ZONING BY-LAW NO. _______ A BY-LAW TO AMEND ZONING BY-LAW NO. 20-2014 as amended Additional Residential Units (ARU's) CORPORATION OF THE TOWNSHIP OF SCHREIBER Box 40, 204 Alberta Street Schreiber, Ontario P0T 2S0 Planning Consultant: Robert J. Miller Professional Land Use Planner 26-2025 2 EXPLANATORY NOTE To Zoning By-law No. __________ Passed by the Council of the Corporation of the Township of Schreiber Lands Affected: This By-law applies only to suitable lots and residential units within the Residential R1, R1H and Residential Multiple R2 Zones and the Rural Ru Zone in the Township of Schreiber. This By-law does not apply to any lands zoned Residential Seasonal SR, Residential Walker Lake RW, Flood Plain FP, Environmental Protection EP or to any residential unit accessory to any use within the General Commercial GC or Highway Commercial HC Zones. Present Zoning: The Schreiber Zoning By-law No. 20-2014, as amended, currently contains provisions addressing "accessory secondary dwelling units/apartments" as originally required by Bill 140, the Strong Communities Through Affordable Housing Act, 2011. Proposed Zoning This Amendment deletes the redundant Bill 140 zoning provisions and replaces them with new "additional residential units (ARU)" provisions to mirror Bill 185 the Cutting Red Tape to Build More Homes Act which came into full effect on June 6, 2024. Section 35.1(3) of the Planning Act confirms that O. Reg. 299.19 Additional Residential Units applies as though it is a by-law passed under Section 34 (Zoning By- laws) of the Planning Act. Official Plan Designation: Schreiber Council is in the process of removing redundant Official Plan Sections 3.1.7(ix) and 3.4.3(ii) for "accessory secondary dwelling units/apartments" which were added to the Official Plan in 2013. As of June 6, 2024 the Planning Act no longer requires regulations for additional residential units in Official Plans. This Zoning By-law Amendment therefore conforms with the Schreiber Official Plan. By-Law Purpose: The purpose of this By-law is to provide Schreiber Council, staff and ratepayers a direct reference to the provincial zoning requirements for additional residential units with no need to consult the Planning Act or the Regulation for the same information. 26-2025 3 ZONING BY-LAW NO. __________ THE CORPORATION OF THE TOWNSHIP OF SCHREIBER Being a By-law under the provisions of Section 34(19.1) of the Planning Act, R.S.O. 1990, to amend Zoning By-law No. 20-2014, as amended, of the Corporation of the Township of Schreiber, with respect to permitting additional residential units on lots within the Residential R1, R1H and Residential Multiple R2 Zones and the Rural Ru Zone in the Township of Schreiber.
