THE CORPORATION OF THE TOWN OF SMOOTH ROCK FALLS BY-LAW # 2026-10 BEING A BY-LAW OF THE CORPORATION OF THE TOWN OF SMOOTH ROCK FALLS TO ESTABLISH THE 2026 WATER AND SEWER RATES AND SERVICE CHARGES WHEREAS Section 10 (1) of the Municipal Act 2001, as amended from time to time, authorizes a municipality to provide any service or thing that the municipality considers necessary or desirable for the public, AND WHEREAS Section 391 (1) (a) of the Municipal Act 2001, as amended from time to time, authorizes municipalities to impose, by by-law, fees or charges on persons for services or activities provided or done by or on behalf of it, AND WHEREAS Section 81 (1) of the said Municipal Act 2001 as amended, authorizes a municipality to shut off the supply of the public utility if fees or charges payable for the supply of the said public utility are overdue. AND WHEREAS Council deems it necessary to establish water and sewer rates and service charges for the 2026 fiscal year. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF SMOOTH ROCK FALLS HEREBY ENACTS AS FOLLOWS: 1. WATER AND SEWER RATES AND SERVICE CHARGES It is hereby authorized that water and sewer rates and service charges be imposed to properties connected to the municipal service. The water and sewer rates and services charges are hereby attached marked "Schedule A". 2. PAYMENT OF WATER AND SEWER RATES LEVIED THAT the water and sewer billing shall be payable by four (4) individual invoices and due on the following dates: a) the first invoice due on the 31st of March, 2026 b) the second invoice due on the 30th of June, 2026 c) the third invoice due on the 29th of September, 2026 d) the fourth invoice due on the 11th of December, 2026 3. PENALTY FOR NON-PAYMENT OF WATER AND SEWER RATES LEVIED AND SERVICE FEES THAT a charge of one and one-quarter percent (1.25%) shall be imposed as a penalty for non-payment of water and sewer rates and services charges, on the first day BY-LAW 2026-10 PAGE 2 following the due dates or any balances thereof remaining unpaid and thereafter an additional charge of one and one-quarter percent (1.25%) shall be imposed and shall be added to every such water and sewer rates levied and service charges or part thereof remaining unpaid on the first day of each calendar month in which default continues. 4. INVOICES OF WATER AND SEWER RATES AND SERVICES CHARGES The Treasurer is hereby authorized to mail, deliver or cause to be mailed or delivered, the invoices to the address of residence or place of business of the person to whom such invoice is required to be given. 5. WHERE AND HOW WATER AND SEWER RATES AND CHARGES PAYABLE Water and sewer rates and service charges shall be payable to The Corporation of the Town of Smooth Rock Falls. All water and sewer rates and services charges, are payable at the Municipal Office, 142 First Avenue or by mail addressed to The Corporation of the Town of Smooth Rock Falls, P.O. Box 249, Smooth Rock Falls, Ontario, P0L 2B0. 6. RETURNED PAYMENTS The Treasurer shall charge a fee of forty dollars ($40) for each non-sufficient-fund (NSF) payment. If a rate payer has two (2) non-sufficient-funds (NSF) pre-authorized payment transactions (either plan), the rate payer will be automatically removed from the plan. Deposit required is $1,000 and will be applied to final bill and/or refunded as required. New Service Installations from Watermain or Sanitary Sewer main to house, where there was no existing services; all work to be carried out by the Building (Property) Owner or his/her Third Party Contractor. All costs are the Building (Property) Owners responsibility. Water Service Repair or Replacement - From Watermain to Property Line only: No Charge Water Service Repair or Replacement - From Property Line to house. All work to be carried out by the Building (Property) Owner or his/her Third Party Contractor: All costs are the Building (Property) Owners Responsibility. Wastewater Service Repair or Replacement - From connection at the main to the Building. All work to be carried by the Building Owner or his/her Third Party Contractor: All costs are the Building (Property) Owners Responsibility. Turn on and/or off water - during regular business hours - May 1 to October 31* - Requested or service suspended for repairs. Turn on and/or off water - during regular business hours - November 1 to April 30* - Requested or service suspended for repairs. *Extra costs will be incurred if the work is required outside of regular hours and for additional work completed beyond regular service. Costs will be determined based on time and staff required to attend. Suspension of services and/or reinstatement of services for extended periods - Requested for non-repair requests.
