## BY-LAW NO. 2024-13 A BY-LAW RELATING TO THE PROMOTION OF HEALTH AND SAFETY OF THE RESIDENTS OF TANTRAMAR The Council of Tantramar, under the authority vested in it by Section 10(1) of the Local Governance Act, R.S.N.B. 2017, ch. 18, and amendments thereto, enacts as follows: In this by-law: ## 1. DEFINITIONS - "Air Rifle" means any air rifle, air pistol, air gun or any other instrument or device for projecting missiles by air pressure obtained by mechanical means. - b) "cargo" means all articles or material carried by a vehicle, including those used in the operation of the vehicle. - c) "Firearm" means a barreled weapon from which any shot, bullet or other projectile can be discharged and that is capable of causing serious bodily injury or death to a person, and includes any frame or receiver adapted for use as a firearm; - d) "designated road" means a highway as defined in the Highway Act. - e) "municipality" means the Municipality of Tantramar. - f) "Paved portion" means the portion of a designated road that is surfaced by a layer of pavement consisting of asphalt, concrete, Portland cement concrete or chip seal. - "Public places" is a place that is open and accessible to the general public. Roads, pavements, public squares, parks, and beaches are typically considered public spaces. - h) "Spring Gun" means any spring gun and includes any instrument or device for projecting missiles by spring pressure obtained by mechanical means. - i) "Tantramar" property" shall include streets, sidewalks, lanes, pathways, and any other property owned or controlled by the Municipality of Tantramar. ## 2. GENERAL PROVISIONS - a) No person shall fight, bully, urinate or spit in public. - b) No person shall coast or slide on a sled, toboggan, wagon, or other device on any street in Tantramar. - c) No person shall put any type of material or any object on a public street or sidewalk in Tantramar. Cargo or material transported by a vehicle shall be contained, immobilized, or secured so that it cannot leak, spill, blow off, fall from, fall through, or otherwise be dislodged from the vehicle and fall onto Tantramar property. - d) No person shall injure or destroy any tree or shrub planted along any of the streets or on any Tantramar property. - e) No person shall remove, destroy, deface, or damage any signboard or nameplate or any written or printed notice lawfully affixed or posted within Tantramar. - f) No person shall staple, tape, nail, tack or affix in any way, any posters, ads, notices, signs, or other items to the telephone, hydro or freestanding poles within Tantramar with the exception of approved postal collars as approved by Tantramar. - g) No person shall accost any other person on Tantramar property with the object of canvassing or inducing such person to purchase goods or merchandise, nor for the purpose of inducing such persons to give or subscribe money for any purpose. - h) Notwithstanding anything contained in this By-Law a person may solicit money for charitable and religious purposes if they have obtained permission from the Chief Administrative Officer or their designate authorizing such solicitation. ## 3. AIR RIFLE, FIREARMS, SPRING GUNS - a) Any use or discharging of an air rifle, spring gun or firearm shall be subject to the provisions of the applicable legislation, including the Fish and Wildlife Act, SNB 1980 c F-14.1, The Criminal Code, RSC 1985, c C-46 and the Firearms Act, SC1995, c-39 as well as the regulations thereunder. - b) No person shall hunt on any land within Tantramar's limits that is posted as a no hunting area by Tantramar. - c) No unauthorized person shall carry any loaded firearm, air gun, BB gun, pellet gun or paint ball gun in any public place in Tantramar unless that person is in a location where it may be legally discharged. - d) An individual may load a firearm or handle a loaded firearm only in a place where the firearm may be discharged in accordance with all applicable Acts of Parliament and of the legislature of a province, regulations made under such Act, and municipal by-laws. ## 4. PENALTIES - a) Any person who violates any of the provisions of this By-Law is guilty of an offense upon conviction under Part Il of the Provincial Offences Procedure Act as a category C offense. ## 5. REPEAL - a) Previous By-Laws entitled Preservation of Order for the former Town of Sackville and/or Village of Dorchester are hereby repealed. ## 6. ENACTMENT - a) This By-Law comes into effect on the date of final passing thereof.
