BY-LAW
NO. 0026
- 1998
Being a By-law regulatingthe design, constructionand alteration
of buildings within the Corporation of the Municipality of Oliver
Paipoonge.
WHEREAS
in the year 1974 an Act was passed to provide for an Ontario Building
Code
and
AND WHEREAS
Section 5-(2) of the Building Code Act provides authority for
Municipal Council to pass By--lawsapplicable to the regulations of the said Act in the
area which the Municipality has jurisdiction
and
WHEREAS
it is deemed both necessary and expedient to adopt the Ontario Buildin
g
Code to regulate the design, construction and alteration of buildings within the
Municipality of Oliver Paipoonge as hereinafter provided
NOW
THEREFORE
THE
COUNCIL
OF THE
CORPORATION
OF THE
MUNICIPALITY
OF
OLIVER
PAIPOONGE
HEREBY
ENACTS
AS
FOLLOWS:

The Ontario Building Code and the regulations thereunder that are from time to
time amended shall be used by the Corporation of the Municipality of Oliver
Paipoonge as a building guide for the construction, design and alteration of
buildings within the Municipality of Oliver Paipoonge .

Permits shall be required for the erection, alteration, demolition or moving of
any building within the Municipality of Oliver Paipoonge which occupies
a11
area
greater
than 100 square feet and a building shall mean
a "structure"
consisting of a wall, roof and ?oor or any one or more of them, and any other
structures
as are designed in the regulations of the Ontario Building Code.

"Building Code" shall mean the regulations made under Section 18 of the
Building Code Act as amendedfrom time to time.

As provided in Section 5-(2)-(c) permit fees applicable to the issuance of
building permits shallbe as attached Schedule "A".

Subject to Section 5-(10)-(d) where a permit fee has been paid by an applicant,
the application is rejected by the Building Inspector or Council, the fee shall

That all other regulations and conditions contained in the Building Code Act
1974 as amended from time to time, shall be in effect within the Municipality of
Oliver Paipoonge .

That By-law 1013-1995 for the former Township of Oliver and By-law 1305-
1995 for the former Municipality of Paipoonge be hereby repealed.
This By-law shall come into force and effect upon the date of passing

SCHEDULE "A"
BY-LAW NO. 0026-1998
RESIDENTIAL AND FARM CONSTRUCTION:
(i)
for all construction of less than One Hundred Dollars ($100.00) in value
there shallbe no fee.
(ii)
for all dwelling construction the fee will be Thirty Cents (.30) per square
foot Q $3.23 per square metre.
(iii)
for all constructionof buildings other than dwellings, the fee will be one
Dollar ($1.00)per square metre g
.0929 cents per square foot subject to a
minimum fee of Fifty Dollars ($50.00).
COMMERCIAL
AND INDUSTRIAL
CONSTRUCTION:
(i)
for
all construction the fee will be Three Dollars ($3.00) for each One
thousand Dollars ($1,000.00) prescribed constructionValue of the building
or structure
or part thereof subject to a minimum fee of Twenty-Five
Dollars ($25.00).
ALTERATION
AND/OR ADDITIONS:
(i)
for all alterations of less than One Hundred Dollars ($100.00) in Value
there will be no fee.
(ii)
for all alterations of greater than One Hundred Dollars ($100.00) in value
the fee will be Two Dollars and Fifty Cents ($2.50) per One Thousand
Dollars ($1,000.00) prescribed alteration Valueof the building or structure
or part thereof subject to a minimumfee of Twenty-Five Dollars ($25.00).

foot ($65.00).
DEMOLITION
PERMIT:
(i)
there will be no fee
PERMITS
FOR TEMPORARY
BUILDINGS:
(i)
for all buildings for which a temporary permit is issued the fee shall by
Thirty Dollars ($30.00).
OCCUPANCY
PERMIT:
(i)
There will be no fee charged for this but a11 occupancy permit is required
when moving into an Lmfmisheddwelling.

OTHER INSPECTIONS:
(i)
the fee for all inspections and/or reports by the building inspector other
than inspections in connection with the permit classes or services
described above shall be thirty Dollars ($30.00) per inspection and/or
report.
PLUMBING PERMITS:
(i)
the fee for plumbing permits shallbe $50.00 (Fifty Dollars)
MOVING PERMITS:
(i)
from one location to another 011 the same property
-- no charge
(ii)
from one location another location within the Municipality or from a
location outside of the Municipality to a location within the Municipality
-
the sum of Twenty-Five ($25.00).
ROADS DEPARTMENT:
(i)
the fee for the installation of an initial culvert shall be Two Hundred and
Fifty Dollars ($250.00).
There shall be no charge for replacement
culverts.
WOODBURNING
APPLIANCES
- INSPECTIONS:
(i)
Existing units in existing homes:
-
inspection will be done by Fire Department designate
-
fee for this inspection is $100.00
-
Municipality to collect the fee
-
Municipality to pay Fire Department Designate upon receipt of a copy
of the inspectionreport
(ii)
New units being built in new homes at the same time as the house is being
built:
-
if the unit is not included in plans, applicant must ?ll out a form
(building) outlining exactly what the unit is, where its going, etc.
-
inspection is done by Building Inspector and included in building fee.
(iii)
New units going into an existing home:
-
Building Inspector will inspect and if putting i11toexisting chinmey,
Fire Department Designate may be called in to assist.
