- (ii) the information relative to the filing as described in paragraph (a);
- (i) the action taken by the Minister,
- send to the Minister a copy of the notice as described in paragraph

By-Law to Adopt the Rural Plan of the Cocagne Rural Community
established under the COMMUNITY PLANNING ACT
Under the authority vested in it by the subsection 44 of the Community Planning Act, R.S.N.B. 2017 c. C-19 of New-Brunswick, the municipal Council of the Cocagne Rural Community, duly assembled, adopted by the majority as follows:
1. This By-Law may be cited as the Cocagne Rural Community Rural Plan By-Law - Community Planning Act.
2. The area of land described as follows and shown more specifically on the map in Schedule B entitled "Zoning the Cocagne community" is designated for the purpose of the adoption of this Rural Plan to which this By-Law applies.
3. The Cocagne Rural Community Planning Area Rural Plan By-Law Community Planning Act is hereby adopted for the Cocagne Rural Community Planning Area, described in section 2 of Part A.

1. Le présent arrêté peut être cité sous le titre Arrêté établissant un plan rural pour la communauté rurale de Cocagne - Loi sur l'urbanisme.
2. Le secteur de terrain décrit comme suit et indiqué plus précisément sur la carte figurant à l'annexe B intitulée « Carte de zonage pour la communauté rurale de Cocagne», est désigné aux fins d'adoption du présent plan rural auquel s'applique le présent arrêté.

## By-Law to Adopt the Rural Plan of the Cocagne Rural Community
established under the COMMUNITY PLANNING ACT
## PART A - INTRODUCTION
The Rural plan of the Cocagne Rural Community [hereinafter referred'to as the Rural Plan] is established in order to provide a framework of reference that will guide the municipal Council in their decision-making process that will ensure beneficial development in the community.
This By-Law is prepared in accordance with Section 44 of the Community Planning Act, R.S.N.-B. 2017 c. C-19 [hereinafter referred to as Community Planning Act] of New-Brunswick. This Rural Plan entitled "Bylow 18-02 to Adopt the Rural Plan of the Cocagne Rural Community".
## 1 AREA COVERED BY PLAN
- 1.1 This By-Law may be cited as the Cocagne Rural Community Rural Plan ByLaw - Community Planning Act.
- 1.2 The area of land described as follows and shown more specifically on the map in Schedule A entitled "Zoning map of the Cocagne Rural community" is designated for the purpose of the adoption of this Rural Plan to which this By-Law applies.

## PARTIE A - INTRODUCTION
Le plan rural de la communauté rurale de Cocagne [ciaprès le Plan rural] est préparé afin de fournir un cadre de référence et un guide qui servira à entériner une prise de décision éclairé par le conseil de la communauté rurale ce qui aura pour effet de permettre les aménagements bénéfiques au développement de la communauté.
Ce plan rural est préparé en conformité l'article 44 de la Loi sur l'urbanisme, L.R.N.-B. 2017 c. C-19 [ci-après Loi sur l'urbanisme] du NouveauBrunswick. Ce Plan Rural constitue l'annexe A de l'arrêté No. 18-02 intitulé « Arrêté adoptant le Plan rural de la communauté rurale de Cocagne ».

- 1.1 Le présent arrêté peut être cité sous le titre Arrêté étublissant un plan rural pour la communauté rurale de Cocagne - Loi sur l'urbanisme.

## PART B - OBJECTIVES AND POLICY STATEMENTS
## OBJECTIVES
## 1. The objectives of the Rural Plan are:
- (a) to protect the values of local residents in order to preserve their quality of life while encouraging sustaidable development;
- to divide the municipality into zones, subject to the authority vested in the Kent Regional Service Commission, specifically:
- (i) possible uses of the lands, buildings bocaten a a zone; and structures
- (ii) mandatory standards relative to land use, as well as to the installation, construction, alteration and use of buildings and structures;
- (c) to probibit the use, installation, construction or alteration of lands, buildings oi structures that fail to comply with the purposes and standards set out in this Rural Plan;
- (d) to allow residents to actively participate in guiding development within their community; and
- (e) to prevent and deter from land use conflicts that would cause negative social or economic consequences.
## PARTIE B - OBJECTIFS ET PRINCIES OBJECTIFS

2. (a) Protéger les valeurs des citoyens pour ainsi préserver leurs qualités de vie tout en encourageant le développement durable

- c) interdire l'usage, l'installation, l'édification ou la modification des terrains, bâtiments ou constructions non conformes aux fins et aux normes mentionnées dans le présent Plan rural.

## POLICIES AND PROPOSALS
The policies and proposals of the Rural Plan are:
## (a) Residential Uses
- It is Council's policy to allow a variety of low density residential uses in the Rural Community to meet the needs of the existing population.
- It is Council's policy to preserve the rural character of the area, to allow the establishment of attractive and safe residential neighbourhoods, and to prohibit uses incompatible with established residential zones.
- The Council proposes that residential development be permitted in conjunction with other uses. Certain measures will be implemented to reduce or minimize conflicts that might arise.
- The Council proposes to permit residential development including mobile homes and micro homes along public streets and roads that have been approved by the Minister of Transportation and Infrastructure or any other accesses approved by the Commission. Residential development projects must comply with the environmental standards prescribed by the Department of Environment and Local Government, the Department of Health, as well as with all other acts or regulations relevant to the projects.
- The Council proposes that residential development along private-access roads be low density.
- The Council proposes that the construction of multi family dwellings be permitted in the community core and while not allowing this activity in rural areas, except in the case of a rezoning under section 59 of the Community Planning Act.
- The Council proposes the prohibition in residential areas of commercial activities that occupy a floor area greater than that governing a home business or occupation, except in the case of a rezoning under section 59 of the Community Planning Act.
## PRINCIPES ET PROPOSITIONS
Principes et propositions du plan rural :
## (a) Usages résidentiels
- -Le Conseil vise, en principe de permettre une variété d'usages résidentiels à faible densité dans la communauté rurale afia de répondre aux besoins d'une population existante.
- Le Conseil vise, en principe de protéger le caractère rural du secteur, de maintenir lés quartiers résidentiels attrayants et sécuritaires et d'interdire les usages incompatibles dans les zones résidentielles établies.
- Le Conseil propose que l'aménagement résidentiel soit permis en conjonction avec d'autres usages. Certaines mesures seront établies afin de réduire ou minimiser les conflits qui pourraient survenir.
- Le Conseil propose de permettre l'aménagement résidentiel incluant les maisons mobiles et les micromaisons que sur le long des rues ou routes publiques approvés par le ministre des Transports et Infrastructures ou autres accès approvés par la Commission. L'installation doit correspondre aux normes environnementales prescrites par les ministères de l'Environnement et Gouverements locaux, de la Santé, ainsi que toutes autres lois ou tous autres règlements pertinents au projet.
- Le Conseil propose que le développement résidentiel le long d'un accès privé soit à faible densité.

## (b) Commercial Uses
- It is Council's policy to allow a variety of commercial development in appropriate areas based on the needs of the community while taking into account transportation system requirements, impacts on the environment and compatibility with the uses made of adjoining lands.
- It is Council's policy to recognize the importance of the economic activity generated by tourism and to encourage this sector to develop and integrate harmoniously with the community's rich heritage, as well as its agricultural and forestry sectors.
- The Council proposes to authorize larger scale businesses in some areas along roadways classified as arterial or collector highways.
- Ihe Council proposes to authorize small scale businesses that meet the needs of the local community, provided the businesses are located on a roadway or public street classified as local.
- The Council proposes that the establishment of new commercial uses in proximity to current commercial uses be encouraged so as to create a business hub.
- The Council proposes that a commercial use not mentioned in the Regulation may be authorized., subject to an agreement under section 59 of the Community Planning Act.
## (b) Usages Commerciaux
- Le Conseil vise, en priacipe de permettre une variété d'aménagements commerciaux daus les secteurs appropriés en fonction des besoins de la communauté, du réseau de transport, de l'impact sur l'environnement et la compatibilité avec les usages des terrains avoisinants.

- Le Conseil propose d'autoriser les usages commerciaux de plus grandes tailles le long des routes possédant une classification collectrice ou artérielle.
- Le Conseil propose d'autoriser les usages commerciaux de petite taille qui répondent aux besoins de la communauté locale et qui se trouvent le long des routes ou rues possédant une classification locale.
- Le Conseil propose que les nouveaux usages commerciaux soient encouragés à proximité des usages commerciaux réels afin de former un noyau d'usages commerciaux.
- Le Conseil propose qu'un usage commercial non mentionné dans le règlement puisse être autorisé, sous réserve d'un accord en vertu de l'article 59 de la Loi sur l'urbanisme.
- (c) Community uses, including recreational equipment and public spaces
- It is Council's policy to allow a variety of community uses to meet the needs of local residents.
- It is Council's policy to strategically encourage the development of the community's collective services.
- It is Council's policy to promote its recreational equipment and to facilitate its green space connectivity by establishing designated pathways.
- -The Council proposes to allow and encourage the majority of community facilities to be established in the community central core.
## (d) Industrial Uses
- It is Council's policy to allow a variety of industrial development in appropriate areas of the community in order to encourage diversified economic development.
- It is Council's policy to minimize the impact of manufacturing operations on the environment and local residents' health and safety.
- The Council proposes that industrial activities that may cause harm to the neighbouring area be permitted only within an industrial park that has the means to implement emergency response measures in the event of a disaster.
- The Council proposes that new types of industrial activities that may have a moderate or significant impact on the environment be authorized, subject to an agreement uader section 59 of the Community Planning Act.
- (c) Usages Communautaires, équipements de loisirs et espaces libres
- Le Consell vise, en principe de permettre une variété d'usages communautaires afin de répondre aux besoins de la population.
- -Le Conseil vise, en principe d'encourager le développement stratégique des services collectifs communautaires.

## (d) Usages industriels
- -Le Consell vise, en principe de permettre une variété d'aménagements industriels dans les secteurs appropriés de la communauté afin d'encourager un développement économique diversifié.
- -Le Conseil vise, en priucipe de minimiser les impacts d'opérations manufacturières sur l'environnement, la santé et la sécurité des gens.
- Le Conseil propose que les usages industriels qui euvent nure à ua voisinage ne soient permis qu' l'intérieur d'un paro industriel possédant les mesure. d'urgences nécessaires pour réagir à un sinistre.
- -Le Conseil propose que les nouveaux usages industriels qui peuvent causer un impact modéré ou important sur l'environnement soient autorisés, sous réserve d'une entente en vertu de l'article 59 de la Loi sur l'urbanisme.
- (e) Recreational facilities and open public spaces uses
- -It is Council's policy to recognize the importance of recreational activities and the development of public spaces.
-It is Council's policy to promote active lifestyles and enhanced social vitality for local residents.
- -The Council proposes that walking trails and/or bicycle paths managed by the Cocagne Rural Community Council, NB Trail or other organizations be permitted and encouraged in the community.
## Environmental preservation
- -It is Council's policy to maintain and ensure the quality of life of residents, preserve the natural beauty of the region, protect areas for which there is community sensitivity, and protect these areas from all harm.
- -It is Council's policy to be vigilant towards infilling activities, construction and improvements carried out on lands with these characteristics in order to prevent flooding, pollution, habitat destruction and other events that may destabilize the flora and fauna and otber aspects of the environment.
- -The Council proposes the probibition of improvements, construction and modifications that a proactions tot will have a negative impact on the environment.
- -The Council proposes that there be mitigation and rehabilitation plans for permitted uses that have a negative impact on the environment in order to protect and maintain the quality of life of residents, control polluting emissions and preserve the natural beauty of the environment
- -The Council proposes that wetland areas as well as lands within 30 metres of a watercourse, lake or marsh be designated as protected (protection of the environment).

- -Le Conseil vise, en principe d'être vigilant envers le remplissage, la construction, et l'aménagement effectué sur les terres en vue de prévenir les inondations, la pollution, la destruction d'habitats et autres évènements qui peuvent déstabiliser la faune, la flore et les autres aspects de l'environnement.
- -Le Conseil propose d'interdire les aménagements, les constructions ou les modifications qui auront un inapact négatif sur l'environnement.
- -Le Conseil propose que les usages permis qui ont un impact négatif sur l'environnement aient des plans de mitigation et de rébabilitation afin de protéger et de maintenir la qualité de vie des résidents, de contrôler les émissions polluantes et de préserver la beauté naturelle de l'environnement.
- -Le Conseil propose que les secteurs de terres humides, ainsi que les terres qui se trouvent à l'intérieur de 30 mètres d'un cours d'eau, d'un lac et d'un marais soient désignés à titre d'usage (protection de l'environnement).
- (g) Uses related to Natural Resources and Hydraulic
- -It is Council's policy to allow natural resources related activities to be carried out, while preserving lands suitable for development for future generations
- -It is Couacil's policy to minimize the impacts of quarry operations on the environment and the health and safety of people.
- It is Council's policy to allow the development of activities on Crown lands that would be compatible with this Rural Plan and the development objectives of the Department of Energy and Resource Development.
- It is Council's policy to develop a strategic land use plan in order to minimize negative impacts to the aquifer that could arise from the exploitation of resources and land development.
- -It is Council's policy to consider new developments related to the extraction or mining of bituminous shale, oil and natural gas after carrying out rezoning and considering the possibility of incorporating reasonable conditions or any other measure stipulated in section 59 of the Community Planning Act.
- -It is Council's policy to minimize the impacts of operations related to the extraction or mining of bituminous shale, oil and natural gas, that is, as a form of main, secondary or accessory use of land, buildings or structures and includes a lease, under consideration or issued, as provided for in the Oil and Natural Gas Act or the Bituminous Shale Act.
- -The Council proposes that quarry operations be set up in appropriate areas tar trom habitable areas, as well as sites of hydrogeological interest to the community, and that these sites must comply with the site rehabilitation plan.

- vii. other matters that it considers relevant to a development.
-The Council proposes to consider the appropriate zone for a proposed development and decide whether it must also amend its policies and proposals for the Rural Plan.

"adult motion picture theatre" means an establishment where, for any form of consideration, films, motion pictures, video cassettes, slides, or other photographic reproductions are shown which are characterized by an emphasis on the depiction or description of specified sexual activities or specified anatomical areas. "adult retail outlet/bookstore" means an establishment in which more than twenty percent (20%) of the floor space or commercial shelving (whichever is less) is used to offer for sale or rent, for any form of consideration, any of the following:
- (i) books, magazines, periodicals, or other printed matter, or photographs, films, motion pictures, video cassettes, slides, or other visual representations that are characterized by an emphasis upon the depiction or description of specified sexual activities or specified anatomical areas; or

"commercial recreation use" means a building or lot or part of a building or lot used solely for commercial recreation, sport or entertainment purposes and without limiting the generality of the foregoing, may include such establishments as dance hails, horse or vehicle racing tracks, rifle ranges, marinas, bowling alleys, miniature golf courses, bingo halls, roller skating rinks and drivein theatres, and may include a dwelling unit or dwelling units for maintenance or security personnel. « propriété condominiale et propriété condominiale de terrain nu» désigne un immeuble ou un ensemble d'immeubles où les occupants sont propriétaires de leur logement (fond franc) y compris les intérêts dépendants dans l'état descriptif et tout autre dépendant qui sont ajoutés aux parties communes, tels qu'établis en vertu de la Loi sur les condominiums (condominium/bare-lands property)
- "condominium development" means a building or group of buildings where the occupants are owners of their dwelling, as set out in Chapter C-16 of the Condominium Property. Act. (développement condominium)
"convenience store" means a retail store which serves the daily or occasional needs of residents of the immediate area with a variety of goods such as groceries, meats, beverages, dairy products, patent medicines, sundries, tobacco, hardware, magazines, videos and newspapers. (dépanneur)
"cultural facilities" means any land, structure or room designed or used mainly for theatre performances or dauce shows, concerts, movies, conferences or exhibits, or a series of artistic, cultural, academic, or scientific exhibits, but that is not an establishment that showcases specifc body parts or sexual activities. - "daycare centre" means an establishment for the provision of care and supervision to children, as regulated under the Child and Family Services Act. (garderie)
- "daycare, neigbourhood" means a facility where care and supervision is provided for a maximum of fifteen children regulated by the Family Services Act. (garderie de quartier)
- "Director" means the Provincial Planning Director appointed under section 4 of the Community Planning Act. (directeur)

- "dwelling unit" means one or more habitable rooms designed, occupied or intended for usé by one or more persons as an independent and separate housekeeping establishment in which a kitchen, sieeping and sanitary facilities are provided for the exclusive use of such persons. (logement)

"educational use" means a place of instruction within the goverment's jurisdiction or an establishment which offers courses equivalent to those regularly provided in a place of instruction under government jurisdiction, and which may include a daycare centre and a residence for students and staff, as long as these buildings are located on the same lot as the place of instruction. "entertainment use" means any activity carried on within a building or part of a building which involves commercial entertainment, amusement or relaxation and, without limiting the generality of the foregoing, includes a tavern, nightclub or other beverage room, an arcade or amusement centre and a pool or billiard hall, but does not include escort services, adult arcades, adult cabarets, adult motion picture theatres, adult retail outlet/book stores, or massage parlours. "escort service" refers to an establishment where, for any form of consideration, escorts are provided for sexual pleasure and which is characterized by an emphasis on specified sexual activities. (agence d'escorte)

"established grade" means with reference to · building, the average elevation of the frished surface of the ground where it meets the exterior of such building, and when used with reference to a structure, shall mean the average elevation of the finished grade of the ground immediately surrounding such structures. "extraction use" means all buildings, aggregate plants, material storage areas and weigh scales associated with the excavation of rock, borrow material, soil for commercial sale or use but does not include structures or storage areas which are fundamental to the activities of mining. "family" refers to one or more persons who are not necessarily related and occupy a space and form a single household as opposed to a group staying in a hotel, boarding house or a rooming house. (famille)

"gross floor area" means the aggregate of the floor areas of a building above and below grade, measured between the exterior faces of the exterior walls of the building at each floor level, but excluding car parking areas within the building; and for the purpose of this clause, the walls of an inder court shall be deemed to be exterior walls. "height" in respect to a main building or structure, the vertical distance between the established grade and the bighest point of the roof surface for a flat roof, hip roof, or gable roof, or to the roof line in the case of a gambrel ot mansard roof. "hobby farming" means an activity or use secondary to the permitted main residential use, which may include:
- (a) adequate pasture land with suitable shelter for a maximum of fifteen (15) hens including other similar species oi a maximum of two (2) livestock at a ratio of I livestock for each 4000m' of lot area.
- (b) a market garden or a plantation covering a maximum area of 6,000 square metres;
- (c) may not include an agricultural activity that poses a risk of contaminating water, air, soil or the surrounding environment, and
- (d) may not include a poultry house, hog barn or slaughterhouse. (usage agricole artisanal)
"home occupation" means a secondary use that is clearly related and secondary to the residential use made of the asset and exercised in an accessory building or in part of a dwelling. (activité professionnelle à domicile)
"hotel or motel" means a commercial building or buildings providing temporary accommodations for travelers or transients on a year-round basis, and may have a public dining room and convention room. (hôtel ou motel)
"household pet" means a domestic animal customarily kept within a dwelling or in an outside pen or accessory building for the sole purpose of pleasure rather than utility, and includes dogs, cats, rabbits, small birds, Vietnamese potbellied pigs and rodents, but excludes cattle, sheep, horses, pigs, poultry, bees and animals customarily kept as farm animals. « animal familier» Animal domestique gardé ordinairement à l'intérieur d'une habitation ou dans un paro extérieur ou un bâtiment accessoire uniquement dans un but d'agrément, mais sans autre utilité; la présente définition comprend les chiens, chats, lapins, petits oiseaux, petits cochons vietnamiens et rongeurs, mais exclut le bétail, les moutons, les chevaux, les cochons, la volaille, les abeilles et les animaux gardés ordinairement comme animaux de ferme. "in-law suite" means an apartment contained within a main single detached dwelling and which is internally accessible from the main dwelling unit. (appartement de parents)
"institutional services" means the use of lands, buildings or structures for the public or not for-profit sectors, and may include, but is not limited to, schools, places of worship, indoor recreational facilities, community centres, public hospitals and government buildings. (service collectif)

"outdoor display court" means an area of land where goods are displayed which are available for sale to the general public from a retail outlet located on the same lot or on another lot. Without limiting the generality of the foregoing, outdoor display includes the display of cars, trucks, vans, motorized campers, trailers, boats, snowmobiles, motorcycles, swimming decorative fountains and prefabricated cottages and homes. "personal service shop" means a building or part of a building in which persons are employed in furnishing direct services and otherwise directly administering to the individual and personal needs of persons, and includes such establishments as barber shops, beauty parlours, automatic laundry shops, hairdressing shops, shoe repair, and tailoring, laundry and dry-cleaning collection depots and shops, but does not and shall not mclude the manutacturing or fabrication of goods for retail or wholesale distribution. "residence for seniors" means a multi-unit residential building that is mainly designed for residents who need to be close to community facilities, such as public transit, retail stores, churches, etc., and includes one or more common areas where residents can socialize, and a portion of which, not exceeding 16 square metres, can be allocated to secondary uses, such as physician's offices or medical clinics, shops providing personal services or a retail store, as well as to other similar uses. Common areas take up an area equal to at least 10% of the total area of each multi-unit building, and the exterior area of the building may take up 50% of the total area. "residential care facility" means a building or place or part of a building in which accommodation aud nursing, supervisory and/or personal care is provided, or is made available for more than three persons with social health, legal, emotional, mental or physical handicaps or problems, and includes such facilities as are licensed by the Family Services Act, or by any other provincial legislation, but does not include any public or private hospital or sanatoriuma, or a jail, prison or reformatory, or a hostel. "sight triangle" means the triangular shaped area of land, free of buildings or structures, formed by measuring from the point of intersection of street lines on a corner lot, the distance required by this by-law, along each such street line and adjoining such end points with a straight line. ## SECTION 2 - PURPOSE, ADMINISTRATION, CLASSIFICATION and CONFORMITY
## 2.1 The purpose of Part C is
- (a) to divide the Cocagne rural community into zones;
- (b) to prescribe, subject to powers reserved to the Kent Regional Service Commission (KRSC):
- (i) the purpose for which land buildings and structures in any zone may be used, and
- (II) the mandatory standards to which land and the placement rection, alteration and use o buildings and structures must conform; and
- (c) to prohibit the use, placement, erection or alteration of lands, buildings or structures other than in conformity with the purposes and standards mentioned in this Regulation.
## 2.2 Powers of Council
- 2.2(1) The Council may prohibit the erection of a building in the Regional Community, for which the Council deems that satisfactory measures were not taken to supply it with electric power, water, sewer, roads and other services or equipment
- 2.2(2) In any zone set out by this regulation, the Council must prohibit the use or the development of land, building or structure. in whole or in part, to be installed, erected, altered or used other than in a matter permitted by this Regulation.
## 2.3 Powers of the Commission
- 2.3(1) No building or structure may be erected on any site where it would otherwise be permitted under this Regulation when, ia the opinion of the Commission, the site is marshy, subject to flooding, excessively steep, or otherwise unsuitable by virtue of its soil or topography.
## ARTICLE 2 - BUT, ADMINISTRATION, CLASSIFICATION ET CONFORMITÉ
## 2.1 La partie Ca pour but;

## 2.3 Pouvoirs de la Commission

- 2.3(2) The Commission may, on such terms and conditions as it considers fit,
- a) authorize for a temporary period not exceeding one year, a development otherwise prohibited by this Regulation, more fully described under paragraph 53(2)1) (i) of the Community Planning

2.3(3) In all zones created by this Regulation, the use of land for the purposes of the supply of:
- electric power;
- b) natural gas or oil;
- c) water supply and storage;
- sanitary disposal and treatment of sewage;
- e) draidage, including storm sewers;
- f) streets, and
- all other public utilities,
is permitted, including the location or erection of any surface-located structure for the purposes of supplying one of the above-mentioned services shall be a particular purpose in respect of which the Commission may, subject to subsection 53(4) of the Community Planning Act, impose terms and conditions.
## 2.3(4) Abandonment of non-conforming use
Where a non-conforming use protected by acquired shall conform to this Regulation.
## 2.3(5) Reconstruction of destroyed building
Where a building or structure has, in the opinion of the Commission, been damaged to the extent of at least one half of the whole, this building or structure shall not be repaired, restored or used except in conformity with this Regulation.

## 2.4 Administration - Amendments
- 2.4(1) A person who seeks to have this Regulation amended shall:
- a) address a written and signed application in duplicate to the Council that includes the following:
- (i) a reference to the provision in the Rural Plan subject to the requested amendment;
- (ii) a list of the properties that the application concems;
- (ill) a list of the owners concerned;
- (iv) à description of the current uses of the lands, buildings or structures;
- (V) a description of the proposed use of the lands, buildings or structures;
- (vi) a description of the requested amendment; and
- (vil) a list of supporting reasons for the requested amendment, along with supporting documentation deemed necessary to promote the project, and
- b) submit payment of a fee of $1,500 to the order of the Council.
- 2.4(2) The Council may return the fee mentioned in paragraph (1)b) in whole or in part.
- 2.4(3) The application referred to in this section must include information that may be required by the Minister or the Commission.
- 2.4(4) The Council may refuse to consider an application referred to in this section, if such application:
- a) consists in changing the zoning of an area of land from one type of zoning to another; of
- b) has not been signed by one or more owners in the area of land mentioned in paragraph a).
- 4(5) Prior to making known its opinion on an pplication submitted pursuant to this section, th Commission may conduct investigations that it deems necessary.
## 2.4 Administration - Modifications
- 2.4(1) Quiconque souhaite faire modifier le présent règlement doit:
- a) adresser au conseil une demande en double exemplaire, écrite et signée, qui comprend les éléments suivants;
- (i) une référence à la disposition du Plan rural sujette à la modification demandée;
- (ii) une liste des propriétés visées par la demande;

- (Vi) une description de la modification sollicitée; et
- (vii) uae liste des motifs à l'appui de la demande de modification, accompagnée de pièces justificatives jugées nécessaires pour faire valoir le projet; et
- b) verser un droit de I 500,00 $ à l'ordre-conseil.
- 2.4(2) Le conseil peut restituer, en tout ou en partie, le droit mentionué à l'alinéa (1)b).
- 2.4(3) La demande visée au présent article doit comprendre des renseignements qui peuvent être requis par le Ministre ou la Commission.
- 2.4(4) La conseil peut refuser de considérer une demande visée au présent article, si une telle demande:
- a) consiste à changer le zonage d'un secteur de terrain d'un type de zonage à un autre; ou

## 2.7 Obligation and conformity
- 2.7(1) In any zone, lands may be used and developed, and buildings and structures, in whole or in part, may be placed, erected, altered or used only in conformity with the requirements of the part of this Regulation pertaining to such zone, except where the requirements are waived.
- 2.7(2) In any zone, the zoning provision of this plan do not apply to lands that are under the administration and control of such Minister of the Crowa or any person that has received an interest in such lands through lease, easement, licence, licence of occupation or other instrument authorized by a Minister.
- 2.7(3) The zones indicated in Schedule A are normally 150 metres deep, unless stated otherwise.

## Residential Zone (R)
## PERMITTED USES
- 3.1.1 The lands, buildings or structures located in a Residential Zone (R Zone) may only be used for the following purposes:
- a) one of the following main uses:
- (i) single-family dwelling;
- (ii) two-family dwelling;
- (ill) a public park, a playground, a playing field or a special-purpose trail; and
- b) one of the following secondary uses:
- (i) a home occupation;
- (ii) a hobby farm;
- (ili) a silviculture or aquaculture use;
- c) with an exemption, for the following secondary use:
- (i) under Section 4.13, an in-law suite;
- d) any building, structure or use secondary to the main use of the land, building or structure of the said main use is permitted.
## LOTS
- 3.1.2 No main building or main structure may be placed, erected or altered and no building or structure may be altered in such a way as to become a dwelling, unless the lot has:
- a) for a single-family dwelling served by a community sewage disposal system,
- (i) a width of at least 23 metres,
- (ii) a depth of at least 30 metres, and
- (iil) an area of at least 690 square metres;
## ARTICLE 3 - Zones

11. (iI) a depth of at least 38 metres;
12. (iii) an area of at least 6,000 square metres.
## DWELLING DIMENSIONS
- 3.1.3 No dwelling shall be placed, erected or altered in such a way that the floor area of the ground floor is less than
- a) for a single-family dwelling
- (1) 75 square metres in the case of a onestorey dwelling;
- (ii) 65 square metres in the case of a splitlevel dwelling or one-and-half-storey dwelling; or
- (iii) 55 square metres in the case of a two or more-storey dwelling; of
- (iv) a minimura width or depta of 4 metres;

- 3.1.5 The height of a main building or main structure may not exceed 9 metres.
## YARD ABUTTING A MAIN BUILDING OR MAIN STRUCTURE
- 3.1.6 A main building or main structure shall not be placed, erected or altered in such a way that it is
- a) less than 7.5 metres from a public street line or private access;
- b) less than 3 metres from the side lot lines; and
- c) less than 3 metres from the rear lot line.

- b) be placed, erected or altered in such a way
- (i) that they are in the front yard of the main building or main structure,
- (it) that they are less than 3 metres from a side lot line or rear lot line; or
- (II) obstruct what would otherwise be the only access to the back yard;
- d) be used
- c) exceed an area of 100 square metres; or
- (i) for coramercial or industrial purposes; or
- (i) for housing.
- 3.1.8 Accessory buildings or structures shall not occupy more that 15% of the lot area.
## LOT COVERAGE
- 3.1.9 Buildings and structures on a lot shall not occupy an area greater than
- a) 45% of the area of an interior lot; or
- b) 35% of the area of a corner lot.
## LANDSCAPING
- 3.1.0 The owner of a residential use lot shall landscape
- a) the front yard of the main building within a 24month period following the expiration of the building permit and/or completion of the construction work;
- b) a strip of land 3 metres around each building on the lot.

- (i) multi-family dwelling
- (ii) a public park, a playground, a playing field or a special-purpose trail; and
- b) one of the following secondary uses:
- (i) a home occupation;
- (i) a hobby farm;
- c) any building, structure or use secondary to the main use of the land, building or structure if the said main use is permitted.

- (ii) a minimum depth of 30 metres; and
- (Ill) a minimum area of 900 square metres;
- b) for a multi-family dwelling, a width of 2 metres and au area of 30 square metres must be added for each unit in excess of 3 units;
- c) for a multi-family dwelling of 3 units, not serviced by a community sewage disposal system,
- (i) a minimum width of 63 metres;
- (ii) a minimum depth of 38 metres; and
- (iii) a minimura area of 6,700 square metres;
- d) for a multi-family dwelling, a width of 5 metres and an area of 1,350 square metres must be added for each unit in excess of 3 units.
## DWELLING DIMENSIONS
- 3.2.3 No dwelling shall be placed, erected or altered in such a way that the floor area of the ground floor is less than
- a) for a multi-family dwelling,
- (i) 30 square metres in the case of a bachelor unit; OI
- (ii) 40 square metres in the case of a onebedroom unit; or
- (iii) 55 square metres in the case of a twobedroom unit; or
- (iv) 65 square metres in the case of a three-. or-more bedroom unit.

- a) the front yard of the main building within the 12month period following the expiration of the building permit and/or completion of the construction work; and
- b) a strip of land 3 metres in width around each building on the lot.
## Commercial Zone (C).
## PERMITTED USES
- 3.3.1 Land, buildings or structures located in a Commercial Zone (C) may only be assigned,
- a) to one or more of the following main uses:
- (i) a retail store or service, convenience store, shopping centre or drugstore;
- (ii) a public service facility;
- (iii) a restaurant;
- (iv) an automobile repair shop, station service, car wash;
- (v) a hotel, motel, inn, or bed and breakfast;

- (xi) an institutional, religious or educational use;
- (xiii) a professional office;
- (xiv) a senior citizens' residence;
- (xV) sales, parts and repair establishments for automobiles, all-terrain vehicles, boats and trailers;
- (xVi) a campground;
- b) all buildings, structures or uses secondary to the main use of the land, building or structure if the said main use is permitted;
- c) in conjunction with the permitted uses in a), one of the following uses may be permitted by variance:
- (1) a single-family dwelling; or
- (ii) a two-family dwelling;
and this residential use may be deemed a main use or secondary use among the permitted uses, as per the conditions that the Commission may establish, including the anticipated commercial character of a district, heritage or history issues, or amy other conditions that the Commission deems relevant.

- (ii) a facility intended for public gatherings or social, cultural or recreational activities;
- (iii) a public park, open space, playground, playing field, recreational facility or specificuse trail;
- (iv) an educational building;
- (v) a daycare;
- (vi) a hospital;
- (vii) a paramedical use;
- (vill) a physician's office;
- (ix) a health clinic;
- (x) a religious institution;
- c) servir

- 3.4.3 A main building or main structure shall not be placed, erected or altered in such a way as to be less than 3 metres from a side or rear lot line.
- 3.4.4 A main building or main structure shail not be placed, erected or altered in such a way as to be less than 7.5 metres from a public street line or other access and less than 15 metres from the street line of an arterial highway.

- (ii) a transportation, trucking or heavy equipment business;
- (iii) a preparation or processing warehouse;
- (IV) an office;
- (V) a wholesale business;
- (vi) a restaurant;
- (vili) a personal service establishment,
- (vii) a commercial daycare;
- (ix) a retail establishment;
- (x) a vehicle sale, maintenance and display establishment;
- (xi) a telecommunications tower;
- (xii) an agricultural use
- (xiii) a silvicultural or aquaculture use;

- (viii) a personal service establishment;
- (ix) a retail establishment;
- (x) a vehicle sale, maintenance and display establishment;
- (xi) a telecommunications tower;
- (хії) an agricultural use;
- (xi) a silvicultural or aquaculture use;
- (xiv) an adult entertainment use;
- (xV) an exploitation use.
- b) any building, structure or use secondary to the main use of the land, building or structure of this main use is permitted.

- (XV) a seniors' residence;
- (xvi) a sales, parts and repair establishment for automobiles, all-terrain vehicles, boats, trailers, or other,

- 3.9.2 The standards and requirements relative to AI zones may not be subject to this regulation. Itstead they are regulated by the Council under section 59 of the Community Planning Act.
## Protection/ Preservation Zone - CSV;
- 3.10.1 Land, buildings or structures located in a Protection/Conservation Zone (CSV) may only be assigned to,
- a) conservation and environmental protection uses and uses involving the protection of aquifers;
- b) buildings, structures or uses secondary to the main use of the land, building or structure, if this maia use is authorized under this section.

## 4.1 HOME OCCCUPATIONS

- ]) beauty or tanning salon (maximum of 2 chairs or 2 units)
- k) pet grooming
- I) healthcare professional
- m) consultant
- 1) artist
- 4.1.2 The operation of a home occupation is subject to the following conditions:
- (a) the number of employees is limited to the owner plus one (1) employee only;
- (b) it is restricted to the home and cannot be established, even in part, it an accessory building;
- (c) the area of occupancy shall not exceed twenty (20) percent of the total area of the home and may not exceed fifty (50) square metres;
- (d) No alteration of the architecture of the home shall be visible from the outside;
- (e) No exterior identification shall be displayed otber than a non-illuminated sign, no larger than one (1) square metre, and the sign shall not be more than two (2) metres in high;

## 4.2 ONE SINGLE MAIN BUILDING PER LOT
- 4.2.1 Unless specifically stipulated elsewhere in the Rural Plan, no more than one main building or main structure may be placed or altered on a lot, and a building or a structure shall not be converted into a second main building or second main structure.
- 4.2.2 The Commission, in accordance with conditions that it deems reasonable, may approve uses in the zones where it is proposed that uses other than one family and two-family dwelliags, excluding condominium projects, be permitted and involve activities occupying more than one main building on the lot.
## 4.3 PARKING
- 4.3.1 Subject to the following conditions, a building or structure shall not be placed, erected, altered or used unless the off-street parking areas have been provided in conformity with the requirements of provisions 4.3.1 to 4.3.5.
- 4.3.2 The locations of off street parking referred to in 4.3.1 must be calculated in the following manner;
- (a) dwelling units (at least one space per dwelling unit);
- (b) retail sales stores or similar establishments (at least one space per 14 square metres of floor area);
- (c) restaurants and bars (at least one location per group of 4 clients which can be served);
- (f) Aucune vente au détail ou services autres que ceux liés à l'activité peroise et aucun entreposage n'est permis sauf si celui-ci est entreposé dans le bâtiment principal, et
- (g) deux emplacements de stationnements hors-rie doivent être disponibles en plus de ceux prescrits par 4.4.2.
## 4.2 UN SEUL BÂTIMENT PRINCIPAL PAR LOT
- 4.2.1 Sauf si spécifiquement préves ailleurs dans le Plan rural, il ne peut être implanté ou modifié plus d'un bâtiment principal ou d'une construction principale sur un lot et il est interdit de transformer un bâtiment ou une construction en un deuxième bâtiment priacipal ou deuxième construction principale.
- 4.2.2 La Commission peut, selon les conditions qu'elle estime raisonnables, approver les usages dans les zones où il est proposé que les usages autres que les habitations unifamiliales et bifamiliales, excluant les projets de condominiums, occupent plus d'un bâtiment principal sur le lot.
## 4.3 STATIONNEMENT
- 4.3.1 Sous réserve des présentes, un bâtiment ou une constructión ne peut être implanté, édiflé, modifié ou utilisé que si des emplacements de stationnement horsrue ont été prévus conformément aux prescriptions des dispositions 4.3.1 à 4.3.5.
- 4.3.2 Les emplacements de stationnements hors-rues visés à 4.3.Í doivent être calculés de la manière suivante;
- (a) logements (un emplacement au moias par logement),
- (b) magasins de vente au détail et établissements similaires (un emplacement au moins par 14 mètres carrés de superficie de plancher),
- (c) restaurants et bars, (un emplacement au moias par groupe de 4 clients qui peuvent être servis);
- (d) offices (at least one space for every 90 square metres of gross floor area up to a maximum of 270 square metres and one additional place per 45 square metres in excess of 270 square metres;
- (e) recreation and amusement facilities, buildings in the Community zone, churches, community centres, recreation centres, clubs and other gathering places one space per 5 fixed seats to the floor or one space for every 20 square metres of gross floor area, whichever number is greater;
- (F) hotels and motels, (one space per room);
- (g) schools and youth clubs (one space per class or room and if it is an auditorium or a gathering place, one additional space per 20 square metres); and
- (b) industrial facility, warehouses, storage yards or buildings, maintenance and repair facilities (one space per 50 square metres of gross floor area, in addition to one space per office unit).
## 4.3.3 A parking space:
- (a) must have a minimum length of 6 metres and a width of 3 metres;
- (b) must have easy access from the street; and
- (c) must be within 250 metres of the building served.
- 4.3.4 If the number of parking spaces is in compliance with the required amount, it is possible to draw up agreements to combine parking spaces serving two or more buildings on the same lot. Parking spaces must:
- (a) be covered with durable materials and designed to avoid dust;
- (b) have exits and access roads that take into consideration the opinion of the Commission, the topography of the land and the traffic flow in general;
- (c) must not be used for the repair or maintenance of automobiles unless it is an emergency.

- (a) établissement industriel, entrepôts, cours ou bâtiments d'entreposage, établissement d'entretien et de réparation, (un emplacement pour 50 mètres carrés de superficie brute, en plus d'un espace pour chaque unité de bureau).
- 4.3.3 Un emplacement de stationnement;
- (a) doit avoir au moins une longueur de 6 mètres et une largeur de 3 mètres,
- (b) doit disposer d'un accès facile à la voie publique, et
- (c) doit être à moins de 250 mètres de l'édifice desservi.
- 4.3.4 Si le nombre d'emplacements de stationnements est conformae au nombre prescrit, des ententes sont possibles pour combiner des emplacements de stationnements desservant deux ou plusieurs édifices sur un même lot;
- (a) doit être recouvert de matériaux durables et propres à éviter la poussière,
- (b) disposer d'accès et de sorties qui tiennent compte, selon l'avis de la Commission, de la topographie du terrain et de la circulation en général, et
- (c) ne pas servir à la réparation ou à l'entretien des automobiles à moins de cas d'urgence.
- 4.3.5 mobility: A parking spot for a person with reduced
- (a) must be at least 7 metres long and 4 metres wide;
- (b) must be located in a place with easy access to the building;
- (c) must be designated and identified separately from other parking spots; and
- (d) the number of spots must comply with the National Building Code of Canada.
## 4.4 OFF-STREET LOADING AND UNLOADING
- 4.4.1 The owner of any building, structure or premises used in whole or in part, requiring the use of vehicles in order to ensure receipt or delivery of goods and materials shall, subject to the terras stated below, install and maintain sites of off-street parking on abutting lots, in order to park, load or unload these vehicles.
- (a) for retail or wholesale stores, bulk storage facilities, warehouses and other similar establishments:
- (i) at least one space if the gross floor area is equal to or less than 450 square metres;
- (ii) at least two spaces if the gross floor area is greater than 450 square metres or less than 2,250 square metres: and
- (ti) one additional space per additional 2,250 square metres of gross floor area.
- (b) for commercial buildings or office buildings, public gathering places, schools, hotels or other buildings or similar premises:
- (i) at least one space; and
- (ii) one additional space for each 30 square metres of gross floor area, when the gross floor area is more than 2,700 square metres.
- 4.3.5 Un stationnement pour la mobilité réduite;
- (a) doit avoir au moins une longueur de 7 mètres et une largeur de 4 mètres,
- (b) doit être aménagé à un endroit qui favorise l'accès facile au bâtiment,
- (c) doit être désigné et identifié séparément des autres cases de stationnements, et
- (a) le nombre de cases doit être conforme au Code National du Bâtiment du Canada.
## 44 CHARGEMENT ET DÉCHARGEMENT HORS-RUE
- 4.4.1 Le propriétaire de tout bâtiment, construction ou local servant, en tout ou en partie, à l'exercice d'un usage nécessitant l'utilisation de véhicules pour assurer la réception ou la livraison des marchandises ou matériels doit, selon les modalités qui suivent, aménager et maiatenir des emplacements de stationnements bors-rue sur les terrains y attenants pour garer ces véhicules et procéder aux opérations de chargements et de déchargements.
- (a) dans le cas des magasins de vente au détail ou en gros, d'établissements d'entreposage en d'entrepôts ou autres établissements similaires;
- (i) un emplacement au moins si la superficie brute de plancher est égale ou inférieure à 450 mètres carrés,
- (i) deux emplacements au moins si la superficie brute du plancher est supérieure à 450 mètres carrés et inférieur à 2250 mètres carrés, et
- (їїї) un emplacement additionnel pour chaque 2250 mètres carré supplémentaire de superficie brute de plancher."
- (b) dans le cas de bâtiments commerciaux ou d'immeubles à bureaux, de lieux de rassemblement public, d'écoles, d'hôtels ou autres bâtiments ou Îocaux similaires;
- (t) un emplacement au moins, et
- (il) un emplacement additionnel pour chaque 30 mètres canés de superficie brute de plancher, lorsque la superficie brute de plancher est supérieure à 2700 mètres carrés.
- 4.4.2 Loading and unloading areas mentioned in 4.4.1 must:
- (a) have a length, width and overhead clearance of at least 9 metres, 3 metres, 5 metres respectively;
- (b) be located in such a way as to permit the loading and unloading of merchandise or material on the premises being served;
- (c) have suitable facilities for entry and exit and unobstructed maneuvering lanes; and
- (d) be paved with durable materials and designed to avoid dust.
## 4.5 FENCES
- 4.5.1 Notwithstanding the other provisions mentioned in this by-law, and subject to 4.5.1 to 4.5.3, a fence may be installed or located in a courtyard.
- 4.5.2 A fence placed within a distance of 7.5 metres from a street line cannot measure more than one (1) metre in height at any location.
- 4.5.3 Subject to 4.5.2, a fence shall not exceed the height of
- (a) 1.8 metres in zones (R) and (RM); 0I
- (b) 2.5 metres in all other zones.
## 4.6 FENCES FOR SWIMMING POOLS
- 4.6.1 A swimming pool may not be installed unless it is surrounded by a fence of a wall, a building of a structure or both and its height must reach 1.5 metres and comply with provisions 4.6.1 to 4.6.6.
- 4.4.2 Les emplacements de chargement et de déchargement visés à 4.4.1 doivent;

## 45 CLÔTURES
- 4.5.1 Malgré les autres dispositions énoucées dans cet arrêté, et sous réserve de 4.5.1 à 4.5.3, une clôture peut être installée ou localisée dans une cour.
- 4.5.2 Une clôture installée à l'intérieur d'une distance de 7.5 mètres d'une ligne de rue ne peut mesurer à quélque endroit que ce soit, plus d'un (I) mètre de hauteur.
- 4.5.3 Sous réserve de 4.5.2 une clôture ne doit pas dépasser la hauteur de
- (a) 1,8 mètres dans une zone (R) et (RM); ou,
- (b) 2,5 mètres dans toute autre zone.
## 4.6 CLỘTURES POUR PISCINES

- 4.6.2 When a wall of a building forms part of the enclosure indicated in 4.6.1,
- (a) a main entrance or a service door cannot be part of it; and
- (b) a door in this location, other than the door to a residence or a dwelling unit, shall be equipped with an automatic closing mechanism and an automatic safety lock installed at 1.5 metres from the bottom of the door.
- 4.6.3 The enclosure described in 4.6.1 shall not be surrounded by ramps, railings or other accessory items which could facilitate the climbing of the wall.
- 4.6.4 A fence, as indicated in 4.6.1
- (a) must be made of chain-link;
- (b) of galvanized chain or covered with vinyl or other products approved by the CSA; the fence can also be made of wood or other materials as specified in 4.6.5;
- (c) shall not be electrified, no barbed wire or any other dangerous product; and
- (d) shall be installed
- (i) at a distance of at least 1.25 metres from the edge of the pool, and
- (ii) at a distance of at least 1.25 metres from anything that could facilitate climbing the fence from the outside.
- 4.6.5 The disposition and construction of a fence in accordance with the requirements of this by-law must
- (a) when it consists of chain-link,
- (i) chain-link with diamond shape of no more than 4 centimetres;
- (ii) the steel wire must be at least 12 or 14 gauge (minimum) and have an approved covering equivalent to the thickness of a 12gauge steel wire; and
- (iii) steel poles with a diameter of at least 4 centimetres; to be buried below the freezing point with a coating of cement and spaced at a maximum of 3 metres; and
- (iv) fitted at the top with a horizontal rail with a diameter of at least 4 centimetres;
- 4.6.2 Quand le mur d'un bâtiment forme une partie de l'enclos indiqué à 4.6.1,
- (a) une entrée principale ou une porte de service ne peut en faire partie; et

- 4.6.4 Une clôture indiquée à 4.6.1
- (a) devra être formée de maillons
- (b) de chaîne galvanisés ou recouverts de vinyle ou autres produits approvés par le CSA; la clôture peut aussi être en bois ou autre matériel tel qu'indiqué à 4.6.5;
- (c) ne peut être électrisée, aucun fil barbelé ou autre produit dangereux; et
- (d) elle sera installée
- (i) à une distance d'au moins 1,25 mètre du rebord de la piscine, et
- (i) à une distance d'au moins 1,25 mètre de tout ce qui pourrait faciliter l'escalade à partir de l'extérieur de la clôture.
- 4.6.5 La disposition et la construction d'une clôture conformément aux exigences des présentes deviont comporter:
- (a) daus le cas d'une clôture en grillage d'acier,
- (i) des maillons en forme de diamant ne dépassant pas 4 centimètres;
- (i) des fils d'acier qui doivent être de calibre 12 ou 14, si ceux-ci sont enduits de revêtement approuvé qui correspond à une épaisseur règlementairé du calibre 12, et
- (itt) des poteaux d'acier dont le diamètre mesure au moins 4 centimètres; ils seront enfouis al-dessous du point de congélation avec un revêtement de ciment et espacé de 3 mètres au maximum, et
- (iv) muni au sonamet d'une traverse en acier horizontale dont le diamètre mesure au moins 4 centimètres;
- (b) in the case of a wood fence,
(i) vertical planks measuring at least 2.5 x 10 centimetres, spaced at a maximum of 4 centumetres attached to structural lumber and arranged in such a way as to prevent climbing from the outside, and
- (ii) square cedat supporting posts measuring at least 10 centimetres or cylindrical posts with a diameter of at least 10 centimetres, buried in the soil below freezing point and placed at 2.5 metre intervals; the part buried in the ground must be treated with a preservative and the fence shall be attached at the top with a horizontal rail measuring at least 5 x 15 centimetres; and
- (c) If it consists of a structure with material not mentioned in (a) and (b), its strength must match what is prescribed herein.
- 4.6.6 The fences forming an enclosure as indicated in 4.6.1:
- (a) must constitute a whole with the fence in terms of its structural aspects and its height,
- (b) shall have solid hinges; and
- (c) shall be equipped with an automatic lock placed at a height of 1.5 metres from the bottom of the door, allowing the door to close automatically.
## 4.7 TOPSOIL REMOVAL
- 4.7.1 Subject to provisions 4.7.1 to 4.7.3, it is not permitted to remove by extraction or any other process, the topsoil of a lot oi of any other parcel of land, for its sale or use.
- 4.7.2 Resulting from the erection of a building or structure, the remaining topsoil may be sold or used, after deducting the amount required for the grading and the landscaping of the lot.
- 4.7.3 Notwithstanding 4.7.1, the production of sod is permitted when the owner of the land devoted to this activity, has concluded an agreement with the Council guaranteeing the restoration of the land.
- (b) dans le cas d'une clôture de bois,

- 4.6.6 Les clôtures comprises dans un enclos tel qu'indiqué à 4.6.1;
- (a) devront former un tout avec la clôture au point de vue structural et de la hauteur;
- (b) seront munies de pentures solides; et
- (c) seront munies d'un verrou automatique placé à une hauteur de 1,5 mètre du bas de la porte, permettant à la porte de se refermer automatiquement.
## 4.7 ENLÈVEMENT DE LA COUCHE DE TERRE ARABLE
- 4.7.1 Sous réserve des dispositions de 4.7.1 à 4.7.3, il est interdit d'enlever par extraction ou de toute autre façon, la couche de terre arable d'un lot ou de toute autre parcelle de terrain, en vue de la vendre ou de l'utiliser.
- 4.7.2 Résultant de l'édification d'un bâtiment ou d'une construction, l'excédent de terre arable peut toutefois être vendu ou utilisé, après déduction des quantités nécessaires pour le nivèlement et l'aménagement paysager du lot.
- 4.7.3 Nonobstant 4.7.1, la production de gazon est permise lorsque le propriétaire du terrain affecté à cette activité, a conclu un accord avec le conseil garantissant la remise en état du terrain.
## 4.8 PLACARDS and SIGNS
- 4.8.1 Other than a traffic control device as defined in the Motor Vehicle Act or a legal notice, no person shall build, erect, exhibit, modify or relocate a sign; furthermore, the owner or lessee of a property may not permit, tolerate or authorize the construction, installation, display, modification or relocation of a sign without obtaining a sign permit under the provisions of this by-law.
- 4.8.2 Notwithstanding 4.8.1 and subject to all other provisions of this by-law, a sign permit is not required for the following nou-illuminated signs, as long as the total number of signs described below is limited to (2) two:
- (a) Signs indicating that a property is for sale, for lease or for reut, provided that such signs are:
- (i) limited to a surface not exceeding one point five (1.5) square metres including all sign faces;
- (ii) limited to two (2) signs per property.
- (b) Sigus indicating that lots are for sale related to an approved subdivision project or a subdivision project submitted for approval, provided that such sign is:
- (i) limited to a total surface area not exceeding three (3) square metres including all siga faces;
- (ii) limited to two (2) faces per proposed subdivision project.
- (c) Signs with a surface of less than zero point two (0.2) square metres and limited to three (3) signs per property.
- (d) Signs that provide information on a construction project or on a contractor carrying out a construction project, provided that such sign is:
- (i) limited to a surface not exceeding three (3) square metres including all sign faces;
- (ii) limited to two (2) faces per proposed construction project.
## 4.8 AFFICHES & ENSEIGNES
- 4.8.1 À l'exclusion d'un dispositif de régulation de la circulation selon la définition qu'en donne la Loi sur les véhicules à moteur, d'un avis légal ou judiciaire, une personne ne doit pas construire, ériger, exposer, modifier ou relocaliser une enseigne, de plus, le propriétaire ou le locataire d'une propriété ne doit pas permettre, tolérer ou autoriser la construction, l'installation, l'étalage, la modification ou la relocalisation d'une enseigne sans qu'un permis d'affichage ne soit obtenu selon les dispositions de cet arrêté.
- 4.8.2 Nonobstant 4.8.1 et sujet à toutes autres dispositions de cet arrêté, un permis n'est pas requis pour les types d'enseignes non-illuminées suivants, tant que le nombre total d'enseignes décrites cidessous est limité à (2) deux:
- (a) Les enseignes qui indiquent qu'une propriété est en vente, à bail ou à louer, pourvu que ces enseignes soient :
- (i) limitées à une surface n'excédant pas une virgule cinq (1,5) mètres carrés incluant toutes les faces d'enseignes;
- (ii) limitées à deux (2) enseignes par propriété.
- (b) Les enseignes qui indiquent que des lots sont en vente en rapport avec un projet de lotissement approuvé ou un projet de lotissement soumis pour approbation pourvu que ladite enseigue soit :
- (i) limitée à une superficie totale n'excédant pas trois (3) mètres carrés incluant toutes les faces de l'enseigne;

- (e) Signs that advertise a candidate, a party or both in a campaign for a public election, provided that the sign is:
- (i) limited tọ a surface not exceeding three (3) square metres including all faces of the sign.
- (f) Signs that advertise a special event organized or approved by the municipality or erected for the sole purpose of decorating for a special occasion.
- 4.8.3 Requirements for the issuance of a sign permit.
- (a) An applicant must complete an application forma provided by the building inspector. It must provide any dditional information required by the buildin aspector in order to assess the compliance of thi request with the applicable by laws and regulations. This information may include, but is not limited to, the following:
- (i) plans and details of the proposed sign, of the framing and pillars;
- (i) site plans showing the boundaries of pocation or uprives tient signs and the proposed location of the sign for which the request is being made;
- (ili) a list of materials to be used for the construction of the sign;
- (iv) all other additional information regarding the strength of the bracing for the siga and the equipment used for the installation.
- (b) No siga permit shall be issued for a sign built on a permanent foundation without the issuance of a building permit in conformity with the Building Regulation.
- (e) Les enseignes qui annoncent un candidat, un parti u les deux dans une campagne en vue d'une électio publique pourvu que l'enseigne soit

- 4.8.3 Conditions à l'émission d'un permis d'enseigne:
- (2) Le demandeur d'un permis doit remplir une formule de demande prescrite par l'inspecteur en bâtiments. I doit présenter toute information additionnelle requise par l'inspecteur en bâtiments afin que celui-ci puisse évaluer la conformité de cette " demande aux arêtés ou aux règlements applicables. Cette information peut inclure, mais n'est pas limitée à ce qui suit :
- (i) les plans et détails de l'enseigae proposée, de la charpente et des piliers;
- (ii) le plan du site démontrant les limites de droit de passage public ou privé, l'emplacement des bâtiments, des enseignes existantes et l'emplacement proposé pour Tenseigue pour laquelle on fait la demande;
- (II) une liste de matériaux qui seront utilisés pour la construction de l'enseigne;
- (iV) toute information additionnelle concernant la capacité de l'étai de l'enseigne et de l'équipement utilisé dans son installation.

- 4.8.4 The following provisions apply:
- (a) Notwithstanding all other provisions in this by-law, the number of signs which can be built, erected, placed, or displayed on a lot shall not exceed four (4) signs.
- (b) A sign shall not extend over a private entrance or sidewalk unless it has a minimum beight of two (2) metres from ground level and shall not obstruct the visibility of motorists when exiting from a private entrance towards the road.
- (c) A sign attached to a wall of a building shall not:
- (i) protrude more than twenty-three (23) centimetres from the wall on which it is attached in the case of a sign on a facade;
- (ii) extend more than forty-five (45) centimetres above the roof, the parapet of the building;
- (iii) extend beyond the ends of the wall on which it is attached;
- (iv) be erected above a private sidewalk unless the bottom of the sign is at least two point five (2.5) metres above the sidewalk;
- (v) have supports resting on a sidewalk or a right-of way; and
- (vi) be within sixty (60) centimetres from the perpendicular extension of the edge of the sidewalk or the boundaries of the portion of road used unless the sigu is attached flush against the wall of the building.
- (d) A sign or sign bracing shall not protride or lean on any part of a public right of way or sidewalk.
- (e) A sign of sign bracing shall not be attached to and shall not obstruct an emergency exit.
- (f) Unless approved by the Commission and subject to terms and conditions it may impose, a sign shall not be installed or erected less than three (3) metres from a fire alarm, telephone wire or an electric wire. This excludes the electric wire used to illuminate or operate such sign.
- 4.8.4 Les dispositions suivantes s'appliquent :
- (a) Nonobstant toutes autres dispositions de cet arrête, le nombre d'enseignes qui peuvent être construites, érigées, placées, affichées sur lot ne doit pas excéder quatre (4) enseignes.
- (b) Une enseigne ne peut se prolonger sur une entrée privée ou un trottoir, à moins d'avoir une hauteur minimale de deux (2) mètres du niveau du sol et ne devra pas gêner la visibilité des automobilistes lorsqu'ils exécuteront une sortie d'une entrée privée pour se diriger vers la rue.
- (c) Une enseigne attachée sur un mur d'un bâtiment ne doit pas :
- (i) être projetée à plus de vingt-trois (23) centimètres du mur sur lequel elle est attachée dans le cas d'une enseigne de façade;
- (ii) se prolonger à plus de quarante-cinq (45) centimètres plus haut que le toit, le parapet du bâtiment;
- III) se prolonger au-delà des extrémites d aur sur lequel elle est attachée
- (iv) être érigée au-dessus d'un trottoir privé à moins que la partie inférieure de l'enseigne soit au moins à deux virgule cinq (2,5) mètres au-dessus du trottoir;
- (V) avoir des soutiens appuyés sur un trottoir ou l'emprise du chemin; et
- (vi) être à moins de soixante (60) centimètres de la prolongation perpendiculaire de la bordure du trottoir ou des limites de la portion de la rue utilisée, à moins que l'enseigne soit attachée directement à plat sur le mur du bâtiment.
- (d) Une enseigne ou étai d'enseigne ne doit pas se projeter ou s'appuyer sur aucune partie d'un droit de passage public ou d'un trottoir.
- (e) Une enseigne ou étai d'enseigne ne doit pas être attaché et ne doit pas obstruer une sortie de secours.
- (D) À moins d'être approuvée par la Commission et sujette aux conditions qu'elle peut imposer, une enseigne ne peut pas être installée ou érigée à moins de trois (3) mètres d'une alarme à feu, d'un fil de téléphone ou d'un fil électrique. - (g) A sign must not be erected if, according to the opinion of the building inspector, it obstructs oi diminishes the visibility of a traffic road sign.
- (b) A sign shall not be attached to a tree.
- (i) Au off-property sign is not permitted unless it is approved by the Commission and is subject to the terms and conditions it imposes.
- (i) Unless otherwise indicated, an illuminated sign is not permitted. It an illuminated siga is permitted, it must be illuminated by a covered light source, stationary and shall be inside the sign or directed towards it. It shall not blind motorists, pedestrians and surrounding properties.
- (k) A sign which is attached, painted, installed or erected on an awning is permitted ouly if the awning is installed in conformity with other zoning provisions and shall not:
- (1) be erected on a private sidewalk unless the bottom part of the sign is at least two point five (2.5) meters above the sidewalk;
- (ii) have supports resting on a sidewalk or a right-of-way;
- (iii) be less than sixty (60) centimetres from the perpendicular extension of the edge of the sidewalk or boundaries of the portion of road used.
- (1) Where a free-standing sign is permitted, it shall not:
- (1) exceed one (1) sign for each thirty-one (31) metres of the property's frontage;
- (ii) extend beyond the limits of the property on which it is located;
- (iii) A free-standing framé, mast or pole on which a sign is attached shall be fixed to a foundation or shall be placed permanently into the ground to a depth of at least one (1) metre.
- (g) Une enseigne ne doit pas être érigée, si, selon l'opinion de l'inspecteur des bâtiments, elle obstrue ou diminue la visibilité d'un panneau de signalisation routière.
- (h) Une enseigne ne doit pas être attachée à un arbre.
- (i) Une enseigne hors propriété n'est pas permise à moins d'être approuvée par la Commission et est sujette aux conditions imposées par celle-ci.
- () À moins d'être autrement indiquée, une enseigne illuminée n'est pas permise. Si une enseigne illuminée est permise, elle doit être illuminée seulement par une source de lumière couverte, stationnaire et doit être localisée à l'intérieur de l'enseigne ou dirigée vers celle-ci. Elle ne doit pas éblouir les automobilistes, les piétons et les propriétés avoisinantes.
- (k) Une enseigne qui est attachée, peinte, installée ou érigée sur un auvent est permise seulement si l'auvent est installé en conformité avec les autres dispositions de zonage et ne doit pas :
- (i) être érigée sur un trottoir privé à moins que la partie inférieure de l'enseigne soit au moins à deux virgule cinq (2,5) mètres audessus du niveau du trottoir;
- (ii) avoir des soutiens qui se prolongent sur un trottoir ou une emprise de rue;
- (iii) être à moins de soixante (60) centimètres de la prolongation perpendiculaire de la bordure du trottoir ou des limites de la portion utilisée de la rue.
- (I) Là où une enseigne autoportante est permise, elle ne doit pas :
- (i) excéder une (1) seule enseigne pour chaque trente et un (31) mètres de devanture de la propriété;
- (ii) se prolonger au-delà des limites de propriété sur laquelle elle est située;
- (iii) une monture autoportante, pylône ou poteau sur lesquels une enseigne est bien attachée doit être fixé à une fondation ou doit · être placé de façon permanente dans le sol à une profondeur d'au moins un (1) mètre.
- (In) Unless otherwise indicated, temporary signs, portable signs as well as signs mounted or built on rolling vehicles, trailers or other device or apparatus used for moving signs from one location to another are probibited. If these sigus are permitted, they are subject to the following conditions:
- (i) the maximum duration for a portable sign to be on a site shall be thirty (30) days and following the removal of the portable sign, the site shall remain clear for a minimum timeline of ninety (90) consecutive days;
- (ii) all other conditions imposed by this bylaw.
- (1) This provision does not apply to vehicles transporting merchandise or people.
## SIZE AND CHARACTERISTICS OF SIGNS PERMITTED IN EACH ZONE
- 4.8.5 Sigas permitted by 4.8.5 (a) to (e) must be used for the sole purpose of naming the business, property wner or product prepared and sold on the premises.
- (a) Residential zones: one- and two-family units (R) and multi-family buildings (RM):
- Notwithstanding the specific conditions described in 4.8.5, the following signs are permitted:
- (i) A non-illuminated sign announcing the occupation of a building as defined by 4.8.2(e) provided that it is a facade or freestanding siga, that the sign does not exceed a total surface of one (1) square metre in (R) zones and one point five (1.5) square metres in (RM) zones, and a maximum height of one potat three (1.3) metres above the ground.
- (m) A moins d'être autrement indiquées, les enseignes temporaires, les enseignes portatives aiasi que les enseignes montées ou fabriquées sur des véhicules roulants, remaorques ou autres dispositits ou appareils servant à déplacer les enseignes d'un endroit à un autre sont interdites. Si ces enseignes sont permises, elles sont sujettes aux conditions suivantes:
- (i) la durée maximale d'une enseigne portative sur un site doit être de trente (30) jours et suite à l'enlèvement de l'enseigne portative, le site doit demeurer libre pour une période minimale de soixante (60) jours consécutifs;
- (ii) toute autre condition imposée par cet arrêté.
- (I) Cette disposition de vise pas les véhicules effectuant le transport de marchandises ou de personnes.
## GRANDEUR ET CARACTÉRISTIQUES DES ENSEIGNES PERMISES À L'INTÉRIEUR DE CHAQUE ZONE.
- 4.8.5 Les enseignes permises par 4.8.5 (a) à (e) doivent être utilisées pour le but exclusif d'indiquer le nom de l'affaire, du propriétaire ou d'un produit préparé et vendu sur la propriété.
- (a) Zones Résidentielles: uni et bi familial (R) et multifamilial (RM):
Nonobstant les conditions spécifiques décrites à 4.8.5, les enseignes suivantes sout permises:
- (i) une enseigne non illuminée qui annonce l'occupation d'un bâtiment tel que défini à 4.8.2 pourra que cette enseigne soit une enseigne de façade ou ume enseigne autoportante, que la surface totale de l'enseigne n'excède un (1) mètre carré dans les zones (R) et un virgule cinq (1.5) mètres carrés dans une zone (RM) et qu'elle ait une hauteur maximale d'une virgule trois (1.3) mètres du sol.
## (b) Commercial Zones (C)
Subject to the specific conditions described it 4.8.5, illuminated or non-illuminated are permitted.
- (i) A facade sign is permitted, provided:
(A) that the facade sign surface shall not exceed the product of the width in metres of the building ou which the sign is attached multiplied by 0.457;
(B) it is not installed on more than iwo (2) sides of the building; and is below the windows of the second floor.
- (ii) A free-standing sign is permitted, provided that it:
(A) has a maximum of two (2) faces, a maximum beight of nine point one (9.1) metres and the siga must have a maximum surface area of six (6) square metres in the Commercial Zone.
- (iii) A temporary sign is permitted, but subject to 4.8.4(i), (1) and (m) provided that:
(A) the surface of the sign does not exceed four (4) square metres;
(B) it is litaited to one (1) sign per parcel of land.
- (c) Industrial Zones (I):
Subject to the specific conditions described in 4.8.5, illuminated or non-illuminated sigus are permitted.
- (i) A free-standing sign is permitted, provided that;
(A) it does not have a clearance of less than three (3) metres and a maximal height of ten (10) metres from ground level.
(B) the total area of the sign does not exceed ten (10) square metres.
- (b) Zones Commerciales : commerciale (C)
Sujettes aux conditions spécif ques décrites à 4.8.5, les enseignes illuminées ou non-illuminées sont permises.
- (i) Une enseigne de façade est permise pourvue;
(A) que la superficie de la façade n'excède pas le produit de la largeur du bâtiment en mètre sur lequel l'enseigne est attachée multipliée par 0,457;
(B) qu'elle ne soit pas installée sur plus de deux (2) côtés du bâtirent; et qu'elle soit au-dessous des fenêtres du deuxième étage.
- (ii) Une enseigne autoportante est permise pourvue qu'elle :
(A) ait un maximum de deux (2) faces, une hauteur maximale de neuve virgule un (9,1) mètres et l'enseigne doit avoir une superficie maximale de six (6) mètres carrés dans la zone commerciale.
- (iii) Une enseigne temporaire est permise sujette à 4.8:4(), (1) et (m) pourvu :
A) que la superficie de la face d 'enseigne ne dépasse pas quatre (4 mètres carrés;
(B) qu'elle soit limitée à une (1) enseigne par terrain.
- (o) Zones Industrielles (T) :
Sujettes aux conditions spécifiques décrites à 4.8.5, les enseignes illuminées ou non- illuminées sont permises.
- (i) Une enseigne autoportante est permise pourvue;
(A) qu'elle n'ait pas de dégagement de moins de trois (3) mètres et une hauteur maximale de dix (10) mètres du niveau du sol.
(B) que la superficie totale de l'enseigne n'excède pas dix (10) mètres carrés.
- (it) A facade sign is permitted, provided:
(A) that the sign surface shall not exceed the product of the width in metres of the building on which the sign is attached multiplied by 0.457.
- (iii) A temporary sign is permitted subject to 4.8.4(i), (1) and (m), provided:
(A) that the sign area be limited to a size of four (4) square metres;
(B) that it is limited to one (1) sign per parcel of land.
- (d) Community Zone (CO):
Subject to the specific conditions described ia 4.8.5, illuminated or non-illuminated signs are permitted.
- (i) A facade sign:
(A) shall not exceed the product of the width in metres of the building on which the sign is attached multiplied by 0.457.
(B) cannot be on more than two (2) sides of the building and must be underneath the windows of the second floor.
- (ii) A free-standing sign must:
(A) have a maximum of two (2) and a total surface not exceeding five (5) square metres and a maximum height of nine (9) metres.
- (il) A temporary siga is permitted subject to 4.8.4(j), (1) and (m), provided:
(A) that the sign facade is limited to four (4) square metres;
- (B) it is limited to one (1) sign per parcel of land.
- (ii) Une enseigne de façade est permise pourru que;

- (i) Une enseigne de façade ;
(A) ne dolt pas dépasser el superficie le produit de là longuew du bâtiment en mètre sur lequel l'enseigne est affichée multipliée pat 0,457.
(B) ne peut pas être sur plus de deux (2) côtés du bâtiment et doit être audessous des fenêtres du deuxième étage.
- (i) Une enseigne autoportante doit;
(A) avoir un maximuma de deux (2) faces et une superficie totale n'excédant pas cinq (5) mêtres carrés et une hauteur maximale de neuf (9) mètres.
- (iti) Une enseigne temporaire est permise sujette à 4.8.4(i), (1) et (m) pourvue ;
(A) que la superficie de la façade de l'enseigne soit limitée à quatre (4) mètres carrés;
- (B) qu'elle soit limitée à une (1) enseigne par lopin de terre.
## (e) Projecting signs
Projecting signs are permitted in all zones, with the exception of residential zones, provided that they do not:
- (i) exceed three (3) square metres of area per sign side or the product of the width of the building in metres on which the sign is attached multiplied by 0.457 whichever is the
- (ii) project over more than one point five (1.5) metres from the building wall;
- (III) be installed less than three (3) metres above ground level;
- iv) project over property boundaries lignments or sidewalks
- (V) exceed the maximum number of one (1) sign per business;
- (vi) project more than forty-five (45) centimetres above the roof of a building;
- (vii) swing freely on their mounts.
## SAFETY AND MAINTENANCE OF SIGNS
- 4.8.6 No owner or lessee of a property on which a sign is located shall allow
- a) the sign, its supports, anchorage and electrical system to become unsightly, dilapidated or dangerous;
- b) Signs including their frames, supports, anchorages and electrical wiring must be made in compliance with the Building by-law, and all relevant provincial and national electrical and fire codes and all their amendments and additions.
## DEFINITIONS
- 4.8.7 Fox the purposes of 4.8.1 to 4.8.7, the following definitions apply:
- "Area of sign facade" means the area delineated by a continuous line, be it actual or imaginary, which surrounds the outer limits of a sign, including any material used to project the sign from a background, excluding brackets, mast and posts.
- e) Affiches en saillie

## SÉCURITÉ & ENTRETIEN DES ENSEIGNES
- 4.8.6 Il est interdit au propriétaire ou au locataire d'un bien sur lequel une enseigne est située de laisser;
- l) a e l e rode son ancrage devenir.
- b) une enseigne y compris le cadre, ses supports, son ancrage et le filage électrique qui n'est pas conforme avec l'arrêté de construction et les codes d'incendie et d'électricité provinciaux et nationaux pertinents.
## DÉFINITIONS
- 4.8.7 Pour les fins de 4.8.1 à 4.8.7, les définitions suivantes s'appliquent:
- « superficie de la façade d'une enseigne » désigne la surface délimitée par une ligne continue, actuelle ou imaginaire entourant les limites extrêmes d'une enseigne, iacluant toute matière servant à dégager cette enseigne d'un arrière-plan à l'exclusion des montants tels que soutiens, mâts et poteaux.
"Facade" means the surface on which the sign is placed; the sign providing more than one side in public view is considered having a corresponding number of faces.
"Facade sign" is a sign which is attached, painted or represented in any manner whatsoever on the façade of a building or structure.
"Free-standing sign" means a sign which is supported by one or more masts, supports or posts attached to the ground. This sign is not connected to a wall of the establishment.
"Height of sign" means the vertical distance between the highest point of the sign from ground level or from the sign bracing.
"Off property sign" means a sign that is not used for the sole purpose of indicating the name of a business, a property or a product which is prepared or sold on the property.
"Projecting sign" means a sign entirely or partially supported by a building and which protrudes more than thirty (30) centimetres from the building.
"Sign" means the indication, the description, the illustration or logo, illuminated or non-illuminated which provides information, such as a product, the location, the activity, the person, the institution or the business and is posted outside a building. This definition excludes traffic road signs as defined by legal notices and the Motor Vehicle Act.
"Temporary sign" means a sign which is not permanently attached to a foundation, or is not permanently installed in the ground to a depth greater than or equal to one (1) metre.
"Total face area of sign" means the sum of the area of the face of each sign located on the property including all existing signs before this by-law was promulgated, but excluding sigus for which a permit is not required.
"Width of the facade of a building" means the horizontal dimension of the part of the building facing the street.

## 4.9 STANDARDS FOR AGGREGATE EXTRACTION SITES
4.9.1 Subject to this section, no person shall undertake or continue the excavation of sand, gravel, clay, shale or limestone or any other material for the purpose of sale or any other commercial use except in conformity with the standards of this regulation
## 4.9.2 The extraction site shall not:
- a) damage any adjoining property;
- b) allow the accumulation of water to a depth greater than 60 centimetres at any time during the year, for an extraction site not fenced;
- c) or serve as a storage place or dump for toxic materials, scrap iron, domestic wastes, construction residues or any other material likely to be harmful to the environment.
4. 4.9.3 All extraction sites shall be subject to the following conditions:
- a) No extraction may be done within 250 metres of any water surface;
- b) No extraction may be done within 250 metres of any public road;
- c) The accesses and public streets over which materials are transported shall be maintained by the operator in a dust-free condition; these access routes shall be located at least 30 m from any main building;
- d) Be located at least 300 metres from any dwelling;
- e) Be located at least 30 metres from private land unless the owner's written authorization has been obtained;
10. £) Be located at a distance of 100 m from the . foundations of a structure, unless the owner's written authorization has been obtained;
- g) Be located at a distance of 100 m from a private potable water well, in the case of a gravel pit or sand pit, unless the well owaer's written authorization has been obtained;
## 4.9 NORMES DE SITES D'EXTRACTION D'AGRÉGATS
- 4.9.1 Sous réserve du présent article, il est interdit d'entreprendre ou de continuer l'extraction de sable, de gravier, d'argile, de schiste argileux, de calcaire ou de tout autre matériau en vue de la vente ou de tout autre usage commercial sauf en conformité avec les noimes du présent arrêté.
- 4.9.2 Le site d'extraction ne doit pas,
- a) endommager une propriété adjacente,
- b) permettre l'accumulation de l'eau à plus de 60 centimètres de profondeur en tout temps pour un site d'extraction non clôturé et
- c) servir de lieu d'entreposage ou de vidange de materiaux toxique, de la ferraille des déchets domestiques, des restes de constructions ou de tous autres matériaux susceptibles d'être nuisible à l'environnement.
- 4.9.3 Tout site d'extraction doit répondre aux normes suivantes,
- a) aucune extraction ne peut être effectuée à moins de 250 mètres de tout plan d'eau,
- b) aucune extraction ne peut être effectuée à moins de 250 mètres d'une route publique,
- c) le propriétaire du terrain doit maintenir libres de poussières, les voies d'accès et les rues servant au transport de matériaux; ces routes d'accès doivent être situées à au moins 30 mètres de tout bâtiment principal,
- d) être situé à une distance minimale de 300 mètres de toute habitation,
- e) être situé à une distance de 30 m des limites d'une terre privée, à moins que l'exploitant n'ait obtenu pour ce faire l'autorisation écrite du propriétaire
- 1) être situé à une distance de 100 m des fondations d'une structure, à moins d'avoir obtenu une autorisation écrite du propriétaire;
- 3) être situé à une distance de 100 m d'un puits priv l'eau potable, dans le cas d'une gravière ou d'un sablière, sauf si une autorisation écrite du propriétaire du puits a été obtenue;
- h) Be located at a distance of 300 m from a commercial, industrial, agricultural or communal well, in the case of gravel pit or sand pit, unless the requesting party has obtained prior written authorization from the Department of Environment and well owner;
- i) Be located at a distance of 600 m from a water supply well, in the case of a rock quarry, unless holding written authorization in that regard from the owner or well user and the Department of Environment; in any event, the activities must be carried out at a minimum distance of 300 m;
- j) Have the top or base of the slope of the excavation, or any building, structure or site of any intended repair or storage located at more than 350 metres from a public highway or private access road;
- k) The owner of the land is responsible for maintaining a safe site (barriers, fences, signs, etc.) and complying with various provincial regulations that may apply;
- I) Have a survey map of the extraction site;
- I) The extraction of material on the site will not exceed a depth where water continually accumulates over more than 5 cm for a period spanning 12 months; however, in the event of a continual accumulation of water exceeding the above-mentioned criterion, the operator responsible will completely cover the accumulated water with material similar to that of the extraction site until there is no more water accumulation;
- 1) The owner of the land is responsible for limiting the times of extraction operations to between 6:00 am and 9:00 pm;

- j) avoir le sommet ou la base de la pente de l'extraction et tout bâtiment, construction ou emplacement destinés à la réparation ou à l'entreposage situés à plus de 350 mètres d'une route publique ou d'un accès privé,
- k) le propriétaire du terrain est responsable de maintenir un site sécuritaire; (barrières, clôtures, affiches etc.), et adhérer aux différents règlements provinciaux qui peuvent être applicables.
- I) avoir un plan d'arpentage du site d'extraction,
13. Da) l'extraction de matériel du site ne dépasse pas une profondeur où l'eau peut s'accumuler de façon continuelle sur plus de 5 cm pour une période s'étalant sur 12 mois; mais advenant qu'il y ait accumulation continuelle d'eau dépassant le critère ci-haut mentionné, l'opérateur responsable recouvrira complètement l'étendue d'eau de matériel similaire à celui du site d'extraction jusqu'à ce qu'il n'y ait plus d'accumulation d'eau,
- 1) le propriétaire du terrain est responsable de maintenir les heures d'opérations d'extractions entre 6h00 et 21h00.
- 0) Where extraction operations have ceased for more than 10 months following expiry of the permit, or for a longer period determined by the Commission, the land shall be restored as follows:
- Removal of equipment, buildings and structures related to the extraction work;
- All stockpiles, earth, sand, gravel of other material can be put back into the excavation, spread out on the site or removed fromn the site once the slope of the excavation has been levelled to 30 degrees of the horizon;
- The site must be levelled and/or be sloped to prevent the accumulation of water to a depth of more than 60 cia at any time, except during the snow melt period, . and the site must be free of debris from the project.
## 4.10 POTABLE WATER PROTECTION
- 4.10.1 Lot servicing through the installation of a private or public potable water well must be done in compliance with New Brunswick Regulation 90-79 established under the Clean Water Act.
## 4.11 AGRICULTURE AND AQUACULTURE OPERATIONS
- 4.11.1 Notwithstanding the conditions that the Department of Agriculture, the Department of Environment and/or the Department of Health may Impose, agricultural operations are subject to the following conditions:
- a) Except for a hog barn, which cannot be less than 1,500 m from a settled area, the farm buildings, except for the owner's buildings, must be located at least 150 m from a dwelling;
- b) No manure, liquid manure, herbicide or pesticide may be spread less than 30 m from dwellings or a quarry, where the angle of slope of the ground towards the quarry is more than 5%; alternatively, spreading is permitted up to the boundary of this property;
- 0) lorsque les opérations d'extractions ont cessé pendant plus de dix mois après épuisement du permis, ou une période plus longue déterminée par la commission, le terrain devra être remis en état de la manière suivante,
- l'enlèvement des équipements, bâtiments ou constructions relatif aux travaux d'extraction,
- tous stockage, terre, sable, gravier ou autres matériaux d'extraction peut être remis dans l'excavation, étendu sur le site ou enlevé du site lorsque la pente de l'excavation a été aplanie à 30 degrés de l'horizon,
- le site doit être nivelé et/ou avoir des pentes de façon à empêcher l'accumulation d'eau sur une profondeur de plus de 60 cm en tout temps, sauf durant la période de fonte des neiges, et le site doit être absent de débris provenant du projet.
## 4.10 PROTECTION DE L'EAU POTABLE
- 4.10.1 La viabilisation d'un lot par l'installation d'un uits privé ou public d'eau potable doit être faite e onformité avec le Règlement du Nouveau-Brunswic 90-79 établi en vertu de Loi sur l'assainissement de
## 4.11 EXPLOITATION AGRICOLE ET AQUICOLE
- 4.11.1 Nonobstant les conditions que pouraient imposer le ministère de l'Agriculture, de l'Environnement et/ou de la Santé, les exploitations agricoles sont soumises aux conditions suivantes;
- a) à l'exception d'une porcherie qui ne peut être à moins de I 500 m d'une zone de peuplement, les bâtiments de ferme doivent, exception faite de ceux du propriétaire, être situés à au moins 150 m d'une habitation,
- b) aucun épandage de fumier, de purin, d'erbicide ou de pesticide ne peut être effectué à moins de 30 ma des habitations ou d'une carrière, lorsque la déclinaison du sol en direction de cette carrière est de plus de 5%, dans l'alternative l'épandage est permis jusqu'à la limite de cette propriété,
- c) No agricultural activity may be carried out less than 45 m from a watercourse;
- d) No livestock-raising farm may be operated less than 60 m from a watercourse.
3. 4.11.2 Aquaculture operations are subject to the conditions that the Department of Agriculture, Aquaculture and Fisheries, the Department of Environment and/or the Department of Health may impose.
## 4.12 BED AND BREAKFASTS AND INNS
- 4.12.1 All establishments for tourists authorized under this by-law must comply with the relevant provincial requirements and regulations, and must comply with the following:
- a) one parking space shall be made available for each room for rent;
- b) Where an establishment for tourists is operated in a residential zone (R), the maximum number of rooms for rent is three (3).
## 4.13 IN-LAW SUITES
- 4.13.1 An in-law suite authorized under this by-law shall conform to the following requirements:
- (a) be contained in the main dwelling and share the same entry way;
- (b) shall not exceed 40% of the dwelling's gross floor area;
- (c) the lot shall be connected to full municipal services or shall be equipped with an authorized and certified septic systemn;
- (d) one parking space shall be required in addition to the parking for the main use of the lot; and
- (e) the driveway access point must be communal to the main dwelling and the in-law suite.

- 4.11.2 Les exploitations aquicoles sont soumises aux conditions que pourraient imposer le ministère des Pêches et de l'Aquaculture, de l'Environnement et/ou de la Santé.
## 4.12. GITES & AUBERGES
- 4.12.1 Tous les établissements touristiques autorisés par le présent arrêté doivent être conformes aux exigences et aux règlementations provinciales pertinentes et doivent aussi se conformer aux exigences suivantes:
- b) lorsque que l'établissement touristique est exercé dans une zone résidentielle (R), le nombre maxiaum de chambres à louer est de trois (3).
## 4.13 APPARTEMENT DE PARENTS
- 4.13.1 L 'appartement de parents autorisé par le présent arrêté doit être conforme aux exigences suivantes:
- (a) être contenu dans le logement principal et partager la même entrée,
- (b) ne pas occuper une aire supérieure à 40% de l'aire brute de plancher de l'habitation,
- (c) le lot reçoit tous les services municipaux ou est doté d'une fosse septique autorisée et certifiée,
- (d) un emplacement de stationnement supplémentaire est aménagé en plus du stationnement requis pour l'usage principal du lot et
- (e) le point d'accès de l'entrée doit être commun tant pour l'habitation principale que pour l'appartement.
## 4.14 KENNELS
- 4.14(1) Kennels are a specific use permitted in the Resource Development Zone for which Commission may impose terms and conditions subject to subsection 34(5) of the Community Planning Act.
- 4.14 (2) The land intended for a kennel must cover an area of at least 4,000 square metres.
- 4.14 (3) No buildiag, structure or dwelling for animals shall be maintained in the front yard required under this by-law.
- 4.14 (4) No building, structure or dwelling used to accommodate animals is permitted within 10 metres of adjacent properties.
- 4.14 (5) Pursuant to paragraph 34(4)(c) of the Community Planning Act, the Commission may impose terms and conditions in order to protect the health, safety and welfare of the general public, and the surrounding properties. Such terms and conditions may include, without being limited to, the following:
- (a) public and animal protection and safety standards as indicated in the document entitled "Code of Practice for Canadian Kennel Operations," dated September 1994, published by the Canadian Veterinary Medical Association;
- (b) adequate ventilation to reduce humidity and prevent disease;
- (c) adequate management of animal waste; and
- (d) a service contract to be established with a veterinarian.
## 4.14 CHENILS
- 4.14(1) Les chenils sont un usage particulier permis dans la zone de développement des ressources pour lequel la commission peut imposer des conditions et des modalités sous réserve du paragraphe 34(5) de la Loi sur l'urbanisme.
- 4.14 (2) Le terrain prévu pour accommoder un chenil doit avoit au moins 4 000 mêtres carrés de superficie.
- 4.14 (3) Aucun bâtiment, construction hebergement pour animaux ne doit être aménagé dans la cour avant exigée par le présent arrêté.
- 4.14 (4) Aucua bâtiment, construction bébergement pour animaux ne doit être aménagé à moins de 10 mètres des propriétés adjacentes.
- 4.14 (5) En vertu de l'article 34(4)(c) de la Loi sur l'urbanisme, la Commission pourra émettre des conditions et des modalités qui visent la protection de la santé, la sécurité et le bienêtre du public en général. et la protection des propriétés environmantes. Telles conditions et modalités peuvent inclure, mais ne se limitent pas à :
- a) des normes de protection et de sécurité du public et des animaux telles qu'exprimées dans le document intitulé « Code de pratiques recommandées pour les chenils du Canada » datée de septembre 1994 et publiée par l'Association canadienne des médecins vétérinaires;
- b) une ventilation adéquate des lieux, afin de réduire l'humidité et prévenir les maladies;
- c) une gestion adéquate des excréments d'animaux; et
- d) un contrat de service établi avec un vétérinaire.
## 4.15 RESTRICTION ON DEVELOPMENT IN AREAS AFFECTED BY SEA LEVELS
- 4.15.1 Notwithstanding any otber provision in this Regulation and subject to section 4.15.2, it is prohibited to develop a habitable area with less than 4.5 metres (CGVD2013) of elevation in relation to a flood plain, wetland or watercourse.
## 3.15.2 Notwithstanding section 4.15.1
No habitable main building or structure may be placed, erected or altered, unless it coraplies with the following terms and conditions:
## a) In the case of a new building:
- i) the habitable or public space must be equal to or greater than 4.5 metres of elevation (CGVD2013);
2. il) the permit application must be accompanied by a plan showing the elevations of the building space, as stated in 4.15.2 i);
3. ili) the minimum exempt elevation is free of any opening in the foundation that may make the building susceptible to water penetration;
4. iv) the foundation in 4.15.2 ili) constitutes an area that cannot be made habitable;
- b) In the case of an existing building, the building may only be enlarged if the work does not reduce the minimum elevation prescribed in this Regulation.
Definitions: (CGVD2013): Vertical Reference Systems, Natural Resources Canada
"elevation" means the vertical distance between the average high tide level, as per CGVD2013, and the highest waterproof point in the building's foundation.
## 4.15 RESTRICTION D'AMÉNAGEMENT EN MILIEU AFFECTÉ PAR LE NIVEAU DE LA MER
- 4.15.1 Par dérogation aux autres dispositions du présent règlement et sous réserve du paragraphe 4.15.2, il est interdit d'aménager un espace habitable à moins de 4.5mètres (CGVD2013) d'élévation d'une plaine innable, dua tere humide ou d'ua cours
## 3.15.2 Par dérogation au paragraphe 4.15.1
Aucun bâtiment principal ou structure habitable ne peut être implanté, édifié ou modifié à moins que celui-ci rencontre les modalités suivantes:
- a) dans l'instance d'un nouveau bâtiment;
- i) l'espace habitable ou public doit être égal ou supérieut à 4.5 mètres d'élévation (CGVD2013)
3. il) la demande de permis doit être accompaguée d'un plan démontrant les élévations de l'espace du bâtiment mentionné en 4.15.2 i).
4. iii) l'élévation minimale exempt aucune · ouverture ou orifice de fondation qui peut brimer l'étanchéité du bâtiment
5. iv) la fondation en 4.15.2 iti) constitue un air non-aménageable en habitation
- b) dans l'instance d'un bâtiment existant, le bâtiment ne pourra être agrandi que si les travaux ne détériorent pas l'élévation minimum prescrite par ce règlement.

«élévation» désigne la distance verticale entre le niveau de la marée haute moyenne selon (CGVD2013) et le point le plus haut étanche de la fondation du bâtiment.
"precautionary principle" means the precautionary principle in international law defined in paragraph 7 of the 1990 Bergen Ministerial Declaration on Sustainable Development: "In order to achieve sustainable development, policies must be based on the precautionary principle. Environmental measures must anticipate, prevent and attack the causes of environmental degradation. Where there are threats of serious or irreversible damage, lack of full scientific certainty should not be used as a reason for postponing measures to prevent environmental degradation."
"sustainable development" means a measure designed to last 50 years.
## 4.16 STANDARDS FOR HABITABLE, NONPERMENENT VEHICULES
- 4.16(1) Subject to this section, a trailer, caravan, motor home or any other habitable vehicle shall not be installed, except where it complies with this by-law.
- 4.16(2) The uses mentioned in 4.16(1) shall not:
- (a) be in the front setback of the main building or structure, except in the case of installations at the property entrance;
- (b) be less than three (3), metres from a side or rear lot line;
- (c) have a period of activity exceeding ninety (90) days during the summer;
- (d) occupy more than two (2) spaces per cadastral lot, the same space as storage, after which it should be stored;
- (e) occupy the same space during the storage phase as during a period of activity;
- (f) violate applicable laws and regulations in the case of connections to appropriate systems of the main building, such as potable water supply, wastewater disposal, electricity or other;
- (g) be for-profit units;
- (h) be altered in order to be installed permanently;
- (i) be located in one of the following zones: multifamily residential (RM), commercial (C), industrial (I), dense industrial (ID), protection/conservation (CSV), or community use (CO).
« Principe de précaution » : désigue le priacipe de précaution du droit international qui est défini au paragraphe 7 de la Déclaration ministérielle de Bergen sur le développement durable (1990) : "'Un développement durable implique des politiques fondées sur le priacipe de précaution. Les mesures adoptées doivent anticiper, prévenir et combattre les causes de la détérioration de l'environnement. Lorsque des dommages graves ou irréversibles risquent d'être ¡afligés, l'absence d'une totale certitude scientifique ne devrait pas servir de prétexte pour ajourner l'adoption de mesures destinées à prévenir la détérioration de l'environnement. "
- « développement durable » : désigne une mesure conçue pour une durée de 50 ans.
## 4.16 NORMES POUR LES VÉHICULES HABITABLES / NON-PERMANENTS
- 4.16(1) Sous réserve du présent article, il est iaterdit de faire l'installation d'une roulotte, une caravane, un motorisé ou tous autres véhicules habitables, sauf en conformité avec les normes du présent arrêté.
- 4.16(2) Les usages qui sont mentionnés au 4.16(1) ne doivent pas:
- (a) être dans la marge de retrait avant du bâtiment principal ou de la construction, sauf pour les installations dans l'entrée de la propriété,
- (b) être moins de trois (3) mètres d'une limite latérale ou de la limite arrière,
- (C) avoir une période d'activité qui excède quatrevingt-dix (90) jours durant la période estivale,
- (d) occuper plus de deux (2) espaces par lot cadastral, le même espace en remisage après quoi il devrait être remisé,
- (e) occuper le même espace en phase de remisage qu'en période d'activité,
- (A) contrevenir aux lois et règlements applicables dans le cas de connexion aux systèmes appropriés du bâtiment principal, source d'eau potable, eaux usées, électricité ou autres.
- (g) être des unités à vocation lucrative et
- (h) être modifié à être installés en permanence.
- (i) être localisés dans l'une des zones suivantes: résidentielle multifamiliale (RM), commerciale (C), industrielle (I), industrielle dense (ID), protection (CSV) et communautaire (CO).
- () be installed for a period exceeding one (1) year in the case of major construction work on the property.
- 4.16(3) Micro dwellings must not:
- (ii) be installed less than six (6) metres from a side or rear lot line;
- (i) be installed less than seven point five (7.5) metres from a front setback;
- (iii) violate applicable laws and regulations in the case of connections to appropriate systems of the maias buildiag, such as potable water supply, wastewater disposai, electricity or otber.
- (v) exceed three (3) units per acre of subdividable land in the case of an installation exceeding one (1) year.
- (iv) be located in one of the following zones: commercial (C), industrial (D), dense industrial (IID) Or protection/conservation (CSV).
## 4.17 COMMERCIAL CONTAINERS AND TRATLERS AS ACCESSORY SÍORAGE STRUCTURES
- 4.17(1) By way of variance and once certain conditions have been put in place, a shipping container ot commercial trailer without hitch and wheels may be approved for accessory use in areas that are zoned R, RM, CO, C, RE, MX and CSV. The variance may only be granted if the committee considering the variance request is satisfied that there will be no adverse safety or other significant considerations for the community, and that visual impact on the neighborhood will be modest or comparable to that of an accessory building. A shipping container or commercial trailer will be permitted as an Accessory Use in Zones I and II in accordance with the requirements prescribed by this
- 4.18 Should a provincial regulation relative to the above-mentioned standards be adopted, the included current standards pursuant to this regulation will be replaced by the specific standards, as stated ia the provincial regulation relative to the permitted uses.
- (i) être installé pour une période excédant un (1) an dans le cas de travaux de construction majeurs sur la propriété.
- 4.16(3) Les micros-maisons ne doivent pas :
- (i) être installés à moins de sept décimal cinq (7.J) mètres d'une marge de recul avant,
- (iii) contrevenir aux lois et règlements applicables dans le cas de connexion aux systèmes appropriés, source d'eau potable, eaux usées, électricités ou autres.
- (ii) être installés à moins de six (6) mètres d'une limite latérale ou de la limite arrière,
- (iv) être localisé dans l'une des zones suivantes: commerciale (C), industrielle (I), industrielle dense (ID), et protection (CSV).
- (V) franchir les trois (3) unités par acre de terrain lotissable dans le cas d'une installation excédant un (1) an.
## 4.17 CONTENEUR D'EXPÉDITION OU REMORQUE COMMERCIALE / STRUCTURE DE RANGEMENT ACCESSOIRE
- 4.17(1) Par dérogation et une fois que certaines onditions auront été mises en place, un conteneu l'expédition ou une remorque commerciale san attelage et sans roues pourra être approuvé comme un usage accessoire dans les zones R, RM, CO, C, RE, MX et CSV. La dérogation ne pourra être accordée que si le comité faisant l'étude de la demande de dérogation est convaincu qu'il n'y aura pas d'effet négatif au niveau de la sécurité ou autre considération importante pour la communauté, et que l'impact visuel sur le voisinage sera modeste ou comparable à celui d'un bâtiment accessoire. Un conteneur d'expédition ou une remorque commerciale sera permis comme usage accessoire permis, dans les zones I et ID en . conformité avec les exigences prescrites par ce règlement. Un conteneur ou roulotte de chantier de construction sera permis pour la durée du permis de construction.
- 4.18 Advenant l'adoption d'un règlement provincial relatif aux normes mentionnées ci-baut, lès normes usages permis.
