RESPECTING STREETS, SIDEWALKS AND
PUBLIC PLACES

BE IT ENACTED by the City Council of the City of
Bathurst, as follows:

In this By-law,

"handbill" means any paper upon which is written
any notice, message, advertising or information of
any kind. (prospectus)
"person" means and includes corporation,
partnership, association, or society. (personne)
"street" means and includes highways, gutter, curb,
boulevard, sidewalk, space between property lines,
parks, parkways, driveways, squares, bridges,
viaducts, off street parking lots, places used by the
public for pedestrian and vehicular traffic. (rue)
"Summer months" means between the twentieth day
of April and the first day of November of any year.

drawn vehicle, or any machinery or other
mechanical equipment moved upon

2.
No person shall place, or cause to be placed, or be
moved over any street any building or like structure, or any
heavy machinery or similar object, or any other object or
material, which may in the course of placement or movement
either interfere with normal traffic or cause damage to the
street, unless;

application in writing is made to the City
Chief of Police for permission to move the said
object; and
a)

When any street or sidewalk has been damaged as a
consequence of the construction or repairs of a building, the

City Engineer may serve notice in writing upon the owner,
tenant, or occupant of the building requiring him to repair the
damage to the street or sidewalk within forty-eight hours
from service of the notice, and, if the repairs are not made as
directed, the City Engineer may cause the repairs to be made
at the expense of the owner, tenant, or occupant and the cost
of the repairs shall be recoverable by the City of Bathurst by
action in any court of competent jurisdiction.

IT SHALL BE AN OFFENCE under this By-law for
a person,

to distribute handbills by placing, scattering,
dropping, or passing them out on any street;

a manner that any material being carried in the
vehicle is allowed to drop there from, for this
purpose all vehicles will be equipped with covers;

to put or place upon any street, or upon any
open plot of ground or upon any portion of vacant
land in the City of Bathurst, any dirt offal, rotten or

other similar debris;

to throw or sweep upon any street or open
plot of ground within the City of Bathurst any
rubbish, or parts of trees, or any other material
which has accumulated in or upon the property;

(e)
being the owner, tenant or occupant of any
land fronting upon any street where a hard surface
sidewalk has been laid, to fail to sweep, keep clean
that portion of the sidewalk which lies adjacent to
the said land during the summer months;

(f)
to skate, ski, toboggan slide, rollerskate,
rollerblade, skateboard, interfere with traffic by
offering vehicle window cleaning services or engage
in any other sport, game or other recreational
activity, on any street except where permitted by the
owner of the premises;

to engage in any sport, game or recreation,
other than walking on any street;

to throw any stone, ball, snow, ice or other
missile, or use any bow and arrow, sling, or catapult,
or discharge any firearm, fireball;

firecracker within the City of Bathurst;

to use any street or sidewalk in such a
manner that pedestrians are injured or jostled
thereby;

to use any sidewalk other than for
pedestrian use without written permission of the
City and under such terms and conditions as the City
may prescribe;

to place, suspend, or expose from any
building, goods, wares, or merchandise, so that the

for any person to permit icicles, snow or ice

others, to occupy more than one-half of the
sidewalk;

for any person to slack, riddle, mix or
otherwise prepare lime, cement, concrete or other
similar material on any street, except with
permission in writing of the City Engineer;

to place, construct or erect on any street any
sign, poster or other advertising device, or to place
or cause or suffer to be placed, any goods, wares, or

(t)
to use any portion of the street for the
purpose of selling any goods, wares, or merchandise
of any nature or for measuring, packing, or
unpacking goods, wares, or merchandise without
written permission of the City and under such terms
and conditions as the City may prescribe.

to place, erect or affix any posters, signs or
advertising material on a street or public right-of-
way without having obtained a permit from the
City Clerk, and,

ou une emprise publique sans avoir obtenu un
permis du secrétaire municipal;
upon deposit of $200.00, the City Clerk
is authorized to issue a permit to the
applicant, and

the applicant is eligible for a refund of
$150.00 provided the posters, signs or
advertising material have been removed no
later than 14 days after the end of the event,
and the City Clerk shall not issue any refund
until the removal of the posters, signs or
advertising material have been confirmed by
the Building Inspector, and

signs or advertising material, the deposit
shall be forfeited and the City Clerk may
cause, without further notice, the removal
of the posters, signs or advertising material,

Clerk may require compliance to the By-

Law and/or the removal of the posters,
signs or advertising material within 24
hours from the issuance of a notice to the
owner of the poster or sign, and

the Building Inspector shall monitor
the City for illegally installed posters, signs
or advertising material and shall inform the
City Clerk of such, and

upon failure of an owner to obtain a
permit or to make suitable arrangements

of the posters, signs or advertising material,

the cost associated with the removal of
the poster or sign may be recovered by the
City in an action of debt in a Court of
competent jurisdiction, and

no permit will be issued for posters to
be installed on utility service poles unless
written approval is obtained and submitted
with the application, and

non-profit community-based
organizations or government agencies,
such as but not limited to the Rotary Club,
Knights of Columbus, Milk Fund Group,

event or activity, shall also apply for a
poster permit but the fees will be waived.

shall not apply to persons who are licensed to
operate within the City, in accordance with By-law
No. 2010-04 entitled "Transient Traders', and
Peddler's, Vendor's and Auction By-law.

A person who sells or offers for sale
anything on a sidewalk is subject to the following
conditions:

He shall not sell or offer for sale
anything from a stand on a sidewalk when
the location is: within 25 feet of the
principle entrance to any building.

5.
(a)
No person shall fill in or obstruct a public
drain, gutter or watercourse or natural drain on
public or private property;

No person shall plant a hedge, shade or
ornamental tree or build a fence or wall on any
public right-of-way;

d'ombrage ou d'ornement ou de construire une
clôture ou un mur sur une emprise publique.
(c)
No person shall landscape the area adjacent
to the street on the public right-of-way in such a
manner that it is higher than the existing street level,
so that it will interfere or obstruct the maintenance
and use of the street;

paysagé dans l'emprise publique attenante à la rue
de façon que cet aménagement soit plus élevé que le

(d)
Every owner of a shade or ornamental tree
growing adjacent to a street, shall keep such tree
pruned or trimmed, so that it does not interfere with
or obstruct the uses of the street.

sorte qu'il ne gêne pas la circulation ou n'empêche

6.
The use of tractors, traction engines or other heavy
vehicles with flanged wheels that are not provided with
attachments so as to make the outer surface of the wheels
smooth, are hereby prohibited on all paved and concrete
streets unless permission has first been secured from the City
Engineer.

d'asphalte ou de béton des tracteurs, des engins de traction et
autres véhicules lourds équipés de roues à boudin non

7.
Heavy merchandise may be transferred to and from
trucks or other vehicles over the sidewalk by the use of skids,
or other suitable protection, provided the sidewalk is not
unreasonably obstructed and such obstruction does not
continue for a period in excess of five minutes at a time,
except where otherwise permitted by the City Engineer or
the Police Chief of the City of Bathurst.

lourdes sur un trottoir à l'aide de patins ou tout autre
dispositif de protection approprié, à condition de ne pas

8.
(1)
And in addition the City Engineer may close
any street, lane, public ground or public place or any
pavement, sidewalk, or crossing for such period as
found necessary to remove any snow, ice, or other
obstruction there from, providing notice of intention
of such closing is prominently displayed in that area
for at least three hours before such closing.

The City Engineer of the City of Bathurst
may also prevent entry to any street, lane, public
ground, or public place or any pavement, sidewalk,
or crossing and may prohibit the improper use
thereof.

Any person who uses any street, lane, public
ground, or public place, or any pavement, sidewalk
or crossing by walking thereon or driving any
vehicle or animal thereon while the order of the City
Engineer for closing the same is in force, shall be
guilty of an offence under this By-law.

9.
It shall be unlawful for any person to place or
maintain or display upon or in view of any street, any sign,
signal or device which resembles an official traffic sign or
signal device, and the same is hereby declared to be a
nuisance and the Chief of Police is empowered to remove the
same or cause it to be moved without previous notice.

dans une rue ou à proximité d'une rue un panneau ou un
dispositif de signalisation ou autre qui ressemble à un
panneau ou à un dispositif officiel de signalisation. Ces
panneaux et dispositifs sont déclarés constituer une
nuisance et le chef de police est habilité à les enlever ou les
faire enlever sans préavis.
10.
No person shall remove, mark or deface any sign
erected or placed by authority of the City Council or any
official of the City of Bathurst.

Il est interdit d'enlever ou de détériorer un panneau
installé par suite d'une décision du conseil municipal ou
d'un fonctionnaire de la municipalité ou d'y porter des
inscriptions quelconques.
PENALTY
PEINE
11.
A person who violates any provision of this By-law
is guilty of an offence and is liable on summary conviction
to a fine not exceeding fifty dollars ($50.00), and in default
of payment is liable to a penalty in accordance with the
Provincial Offences Procedure Act.

Quiconque contrevient aux dispositions de cet
Arrêté est coupable d'une infraction punissable sur
déclaration de culpabilité par procédure sommaire et
passible d'une amende ne dépassant pas cinquante dollars
(50,00$), et, en cas de défaut de payer, d'une pénalité en
vertu des dispositions de la Loi sur la procédure
applicable aux infractions provinciales.
12.
By-law No. 582, entitled "A By-Law of the City of
Bathurst respecting Streets, Sidewalks and Public Places",
and all its amendments are hereby repealed.

Est abrogé l'arrêté 582 intitulé "A By-Law of the
City of Bathurst respecting Streets, Sidewalks and Public
Places", ensemble ses modifications.

the Corporate Seal of the said City to be affixed to this by-
