ACommunity ofCommunities BY-LAWRESPECTING SMOKING INTHECAPEBRETONREGIONAL MUNICIPALITY AsAmended toNovember 18, 2003) BEITENACTED bytheRegional Council oftheCape Breton Regional Municipality asfollows: ShortTitle 1. ThisBy-lawshallbeknown asthe "Smoking By-law." Purpose 2. (a) Thepurpose oftheby-lawistosignificantly limitthepublic'sexposure tothe damaging effectsofsecond-handsmoke. b)Toprotect employees whoworkinindoor public places fromthedamaging effects ofsecond handsmoke. Interpretation 3. InthisBy-law: Casino" a) means anygaming facility operating underacasino license issued under theNSGaming Control Actunder authority oftheNSGaming Commission or subsequent successor; Drinkingstablishment" b) E means alicenced lounge, cabaret, beverage roomor tavernbutdoesnotinclude alicensed dinning room, orrestaurant; Health CareComplex" c) means anyhealthcarehospital; Mall" d) means anypublic areawhich istotally enclosed andtowhich commercial establishments have access andincludes foodfairsandsimilar congregations of foodestablishments, whicharegrouped together andprovide common seating for patrons, butdoesnotinclude partsofstructures otherwise defined inthisby-law; By-LawRespecting Smoking intheCapeBreton Regional Municipality (amended) Patio" e) means anyoutdoor seating areawhichisnotcovered, inwholeorinpart, byarooforawning; PlaceofPublic Assembly f)" means abuilding orpartthereof, used, orintended to beused, bythepublic, whether gratisorforafee, forcivic, political, travel, religious, social, educational, entertainment, recreational orlikepurposes, including butnotlimitedto, bowling alleys, poolhalls, thelobbyorhallways, lunch room, cafeteria ofaninstitution orofficebuilding ortheopen spaceportions ofa shopping centerorshopping mall, including afoodcourtareanotseparated from theopenspaceportions byaphysical enclosure, andincludes aretailstore; Proprietor" g) means theperson whocontrols, governs ordirects theactivity carried onwithin thekindsofpremises referred tointhisby-lawandincludes the person whoistheassessed ownerortheoccupant ofthepremises, andincludes a corporation, asshown ontheAssessment RollfortheCape Breton Regional Municipality; Reception Area" h) means thespace usedbyanofficeorestablishment forthe receiving orgreeting ofcustomers, clientsorotherpersons dealing withsuch officeorestablishment; Restaurant" i) means anestablishment orthat portion ofanestablishment, engaged inthesaleandservice offoodtothepublic forconsumption onthe premises, andincludes alicensed diningroom, asidewalk caféandaroofcovered patiobutdoesnotinclude adrinking establishment; Retail Store" j) means abuilding orpartofabuilding, booth, stallorplace usedfor thepurpose ofretailtradeorservices, butdoesnotinclude: i) aplace wheretheonlytradeorbusiness carried onisthatofarestaurant, licensed diningroom, ordrinking establishment; or ii) aplacewhere theonlytradeorbusiness carried onisthatofthecustom blending oftobaccos, orsaleoftobaccos, pipes, cigars orsmokers' sundries; oracigarparlour orpleasure smoking room; Service line" k) means anindoor lineoftwo (2) ormore persons awaiting service ofanykind, regardless ofwhether ornotsuchservice involves theexchange of money including butnotlimitedto: i) sales; ii) provision ofinformation, transactions oradvice, and iii) transfers ofmoneyorgoods; 2 By-LawRespecting Smoking intheCapeBreton Regional Municipality (amended) Smoke" or "Smoking" l) includes thecarrying oflighted cigar, cigarette, pipeor anyotherlighted smoking equipment. Smoking Restrictions 4.1Noperson shallsmoke, andnoproprietor shallpermit smoking, inanyofthefollowing places, excepting apremises where theonlytradeorbusiness carried onisthecustom blending oftobaccos, orthesaleoftobaccos, pipes, cigars, orsmoker'ssundries: a)Inarestaurant, alimited service food establishment, acasino, drinking establishment orbingohall; b)aplaceofpublic assembly; c)arenas, bowling alley orpoolhall; d)anyservice counter inanypremises including unenclosed areas behind suchservice counters; e)anyservice lineonanypremises; f)anyreception areaincluding anyunenclosed areaadjoining areception area; g)anyhotelroomormotelroomdesignated bytheproprietor asnon-smoking; h)anyelevator, escalator, orstairway which isgenerally usedbyandopentothe public; i)anypublic transportation facilities andvehicles; j)anytaxicab orlimousine, shuttleortourvehicle licensed undertheCapeBreton Regional Municipality; k)anyrestrooms generally usedbyandopentothepublic; l)school buses; m) healthcare hospital complex n)anybuilding exterior oroutside areaunderthecontrol oftheowner orthe proprietor designated asanon-smoking areawithappropriate signage. 3 By-LawRespecting Smoking intheCapeBreton Regional Municipality (amended) NoSmoking inDesignated Areas 5. 1. Subject toanorderoftheProvincial FireMarshal orofaFireChiefareas NON-SMOKING AREAS designated as shallbekeptfreeofallashtrays and othersuchitemsforthediscarding ofsmoking material. SignsRequired 6.1The personinchargeor, theproprietor ofpremises andtheoperator ofanypublic transportation vehicle, school bus, taxi, limousine, shuttle ortourvehicle shall ensure thatasufficient number ofsignsasprescribed bythisby-lawaredisplayed soastobeclearly visiblefromallpartsofthepremises ortransportation vehicle. Exterior Signs 6.2The proprietor ofabuilding where smoking isprohibited shallaffixtoallentrance doorsoftheestablishment ataheight of1.25to1.75metres fromthefloorasign which isclearly visible fromtheoutside indicating whether ornotthepremises provides anon-smoking areaandthesignmaybeinkeeping withthearchitectural character ofthebuilding. Interior Signs 7Where smoking isprohibited inabuilding orapartthereof, orwheretheproprietor hasdesignated allorpartofthepremises asnon-smoking, theproprietor shall: a) prominently display asufficient number ofsignsasprescribed bySection 8, soastobeclearly visible fromallpartsofthepremises towhichthesigns apply; and Signs 8. Forthepurpose ofsubsection (2) hereof theletterheight meanstheactualheightofthe letter regardless ofwhether itisacapitalorlowercaseletter; where asection ofthisby- lawrequires asigntobeinaccordance withthissection, suchsignshall: a)carrythetext "NoSmoking" todesignate anareawhere smoking is prohibited, incapitalorlowercaselettersoracombination ofboth; b)haveawhite background, withredletters inthecaseofa "No Smoking" sign, provided thatthisclause shallnotapplytosigns required tobeplaced inrestaurants which maybeofacolour and designinkeeping withthecharacter oftherestaurant; and c)withrespect tosizeoflettering, benotlessthanthefollowing height, based uponthemaximum viewing distance indirect lineatsight, as follows: 4 By-LawRespecting Smoking intheCapeBreton Regional Municipality (amended) 8.1.1 viewing distance oftwelve (12) feetorless - letterheightofone (1) inch; 8.1.2 viewing distance ofmorethantwelve (12) feetandlessthantwenty-five 25) feet - letterheightoftwo (2) inches; 8.1.3 viewing distance ofmore thantwenty-five (25) feetandlessthanfifty (50) feet - letterheightofthree (3) inches; 8.1.4 viewing distance ofmore thanfifty (50) feetandlessthanseventy-five (75) feet - letterheightoffour (4) inches.; 8.1.5 viewing distance ofgreater thanseventy-five (75) feetormore - letter heightoffive (5) inches; 8.1.6 include inthetextatthebottom ofeachsign "CapeBreton Regional Municipality By-law" inlettersnotlessthan10-3/8inchesinheight. NoSmoking Symbol 3)Thefollowing graphic symbol maybeusedtoindicate "NoSmoking" areas: Onawhitebackgroundwiththecircleandinterdictorystrokeinred. 5 By-LawRespecting Smoking intheCapeBreton Regional Municipality (amended) Offence andPenalty 9.1Any person, firmorcorporation whoviolates anyprovision ofthisBy-lawshall upon summary conviction ofthisby-lawbeguiltyofanoffence and, onsummary conviction isliabletoafineofnotlessthanthefollowing amounts. Offences Individual Corporation First $ 100.00 $ 500.00 Second $ 200.00 $ 700.00 Third $ 300.00 $ 1,000.00 Maximum $ 1,000.00 $ 5,000.00 9.2 Indefault ofpayment thereof forthwith orwithin suchtimeasthepresiding Provincial Court JudgeorJusticeofthePeace shalldirect, thefineimposed shall berecoverable undertheprovisions oftheSummary Offences Act. 9.3 Every person, firmorcorporation whocommits anoffence ofacontinuing nature against thisBy-lawupon summary conviction, isliabletoafineofnotlessthan onehundred dollars ($100) foreachdaysuchanoffence iscontinued. 9.4 Where abreach ofthisBy-lawisanticipated orisofacontinuing nature, the Municipality mayapplytoaJudgeoftheSupreme CourtofNovaScotia foran Injunction orother order andtheJudge maymakeanyorderthathedeems necessary toenforce theprovisions ofthisBy-law. 9.5 AnyBy-laworanyprovision thereof passed andapproved byanyformer Municipality within theboundaries oftheCounty ofCape Breton priortothe effective dateofthisbylaw, which conflicts withoractscontrary totheprovisions ofthisBy-lawarehereby repealed withthisBy-lawbecoming lawandanyother provisions ofsuchBy-lawshereby ratified andconfirmed insofar astheyarenotin conflict withtheBy-law. 9.6 Forthepurposes ofenforcement anofficer shallhavetherighttoentry, without warrant orpriornotice, forthepurposes ofadministering anyoftherequirements ofthisBy-law, toallproperties affected bythisbylaw, atallreasonable times, in ordertoascertain whether suchregulations orotherBy-lawsarebeingobserved. 6 By-LawRespecting Smoking intheCapeBreton Regional Municipality (amended) Enforcement Agreements 10. Anyproprietor maythrough agreement withtheCapeBreton Regional Municipality designate aperson orpersons tobeappointed special constables for thepurpose ofenforcing thisby-lawontheproprietor'sproperty. Standing Committee 11.1 There shallbeastanding committee formed toperiodically review thisby-law. Theintentofthecommittee willbetoassesstheby-law'sperformance withaneye towards amendments, whicharedeemed tocreateamoreeffective by-law. 11.2 Thiscommittee shallconsistofrepresentatives fromthefollowing: One (1) member fromthehealthcarecommunity; i. One (1) member fromthebusiness community; ii. One (1) member fromthebeverage anddiningroomcommunity; iii. One (1) member fromaadvocacy groupsuchastheCanadian Cancer iv. Society, Heart andLung Foundation orothergroups whoarealigned totheheathconcerns associated withsmoking; Two (2) members atlargefromthecommunity. v. Themanager responsible forthisbylawshallappoint members. vi. th PASSED ANDAPPROVED byCouncil onthe17 dayofApril, A.D., 2001, and th amended onthe18 dayofNovember, 2003. JOHNW.
