CAPE BRETON REGIONAL MUNICIPALITY By-LawT1 STREETS 1. ( 1) Anyperson proposing tosetoutanyshadeorornamental treewithinthelimitsofany streetintheRegional Municipality shallfirstapplyforthepermission oftheDirector of Engineering & Public Works. 2) Theapplication shallspecify theintended location ofthetrees. 3) TheDirector ofEngineering & Public Works shallgrantpermission unless theplanting willinterfere withtheefficient flowoftrafficorwillimpede theviewoftrafficatany intersection. 2. Noowner oroccupant ofanybuilding shallpermit water, iceorsnowtopour, driporfallfrom theroofsoreavesofthebuildings oranypartthereof uponanystreetorsidewalk. 3. Noowneroroccupant ofanylandsintheRegional Municipality shallpermit watertoflow fromthelandsowned oroccupied ontoanystreetorsidewalk. 4. Noperson shallobstruct anystreetorsidewalk intheRegional Municipality inanyfashion whatsoever. Thisshallinclude, butnotbelimitedto, placing snowinoruponanystreetor sidewalk intheRegional Municipality soastocause anyimpediment tofootorvehicular passage, parking ortraffic. 5. ( 1) Noperson shallerectorplaceanysignorotherstructure, whether moveable ornot, within thelimitsofanystreetintheRegional Municipality. 2) Subsection (1) doesnotapplytoasignorawning thatprojects overasidewalk or otherpartofthestreetallowance, excepting thetravelled way, ataminimum heightofnotless thansevenfeet. 3) Subsection (1) doesnotapplytoamovable signsituate onthesidewalk infrontofa placeofbusiness, thatrelatestothebusiness carried onwithin, andthatdoesnotimpede the movement ofpedestrians. Where asidewalk orstreet hasbeenbroken orotherwise injured inconsequence ofthe erection, demolition, alteration orrepairofanybuilding, theowner ofthebuilding shallrepair thesametoastandard notlessthanthatoftheadjacent sidewalk orstreet. 7. Noperson shallmove anyheavyloadoverordeposit anyheavyloadonanysidewalk unless thesidewalk hasbeenfirstprotected byacovering ofboards notlessthanoneinchthick. 8. Noperson shalldraganyload, orpermit anyloadorpartthereoftodrag, onanystreetinthe Regional Municipality. 10. Noperson shallthrowordeposit, orpermittobethrown ordeposited, anydirt, filth, litter, rubbish orothermatter onanystreetintheRegional Municipality. 11. Failuretocomply withanyoftheprovisions ofthisBy-Lawshallconstitute abreach thereof andmake theoffender subject tothepenalties outlined inBy-lawG-1oftheCapeBreton Regional Municipality, the "Penalties By-Law" so-called. 12. AnyBy-Laworanyprovision thereof passed andapproved byanyformer Municipality withintheboundaries oftheCounty ofCapeBreton priortoJuly31, 1995which conflicts withoractscontrary totheprovisions ofthisBy-Lawarehereby repealed withthisBy- Lawbecoming lawandanyother provisions of suchBy-Lawshereby ratified and confirmed insofar astheyarenotinconflict withthisBy-Law. THISISTOCERTIFY thattheforegoing isatruecopyofaBy- Lawdulypassedinthemanner prescribed bylawatadulycalled meeting oftheCouncil oftheCape Breton Regional Municipality th heldonthe21stdayofNovember, 1995, andamended onthe18 dayofJune, 1996.
