MUNICIPALITY OF THE COUNTY OF KINGS For By-Law information contact the Municipal Clerk Tel: (902)678-6141 Fax: (902)678-9279 E-mail: [email protected] BY-LAW # 94 NON SMOKING AT/ON VILLAGE OF NEW MINAS RECREATION FACILITIES BY-LAW (A By-law prohibiting smoking at or on outdoor Village-owned and/or Village-operated recreational facilities) Authority The Council of the Municipality of the County of Kings under the authority vested in it by the Municipal Government Act, Section 172 (1) (a), (b), (c) and (d), does hereby enact as follows: 1. This By-law shall be known as the "Non Smoking at or on Village of New Minas Recreation Facilities By-law". 2. This By-law shall apply within the boundaries of the Village of New Minas. Interpretation In this By-law, "Smoke" means the act of smoking tobacco, including smoking a cigarette, cigar or pipe, as evidenced by the giving-off of tobacco smoke. In absence of evidence to the contrary, where smoke is given off from a cigarette, cigar, or pipe, it shall be presumed that the substance being smoked is tobacco. "Village" means the Village of New Minas. "Village-owned and/or Village-operated Recreational Facilities" means walking trails, fields, playgrounds, parks, ice-rinks and all manner of similar properties or facilities owned and/or operated by the Village of New Minas. General Prohibition No person shall smoke on any Village-owned or Village-operated outdoor recreational facility. MUNICIPALITY OF THE COUNTY OF KINGS BY-LAW # 94 cont'd 2 Offences and Penalties Any person who contravenes or fails to comply with Section 3 of this By-law shall be liable to a penalty not less than $50 and not exceeding $200 for a first offence and a fine of not less than $100 and not more than $300 for a second or subsequent offence.
