## By-law Number 13-10
A BY-LAW TO AMEND BY-LAW 05-35, A BY-LAW RESPECTING BUILDING PERMITS AND INSPECTIONS, BY-LAW 05-32, A BY-LAW REGULATING OUTDOOR SWIMMING POOLS AND BY-LAW 07-08, A BY-LAW TO REGULATE OUTDOOR SOLID FUEL COMBUSTION APPLIANCES

WHEREAS the Building Code Act, 1992, as amended, Section 7(1) (c) authorizes the council of a municipality to pass by-laws to require payment of fees on applications for an on the issuance of permits, requiring the payment of fees for maintenance inspections, and prescribing the amounts of the fees;
AND WHEREAS the Section 7 of the Act further provides for the payment of interest and other penalties, including payment of collection costs, when fees are unpaid or are paid after the due date;
AND WHEREAS the Building Code Act, 1992, as amended, Section 7(6) stipulates that if a principal authority proposes to change any fee imposed under clause (1)(c) the principal authority shall give notice of the proposed changes in fees to such persons as may be prescribed and hold a public meeting concerning the proposed changes:
AND WHEREAS public notice of the proposed changes in fees was advertised in the EMC Smiths Falls and St. Lawrence editions on February 21, 2013;
AND WHEREAS the public meeting to receive comments regarding the proposed changes was held on March 25, 2013;
AND WHEREAS Section 3 of By-law 01-14, A By-law to Regulate Outdoor Swimming Pools Pool By-law establishes the Township's ability to levy fees for the issuance of permits for the construction of pools within the Township;
AND WHEREAS Section 2 of By-law 05-32 established the permit fee for the construction of pools;
AND WHEREAS Section 11 of By-law 07-08, A By-law to Regulate Outdoor Solid Fuel Combustion Appliances, set out the permit fee for the installation of a outdoor solid fuel combustion appliances;
NOW THEREFORE the Municipal Council of the Corporation of Elizabethtown-Kitley enacts as follows:
1. THAT Schedule A to By-law 05-35 be replaced with Schedule A to this By-law.
2. THAT Section 2 of By-law 05-32 be amended in accordance with line 19 of Schedule A to this By-law.
3. THAT Section 11 of By-law 07-08 be amended in accordance with line 20 of Schedule A to this By-law.
4. THAT this By-law shall come into force and be in effect on the date of passing thereof.
