this section, the CAO and/or Public Works Foreman;
- 5.4.1 fix the hour and route of the special event;
- 5.4.2 give such direction to the applicant regarding such special event to prevent any necessary or unreasonable obstruction of a highway and tend to prevent a breach of peace;
- 5.4.3 may cause such temporary barriers or traffic control devices as may be deemed necessary.
## · SNOW VEHICLES/OFF-HIGHWAY VEHICLES
- 6.1 No person shall operate an off-highway vehicle as defined in the Traffic Safety Act on any portion of the highway, unless;
- 6.1.1 an individual has been authorized to operate an off-highway vehicle for the purpose of removing snow off sidewalks with a special permit granted from the CAO annually.
## 7 HEAVY VEHICLES
- 7.1 No person shall operate a Heavy Vehicle on a highway other than a highway designated as a truck route as per Policy 04-03 - Road Classification.
- 7.2 The following do not contravene section 7.1 of this bylaw if a heavy vehicle is operating on the shortest route between the premises or location concerned and the nearest truck route by person;
- 7.2.1 delivering or collecting goods or merchandise to or from the premises of Bonafide customers;
- 7.2.2 travelling to or from the business premises of the owner of the heavy vehicle;

## 11 BICYCLES
- 11.1 No person shall ride a bicycle on a sidewalk except;
- 11.1.1 when the person riding the bicycle in such a way that it will not interfere with a pedestrian lawfully on or using such sidewalk, footpath, or walkway.
## 12 PARKING
- 12.1 Unless approved traffic control devices indicate otherwise, all parking in Town shall be parallel.
- 12.2 Any person when parking parallel on a roadway shall park his or her vehicle parallel to the curb or edge of the roadway and;
- 12.2.1 with the right hand front wheel no further than 45.5cm (18 inches) from the curb.
- 12.3 No person shall leave a vehicle unattended on a highway if the vehicle has been placed on a jack or similar device, and;
- 12.3.1 one or more wheels have been removed from the vehicle, or
- 12.3.2 part of the vehicle is raised.
- 12.4 Unless required or permitted by the traffic control device or in compliance with the direction of a Peace Officer or other person duly authorized to do so, to avoid conflict with other traffic, a person shall not stop or park their vehicle;
- 12.4.1 on a sidewalk or boulevard,
- 12.4.2 on a crosswalk or any park of a crosswalk,
- 12.4.3 within an intersection other than immediately next to the Curb in a "T" Intersection,
- 12.4.4 at an intersection nearer than 5 meters (16.4 feet) to the projections of the corner property line immediately ahead or immediately to the rear, except when his vehicle is parked in a space where a traffic control device indicates parking is permitted,
- 12.4.5 within 5 meters (16.4 feet) upon the approach of any "Stop" sign or "Yield" Sign,
- 12.4.6 within 5 meters (16.4 feet) of any fire hydrant or when the hydrant is not located at the Curb, within 5 meters (16.4 feet) of the point on the curb nearest the hydrant,
- 12.4.7 within 1.5 meters (4.9 feet) of access to a garage, private road or driveway, or a vehicle crossway over a sidewalk,
- 12.4.8 alongside or opposite any street, excavation or obstruction when the stopping or parking would obstruct traffic,
- 12.4.9 at any place where a traffic control device prohibits stopping or parking during the times as stopping and parking is prohibited, or
- 12.4.10 on a roadway side of a vehicle parked or stopped at the curb of the roadway.
- 12.5 A person shall park their vehicle with the normal flow of traffic.
- 12.6 No vehicle may be parked at an angle to the curb in a cul-de-sac unless that vehicle is parked in such a manner as not to interfere with the free flow of traffic in the cul-de-sac.
- 12.7 No person shall park a public vehicle upon a roadway within the Town of Stavely unless specifically permitted or designated to be a parking area for such public vehicle and no person shall park a public vehicle upon a highway within the Town of Stavely where it is practical to park the public vehicle off the roadway in a designated parking zone and in no event shall a person park a public vehicle upon the roadway unless;

- 7.2.3 moving a house for which the necessary moving permits have been issues by the town;
- 7.2.4 travelling to or from a licensed repair facility for the purpose of repairing heavy vehicles;
- 7.2.5 pulling a disabled vehicle from a highway prohibited to heavy vehicles; or
- 7.2.6 driving heavy vehicles engaged in lawful public works or essential services requiring them by the very nature of such work to deviate from established truck routes.
- 7.3 A heavy vehicle operated pursuant to section 7.2 of this bylaw shall not exceed a speed of thirty (30) kilometers per hour.
- 7.4 No person shall park heavy vehicles upon any highway in the Town of Stavely.
## 8 MAXIMUM WEIGHT
- 8.1 Weight restrictions and regulations in connection thereto are hereby regulated by the provisions set out in the Motor Transport Act and amendments thereto.
## 9 DANGEROUS GOODS
- 9.1 Dangerous Goods must comply with the Dangerous Goods Transportation Handling Act, RSA 2000, Chapter D-4 and any amendments thereto.
- 9.2 No person shall park a vehicle used primarily for the conveyance of Dangerous Goods;
- 9.2.1 upon a highway; or
- 9.2.2 upon a property within fifteen (15) meters of a building except during the time such vehicle is necessarily motionless while delivering gasoline or oil to garages, retail dealers in gas and oil, or residential dwellings.
- 9.3 No person shall operate a vehicle conveying dangerous goods on a highway other than a highway designated as Level 1 in Policy 04-03 - Road Classification.
## 10 PEDESTRIANS
- 10.1 At a crosswalk at an intersection marked with lines a pedestrian shall cross either of the intersecting highways of the intersection within the limits of such lines.
- 10.2 No pedestrian or group of two (2) or more pedestrians shall stand or walk upon a roadway in such a manner;
- 10.2.1 as impeding or likely to impede traffic upon the highway;
- 10.2.2 the purpose of soliciting a ride;
- 10.2.3 to annoy or inconvenience any other person lawfully upon such highway;
- 10.2.4 to obstruct the entrance to a building; or
- 10.2.5 which prevents other persons using such highway and forthwith after the request has been made by a peace officer or other person duly authorized to do so, shall disperse and move away.
- 10.3 Nothing in Section 10 of this bylaw shall be constructed as prohibiting the assembly of persons for the purpose of watching a parade or procession duly authorized by the Town.
- 10.4 No person shall race or cause a race upon a roadway.

- 12.7.1 a clear and obstructed width opposite the vehicle is left for free passage of other vehicles thereon, and
- 12.7.2 a clear view of the parked vehicle may be obtained for a distance of 60 meters (196 feet) along the Highway in both directions.
- 12.8 Notwithstanding Section 12.7 except;
- 12.8.1 when a public vehicle is incapable of moving under its own power;
- 12.8.2 where some other emergency arises;
- 12.8.3 as otherwise permitted within this bylaw;
- 12.8.4 no person shall park a public vehicle on the roadway, parking lane or shoulder portions of the highway within the Town of Stavely.
- 12.9 Nothing in this section shall be construed to prohibited police vehicles, ambulances, fire trucks or vehicles engaged in highway repair, maintenance, or inspection work or by employees of the Town of Stavely or the applicable government agencies in carrying out their work upon the roadway when it is advisable to do so.
- 12.10 No person shall park in any truck loading or unloading space properly marked by a traffic control device indicating the restrictions which apply hereto except a commercial vehicle lawfully engaged in loading/unloading merchandise.
- 12.11 No person shall park their vehicle so it will in any way interfere with the use of a doorway intended as a fire or emergency exit from any building fronting or abutting a highway, or any private property where signs are displayed.
- 12.12 No person shall park their vehicle in an entranceway or exit to any Firehall.
- 12.13 Notwithstanding any other provision in this bylaw, the Town Foreman, Fire Chief or designated employee may cause movable signs to be placed on or near a roadway, such signs to read "No Parking". After such signs are placed on or near a roadway;
- 12.13.1 no person shall park or leave a vehicle on the signed portion of the roadway for any part of the twenty-four (24) hour period following the location of the sign thereon,
- 12.13.2 any vehicle that is on such roadway when such sign are placed thereon shall be removed promptly by the owner or operator,
- 12.13.3 when any emergency snow removal, street cleaning, or street repair commences on a signed roadway, any vehicle obstructing shall be removed, and
- 12.13.4 when it is practical, the vehicle on removal from the roadway being maintained, will be left nearby to minimize inconvenience and expense to its owner and operator.
- 12.14 No person shall park any trailer (whether designated for occupancy by person for the carrying of goods) upon any highway unless the said trailer is attached to a vehicle by which it may be propelled or drawn and when so attached the trailer shall be deemed part of the vehicle and subject to the regulations pertaining to vehicles.
- 12.15 No person shall park a vehicle or a vehicle with any type of trailer attached upon any highway if the overall length of the vehicle or the vehicle with trailer exceeds 7.5 meters (24 feet 6 inches). the foregoing restrictions shall not apply to prohibit;
- 12.15.1 Vehicles parked on a highway for the purpose of loading or unloading goods to or from premises abutting such highway.
- 12.16 No person shall park a vehicle or trailer on a highway if they do not bear a current license plate, this includes;
- 12.16.1 storing vehicles in residential yards or lot areas, or;

- 12.16.2 junked or wrecked vehicles or trailers or parts thereof being stored in residential yards or lot areas.
- 12.17 Yellow paint applied to the curb is hereby declared to be an official sign indicating that parking is prohibited where the curb is so marked.
- 12.18 No person shall park any trailer or recreational vehicle upon any highway, with the exception of loading and unloading for a maximum of 24 hours unless permission has been granted for special circumstances by the CAO or the Peace Officer, and the said trailer or recreational vehicle is attached to a vehicle by which it may be propelled or drawn and when so attached, the trailer shall be deemed a part of the vehicle and subject to the regulations pertaining to vehicles throughout this bylaw.
## 13 ACCESSIBLE PARKING
- 13.1 The Town is hereby authorized an empowered to establish such parking stands as deemed necessary for the exclusive use of disabled persons who operate or travel by vehicle. such established areas require the owner/operator of the vehicle to be accompanied by a portable place card from Alberta Registries identifying that vehicle is being used for the transportation of disabled persons.
## 14 TEMPORARY CLOSING TRAFFIC
- 14.1 In any case whereby reason of an emergency or of any special circumstances the Public Works Foreman, CAO, Fire Chief, Peace Officer or his designate, may in the public interest close traffic including pedestrian traffic on any portion of the highway.
## 15 MISCELLANEOUS OFFENCES
- 15.1 Every person shall be guilty of an offense who coasts on a highway on a sled, toboggan, or skis.
- 15.2 No person operating a vehicle shall pass or attempt to pass a school bus with flashing red lights activated.
- 15.3 No person shall, without authorization from the CAO or Public Works Foreman, deposit snow, ice, earth, rocks, trees, or other substances or objects on a Highway.
- 15.4 The Town may remove unauthorized deposits of snow, ice, earth, rocks, trees, or other substances or objects on the highway and charge the expenses to do so to the person responsible, in addition to any fine or penalty imposed.
- 15.5 No person shall drive across open land owned by the Town of Stavely.
- 15.6 No person shall willfully remove, throw down, deface or alter, injure or destroy a traffic control device placed, marked or erected on or beside a highway.
- 15.7 No person shall park or drive a vehicle on a sidewalk or boulevard-with the exception of 49th ave between 50th & 52nd street-as this section of street is the designated truck route.
- 15.8 No person shall, except in the case of an emergency, use an engine brake of any kind to slow or stop a motor vehicle.

## 16 PENALTIES
- 16.1 A person who contravenes any provision of this bylaw is guilty of an offense and liable to the penalties set out in;
- 16.1.1 Schedule A of the bylaw; and
- 16.1.2 not less than $150.00, and not exceeding $10,000.00.
- 16.2 Where a Peace Officer or Bylaw Officer believes a person has committed a breach of this bylaw, a Municipal Bylaw violation tag, a violation ticket pursuant to the Provincial Offences Procedure Act can be issued.
- 16.3 A Municipal Bylaw violation tag shall be in a form approved by the Town.
- 16.4 If a Municipal Bylaw violation tag is not paid within 21 days, a Peace Officer or Bylaw Officer is authorized and empowered to issue a violation ticket pursuant to the Provincial Offense Procedure Act.
- 16.5 Service of any notice or tag shall be sufficient if it is;
- 16.5.1 personally served;
- 16.5.2 served by regular mail; or
- 16.5.3 attached to the Vehicle in respect to which the offense is alleged to have been committed.
- 16.6 A person served with a violation ticket pursuant to section 16.2 of this bylaw may make a voluntary payment in respect of the summons served within the violation ticket as per Schedule A.
## 17 READINGS AND REPEALS
- 17.1 This Traffic Control Bylaw No. #859 shall take effect upon third and final reading
- 17.2 The Traffic Control Bylaw, being Bylaw #734, #808 & #766 is hereby repealed.
## 18 READINGS
- 18.1 Read a first time this 9th day of June, 2025
- 18.2 Read a second time this 23rd day of June, 2025.
- 18.3 Read a third time and finally passed this 23rd day of June, 2025.
