"building" means any structure used or intended
for supporting or sheltering any use or occupancy;

"fixture" means a receptacle, appliance, apparatus
or other device that discharges sewage or clear-
water waste, and includes a floor drain; (appareil

prevent oil, grease, sand or other materials from

or firm who undertakes to install, extend, alter,
renew or repair any part of a plumbing system and
holds a valid plumbing contractor's license issued
by the Province of New Brunswick; (entrepreneur

"Plumbing Inspector" means a person appointed
by Council to administer and enforce this by-law;

"plumbing system" means a drainage system, a
venting system and a water system or parts thereof;

"qualified plumber" means a person who holds a
certificate of qualification in the plumbing trade
issued under the Apprenticeship and Occupational
Certification Act, Chapter A-9.1, R.S.N.B., and
amendments thereto, and a license issued pursuant
to the Plumbing Installation and Inspection Act,
S.N.B.
1976,
chapter 9.1,
and
regulations
thereunder or a license issued pursuant to a by-law
made pursuant to section 6; (plombier qualifié)
"regulation" means Regulation 84-187 under the
Plumbing Installation and Inspection Act, S.N.B.
1976, Chapter P-9.1; (règlement)
"work" means to construct, reconstruct, renew, add
to, alter or extend any portion of the plumbing

PURPOSE

The purpose of this by-law is:

installation of all drainage systems for
sewage, clear-water waste and storm
water, all venting systems for the drainage
systems, all water service pipes and all
water distribution systems for buildings,

3.
ADOPTION OF CODE

3.01
The National Plumbing Code of Canada,
in its latest edition, including any
amendments thereto, is hereby adopted as
the standard to which all work undertaken
in the City must conform.

The City shall keep one copy of the Code
available for public use, inspection and

EXEMPTION

EXEMPTION
Notwithstanding section 4.03, a person shall be
exempted from obtaining a permit when a fixture,
valve or faucet is repaired or replaced, a stoppage
cleared or a leak repaired and if no change to the
piping is required.

Only a plumbing contractor may apply for
a plumbing permit. A plumbing contractor
seeking to obtain a permit for all work
shall make a signed application in writing

The permit application referred to in
section 6.01 shall be made on a form
provided by the plumbing inspector and
such application shall include:

8.
ISSUANCE OF PERMIT
8.

8.01
Upon receipt of a complete application
pursuant to section 6, and upon receipt of
payment of all fees required by this by-
law, the plumbing inspector shall within a
reasonable time issue a permit, provided
that the proposed work complies with this
and all other applicable City by-laws, and
all Acts and Regulations of the Province
of New Brunswick (as determined by the
plumbing inspector).
8.01

8.02
A permit issued pursuant to this by-law
shall be valid for a period of one year from
issuance after which time the permit shall
be deemed null and void, unless it is
renewed with the permission of the
plumbing inspector.

Notwithstanding section 8.01, where the
proposed work being applied for is part of
a project that requires a building permit as
directed by By-law R-1, the plumbing
inspector may not issue a permit unless the
Building Inspector is in receipt of an
application for a building permit.

The issuance of a permit or the review of
the drawings and specifications, or
inspections
made
by
the
plumbing
inspector during construction of the work,
shall not relieve the permit holder from
full responsibility for carrying out the
work in accordance with the requirements
of this by-law.

9.
REVOCATION OF PERMIT

A permit issued pursuant to section 8 shall be
deemed revoked by the plumbing inspector if the
work described in the permit is:

not commenced within six months from
the date of issuance;

DUTIES OF THE PERMIT HOLDER

received, permits and orders issued,
inspections and tests made, and shall
retain copies of all papers and documents
connected with the administration of his
duties;

when necessary, direct that tests of

and assemblies be made, or sufficient
proof be submitted at the expense of the
plumbing contractor, where such evidence
or proof is necessary to determine whether
the material, device, construction or
assembly meet the requirements of the
Code,
other
regulations
or
the
requirements of this by-law;

time for the purpose of administering or
enforcing this by-law, or any regulations
as defined in this by-law.

FEES

12.01
No plumbing permit shall be issued under
section 8 until the fee set out in Schedule
"A", which has been attached to and forms
part of this by-law, has been paid.

The person to whom a permit has been
issued may within thirty days of the
issuance of such permit apply for a refund
of 50% of the fee paid hereunder provided
no work has been done under the permit.
Upon payment by the City of such refund,
the permit shall be deemed to be
cancelled.

anything
herein
contained, where work requiring a permit
under this by-law has been commenced by
anyone prior to the issuance of such
permit, the fees prescribed herein shall be
doubled.

Every person who contravenes any
provision of this by-law is guilty of an
offence and liable on summary conviction
to a fine of not less than fifty dollars
($50.00) and not more than two hundred
dollars ($200.00).

Further, plumbing work which is covered
before inspection is to be uncovered at no

Plumbing
Inspector

undertake the required inspection.

affect any matter or thing whatsoever
completed, existing or pending at the time
of repeal.

The fees for Plumbing Permits and the installation
of plumbing fixtures shall be the same as those
fees established by the Province of New
Brunswick under the Plumbing Installation and
Inspection Act, excluding any reference to
"homeowner's plumbing permits".
Les droits exigibles pour l'obtention d'un permis de
plomberie et l'installation d'appareils sanitaires sont
ceux fixés par la province du Nouveau-Brunswick

In addition to the foregoing, there shall be a charge
of $16.00 for each of the following which apply:

Petroleum separator
