THE CORPORATION OF THE VILLAGE OF BURK’S FALLS
BY-LAW NO. 04-2022
Being a By-law to establish water and sewer rates and charges
to ratepayers of the Village of Burk’s Falls Water and Sewer System
including water and sewer rates and charges to service
a portion of the Township of Armour
WHEREAS Section 391 of the Municipal Act, S.O. 2001, C. 25, as amended, provides that a
municipality may pass by-laws imposing fees or charges on any class of persons:
a) for services or activities provided or done by or on behalf of it;
b) for costs payable by it for services or activities provided or done by or on behalf of
any other municipality or local board;
c) forthe use of its property including property under it’s control; and
d) for capital costs payable by it for sewage and water services or activities which will be
provided or done by or on behalf of it after the fees or charges are imposed.
AND WHEREAS Section 397(1) of the said Municipal Act provides that a municipality may pass
by-laws for:
a) interest charges and other penalties, including the payment of collection cost, for fees
and charges that are due and unpaid;
b) discounts and other benefits for early payment of fees and charges;
c) fees and charges that vary on any basis the municipality or local board considers
appropriate and specifies in the by-law, including the level or frequency of the service
or activity proved or done, the time of day or of the year the service or activity is
provided and whether the class of persons paying the fee or charge are residents or
non-residents of the municipality;
d) different classes of persons and deal with each class in a different way; and
e) the exemption, in whole or in part, of any class of persons from all or any part of the
by-law.
AND WHEREAS notice has been provided to the residents of the public meeting held on
February 22, 2022.
NOW THEREFORE the Council for the Corporation of the Village of Burk’s Falls enacts as
follows:
1.
Water & Sewer Rates shall be increased as outlined in Schedule A, attached hereto and
forming part of this by-law, effective January 1, 2022 (per Bylaw 15-2020) for residents
within the Village of Burk’s Falls.
Water & Sewer Rates shall be increased as outlined in Schedule A, attached hereto and
forming part of this by-law, effective January 1, 2022 (per Bylaw 15-2020) for residents
within a portion of the Township of Armour.
A $25.00 surcharge per service per billing for residents within the Village of Burk’s Falls
be in effect to supplement future reserves and upgrades to the Village of Burk’s Falls
water and sewer system.
A $50.00 surcharge per service per billing for residents within a portion of the Township
of Armour be in effect to supplement future reserves and upgrades to the Village of
Burk’s Falls water and sewer system.
Unmetered/unread water customers will be charged a minimum of three (3) times the
minimum billing and will be encouraged to have their service metered/read.
Sewer rates to be equal to that of water rates.
Penalty charges and disconnection of services shall increase as outlined in Schedule B,
attached hereto and forming part of this by-law, effective upon the final passing of this by-
law.
AS READ A FIRST, SECOND, THIRD TIME AND FINALLY PASSED THIS 22 DAY OF
FEBRUARY, 2022.
