BYLAW NO. 1896-2024
BEING A BYLAW OF THE TOWN OF SYLVAN LAKE IN THE PROVINCE OF ALBERTA TO
REGULATE PEDESTRIAN AND VEHICLE TRAFFIC, PARKING, AND THE USE OF ALL
HIGHWAYS, SIDEWALKS AND PUBLIC PLACES IN THE TOWN OF SYLVAN LAKE.
WHEREAS the Municipal Government Act, RS.A 2000 Chapter M-26 provides that a municipality
has the direction, control and management of all roads within the municipality;
AND WHEREAS the Traffic Safety Act, RSA 2000, Chapter T-6, authorizes a municipality to pass
bylaws which govern, restrict, regulate and control vehicle, animal and pedestrian traffic; use of
highways, streets, sidewalks, lanes and other public places; and parking of vehicles;
AND WHEREAS the Municipal Government Act, RS.A 2000, Chapter M-26 authorizes a municipality
to pass bylaws respecting the safety, health and welfare of people and the protection of people and
property; activities and things in, on or near a public place or place that is open to the public; and
transport and transportation systems;
NOW THEREFORE the Municipal Council of the Town of Sylvan Lake duly assembled enacts as
follows:
TITLE
1. This Bylaw may be cited as the "Traffic Safety Bylaw".
DEFINITIONS
2. The definitions contained in the Traffic Safety Act RS.A 2000, c. T-6 and Regulations
thereunder shall apply to this Bylaw unless a contrary intention is stated in this Bylaw.
3. In this Bylaw:
a) "CAO" means the Chief Administrative Officer for the Town of Sylvan Lake, or the
CAO's authorized designate;
b) "Controlled Spaces" means that portion of a street or parking lot where parking is
subject to charge and regulation in accordance with the applicable Traffic Control
Device.
c)
"Council" means the Municipal Council of the Town of Sylvan Lake;
d) "Curb" means the actual concrete or asphalt curb, or in the absence of one, the
dividing line of a Highway between the edge of the roadway and that part of the
Highway not intended for vehicular use;
e)
"Drop-Off Only" means a space, zone, or portion of a Highway adjacent to a Curb
designated by a Sign placed by the Town permitting stopping of a Vehicle therein
while under continuous supervision of the driver and only for the period necessary
while actively engaged in loading or unloading passengers;

f)
"Emergency Vehicle" means emergency vehicles of every nature and kind including,
but not limited to, fire trucks, ambulance services, police services, peace officer
agencies, and bylaw enforcement services, while such vehicle is engaged in active
service;
g)
"Firefighter" includes a fulltime or volunteer firefighter;
h)
"Highway" means any thoroughfare, street, road, trail, avenue, parkway, driveway,
viaduct, lane, alley, square, bridge, causeway, trestle way or other place or any part
of any of them, whether publicly or privately owned, that the public is ordinarily
entitled or permitted to use for the passage or parking of vehicles and includes (i) a
sidewalk, including a boulevard adjacent to the sidewalk, (ii) if a ditch lies adjacent
to and parallel with the roadway, the ditch, and (iii) if a highway right of way is
contained between fences or between a fence and one side of the roadway, all the
land between the fences, or all the land between the fence and the edge of the
roadway, as the case may be, but does not include a place declared by regulation
not to be a highway;
i)
"Loading Zone" means a portion of a street set aside adjacent to a Curb designated
by a Sign for the exclusive use of Vehicles for the sole purpose of loading or
unloading of passengers or goods;
j)
"Mobility Aid" means a device used to facilitate the transport, in a normal seated
orientation, of a person with a physical disability;
k)
"Municipal Tag" means a ticket issued on behalf of the Town in a form prescribed by
the CAO for a bylaw offence;
I)
"Objectionable Noise" means any sound caused by or emanating from a motor
Vehicle that annoys or disturbs humans or endangers the health and safety of
humans and includes:
i.
a roaring or explosive sound, or
ii.
the sound from Vehicle-mounted amplification equipment, a bullhorn or other
device used to amplify voices, which is continuously made for more than two
minutes at the same location, or
iii.
the sound of a diesel engine which has been idling or otherwise running
continuously for more than five minutes at the same location except where
the diesel engine is located within a garage or location as permitted by the
Land Use Bylaw and intended for its long term parking; or
iv.
the sound of a motor Vehicle security system which is made for a period
exceeding five minutes, or more than three times for any duration in one 24-
hour period, except for the motor Vehicle security system's activation status
signal;
m) "Parade or Procession" means any group of pedestrians or Vehicles or a combination
thereof (other than a funeral or military procession), marching, walking, running,
standing, proceeding or riding upon Town property or a Highway with the Town;

n) "Parking Contractor" means a corporation, agency, or other entity under contract with
the Town to manage and operate public parking facilities for the Town.
o) "Pathway System" means a multi-purpose thoroughfare designated by the Town
from time to time and set aside for use by pedestrians, cyclists and persons using
wheeled conveyances, which is improved by asphalt, concrete, stone, or brick,
whether or not it is located in a park, and includes any bridge or structure with which
it is contiguous.
p) "Payment Terminal" means a device operated and maintained by the Parking
Contractor for the collection of parking fees and the regulation of parking spaces.
q) "Peace Officer'' includes a member of the Royal Canadian Mounted Police, a Bylaw
Officer as appointed by the Town, and a Community Peace Officer as appointed by
the Solicitor General of Alberta;
r)
"Phone Payment Service" means an account with the Parking Contractor that is
activated when an owner or' operator, by calling a phone number listed on the
payment terminal, records the zone in which the Vehicle is parked, the license plate
of the parked Vehicle, and the time required for the use of the parking space;
s)
"Playground Zone" means that portion of a Highway identified as a Playground Zone
by a Traffic Control Device;
t)
"Recreational Vehicle" means a vehicle or trailer designed, constructed, modified, or
equipped as a temporary dwelling or sleeping place for travel, vacation, or recreation
use, and includes, but is not limited to, campers, tent trailers, fifth wheel travel trailers
and motor homes;
u) "Residential District" has the meaning set out in the Town's Land Use Bylaw;
v) "School Zone" means that portion of a Highway identified as a School Zone by a
Traffic Control Device;
w) "Sidewalk" means that part of the Highway especially adapted to the use of or
ordinarily used by pedestrians and includes that part of a Highway between the curb
line or, where there is no curb line, the edge of the roadway, and the adjacent
property line whether or not it is paved or unpaved;
x) "Sign" or "Traffic Control Device" means any Pay Terminal, sign, signal, marking, or
device placed, marked or erected under the authority of this Bylaw for the purpose of
regulating, warning or guiding as defined in the Traffic Safety Act of Alberta and
regulations thereunder;
y)
"Town" means the Corporation of the Town of Sylvan Lake, or the area contained
within the corporate boundaries of the Town, as the context requires;
z)
"Town Parking Lots" means any land owned or controlled by the Town designated
for parking where parking is authorized by the terms and conditions of a Sign,
including a Payment Terminal, on the subject land.
aa) "Vehicle" shall include a trailer, unless the context requires otherwise. It does not
include a non-motorized bicycle, skateboard, long-board, scooter or roller blades;

bb) "Violation Ticket" means as defined in the Provincial
Offences Procedure Act,
RSA 2000, c. P-34;
PARKING
Parking On Private Land
4.
No person shall park a Vehicle on private land which has been clearly marked by a Sign,
containing the words "No Parking on Private Property. Unauthorized Vehicles will be Towed
at the Owner's Expense", or words to the like effect, erected by the owner, tenant, or their
agent, at the entrance to, or within the boundaries of, such private land, unless such person
has obtained the permission of the owner, tenant, occupant or person in charge of the said
private land.
a)
The Town is not responsible for any enforcement, towing, removal or impounding or
associated charges
5. No person shall park a Vehicle on a parking lot on private land to which the public has access,
contrary to the terms, conditions, or prohibitions contained in a clearly marked Sign erected
by the owner, tenant, occupant or person in charge of such private land, at the entrance to,
or, within the boundaries of, such private land.
Parking On Town Land
6. No person shall operate or park any Vehicle at any time on any land owned by the Town,
including, but not limited to, parks, boulevards or green spaces, without first obtaining written
permission from the Town to do so.
7.
Notwithstanding Section 6, parking is permitted on Town land that the Town may designate
by Signs for Vehicle parking.
8. Section 6 shall not apply to an Emergency Vehicle or a Town owned Vehicle.
ABANDONED VEHICLES
9. No person shall park a Vehicle on a Highway that is not a parking lot at the same location
in excess of 72 consecutive hours.
10. Where public parking is permitted on public or private property, no person shall park a Vehicle
at the same location in excess of 48 hours, without the express or implied consent of the
owner or person in lawful possession or control of the property.
11. A Vehicle left parked at a location referred to in Sections 9 or 10 in excess of the time
specified shall be deemed to have been abandoned at that location for the purposes of this
Bylaw.
ALLEYS
12. No person shall park a Vehicle in an alley unless a Sign permits parking at that location.
13. Notwithstanding Section 12, alleys may be used for the:

a) loading or unloading of goods from a commercial Vehicle for a period not
exceeding 30 minutes; or
b)
loading or unloading of goods or passengers from a Vehicle, other than a
commercial Vehicle, for a period not exceeding 5 minutes;
provided the Vehicle concerned is attended at all times and does not obstruct the passage
of other Vehicles or persons along the alley.
RECREATIONAL VEHICLES
14. No person shall park a Recreational Vehicle on any Highway within the Town.
15. Notwithstanding Section 14, non-residents of the Town may park a Recreational Vehicle on
a Highway within the Town between April 1 and October 31 of a calendar year, except along
Lakeshore Drive and 50th Street, where parking a Recreational Vehicle is prohibited year
round.
16. Notwithstanding Section 14, residents of the Town may park a Recreational Vehicle on a
Highway adjacent to their residence between April 1 and October 31 of a calendar year in
accordance with Section 15. Any Recreational Vehicle parked on a parcel shall be parked in
accordance with the Town Land Use Bylaw.
17. Non-residents or residents who park a Recreational Vehicle pursuant to Sections 15 or 16
shall park it in such a manner that it does not protrude into a roadway, alley or Sidewalk,
or pose a traffic or safety hazard.
18. In a Residential District, non-residents and residents who park a Recreational Vehicle
pursuant to Sections 15 and 16, shall not park a Recreational Vehicle on a Highway
immediately adjacent to, or, directly in front of, a residence, without the consent of the owner
or occupant of that residence.
19. A Recreational Vehicle parked pursuant to Sections 15 or 16 can remain parked in one place
for a period of 72 consecutive hours, after which time it shall be removed to an off- Highway
location for at least 48 hours before it may be parked again on a Highway within the Town.
20. No person shall occupy any Recreational Vehicle as a dwelling or sleeping place at any time
while it is parked on a Highway. Such use of a Recreational Vehicle may take place only at
an approved campground or area designated for parking Recreational Vehicles for the
purpose of occupation.
21. No person shall park any trailer upon any Highway unless the said trailer is attached to a
Vehicle by which it may be propelled, or drawn, and when so attached, the trailer shall be
deemed part of the Vehicle and subject to the provisions pertaining to Vehicles.
ANGLE PARKING
22. All angle parking zones shall be marked by Signs.

23. Where angle parking is permitted or required and parking guidelines are visible on the
roadway, a driver shall park his Vehicle:
a)
between and parallel to any 2 of the guidelines; and
b)
with one front wheel not more than 500 millimeters from the Curb or edge of the
roadway.
24. Where angle parking is permitted or required and no parking guidelines are visible a driver
shall park his Vehicle:
a)
at an angle of between 30 and 60 degrees to the Curb or edge of the roadway,
and
b)
with one front wheel not more than 500 millimeters from the Curb or edge of the
roadway.
PARALLEL PARKING
25. When parking a vehicle on a roadway, a person may only park a vehicle
a)
With
i.
The sides of the vehicle parallel to the curb or edge of the roadway, and
ii.
The right wheels of the vehicle not more than 500 millimeters from the right
curb or edge of the roadway,
OR
b)
In the case of a one-way highway where parking on either side is permitted, with
i.
The sides of the vehicle parallel to the curb or edge of the roadway,
ii.
The wheels that are the closest to the curb or edge of the roadway not
more than 500 millimeters from the curb edge, and
iii. The vehicle facing in the direction of travel authorized for the highway.
CONTROLLED PARKING SPACES
26. The CAO may authorize parking spaces on any street or in any parking lot to be designated
as Controlled Spaces and cause to be installed a Payment Terminal for the payment for the
use of a space.
27. No owner or operator shall allow a Vehicle to remain in a Controlled Space for longer than
the period of time indicated on the applicable Traffic Control Device or in the instructions on
the Payment Terminal.
28. The owner or operator shall pay for the use of the Controlled Space in accordance with the
instructions on the Payment Terminal or given by the Phone Payment Service.
29. Payment may be made at the Payment Terminal either by:
a)
the deposit offunds; or
b)
electronic payment by credit card; or
c)
the activation of an account by a Phone Payment Service.

30. No owner or operator of a Vehicle shall allow such Vehicle to remain in a Controlled Space
for longer than the period of time for which payment is made.
31. No owner or operator of a Vehicle shall allow such Vehicle to remain in a Controlled Space
for longer than the period of time permitted by the applicable Traffic Control Device.
32. After the issuance of a Municipal Tag or Violation Ticket concerning a Vehicle for a first
violation of Sections 26, 29 or 30, should such Vehicle be found in the same Controlled
Space for a further period, a subsequent violation shall be deemed to have occurred and a
further Municipal Tag or Violation Ticket may be issued for a second or subsequent violation
of Sections 26, 29 or 30.

33. Where parking spaces have been marked, no owner or operator shall stop or park, or, allow
the stopping or parking of, any Vehicle other than:
a) wholly within the Controlled Space; or
b) between the lines or markings indicating the limits of a single parking space.
34. Notwithstanding the provisions of Section 32, where parallel parking is permitted, a Vehicle
or a combination of a Vehicle and attached trailer, may be parallel parked in two adjoining
Controlled Spaces, both parallel to the curb if the required payment is made for 2 Controlled
Spaces.
35. Notwithstanding any provision in this Bylaw, all Vehicles owned or under contract to the
Town, any emergency Vehicles such as ambulances, fire trucks, police or enforcement
Vehicles, as well as any utilities service including telephone, electrical, natural gas and cable
vision services are hereby exempt from Sections 26 to 33, when parked in performance of
their duties.
36. No owner or operator of a Vehicle may park such Vehicle in a Controlled Space:
a) where prohibited by a Traffic Control Device; or
b)
contrary to the instructions on the Payment Terminal.
37. Immediately after parking a Vehicle in a Controlled Space, the owner or operator shall
purchase the use of the space by inputting on the Payment Terminal or the Phone Payment
Service the:
a) zone in which the Vehicle is parked;
b) the license plate number of the Vehicle parked on the zone Controlled Space; and
c)
depositing a form of payment described in Section 28.
TOWN PARKING LOTS
38. Council may, by resolution, designate such Town owned lands as it deems necessary as
Town Parking Lots in which parking stalls may be rented to persons.
39. No person shall park a Vehicle on a Town Parking Lot in contravention of the prohibitions
stated on any Sign at the entrance to, or within the boundaries of, such lot.
40. No person shall store any Vehicle in any Town Parking Lot without a permit. A Vehicle shall
be deemed to be stored when it remains in the parking lot for 36 consecutive hours or
longer. Any Vehicle so stored may be removed and stored by the Town and the costs thereof
shall be charged to and shall be payable by the owner of the Vehicle; in addition to any fine
or penalty imposed with respect to any violation.
41. The Town shall not be liable for any loss or damage howsoever caused that may occur to
any personal property, including a Vehicle, while any Vehicle is parked on any Town Parking
Lot, or upon any Town Lands, or as a result of any removal and/or storage pursuant to
Section 39.

DISABLED PARKING
42. Parking spaces for persons with disabilities shall be marked by Signs posted by the Town.
43. No person shall stop or park a Vehicle in a parking space, or any part thereof, that is marked
or designated for the use of persons with disabilities, unless:
a) the Vehicle displays a placard or license plate issued or recognized by the
Registrar for a person with a disability; and
b) the Vehicle is operated by, or, is being used to transport, a person with a disability.
44. Where, pursuant to Section 42, the Vehicle is identified by a placard for a person with a
disability, the owner or operator shall have such placard visibly displayed while the Vehicle
is stopped or parked in a parking space designated for disabled parking.
LOADING ZONE
45. The loading and unloading of goods to or from a Vehicle to businesses on 50th Street shall
take place at the rear or side of such business. No loading or unloading of goods to or from
a Vehicle shall take place at the front of any business located on 50th Street.
46. No person shall stop or park a Vehicle in a Loading Zone for a period exceeding:
a) 5 minutes if loading or unloading, passengers or goods, into or from, a Vehicle that
is not a commercial Vehicle; and
b) 30 minutes if loading or unloading goods, into or from, a commercial Vehicle.
RESTRICTIONS AND PROHIBITIONS ON STOPPING AND PARKING
General Provisions
47. Except as required or permitted by this bylaw, by a Traffic Control Device, or in compliance
with the directions of a Peace Officer, a person shall not stop, park, or leave standing, an
attended or unattended Vehicle:
a)
adjacent to a curb painted yellow, or any portion thereof;
b) adjacent to a curb painted blue, or any portion thereof, unless in accordance to
Sections 42 and 43;
c)
on a Sidewalk or boulevard;
d)
on a crosswalk;
e) within an intersection other than immediately next to the Curb in a "T" intersection;

f)
at an intersection nearer than 5 metres to the projection of the lateral Curb line of the
Highway at right angles to the direction of travel of the Vehicle;
g)
within 5 metres of the approach to a stop Sign or yield Sign;
h)
within 5 metres of any fire hydrant, or when the hydrant is not located at the Curb,
within 5 metres of the point on the Curb nearest the hydrant;
i)
within 1.5 metres of an access to a garage, private road or driveway, or a Vehicle
crossway over a Sidewalk;
j)
within 5 metres of the near side of a marked crosswalk;
k)
alongside or opposite any street excavation or obstruction when the stopping or
parking would obstruct traffic;
I)
at any other place where a Traffic Control Device prohibits stopping or parking,
during the times stopping or parking is so prohibited;
m) on the road side of a Vehicle parked or stopped at the Curb or edge of the roadway;
n) on a Highway in excess of the time designated and marked on a Sign posted for
the purpose of restricting the time for parking a Vehicle in that location;
o) at or near the site of any fire, accident or other emergency, if stopping or parking
would obstruct traffic or hinder Emergency Vehicles or peace officers, firemen,
ambulance drivers or assistants or rescue officers or volunteers;
48. No person shall park a Vehicle in a Drop-off Only zone.
49. No person shall park any Vehicle, off-highway Vehicle, boat or trailer (empty or loaded) in
a vacant lot in a Residential District.
50. In order to determine the time which a Vehicle has been parked in a location where parking
is restricted to a specific time, a Peace Officer or other person authorized to enforce this
Bylaw, is hereby authorized to place an erasable chalk mark on the tread face of the tire of
a parked Vehicle without that person or the Town incurring any liability for doing so.
51. No person shall remove an erasable chalk mark placed under Section 49 while the Vehicle
remains parked in the location where it was marked.
Second Offence
52. After a Municipal Tag or Violation Ticket has been issued regarding a Vehicle for a first
violation of Section 46 and, should the Vehicle remain parked in the same space in excess
of the time permitted on the Sign for a further period, a second violation shall be deemed to
have occurred.

Street Maintenance
53. The CAO is hereby authorized to make provisions and regulations in times of emergencies
such as snow removal, street cleaning or maintenance and in areas where construction or
repairs are being carried out upon or near Highways, related to the control and regulation of
traffic, and may:
a)
designate any Highway or area as one which is closed temporarily in whole or in part
to traffic;
b)
designate any area as one in which parking privileges are temporarily suspended;
and
c)
cause moveable Signs to be posted 24 hours in advance of street maintenance on
or near a roadway containing the words "STREET MAINTENANCE- NO PARKING"
or words to the same effect so as to prohibit parking until the Sign is removed by the
Town.
54. After the expiration of 24 hours from the time a Sign or Signs referred to in Section 52(c)
have been placed and until such Sign or Signs have been removed by the Town, no person
shall park, or leave parked, a Vehicle on a Town block.
55. Any Vehicle parked, or left parked, in contravention of Section 52 may be tagged or ticketed
and towed at the owner's expense.
Exemption From Parking Provisions
56. Nothing in this Bylaw prohibits a person from driving, stopping or parking a Vehicle that is:
a)
owned by, or, under contract to, the Town;
b)
an Emergency Vehicle;
c)
a towing service Vehicle; or
d)
a public utilities Vehicle, such as telephone, electrical, natural gas and cable vision
system,
while such Vehicle is being operated in the performance of that person's duties.
57. The CAO may issue a card, placard, sticker, permit or any other form, to an owner of a parcel
as defined by the Land Use Bylaw, within the Town, authorizing parking of a Vehicle or
exempting a Vehicle from the provisions of any section of this bylaw as recorded on the said
card, placard, sticker, permit or other form.
OFF-HIGHWAY VEHICLES AND MAINTENANCE EQUIPMENT
58. A Peace Officer, Town employee or agent of the Town, may operate off-highway Vehicles
or maintenance equipment on Highways, or land owned by the Town, where such operation
is required in connection with the duties of that person or in case of emergency.

OBJECTIONABLE NOISE FROM MOTOR VEHICLE
59. No person shall make, continue, or, allow to be made or continued, any Objectionable Noise
from a Vehicle.
60. Sections 57 and 58 do not apply to persons participating in parades or operating Emergency
Vehicles.
MOTOR VEHICLE SMOKE
61. No owner or operator of a Vehicle shall permit the operation of a Vehicle on a street while
that Vehicle is discharging a plume or trail of visible smoke from its exhaust pipe or exhaust
system.
PEDESTRIANS AND JAYWALKING
62. No person shall stand, sit or lie on any Highway or Sidewalk so as to obstruct the entrance
to buildings or to obstruct or prevent other persons using such Highway or Sidewalk.
63. After a request has been made by a Peace Officer to move, such person shall disperse and
move away.
64. A person shall not cross, or attempt to cross, from one side of a roadway to the other side,
at any point other than within a crosswalk.
65. Within a crosswalk, a person shall not cross, or attempt to cross, from one side of a
roadway to the other side when a Traffic Control Device prohibits such crossing.
66. Peace Officers are exempt from Section 63 and 64 in the course of their duties.
SIDEWALKS
67. No person shall operate or park a Vehicle on the Pathway System or on any Sidewalk,
pedestrian overpass, bicycle path or pedestrian path within the Town.
68. Notwithstanding Section 66, any Mobility Aid, wheelchair, motorized wheelchair or power
chair designed for the purpose of increased mobility for persons with disabilities may be
operated on the Pathway System, a Sidewalk, and bicycle or pedestrian paths within the
Town.
BICYCLES, SKATEBOARDS, LONG-BOARDS, SCOOTERS, ROLLER BLADES
69. A person may operate a bicycle on a Sidewalk where not prohibited by Signs.
70. A person may operate a bicycle on any part of the Pathway System within the Town where
not prohibited by Signs.

71. No person shall operate a bicycle, skateboard, long-board, scooter or roller blades on a
Sidewalk, Pathway System, or area on which the operation of the same is prohibited by
signage. Where signage prohibits the operation of a bicycle, it also prohibits skateboards,
long-boards, scooters, and roller blades.
72. No person shall operate a bicycle, skateboard, long-board, scooter, or roller blades on any
street furniture, railing or staircase.
73. Notwithstanding Section 68 and Section 69, a child's bicycle, equipped with training wheels,
or, a bicycle operated by a person under the age of 12 years of age, can be operated on any
Sidewalk or on any part of the Pathway System within the Town.
74. No person shall leave any bicycle, skateboard, long-board, scooter, or roller blades
unattended so as to create a hazard upon any Highway, Sidewalk, or Pathway System.
75. A Peace Officer may seize and impound for a period of up to 14 days any bicycle,
skateboard, long-board, scooter, or roller blades used or operated in contravention of this
Bylaw.
76. Any bicycle, skateboard, long-board, scooter, or roller blades not redeemed by the owner
within 14 days will be deemed the property of the Town and may be disposed of by the Town.
77. Unless otherwise provided for in this Bylaw, or unless Pathway System Signs prescribe a
lesser or greater speed limit, no person shall operate a bicycle, skateboard, long-board, roller
blades at a rate of speed in excess of twenty (20) kilometres per hour on any part of the
Pathway System within the Town.
78. No person shall operate a bicycle, skateboard, long-board, roller blades on any part of the
Pathway System within the Town at a rate of speed that is unreasonable having regard to all
the circumstances, including but not limited to:
a) the nature, condition and use of the Pathway System;
b) any conditions, including weather, that may affect visibility; and
c) the volume and type of traffic on the Pathway System regardless of whether that
person is travelling at the applicable speed limit.
SPEED LIMIT
79. Unless otherwise provided for in this Bylaw, or unless Highway Signs prescribe a lesser or
greater speed limit, no person shall operate a Vehicle at a rate of speed in excess of forty
(40) kilometres per hour on any Highway within the Town.
80. Notwithstanding Section 78, no person shall operate a Vehicle in an alley at a rate of speed
greater than twenty (20) kilometres per hour.
81. The maximum speed limit for a School Zone or a Playground Zone is 30 kilometers per hour.

82. The maximum speed limit for a School Zone is in effect between the hours of 8:00 a.m. and
4:30 p.m. on any day that school is held.
83. The maximum speed limit for a Playground Zone is in effect between the hours of 8:00
a.m. and 9:00 p.m. daily.
TRAFFIC CONTROL DEVICES
Sign Placement
84. Pursuant to Section 110 of the Traffic Safety Act, the CAO is hereby delegated the authority
to place, erect, display or alter Traffic Control Devices at such locations within the Town as
he may determine, or as Council may by resolution direct, for the purpose of controlling and
regulating traffic, have appropriate Traffic Control Devices, or devices deemed necessary to
provide proper traffic control, placed and maintained to indicate School Zones, Playgrounds
Zones and speed limits.
85. No person shall operate or park a Vehicle in contravention of any Traffic Control Device
posted by the Town.
Sign Removal
86. No person shall remove or interfere with any Traffic Control Device or barricade or notice
of Highway closing or suspension erected or posted by the Town.
FLASHING GREEN LIGHTS
87. A Firefighter may carry on, or in, a Vehicle, a lamp that produces intermittent flashes of green
light and may operate the lamp if the Vehicle is proceeding to a fire or other emergency.
88. No person, other than a Firefighter, shall operate a lamp that produces intermittent flashes
of green light within the Town.
PARADES AND PROCESSIONS
89. No person or organization shall hold, organize, or take part in any Parade or Procession
on a Highway within the Town without first obtaining a permit from the CAO.
90. Every participant in a Parade or Procession, and the organization and leaders thereof,
shall be guilty of an offence for a violation of Section 88.
91. Any person desiring to hold a Parade or Procession within the Town shall apply in writing
to the CAO at least 60 days prior to the proposed date of the Parade or Procession. The
application shall include the following information:
a) the name, address and telephone number of the applicant and, if the applicant is
an organization, the names, addresses and occupations of the executives thereof;
b) a signed undertaking from the person who will be in control of the event, agreeing
to be responsible for the good order and conduct thereof;

c) the nature and object of the Parade or Procession;
d) the date and time during which the Parade or Procession is proposed to be held;
e) the intended route or area proposed to be covered by the Parade or Procession;
f)
the approximate number of people and/or Vehicles anticipated to take part in the
Parade or Procession;
g) the approximate size, number and nature offlags, banners, placards or such similar
things to be carried and particulars of signs, inscriptions, and workings to be
exhibited and such written application shall bear the signatures and addresses of the
persons who will be in control of the Parade or Procession, and who undertake to be
responsible for the good order and conduct of the Parade or Procession; and
h) any other information required by the CAO.
92. The CAO may, for any reason, refuse to issue a permit for a Parade or Procession. In the
event of such refusal, the applicant may apply to Council which may, by resolution, direct the
issue of such permit, subject to the provisions of the Bylaw.
93. The CAO shall fix the hour and route of the Parade or Procession and give such directions
to the applicant in regard to such Parade or Procession as in the CAO's opinion will prevent
any unnecessary or unreasonable obstruction to the street or Sidewalk and tend to prevent
a breach of the peace, and shall make the necessary arrangements for the proper policing
of the streets in connection with such Parade or Procession.
94. During the course of any permitted Parade or Procession, no person shall throw any material,
either before or during the Parade or Procession, from a float. In addition to a fine, any
person doing so may be immediately removed from the Parade or Procession by a Peace
Officer.
95. No Parade or Procession shall obstruct the movement, use or operation of an Emergency
Vehicle.
OBSTRUCTIONS
Trees And Vegetation
96. A person shall not permit any hedge, tree or shrub, whenever planted, on property owned
or occupied by him located within a triangle formed on a corner site by the two curb lines
adjoining an intersection, including a lane intersection, and two points located 7.5 metres
from the said corner where the curb lines meet, herein referred to as the "corner visibility
triangle", to grow or remain at a height greater than 750 millimeters.
97. If a person is directed by a Peace Officer to reduce any hedge, tree or shrub located in a
corner visibility triangle to a height not in excess of 750 millimeters, and fails to carry out
such direction within seven days of receipt of such direction, the Town may remove any such
hedge, tree or shrub or reduce it to the required height, and if the cost of such work is not
paid on demand by the owner or occupant of the property in question, the Town

may recover the expense of such work, with costs, by action in any Court of competent
jurisdiction, or may charge the expense of the work as taxes against such property.
98. An owner or occupier of private property shall ensure that trees, shrubs or other vegetation
growing on his property, and on adjacent boulevards between his property line and the Curb,
shall be trimmed so that no branches project over a Sidewalk at an elevation of less than
225 cm (7.5 ft.) or over a roadway or alley at an elevation of less than 412 cm (13.5 ft.).
SNOW, ICE AND DIRT
99. No person shall place, pile or store any snow, ice, gravel, dirt, equipment or other obstruction,
on any Highway or Town property without first obtaining a permit for such purpose from the
CAO.
100.
Any person in contravention of Section 98 shall remove or cause the removal
of such snow, ice, gravel, dirt, equipment or other obstruction, within twenty four (24) hours
after notification to do so by the CAO. After the expiration of twenty four (24) hours, the Town
may remove all snow, ice, gravel, dirt, equipment or other obstruction, perform all necessary
repairs and the person in contravention shall make payment to the Town of all costs of
removal upon demand by the Town.
OBSTRUCTIONS ON HIGHWAY OR SIDEWALK
101. No person shall place an electrical cord, hose, chain or other similar obstruction over or
across any portion of a Highway.
102. No person shall place an electrical cord, hose, chain or other similar obstruction over or
across any portion of a Sidewalk so as to create a hazard to persons using the Sidewalk.
WHEEL, TIRE OR TRACK PROJECTIONS
103. No person shall operate, propel or move on any roadway any Vehicle having metal spikes,
lugs, cleats, skids, or bands projecting from the surface of the wheel, tire or track of such
Vehicle unless a permit to do so has been obtained from the CAO. This prohibition does
not apply to the use of studded tires or tires with snow chains on a Vehicle.
VEHICLE ON JACK
104. No person shall leave a Vehicle unattended on a Highway while it is supported by a jack or
similar device.
ANIMAL TRAFFIC
105. No person shall permit any livestock, horse drawn Vehicle or sleigh to stand or be upon
any Highway, whether attended or unattended, so as to obstruct traffic thereon.

106. No person shall lead, ride, or drive a horse or other livestock on any Town property other
than on Town roadways, except as provided for in other Town bylaws.
REMOVAL AND IMPOUNDMENT OF VEHICLES
107. A Peace Officer is hereby authorized to remove or cause to be removed any Vehicle,
including a trailer:
a) operated or parked in contravention of any provision of this bylaw; or
b) where emergency conditions may require such removal from a Highway.
108. Such Vehicle may be removed to a place designated by the CAO, where it will remain until
claimed by the owner or his agent.
109. No impounded Vehicle shall be released to its owner or his agent until the impounding
charge and removal charge on the Vehicle have been paid, such charges shall be in addition
to any fine or penalty imposed in respect of any violation of this Bylaw, or to any payment
made in lieu of prosecution as hereinafter provided. The Town is not responsible for any
towing, removal or impounding charges.
SNOW REMOVAL OR STREET CLEANING
110. Notwithstanding anything herein contained, in conjunction with snow removal, street
cleaning or road repair operations carried on by the Town employees or contractors, the
Town may tow Vehicles from the street being cleaned, cleared or repaired, at the expense
of the owner, and impound them, or, without impounding them, may remove them to another
street within the Town.
PENALTIES
110. Any person who contravenes any provision of this Bylaw is guilty of an offence and liable
to the penalties set out in Schedule A herein.
111. Any person who contravenes any of the provisions of the Bylaw for which no penalty is
specified in Schedule A herein, shall be liable on summary conviction to a fine of not less
than $50.00 and not more than $10,000.00.
112. Notwithstanding the penalties specified in Schedule A or Section 111 herein, where a
Vehicle or trailer is towed in connection with a contravention of this Bylaw, without
impounding it, the penalty for the contravention shall be increased by an additional amount
as set out in Schedule B herein.
113. For the purposes of this Bylaw, the owner of a Vehicle includes any person registered
as an owner at the Registrar.
114. Where a Vehicle is operated, driven, used, parked or left in contravention of any provision
of this Bylaw, the owner of the Vehicle is liable for the contravention and shall

make payment of the penalty prescribed herein, unless there is evidence before the court
that, at the time of the contravention, the Vehicle was not operated, driven, used, parked
or left by the owner or by any other person with the owner's consent, express or implied.
115. In the case of an offence that is of a continuing nature, a contravention constitutes a
separate offence in respect of each day, or part of a day, on which the offence continues
and any person guilty of such an offence is liable, upon summary conviction, to a fine in
an amount not less than that prescribed in Schedule A of this Bylaw, for each such day.
MUNICIPAL TAGS AND VIOLATION TICKETS
116. Where a Peace Officer has reasonable grounds to believe a person has contravened any
provision of this Bylaw, he or she may issue such person a Municipal Tag allowing the
payment of the specified penalty to the Town which shall be accepted by the Town in lieu
of prosecution for the offence.
117. Service of a Municipal Tag shall be sufficient if it is:
a) personally served on the owner or operator of the Vehicle; or
b) attached to the Vehicle in respect of which an offence is alleged to have been
committed; or
c) mailed to the address of the registered owner of the Vehicle as recorded at the
Registrar or to the address of the person in possession of the Vehicle.
118. If a Municipal Tag is issued in respect of an offence, it must set out the specified penalty
amount for the contravention under the Bylaw. The amount of the specified penalty may
be reduced by the amount prescribed in Schedule A of this Bylaw if paid to the Town within
10 days of the date of service of the Municipal Tag, and payment of the reduced amount
shall be accepted by the Town in full satisfaction of the Municipal Tag.
119. After the expiry of 10 days from the date of service of the Municipal Tag, the full specified
penalty amount must be paid to the Town. After the expiry of 20 days from the date of
service of the Municipal Tag, a Violation Ticket may be issued in respect of the offence.
120. Nothing in this Bylaw shall prevent a Peace Officer from immediately issuing a Violation
Ticket to any person who has contravened any provision of this Bylaw without first issuing
that person a Municipal Tag.
121. If a Violation Ticket is issued in respect of an offence, the Violation Ticket may:
a) specify the fine amount established by this Bylaw for the offence; or
b) require a person to appear in Court without the alternative of making a voluntary
payment.
122. A person who is issued a Violation Ticket in respect of any offence may, if the Violation
Ticket specifies the fine amount established by this Bylaw for the offence, make a

voluntary payment equal to the specified fine by delivering the Violation Ticket and the
specified fine to the Provincial Court Office specified on the Violation Ticket.
123. No person, other than the owner or operator of the Vehicle, shall remove any Municipal
Tag placed on or affixed to the Vehicle by a Peace Officer in the course of his or her duties.
124. No person other than a Peace Officer shall place a Municipal Tag on a Vehicle.
SEVERABILITY & REPEAL
125. It is the intention of Council that each provision of this Bylaw should be considered as being
separate and severable from all other provisions. Should any section or provision of this
Bylaw be found to have been improperly enacted, then such section or provision shall be
regarded as being severable from the rest of this Bylaw and that the Bylaw remaining after
such severance shall remain effective and enforceable.
OWNER LIABLE
126. If a Vehicle is involved in an offence referred to in this Bylaw, the owner of that Vehicle
is guilty of an offence.
127. Section 126 does not apply if the owner of the Vehicle satisfies the Court that:
a) the owner did not park the Vehicle or was not driving the Vehicle at the time of the
offence; and
b) the person who parked the Vehicle or was driving the Vehicle at the time of the
offence did so without the owner's express or implied consent.
GENERAL
128. Whenever the singular and masculine gender is used in this Bylaw, the same shall include
the plural, feminine and neutral gender whenever the context so requires.
129. A copy of a record of the Town, certified by the CAO as a true copy of the original, shall
be admitted in evidence as prima facie proof of the facts stated in the record without proof
of the appointment or signature of the person signing it.
130. Schedules A and Schedule B may, from time to time, be amended by a resolution of
Council.

131. This Bylaw shall come into effect upon third reading, and Bylaw 1781-2019 and
amendments thereto are hereby repealed.
