## RURAL MUNICIPALITY OF SWAN RIVER
## BY-LAW NO. 2385/04
Being a By-Law of the Rural Municipality of Swan River To Administer and Enforce the Manitoba Building and Plumbing Codes Including The Buildings and Mobile Homes Act
WHEREAS the Municipal Act requires municipalities to pass Building Code By-Laws in order to adopt, administer, and enforce Part Nine of the Manitoba Building and Plumbing Codes;
AND WHEREAS the Council of the Rural Municipality of Swan River deems it advisable and in the best interests of the Municipality to include Chapter B93 and Regulation 96/87 R of the Statutes of Manitoba in this By-Law;
AND WHEREAS Chapter B93 is referred to as The Buildings and Mobile Homes Act, with attached Schedule "A" - Construction Codes or Standards for Mobile Homes, and Schedule "B" - Fees for Permits and Inspections of Mobile Homes;
AND WHEREAS the Department of Labour, Office of the Fire Commissioner has supplied and recommended the adoption of the attached Schedule "C";
AND WHEREAS the Council of the Rural Municipality of Swan River has set the Building Permit and Plumbing Permit fees as provided in the attached Schedule "D";
AND WHEREAS the Council of the Rural Municipality of Swan River deems it advisable and in the best interests of the Municipality to add the attached Schedule "E" to our Manitoba Building and Plumbing Codes;
NOW THEREFORE the Council of the Rural Municipality of Swan River, duly assembled, enacts as follows:
- (1) THAT the attached Schedule "A" (Construction Codes & Standards for Mobile Homes per Chapter B93) be and hereby form part of this By-Law;
- (2) THAT the attached Schedule "B" (Fees for Permits & Inspections of Mobile Homes per Chapter B93) be and hereby form part of this By-Law;
- (3) THAT the attached Schedule "C" (Basic Building Permit By-Law) be and hereby form part of this By-Law;
- (4) THAT the attached Schedule "D" (General Fee Schedule) be and hereby form part of this By-Law;
- (5) THAT the attached Schedule "E" (General Information Outlining Responsibilities of Those Involved Regarding Moving Buildings Into & Within the RM) be and hereby form part of this By-Law;
- (5) THAT this By-Law shall come into force and effect immediately upon the passing thereof;
- (6) THAT By-Law No. 2379/04 dated March 23rd , 2004 and By-Law No. 2382/04 dated July 13", 2004 be and are hereby repealed.

## CHAPTER B93
## THE BUILDINGS AND MOBILE HOMES ACT
HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
## Definitions.
1
In this Act
"board" means The Building Standards Board for which provision is made in section 11; ("Commission")
## "building" means
(a) a building or structure used or to be used for dwelling, public or commercial purposes, or a combination of all or any of those purposes, or
(b) a prefabricated building or structure of the kind described in clause (a), or
(c) a mobile home; ("bâtiment")
"building construction code" means a code of building construction standards; ("code du bâtiment")
"building construction standard" means a standard for
(a) construction materials, or plumbing or electrical materials or installations, or equipment or appliances, or any combination thereof, to be used or installed in any building or part of a building, or
(b) the method to be used in the construction or demolition of any building or part of a building: ("norme de construction des bâtiments")

- "factory built buildings" means buildings which are manufactured either wholly or in part, at an off-site location; ("bâtiment usiné")
- "farm building" means a building or structure, other than a dwelling, situated on a farm and used or to be used in the actual farming operation; ("bâtiment de ferme")
- "inspector" means an inspector appointed under The Department of Labour Act; ("inspecteur")
- "minister" means the member of the Executive Council charged by the Lieutenant Governor in Council with the administration of this Act; ("ministre")
- "mobile home" means a portable dwelling unit that
(a) is capable of being transported on its own chassis and running gear by towing or other means, or
(b) is placed on the chassis or body of a motor vehicle, or
and is designated to be used as living quarters or as accommodation for travel, recreation or
- (c) forms part of a motor vehicle, vacation purposes; ("maison mobile")
- "municipality" means any locality, the inhabitants of which are incorporated and continued under the authority of The Municipal Act or some other Act of the Legislature, including any local government district, rural municipality, incorporated city, town, village or suburban municipality, or, where the context so requires, the area of any municipality: ("municipalité")
- "renovation" means a renovation as defined in the regulations: ("rénovation")
- "repair" means a repair as defined in the regulations. ("réparations")
- "inspecteur" Inspecteur nommé en vertu de la Loi sur le ministère du Travail. ("inspector")
- "maison mobile" Maison d'habitation mobile qui, selon le cas:
a) est susceptible d'être déplacée sur son propre châssis et son propre dispositif de roulement par remorquage ou autrement:

## Application of Act
2(1) Subject to subsection (2), this Act applies to the construction, erection, placement, alteration, repair, renovation, demolition, relocation, removal, occupancy or change in occupancy of any building or addition to a building.
## Exceptions
2(2) This Act does not apply to
(b) any building or class of buildings excluded by the regulations; or
(a) any farm building; or
(c) any part of the province or any municipality excluded by the regulations; or
(d) any of the things set out in subsection (1) the doing of which was commenced or completed before June 14, 1974.
## Safety hazards
2(3) Notwithstanding clause (2) (d), where in the opinion of an inspector a building or portion of a building, whether the work in respect thereof was commenced or completed before or after June 14, 1974 constitutes a safety hazard, the inspector may require such steps to be taken, in accordance with any applicable building construction code or building construction standard adopted, established or preseribed under section 3, as are necessary in his opinion to remove the hazard.
## Adoption of construction standards
3(1) For the purposes of this Act, the Lieutenant Governor in Council may, by regulation,
(a) adopt any established building construction code or building construction standard, in whole or in part, for use in the province or any part of the province or any municipality;
(b) prescribe variations in, additions to or deletions from any building construction code or building construction standard adopted under clause (a):
(c) establish or prescribe any building construction code or building construction standard for use in the province, or any part of the province, or any municipality.
## Application de la Loi

## Exceptions

## Dangers
Malgré l'alinéa (2)d), l'inspecteur qui estime qu'un bâtiment ou une partie d'un bâtiment dont la construction a été commencée ou terminée avant ou après le 14 juin 1974 présente un danger, peut exiger que des mesures conformes au code du bâtiment ou aux normes de construction des bâtiments applicables établis, adoptés ou prescrits par l'article 3 soient prises dans la mesure qu'il juge nécessaire à l'élimination du danger.
## Adoption des normes de construction
Pour l'application de la présente loi, le lieutenant-gouverneur en conseil peut, par règlement:
a) adopter en totalité ou en partie un code du bâtiment ou des normes de construction des bâtiments qui existent déjà et les rendre applicables à la province ou à une partie de la province ou à une municipalité:
b) modifier par addition ou suppression les codes et normes visés à l'alinéa a):
c) créer ou prescrire un code du bâtiment ou des normes de construction des bâtiments pour la province, une partie de la province ou une municipalité.
## Subsequent changes in adopted standards
- The adoption of any established building construction code or building construction standard under clause (1)(a), in whole or in part and either in existing form or in a form as altered under clause (1)(b), is, except as otherwise provided in the regulations, deemed to be as well an adoption of
(a) any prior or subsequent amendment made to the code or standard by the establishing organization or body; and
(b) any new code or standard subsequently substituted by the establishing organization or body for the code or standard adopted, and any new code or standard so substituted is deemed to be subject to such alterations, with such modifications as the circumstances require, as may have been made in the adopted code or standard under clause (1)(b).
## Other construction standards invalidated
- 3(3) Notwithstanding anything to the contrary in any other Act of the Legislature, no building construction code or building construction standard adopted, established or prescribed for the province or a part of the province or a municipality by or under that Act before or after the coming into force of this Act has any force or effect unless it is the building construction code or building construction standard adopted, established or prescribed for the province or that part of the province or that municipality, as the case may be, under this section.
## Municipal responsibility
- Notwithstanding anything to the contrary in any other Act of the Legislature, each municipality unless excluded under clause 2(2)(c) shall adopt and enforce any building construction code or building construction standard adopted, established or prescribed under section 3 for the province or the municipality or the part of the province in which the municipality is situated, and may make such by-laws as are necessary for those purposes.

## Non application des autres normes de construction

## Obligation des municipalités

## Designation by minister.
5(1) Notwithstanding section 4, the minister may designate classes of work involved in building construction, or classes of buildings within the province or any part of the province or any municipality with respect to which permits or occupancy permits or both, issued under this Act, are required and the minister or any person or agency acting under his authority shall issue the required permits and administer the regulations with respect to those buildings, areas, or classes of work.
## Rescinding of designation.
5(2) Upon application by a municipality, the minister may rescind the designation of that municipality or area of any part thereof if he is satisfied that the municipality or area can adequately enforce the standards adopted or established under subsections 3(1) and (2).
## Permits.
6(1) For the purposes of section 5, and for the purposes of any building or proposed building that is not within a municipality and is not included in a class of buildings designated under section 5, the minister may issue a permit, in a form prescribed by the minister and authorizing the doing of the things specified in the permit, to any person who submits to the minister
- (a) a completed application for the permit on a form prescribed and furnished by the minister;
(b) a set of plans, in such form, together with such number of duplicate sets, as the minister may prescribe, showing to the satisfaction of the minister that the proposed work or change in use or occupancy complies with the provisions of this Act and the regulations;
and remits to the minister such fees as may be prescribed in the regulations.
## Occupancy permits.
6(2) For the purposes of section 5, and for the purposes of any building or proposed building that is not within a municipality and is not included in a class of buildings designated under section 5, the minister may issue an occupancy permit, in a form prescribed by the minister and

## Permis
6(1) Pour l'application de l'article 5 et pour les fins d'un bâtiment construit ou d'un bâtiment qu'il est proposé de construire qui n'est pas ou ne sera pas situé dans une municipalité et qui ne fait pas partie d'une catégorie de bâtiments désignée aux termes de l'article 5, le ministre peut délivrer un permis établi dans la forme qu'il désigne et autorisant les actions que le permis indique, à toute personne qui lui présente :
- a) une demande de permis dûment remplie au moyen de la formule prescrite et fournie par le ministre;
b) un ensemble de plans établis dans la forme prescrite par le ministre avec le nombre d'exemplaires prescrit par lui, indiquant de façon satisfaisante pour le ministre que les travaux proposés ou le changement d'usage ou d'occupation est conforme aux dispositions de la présente loi et des règlements,
et lui verse les droits prescrits par les règlements.
## Permis d'occupation
6(2) Pour l'application de l'article 5 et pour les fins d'un bâtiment construit ou d'un bâtiment qu'il est proposé de construire ailleurs que dans une municipalité et qui ne fait pas partie d'une catégorie de bâtiments désignée aux termes de l'article 5, le ministre peut délivrer un permis authorizing the use or occupancy of the building or place described in the occupancy permit, to any person who
- (a) complies with subsection (1); and
- (b) completes the doing of the things authorized in the permit issued to the person under subsection (1), in a manner that, to the satisfaction of the minister, is in accordance with the plans submitted under subsection (1) and any conditions specified in the permit or 1 in the permit or prescribed in the regulations, but subject to any subsequent requirement of an inspector or order of the minister imposed upon or made against the person under this Act; and
- (c) remits to the minister such fees as may be prescribed in the regulations.
## Conditional permits.
A permit or occupancy permit issued under this section may be issued subject to such conditions as may be necessary in the opinion of the minister, and those conditions shall be specified in the permit or occupancy permit, as the case may be.
## Conditions prescribed by regulation.
6(4) The Lieutenant Governor in Council may, by regulation, prescribe conditions to which all or any permits or occupancy permits issued under this section shall be subject.
## Unforeseeable conditions.
6(5) Every permit or occupancy permit issued under this section is deemed to be issued subject to any requirement that an inspector may, subsequent to the issuance, deem necessary to meet any condition that was not anticipated in the plans submitted under subsection (1) and that, in the opinion of the inspector, was not foreseeable at the time the permit or occupancy permit was issued.
## Inspections.
An inspector appointed under The Department of Labour Act may carry out any inspection required for the purposes of this Act.

## Inspections

## Right of entry.
7(2) An inspector, upon presentation of an authorization signed by the minister, may at any reasonable time enter any premises for the purpose of making an inspection under this Act, and any person in charge of the premises shall allow the inspector free access thereto.
## Review of inspector's requirement.
8(1) The minister may review any requirement imposed by an inspector under this Act, and may confirm the requirement or order the requirement varied or rescinded
## Review of municipal permits.
8(2) Notwithstanding anything to the contrary in this or any other Act of the Legislature, the minister may review
- (a) any permit, occupancy permit or authorization issued by a municipality, authorizing any of the things set out in subsection 2(1); or
- (b) any refusal to issue a permit, occupancy permit or authorization of the kind described in clause (a); or
- (c) any requirement imposed by a municipality with respect to any of the things set out in subsection 2(1);
and perform or cause to be performed such inspections as he deems necessary for the purposes of the review, and confirm the issuance, refusal or imposition, or order the permit, occupancy permit, authorization or requirement, as the case may be, varied or rescinded
## Documents relating to review.
8(3) Any person or municipality having possession of any papers or documents relating to a matter that the minister is reviewing under subsection (2) shall, upon the request of the minister, furnish the papers or documents or copies thereof to the minister.
## Minister may do work.
9(1) Where there is a contravention of or failure to observe any provision of this Act, or a regulation, order or requirement made or imposed thereunder, the minister may, at the cost of and upon notice to each person responsible for the contravention or failure, after expiry of a period of

et procéder ou faire procéder aux inspections qu'il juge nécessaires pour les fins de l'examen et confirmer la délivrance, le refus ou l'exigence ou encore, ordonner que le permis, le permis d'occupation, l'autorisation ou l'exigence, selon le cas, soient annulés ou modifiés.
## Documents relatifs à l'examen
8(3) Toute personne ou municipalité qui a en sa possession des papiers ou documents qui se rapportent à une question soumise à l'examen du ministre aux termes du paragraphe (2) doit, à la demande du ministre, fournir ces papiers ou documents ou une copie de ceux-ci au ministre.
## Le ministre peut faire des travaux

## No Crown liability.
No liability attaches to the minister or the Crown for any loss or damage resulting to any person from anything done or caused to be done by the minister under subsection (1).
## Owner's liability.
Nothing done or caused to be done by the minister under subsection (1) relieves any person served with a notice under that subsection from any penalty provided for the contravention under this Act.
## Service.
Service of any notice or document by registered mail addressed to the person being served at his last known address is a sufficient service for all purposes under this Act.
## Building standards board.
11(1) The Lieutenant Governor in Council may appoint such persons as he may determine who, upon appointment, shall constitute and be the members of a board to be known as "The Building Standards Board"
## Powers and duties of board.
- 11(2) The board may
- (a) make rules for its own procedure;
- (b) advise the minister on such matters pertaining to building construction codes or building construction standards as he may require;
- (c) perform such other duties and functions as the minister may require.
## Chairman and vice-chairman.
11(3) The Lieutenant Governor in Council m y appoint one of the members of the board as chairman and another as vice-chairman: the vice-chairman shall perform the duties of the chairman in the absence of the chairman.

## Président et vice-président
11(3) Le lieutenant-gouverneur en conseil peut nommer un président et un vice-président parmi les membres; le vice-président remplace le président en son absence.
## Terms of office.
11(4) Unless he sooner resigns or is removed from office, each member of the board including the chairman and vice-chairman shall hold office for a term of two years from the date of his appointment, and thereafter until his successor is appointed, and may be re-appointed for a further term or terms.
## Vacancies.
11(5) Any vacancy that occurs in the membership of the board shall be filled by a new member appointed by the Lieutenant Governor in Council; and the member so appointed shall hold office for the unexpired balance of the term of the member in respect of whom the vacancy occurred, and thereafter until his successor is appointed
## Remuneration.
11(6) The members of the board shall receive such remuneration for their services as members of the board as may be fixed by the Lieutenant Governor in Council, and such reimbursement for expenses necessarily incurred in connection with those services as the minister may approve.
## Quorum.
11(7) is a quorum. A majority of the members of the board
## Hearing.
12(1)
(a) the issue or refusal of a permit or occupancy permit, or the requirement of an inspector, or an order of the minister, under this Act; or
Any person who feels aggrieved by
(b) the issue or refusal of a permit or occupancy permit or authorization, or the imposition of a requirement, of the kind described in subsection
and any municipality affected by an order of the minister under this Act, may within 15 days after the issuance or refusal or the making of the requirement or order, as the case may be, apply to the minister for a hearing.
## Time for hearing.
12(2) Any hearing under subsection (1) shall be before the minister and shall be held as soon as practicable after the making of the application therefor.
## Mandat

## Audiences

12(3) Any party to a hearing under subsection (1) may attend the hearing and, either himself or through counsel, present evidence and make representations thereat in his own behalt.
## Order.
12(4) Upon a hearing under subsection (1) or within a reasonable time thereafter, the minister may make such order with respect to the subject matter of the hearing as he deems fit.
## Appeal.
13 An appeal to a judge of the Court of Queen's Bench may be taken from any order made under section 12; and any appeal under this section shall be initiated by filing an originating notice of motion in the office of the court within 30 days of the making of the order.
## Offence and penalty.
14 Any person who, in contravention of any provision of this Act or a regulation, requirement or order made or imposed thereunder, does or causes to be done or permits the doing of any of the things set out in subsection 2(1), or who contravenes or fails to observe any provision of this Act or a regulation, requirement or order made or imposed thereunder, is guilty of an offence and liable on summary conviction, for each day that the offence continues, to a fine not exceeding $5,000.
## Regulations.
15 For the purposes of carrying out the provisions of this Act according to their intent, the Lieutenant Governor in Council may make such regulations and orders as are ancillary thereto and not inconsistent therewith: and every regulation and order made under, and in accordance with the authority granted by. this section has the force of law: and, without restricting the generality of the foregoing, the Lieutenant Governor in Council may make regulations and orders,
(a) defining "renovation" and "repair":
(b) excluding any building or class of buildings or any part of the province or any municipality from the operation of this Act:

## 1 In this regulation.
## "apparent safety hazard" means.
(a) the non-compliance of a mobile home with any provision of the standards, where the non-compliance is visually apparent to an inspector without dismantling any part of the mobile home or any part of any installation. equipment or appliance therein, or
(b) any condition in a mobile home that is visually apparent to an inspector without dismantling any part of the mobile home or any part of any installation, equipment or appliance therein. and that is shown, by scientific laboratory tests of that condition or any identical condition in that or another mobile home or elsewhere. to be a dangerous condition: (* danger apparent »)
"applicant" means an applicant for a permit; (" requérant »)
"dealer" means a person who, with or without remuneration or consideration of any kind, in the course of his business buys. sells, exchanges. advertises. exhibits. or offers for sale or lease. new or used mobile homes: (- concessionnaire »)

- "standards inspection" means an inspection to ascertain whether or not a mobile home complies with the standards. (" inspection de conformité aux normes ·)

- The codes or standards set out in 2 Schedule A are adopted as the construction codes or construction standards for mobile homes.

- 3 No Individual. including a dealer or manufacturer, shall at wholesale or retail or by auction or otherwise, directly or indirectly, offer or expose for sale. rent or lease. or otherwise commercially dispose of a mobile home that does not bear a label.
- 4 No dealer or manufacturer shall, at wholesale or retail or by auction or otherwise. directly or indirectly, offer or expose for sale, rent or lease or otherwise commercially dispose of a new mobile home, that does not comply with the codes or standards referred to in Schedule A.

- 5 No dealer or manufacturer shall, at wholesale or retail or by auction or otherwise. directly or indirectly, offer or expose for sale, rent or lease or otherwise commercially dispose of a used mobile home without a permit for the purpose issued by the minister or a person or dealer authorized by the minister to issue a permit on behalf of the minister.
- 6 Every dealer or manufacturer who applies for a permit under section 5 shall complete and submit to the minister an application therefor on a form supplied by the minister and containing the information required by the form together with such fee as may be prescribed therefor in Schedule B.
- 7(1) Where an applicant complies with section 6, the minister shall cause an inspection of the mobile home to be made.
- 7(2) Where an inspection of a mobile home under subsection (1) shows that the mobile home
- (a) bears a label: and
- (b) has no apparent safety hazard:
the minister or a person acting under the minister's authority shall issue the required permit.

- 7(1) Si le requérant se conforme aux dispositions de l'article 6. le ministre fait procéder à une inspection de la maison mobile.
- 7(2) Le ministre ou la personne agissant sous son autorité délivre le permis requis si l'inspection d'une maison mobile menée en application du paragraphe (I) révèle que celle-ci :
- a) porte une étiquette:
b) ne présente aucun danger apparent.
- 8(1) Where an inspection of a mobile home under section 7 shows that the mobile home bears a label but has an apparent safety hazard. the minister or the person acting under the minister's authority shall not issue the required permit.
- 8(2) Where under subsection (1). the Issuance of the required permit is refused. the minister or the person acting under the authority of the minister. may require the applicant to remove the safety hazard before issuing the required permit.
- 8(3) Where an applicant for a permit is required under subsection (2) to remove any safety hazard and the applicant has removed the safety hazard, the applicant may request the minister or the person who required the removal of the safety hazard to carry out a safety hazard inspection and upon such request the minister or a person authorized by the minister shall carry out a safety hazard inspection of the mobile home.
- 8(4) Where a safety hazard inspection under subsection (3) indicates that the safety hazard is removed. the minister or a person authorized by the minister shall issue the required permit. but where the inspection indicates that the safety hazard is not removed, the required permit shall not be issued until a safety hazard inspection indicates that the hazard is removed.
- 8(5) The fee payable for a safety hazard inspection subsequent to the first safety hazard inspection is as indicated in Schedule B.
- 9(1) Where an inspection of a mobile home under section 7 shows that the mobile home does not have an apparent safety hazard and does not bear a label. the minister shall not issue the mobile home complies with the standards.

- 8(3) Le requérant qui a éliminé le danger qu'il était tenu d'éliminer, aux termes du paragraphe (2), peut demander au ministre ou à la personne qui a exigé l'élimination du danger de procéder à une inspection de sécurité et. sur réception d'une telle demande. le ministre, ou la personne qu'il autorise à le faire. procède à l'inspection de sécurité de la maison mobile.
- 8(4) Si l'inspection de sécurité menée en application du paragraphe (3) révèle que le danger a été éliminé. le ministre. ou la personne qu'il autorise à le faire, délivre le permis requis. Cependant. si l'inspection révèle que le danger n'a pas été éliminé. le permis requis ne peut être délivré avant qu'une autre inspection de sécurité n'ait montré que le danger a été éliminé.
- 8(5) Le droit exigible pour une inspection de sécurité consécutive à la première inspection de sécurité est celui prévu à l'annexe B.
- 9(1) Si l'inspection d'une maison mobile menée en application de l'article 7 révèle que bien que celle-ci ne présente aucun danger apparent. elle ne porte pas d'étiquette. le ministre ne délivre pas le permis requis, mais exige que la personne requérant le permis demande, au moyen de la formule qu'il lui fournit. une inspection de conformité aux normes.
- 9(2) Upon receipt of an application under subsection (1) together with such fee therefor as prescribed in Schedule B, the minister or a person acting under the minister's authority shall cause a standards inspection of the mobile home to be made and where the inspection shows that the mobile home complies with the standards, the person carrying out the Inspection shall affix a label to the mobile home and the minister or a person acting under the minister's authority shall Issue the required permit.
- 9(3) Where under subsection (2) an inspection of the mobile home shows that It does not comply with the standards, the required permit shall not be issued until the mobile home complies with the standards.
- 10 Where a manufacturer of mobile homes in Manitoba remits to the minister, with respect to any mobile home in the manufacturer's plant, the appropriate manufacturer inspection fee prescribed therefor in Schedule B, the minister shall cause to be made a manufacturer inspection of the mobile home and, if the inspection shows that the mobile home complies with the standards. the person carrying out the inspection shall affix a label to the mobile home.
- 11 Every permit issued with respect to a mobile home is issued subject to the condition that no enlargement. modification, alteration or reconstruction of the mobile home shall be effected after the date of the inspection immediately preceding the issuance of the permit unless
- (a) the holder of the permit notifies the minister thereof: and
- (b) an inspection of the mobile home shows that the enlargement. modification. alteration or reconstruction, as the case may be. complies with the standards.
- 12 Any person requiring a safety hazard or standards inspection of a mobile home outside the province shall at that person's own cost. make all the necessary travel and accommodation arrangements to carry out the inspection.
- 9(2) Sur réception d'une demande présentée en application du paragraphe (1). accompagnée des droits applicables prescrits a l'annexe B, le ministre ou la personne agissant sous son autorité falt soumettre la maison mobile à une Inspection de conformité aux normes. - 10 Si un fabricant de maisons mobiles au Manitoba verse au ministre. relativement à une maison mobile se trouvant dans son usine, le droit approprié d'inspection chez le fabricant prescrit à lannexe B. le ministre fait procéder à une inspection de la maison mobile chez le fabricant et, si l'inspection révèle que la maison mobile est conforme aux normes, la personne qui procède à l'inspection appose une étiquette sur la maison mobile.
- 11 Les permis délivrés à l'égard de maisons mobiles le sont à la condition qu'il ne soit effectué aucun agrandissement ni aucune modification. transformation ou reconstruction de la maison mobile après la date de l'inspection menée immédiatement avant la délivrance du permis, sauf si :
- a) le titulaire du permis en avise le ministre:
- b) une inspection de la maison mobile révèle que l'agrandissement. modification, la transformation ou la reconstruction. selon le cas. est conforme aux normes.
- 12 La personne qui demande une inspection de sécurité ou une inspection de conformité aux normes. à l'égard d'une maison mobile se trouvant à l'extérieur de la province. prend. à ses frais, toutes les dispositions nécessaires en matière de déplacement et d'hébergement nécessaires afin d'assurer la tenue de l'inspection.
- Where any person is in breach of any provision of the Act or this regulation in respect of a moble home for which a permit has been Issued. the minister shall forthwith cancel the permit.
- 14 Nothing in this regulation prevents any dealer or manufacturer who has been refused a permit. or whose permit has been cancelled, from re-applying for a permit.
- 15(1) Notwithstanding any other provision of this regulation, where upon the coming into force of this regulation, including any regulation for which this regulation is substituted, a person, other than a dealer or manufacturer of a mobile home owns a mobile home that does not bear a label, the minister, upon application therefor, may authorize an Inspection of the mobile home, If the minister is satisfied that the home was acquired by that person prior to the coming into force of this regulation.
- Where inspection subsection (1) shows that the mobile home has no apparent safety hazard, the person carrying out the inspection shall affix the required label to the mobile home.
- 15(3) The fee for an inspection under this section is as set out in Schedule B.
- 13 Lorsqu'une personne contrevient à une disposition de la Loi ou du présent règlement a regard d'une maison mobile pour laquelle un permis a été délivré. le ministre annule le permis sur-le-champ.

- 15(1) Par dérogation à toute autre disposition du présent règlement. si, au moment de l'entrée en vigueur du présent règlement. y compris de tout reglement auquel se substitue le présent règlement, une personne, autre qu'un concessionnaire ou un fabricant de maisons mobiles, possède une maison mobile qui ne porte pas d'étiquette. le ministre peut, sur demande à cet effet, autoriser l'inspection de la maison mobile, s'il est convaincu que la maison a été acquise par cette personne avant l'entrée en vigueur du présent règlement.
- Si l'inspection menée en application du paragraphe (1) révèle que la maison mobile ne présente pas de danger apparent, la personne qui a procédé à l'inspection appose l'étiquette requise sur la maison mobile.
- 15(3) Le droit exigible pour l'inspection prévue au présent article est celui mentionné à l'annexe B.

- 1 Fee for a permit under section 5: $5.

- The fee for a third or subsequent safety hazard inspection required in respect of the same application under section 8 shall be twice the fee for the Immediately preceding safety hazard inspection.
- The fees for a standards inspection under section 9 are as follows:
- (a) floor area of over 100 square meters (1080 sq. ft.): $600.:
- (b) floor area of 50 square meters (540 sq. ft.) or more but not over 100 square meters (1080 sq. ft.): $450.:
- (c) length of 10 meters (33 ft.) or more and a floor area of under 50 square meters (540 sq. ft.): $300.:
- (d) length of four meters (13 ft.) or more but less than 10 meters (33 ft.): $75: $95

Manitoba Regulation 96/87 R amended 1 The Mobile Homes Standards and Permits Regulation, Manitoba Regulation 96/87 R, is amended by this regulation.
## ? Schedule B is amended
- (a) in section 1, by striking out "$5." and substituting "$20.";
- (b) in section 2, by striking out "$5." and substituting "$20.";
- (c) in clause 4(d), by striking out "$75." and substituting "$95."; and
- (d) in clause 4(e), by striking out "$45." and substituting "$75.".
Coming into force This regulation comes into force 30

Le présent règlement modifie le Règlement sur les normes et les permis relatifs aux maisons mobiles, R.M. 96/87 R.
## 2 L'annexe B est modifiée :
- a) dans l'article 1, par substitution, à « 5 $ », de « 20 $»;
- b) dans l'article 2, par substitution, a « 5 $», de « 20 $»;
- c) dans l'alinéa 4d), par substitution, à * 75 $», de « 95 $ »;
- d) dans l'alinéa 4e), par substitution, à * 45 $», de = 75 $».
## Entrée en vigueur
- Le présent règlement entre en vigueur 30 jours après son enregistrement.
## SCHEDULE "E"
## TO BY-LAW NO. 2385/04
Respecting Moving of Building Into and Within The Rural Municipality of Swan River
- (a) That only new buildings are permitted to be moved into and within the Rural Municipality wan River without consideration by Council in sessio
- (b) That all such buildings to be moved shall comply with the Manitoba Building Code.
- (c) This permit becomes null and void if work or construction authorized is not commenced within six (6) months.
## 2. Existing Buildings:
- a) That should any person, firm or corporation apply to move into or within the Rural Municipality of Swan River any building that is not a new building, the said party may apply directly to Council with a letter from the local Building Inspector regarding the structural soundness of the said building.
- b) That the building to be moved may be subject to Building Inspection Fees as follows:
3. Council's Responsibility:
| i. | For single family residential and accessory use buildings plus travel costs at current rates |
|------|------------------------------------------------------------------------------------------------|
| ii. | For all other buildings plus travel costs at current rates |
| iii. | For all other subsequent inspections plus travel costs at current rates |
Council will consider each such application on its merits and in the best interest of the Rural Municipality and of the applicant.
## 4. Applicant's Responsibility:
To provide the following information with regards to the building being moved and / or the foundation and site to which the building is to be moved:
- a) Every owner shall give notice to the Rural Municipality upon completion of any work prior to any occupancy of a building or part thereof after construction, partial demolition or alteration of that building or change in the occupancy of any building or part thereof.
- b) A site plan, drawn to scale, showing the location of the proposed building on the proposed lot location.
3. RTM (Ready to Move Home) and Mobile / Modular Home
4. A copy of all permits (Building, Plumbing & Electrical taken out for the building in he location of construction.
5. A complete set of plans and specifications.

7. All building components requiring a Professional Certificate, in accordance with Manitoba Building Code, shall bear the Professional Seal of an Engineer licensed in the

If the building was built without the required Building, Plumbing and Electrical inspections, a professional engineer licensed in the Province of Manitoba shall conduct a plan review and carry out the required inspections and provide a written report of such. The written report shall bear the Professional Seal of the Engineer.
## 5. Building Inspector's Responsibility:
To inspect said building and ensure receipt of and review the following information to ensure compliance with the Manitoba Building Code:
- a) A complete set of plans and specifications.
- b) All building components requiring Profession Certificate shall bear the Professional Seal of an Engineer licensed in the Province of Manitoba.
- d) If the building was built without the required Building, Plumbing and Electrical inspections, a professional engineer licensed in the Province of Manitoba shall conduct a plan review and carry out the required inspections and provide a written report of such. The written report shall bear the Professional Seal of the Engineer.
- c) A copy of all permits (Building, Plumbing & Electrical) taken out for the building in the location of construction. A copy of all inspection reports shall accompany the permits.
- e) A site plan, drawn to scale, showing the location of the proposed building on the proposed lot
