THE CORPORATION OF THE TOWNSHIP OF SEVERN
BY-LAW NO. 2024-31
BEING A BY-LAW TO IMPOSE FEES AND CHARGES FOR THE CEMETERIES WITHIN
THE BOUNDARIES OF THE CORPORATION OF THE TOWNSHIP OF SEVERN
________________________________________________________________________
WHEREAS the Municipal Act, S.O. 2001, Chapter 25, Section 391., authorizes a
Municipality to impose fees or charges on persons for services or activities provided or
done by or on behalf of it, for costs payable by it for services or activities provided or done
by or on behalf of any other municipality or any local board and for the use of its property,
including property under its control;
AND WHEREAS the Corporation of the Municipality of Severn owns and operates the
municipal cemetery known as the Coldwater Cemetery;
AND WHEREAS the Funeral, Burial and Cremation Services Act, 2002, S.O. 2002, c. 33
(the Act) regulates the operation of cemeteries in Ontario;
AND WHEREAS as required by the Act, the Council of the Corporation of the Township of
Severn enacted a By-law to provide for the maintenance and management of the
cemeteries;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF
SEVERN HEREBY ENACTS AS FOLLOWS:
1.
That the Coldwater Cemetery fees imposed by the Municipality shall be outlined
on Schedule "A" attached hereto and forming part of this By-law.
2.
That all fees shall be paid in full before any service or supplies are provided.
3.
That this by-law come into force and effect upon passage.
4.
That Schedule "A" of By-law 2023-36 is hereby repealed.
By-law read a first, second, and third time and finally passed this 9th day of May, 2024.
