## TOWN OF HARTLAND By-LAW No. B-46.5 <!-- image --> ## A BY-LAW To AMenD By-LAW No. B-46, A ZONING BY-LAW FOR THE TOWN OF HARTLAND Pursuant to Section 117 of the Community Planning Act, the Council of the Town of Hartland enacts the following amendments to Zoning By-law No. B-46: 1. Repealing section 3.22 and replacing it with the following: ## 3.22 Keeping of Livestock No land or any portion thereof may be used for the keeping or breeding of livestock, except for: - (a) the RA (Rural Area) Zone, and - (b) the keeping of hens within the R1 and R2 Zone 2. Repealing section 4.1.8(1)(h) and 4.1.8(1)(g), and adding the following section to 4.0-RESIDENTIAL ZONES: ## 4.1.15 Keeping of Hens Where permitted, the keeping of hens shall comply with the following: - (c) be restricted only to lots where there is an existing single detached dwelling; - (d) a maximum of six hens can be kept and shall not include roosters; - (e) the sale of any products derived the chickens (eggs, meat, manure) and their slaughter on the lot is prohibited; - (f) any manure or waste material shall be removed from the site (or composted) on a regular basis; - (g) the keeping of hens shall not take place in Zone A of the Town of Hartland's Wellfield Protection Area; - (h) a site plan is provided depicting the proposed location of coop &amp; run, location of potable well and other structures on property, along with distance to neighbouring properties; - (i) a roofed enclosure consisting of a chicken coop connected to a chicken run is required and shall be fully enclosed by wired fencing and impermeable to predators; - (i) the enclosure shall be set back a minimum of 10 metres from any dwelling on an adjacent lot and a minimum of 3 metres from any side or rear lot line; and - (k) the coop and run together may not occupy a space larger than 9.5 square metres. 3. Adding the following to subsection (b) of 4.2.1-R-1 Zone Permitted Uses: (v) the keeping of hens. 4. Adding the following to subsection (b) of 4.3.1--R-2 Zone Permitted Uses: (vii) the keeping of hens. Read a first time by title this 12th day of\_ April 2022.
