THE CORPORATION OF THE TOWN OF LINCOLN
BY-LAW NO. 2025-61
A BY-LAW TO ESTABLISH AND REGULATE PAYMENT
OF VARIOUS FEES AND CHARGES
WHEREAS:
1.
Section 391 of the Municipal Act, 2001, S.O. 2001, c.25, as amended,
provides that despite any Act, a municipality may pass by-laws imposing
fees or charges on any class of persons for services or activities provided
or done by or on behalf of it and for the use of its property, including
property under its control.
2.
Section 69 (1) of the Planning Act R.S.O. 1990, c. P. 13, as amended,
provides that a municipality may establish a tariff of fees for the processing
of applications.
3.
Section 7 of the Building Code Act, 1992, S.O. 1992, as amended,
authorizes a municipal Council to pass by-laws concerning the issuance
of permits and related matters requiring the payment of fees on
applications for and on the issuance of permits.

The Town of Lincoln Budget Committee considered and approved Report
FN-11-25 on November 12, 2025, and deems it expedient to enact a
comprehensive by-law establishing and requiring the payment of fees for
information, services, activities and use of Town property.
NOW THEREFORE, THE COUNCIL OF THE CORPORATION OF THE TOWN
OF LINCOLN ENACTS AS FOLLOWS:
1.
The fees and charges as set out in Schedule A attached hereto and
forming part of this By-law are hereby established and adopted by the
Council of the Town of Lincoln
2.
The fees and charges as listed in Schedule A to this By-Law include
Harmonized Sales Tax (HST), where indicated.
3.
All fees and charges applicable under this by-law shall be payable in
advance of services being rendered, except for:
a. Emergency services
b. Actions taken by the Town to rectify failures or by-law infractions
on the part of a resident, in which case, the fee payable will be in
arrears and invoiced after the service or activity is provided
c. Instances where the timing and conditions for payment is
prescribed in agreements or contracts approved by Council.

In the event that any information, service, activity or use of Town
property is requested by a person, and a fee or charge for such
information, service, activity or use of Town property has not been
specifically provided for in Schedule A, a fee or charge shall be
calculated by Town staff to appropriately recover town costs and shall
be incorporated into this By-law as soon as is practicable.
5.
Fees and charges that have been imposed in accordance with this by-
law that remain unpaid after the date on which they are due shall have
interest applied at the rate of 1.25% per month until paid in full.
6.
All fees owing to the Town that are unpaid are considered a debt to the
Town and, together with all interest and penalties accrued thereupon,
may be collected by the Town by action, or may be collected by the
Town on its behalf, or may be added to the property tax roll and collected
in like manner as taxes.

The Treasurer is authorized to carry out the administration of this By-
law, including but not limited to the enforcement thereof, the collection
activity, and for initiating such legal action as may be considered
appropriate.
8.
Should any part of this By-law, including any part of a Schedule attached
hereto, be determined by a court of competent jurisdiction to be invalid
or of no force, it is the stated intention of Council that such invalid part
of this By-law shall be severable from this Bylaw and that the remainder
of this By-law, including the remainder of each Schedule, as applicable,
shall continue to operate and be in force.
9.
This By-law should be known as the "Fees and Charges By-law".
10.
By-law 2024-85 is hereby repealed.
11.
This By-law shall come into force and take effect on January 1, 2026.

REFUND OF FEES
If administrative functions, zoning functions and grading reviewing functions have been performed, 60% of the fee may be refunded.
If administrative functions, zoning functions, grading review functions and plan examination functions have been performed, 40% of the fee may
be refunded.
If the permit has been issued and no inspections have been performed subsequent to the issuance of the permit 30% of the fee may be
refunded. Once any inspections have been performed, no refund will be given.
No refund shall be made of an amount less than $225.00.
Any payments outstanding to the town shall be deducted from the performance deposit by the Treasurer, prior to the refund being
issued.
If only administrative functions have been performed, 70% of the fee may be refunded.
In the event of non-commencement of any project after a permit has been issued, the applicant may, provided a written request has been
made, be entitled to a refund of permit fees. The refund shall be determined by the Chief Building Official in accordance with the following
schedule which sets out the percentage of fees eligible for refund:
Fees are subject to change from time to time. the permit fee is payable at the time of the submission of the application. The balance of the fee
as a result of the review of the building permit and all other fees are payable prior to the issuance of a building permit.

To obtain a refund of your performance bond deposit, please contact the building department. Your refund request must include evidence that
the required works have been completed for which the deposit was secured to the satisfaction of the Chief Building Official. After a minimum of
one year, the Town may send a notice to the address on file to notify you that the deposit may be subject to forfeiture if we do not receive a
response from you within thirty (30) days. If through no fault of the Town, the deposit has not been refunded after the expiry of the thirty (30) day
period, the Town may without further notice declare the deposit forfeited, whereupon the deposit shall become the property of the Town free of all
claims.
Any payments outstanding to the Town shall be deducted from the deposit by the Treasurer, prior to the refund being issued.
Where any application requires the town to hire a consultant to review supporting technical studies on behalf of the town, the applicant shall be
responsible for all costs, and those costs shall be payable upon submission of an invoice from the town.
Any work for which a permit is issued shall be deemed to have been abandoned and cancelled six months after the date of filing, unless in the
opinion of the Chief Building Official such work is seriously proceeded with and a full fee shall be required to activate a new permit application.

NOTES
9. Relocation permit for a building authorizes the moving of the building only. A separate building permit is required for the foundation and any
other construction.
10. Fees for additions shall be calculated at the same rate as stated for major occupancy.
11. Where construction has commenced prior to the issuance of a building permit, the prescribed permit fees shall be doubled. Construction is
defined as placing of concrete; installation of plumbing or buried piping for building drain, sewer drainage pipe or water distribution pipe.
8. If the work regulated by the permit cannot be described otherwise, the permit application fee shall be $12.77 for each $1,000.00 of the value of
the work proposed. The value to be determined by the Chief Building Official.
7. Revisions or amendment to a permit is $80.13 per hour with a minimum of $100.00

The draft plan of subdivision application fee is associated with the initial review of the subdivision proposal only and shall not be deemed to be
payment towards the administration and overhead, engineering, legal and other costs incurred by the municipality in preparing and administering
subdivision agreements. the subdivision agreement, pre-servicing agreement and development agreement administration fees are payable prior to
the registration of the agreement.
The site plan administration fees are payable prior to approval of the site plan, when the signed agreement has been submitted by the applicant to
the town.
If an application is withdrawn after circulation to commenting agencies but prior to public notice being mailed or advertised, 40% of the fee may be
refunded.
If an application is withdrawn after notice of the public meeting being mailed or advertised, but prior to the staff report being prepared, 20% of the
fee may be refunded.
In addition, any payments outstanding to the town shall be deducted from the application fee by the Treasurer, prior to the refund being issued by
the town.
Any application which has been withdrawn or has been inactive for a period of one year shall be considered abandoned and a full fee shall be
required to activate a new application.

Legal review, appraisal and surveying fees will be charged back to the applicant based on actual costs
To secure payment of such costs, the applicant will provide the town, upon notice and/or acknowledgement of an objection from the local planning
appeal tribunal, with an initial deposit of $5,000.00, such amount to be increased by an amount determined by the town in the event the town
determines that the nature of the application indicates that $5,000.00 may be inadequate.
Where any application requires the town to hire a consultant to review supporting technical studies on behalf of the town, the applicant shall be
responsible for all costs, and those costs shall be payable upon submission of an invoice from the town.
Where a decision on a development application in respect of a planning matter is referred or appealed to the local planning appeal tribunal and the
town and the applicant jointly support the decision, the applicant shall be responsible for all costs to the municipality associated therewith; this
includes all legal, expert testimony, and administrative and overhead costs.
Where a Committee of Adjustment decision has been appealed and council does not adopt the position recommended by town staff, then the
following provision shall apply in the event the applicant obtains a summons compelling town staff to attend the hearing of the local planning appeal
tribunal. Staff shall undertake such preparations as required for the hearing and the costs of such preparations and attendance at the hearing,
including any legal costs not otherwise associated with the hearing, shall be paid by the applicant who has obtained the summons. In this instance
the fee is $5,000.00 and shall be paid to the town not later than the day before the scheduled hearing of the Local Planning Appeal Tribunal.
Any costs to the town in excess of the deposit shall be paid to the town by the applicant upon submission of an invoice.

Current Ministry of Transportation rate for each responding apparatus for each hour or portion thereof, plus personnel rate for each
responding firefighter for each hour or portion thereof, plus any additional costs incurred during emergency response including but
not limited to foam and extinguishing agents, dry sprinkler powder aerosol (DPSA) or similar devices, metered water, costs to
replace damaged or destroyed equipment, costs for on-scene firefighter rehabilitation and decontamination services, and specialized
response costs such as third-party contractors and equipment (see notes).
1.Should the insurer pay the coverage to the property owner, the property owner is liable to remit these funds to the municipality or
its representative.
2.These cost recovery fees are HST exempt.
3.Where the Municipality believes and/or Indemnification Technology® indicates Fire Department Specific Response Fees are
applicable but the Owner does not have, in part or in full, insurance coverage for fire department charges for the Property, the
Municipality may adjust the Fire Department Specific Response Fees to the extent of insurance coverage upon provision by the
Owner of evidence, to the satisfaction of the Municipality, that no such insurance coverage exists or to demonstrate the limits of such
coverage.
Should the insurer pay the coverage to the property owner, the property owner shall be liable to remit these funds to the municipality
or its representative.
Response to an incident requiring technical rescue services, such as water or ice rescue, rope rescue, trench rescue, off-road
rescue, to provide emergency service to a resident or non-resident of Lincoln, minimum 1 hour per responding apparatus.
