THE CORPORATION OF THE TOWNSHIP OF THE ARCHIPELAGO BY-LAW No. 15-43 Being a By-law to regulate the classification and use of the Township’s Roads WHEREAS Section 27 of the Municipal Act, 2001 S.O. 2001, c. 25, as amended, (the "Municipal Act"), provides that a municipality may pass by-laws in respect of highways under its jurisdiction; AND WHEREAS The Corporation of the Township of The Archipelago wishes to preserve its water-based character, protect its natural environment and limit the expansion of its services with respect to the highways under its jurisdiction (the “Township's roads"); AND WHEREAS The Corporation of the Township of The Archipelago deems it expedient to enact a comprehensive by-law to regulate the classification and use of the Township's roads; NOW THEREFORE BE IT ENACTED as a By-law of the Council of The Corporation of the Township of The Archipelago (the "Township”) as follows: Title 1. This By-law may be referred to as the Township's “Roads By-law”. Definitions 2. In this By-law: a) "bridge" means a public bridge forming part of a highway or on, over or across which a highway passes; b) "highway" means a common and public highway and includes any bridge, trestle, viaduct or other structure forming part of the highway and, except as otherwise provided, includes a portion of a highway; c) "provincial highway" means a highway under the jurisdiction of the Province of Ontario; d) “Township road" means a highway under the jurisdiction of the Township; and, e) "seasonal road" means a Township road maintained by the Township on a seasonal basis only; f) "year-round road" means a Township road maintained by the Township throughout the year. What Constitutes a Township Road 3. | The following are Township roads, unless they’ve been closed: a) all highways under the jurisdiction of the Township that existed on December 31, 2002; b) all highways established by by-law of the Township on or after January 1, 2003; c) all highways transferred to the Township under the Public Transportation and Highway Improvement Act; d) all road allowances made by the Crown surveyors that are located in the Township; and, e) all road allowances, highways, streets and lanes shown on a registered plan of subdivision located in the Township; By-law No. 15- ‘43 Page 2 The Classification of Township Roads 4. All Township roads are classified under O. Reg. 239/02 of the Municipal Act, 2001 S.O. 2001, c. 25, as amended, based on the speed limit applicable to it and the average annual daily traffic on it, as shown on Schedules "A" and "B" attached to this By-law as follows: Schedule “A” — Road Classifications in the South Archipelago Schedule “B” — Road Classifications in the North Archipelago 5S. The road names, general location and categories of all Township roads is shown on Schedules "C" and "D" attached to this By-law as follows: Schedule “C” — Mapping of Year-Round, Seasonal and Private Roads in the South Archipelago Schedule “D” — Mapping of Year-Round, Seasonal and Private Roads in the North Archipelago Maintenance Levels 6. The following maintenance levels are provided for the Township’s roads: a) Year-Round Roads — all season maintenance b) Seasonal Roads — summer maintenance only c) Private Roads — no Township maintenance 7. No changes to the maintenance level of the Township's year round or seasonal roads will be permitted, except by amendment to this By-law. Speed Limits 8. On Township roads, no person shall operate a motor vehicle at speeds greater than those set forth on Schedules "E" and “F” attached to this By-law as follows: Schedule “E” — Speed Limits in the South Archipelago Schedule “F” — Speed Limits in the North Archipelago Stop Signs 9. The intersections of the Township roads as set out in Schedule "G" attached to this By-law, are the locations at which stop signs shall be erected. Load Periods 10. Reduced load periods apply to all Township roads during the period from March 1* to the May 31° inclusive, in each and every year, or for such period as may be determined by the Township’s Manager of Public Works and Facilities, subject to the provisions of the Highway Traffic Act, R.S.O 1990, as amended. Unauthorized Work/Repairs to Township Roads 11. No persons, other than those authorized by the Township, shall make or maintain repairs to Township roads. 12. No persons, other than those authorized by the Township, shall plough or seek to clear snow accumulation from the Township's roads. 13. No persons, other than those authorized by the Township, shall clear, grade or otherwise affect the unopened road allowances that are located in the Township. Township Property 14. No person shall alter, deface or otherwise destroy, remove, relocate or wrongfully have in his possession any signs, indicators or notices that have been, or that st iy erected upon Township property by Township workmen, employees or Officials. By-law No. 15-43 Page 3 Obstructing Township Roads 15. No person shall deposit or place any article, snow, dirt, fill or refuse on any Township road which will cause obstruction, injury or fouling of such road or the encumbrance of public travel thereon at any time. 16. No person shall cause obstruction or injury to any drainage ditch or culvert on any Township road. Parking on Township Roads 17. No person shall park a motor vehicle or trailer on any Township road except for “emergency parking only” or where parking is authorized and posted by the Township. 18. Upon discovery of any vehicle parked or standing in contravention of the provisions of this By-law, a By-law Enforcement Officer appointed by the Township may cause it to be moved or taken to and placed or stored in a suitable place and all costs and charges for removing, care and storage thereof, if any, are a lien upon the vehicle which may be enforced in the manner provided by Part 1 of the Repair and Storages Liens Act, R.S.O. 1990. Offences and Penalties 19. Any person who contravenes any provision of this By-law is guilty of an offence and, on conviction, is liable to a fine as provided for in the Provincial Offences Act, R.S.O. 1990, c.P. 33. Severability 20. If any section or part of this By-law is found to be illegal or beyond the power of the Township to enact, such section, part or item shall be deemed to be severable and all other sections or parts of this By-law shall be deemed to be separate and independent therefrom and to be enacted as such.
