DISTRICT OF HUDSON'S HOPE BYLAW NO. 958, 2025 A Bylaw to amend Fees and Charges Bylaw No. 915, 2020 WHEREAS Council has the authority to impose fees and charges in respect to any service Council considers necessary or desirable; AND WHEREAS Council wishes to amend District of Hudson's Hope fees and Charges Bylaw No. 915, 2020; NOW THEREFORE the Council of the District of Hudson's Hope, in an open meeting assembled, enacts as follows: GENERAL PROVISIONS 1.1 This Bylaw shall be cited as "District of Hudson's Hope Fees and Charges Amendment Bylaw No. 958, 2025". 1.2 If any portion of this Bylaw is declared invalid by a court, the invalid portion shall be severed, and the remainder of the Bylaw is deemed valid. 1.3 The headings used in this Bylaw are for convenience only and do not form part of this Bylaw and are not to be used in the interpretation of this Bylaw. 1.4 Schedules B and C are attached to and forms part of this Bylaw. AMENDMENT 2.1 District of Hudson's Hope Fees and Charges Bylaw No. 915, 2020 is amended as follows: a. Replacing Schedule B - Water Services Fees & Charges, with the attached Schedule B - Water Services Fees & Charges; and b. Replacing Schedule C - Sewer Services Fees & Charges, with the attached Schedule B - Water Services Fees & Charges. Corporate Officer District of Hudson's Hope Fees and Charges Amendment Bylaw No. 958, 2025 Page 3 of 6 3 SCHEDULE B - WATER SERVICE FEES & CHARGES DEFINITIONS 1.1 Unless otherwise defined, the terms used in this schedule shall have the meanings as set out in the Water Service Regulation Bylaw No. 930, 2022, as amended or replaced. 1.2 In this Schedule; Dwelling Unit has the same meaning as defined in the District of Hudson's Hope Zoning Bylaw No. 949, 2024, as amended or replaced; and Regular Working Hours means Monday to Friday, 8:00 am to 4:00 pm, excluding holidays. SERVICE CONNECTION FEE 2.1 The fee for installation of each water service connection by the District is the greater of: a) 100% of the District's actual and reasonable costs of the installation of the Service Connection and restoration plus any applicable taxes; or b) One Thousand Dollars $1,000. 2.2 Prior to the installation of the Service Connection, the applicant shall pay to the District the amount estimated by the Director of Public Works or designate to cover the District's actual and reasonable cost to install the Service Connection, including the District's materials, labour, equipment, overhead, administrative, and restoration costs. 2.3 Upon completion of the installation of the Service Connection, the applicant must pay to the District any further amount required to cover the District's actual and reasonable costs to install the Service Connection and restore the area. 2.4 If the District's actual and reasonable costs to install the Service Connection and restore the area is less than the estimate provided to the applicant, the District will refund the difference to the applicant. FEE FOR TURNING A CURB STOP ON OR OFF 3.1 The fee to have the District turn on or turn off a Curb Stop during Regular Working Hours with 72 hours' notice is $40.00. 3.2 The fee to have the District turn on or turn off a Curb Stop outside of Regular Working Hours is $250.00 if completed within three hours. 3.3 The fee to have the District turn on or turn off a Curb Stop without 72 hours' notice is $250.00 if completed within three hours. 3.4 The fee to have the District turn on or turn off a Curb Stop outside of Regular Working Hours or without 72 hours notice is $500.00 if the call out takes longer than three hours. District of Hudson's Hope Fees and Charges Amendment Bylaw No. 958, 2025 Page 4 of 6 4 ABANDONMENT FEE 4.1 The fee for abandoning a Service Connection shall be equal to 100% of the District's actual and reasonable costs to complete the disconnection of the Water System from the owner's Property, plus any applicable taxes. 4.2 Payment of the District's estimate of the cost to complete the disconnection is required in advance of disconnection. 4.3 Any amount paid in excess of the District's actual and reasonable costs to install the Service Connection and restore the area is refundable. WATER METER TESTING FEE 5.1. The fee for a water meter test is $175.00. WATER RATES 6.1 The owner of each Dwelling Unit connected to the Community Water System, shall pay an annual fee of $280.00 per year for unmetered water. 6.2 The owner of each non-residential premise connected to the Community Water System, shall pay an annual fee of $600.00 per year for unmetered water. 6.3 The owner of each non-residential premises connected to the Community Water System with a functioning water meter shall pay 70 cents per 1,000 litres used each month, with a minimum monthly charge of $50.00. 6.4 The annual fee will be issued in two bi-annual payments. 6.5 Despite section 6.4, metered invoices will be issued monthly. 6.6 Invoices must be paid to the District within 60 calendar days of the invoice being mailed. 6.7 A 10% late payment charge will be applied to the remaining unpaid portion after 60 days. 6.8 A prorated refund of the annual fee will be allowed, if the water supply to the Dwelling Unit is turned off by the District at the owner's request, and the water service remains off for over a month. 6.9 The rates for the token-operated water stands at the Beryl Prairie Fire Hall and on Clarke Avenue are: a. 50 Imperial Gallons for one 25 cent token, or b. 200 Imperial Gallons for one $1 token. 6.10 The rate for the commercial water stand on Clarke Avenue is 1.82 cents per Imperial Gallon or $4.00 per cubic meter District of Hudson's Hope Fees and Charges Amendment Bylaw No. 958, 2025 Page 5 of 6 5 SCHEDULE C - SEWER SERVICE FEES & CHARGES DEFINITIONS 1.1 Unless otherwise defined, the terms used in this schedule shall have the meanings as set out in the Sewer Service Regulation Bylaw No. 845, 2014, as amended or replaced. 1.2 In this Schedule, Dwelling Unit has the same meaning as defined in the District of Hudson's Hope Zoning Bylaw No. 949, 2024, as amended or replaced. SERVICE CONNECTION FEE 2.1 The fee for installation of each Sewer Service Connection by the District is the greater of: a) 100% of the District's actual and reasonable costs of the installation of the Service Connection and restoration plus any applicable taxes; or b) Two Thousand Dollars $2,000. 2.2 The costs referred to in Section 2.1 include the following restoration works: a) Any auguring or restoration of concrete curbs and sidewalks, or road surfaces; b) Any cutting, excavation or backfilling of frozen ground; or c) Any additional restoration works will be charged at 100% of actual costs of the restoration works. 2.3 If a local service tax or latecomer charge is established by a separate bylaw or agreement for sanitary sewer service, that bylaw or agreement takes precedence over the connection fee. ABANDOMENT FEE 3.1 The fee for abandoning a Service Connection shall be equal to 100% of the District's actual and reasonable costs to complete the disconnection of the water system from the owner's premise, plus any applicable taxes. 3.2 Payment of the District's estimate of the cost to complete the disconnection is required in advance of disconnection. 3.3 Any overpayment beyond the District's actual installation and restoration costs is refundable. SEWER RATES 4.1 The owner of each Dwelling Unit connected to the Community Sewer System, shall pay an annual fee of $230.00 per year. 4.2 The owner of each non-residential premises connected to the Community Sewer System, shall pay an annual fee of $252 per year. District of Hudson's Hope Fees and Charges Amendment Bylaw No. 958, 2025 Page 6 of 6 6 4.3 The owner of each non-residential premises with a functioning water meter shall pay 45% of the invoice for water, with a minimum monthly charge of $21.00. 4.4 The annual fee will be issued in two bi-annual payments. 4.5 Despite section 4.4, metered invoices will be issued monthly. 4.6 Invoices must be paid to the District within 60 calendar days of the invoice being mailed. 4.7 A 10% late payment charge will be applied to the remaining unpaid portion after 60 days. 4.8 A prorated refund of the annual fee will be allowed, if the connection to the Dwelling Unit is turned off by the District at the owner's request, and the service remains off for over a month.
