THE CORPORATION OF THE TOWNSHIP OF ST. CLAIR
BY-LAW NUMBER 39 of 2023
A By-law of to set the fees for cemeteries owned
by the Township of St. Clair
WHEREAS Part XII of the Municipal Act, 2001, as amended, authorizes a
municipality to impose fees and charges;
AND WHEREAS the Township of St. Clair owns, operates and maintains both active
and inactive cemeteries;
AND WHEREAS Section 150 of the Funeral, Burial and Cemeteries Services Act,
2002, O. Reg. 30/11 authorizes a cemetery operator to make bylaws governing the
operation of cemeteries;
AND WHEREAS it is deemed expedient to precribe cemetery fees to comply with
the new legislation and regulations;
NOW THEREFORE the Council of The Corporation of the Township of St. Clair
enacts as follows:
1. That this Bylaw shall be cited as “The Cemetery Fee Bylaw’;
2. That the attached Schedule A, which sets out the fees to be charged for
cemetery services, be hereby adopted;
3. That these fees are subject to all applicable taxes;
4. That the fees on Schedule A shall increase by the average annual CPI
effective each September 1st commencing in 2024. The average annual CPI
is to be calculated using the previous twelve months (September ‘st of
previous year to August 31st of current year);
5. That the fees on Schedule A shall come into effect upon passage of this bylaw
unless otherwise specified;
6. That this bylaw shall come into effect on its passing.
