THE CORPORATION OF THE TOWNSHIP OF TINY
BY-LAW NUMBER 20-015
A BY-LAW TO ESTABLISH REGULATIONS
FOR THE PARKING OF VEHICLES WITHIN
THE TOWNSHIP OF TINY
WHEREAS the Council of The Corporation of the Township of Tiny
deems it desirable and expedient to pass a by-law to regulate parking in
the Township of Tiny;
NOW THEREFORE this Council of the Corporation of the Township of
Tiny hereby enacts as follows:
A.
DEFINITIONS
For the purpose of this By-law;
1.
"Disabled Parking Permit" means a valid disabled parking permit
issued by the Ministry of Transportation of Ontario;
2.
"Fire Access Route" shall mean any roadway, driveway, lane,
ramp or other means of vehicular access to or egress from,
around or from a building, or property when the fire access route is:
(a)
located on private property; and,
(b)
not less than 4.5 m. wide; and,
(c)
posted with required signs,
and shall include any part of a parking area set aside by visible
markings or markers for the purpose of vehicular movement and
that has been designated by the Fire Department for the
Municipality to be a fire access route;
3.
"Heavy Vehicle" means a commercial vehicle having an unloaded
weight greater than 1,000 kilograms;
4.
"Highway" includes a common and public highway, street,
boulevard, court, centre, crescent, avenue, parkway, driveway,
square, place, lane, bridge, viaduct or trestle, any part of which is
intended for or used by the general public for the passage of
vehicles and includes the area between the lateral property lines
thereof;
5.
"Intersection" means the area embraced within the prolongation
or connection of the lateral curb lines, or if none, then of the
lateral boundary lines of two or more highways that join one
another at an angle, whether or not one highway crosses the other;
6.
"Jackson Park Parking Lot" is legally described as Part of Lot 19,
Concession 8 (Part of Beach, Registered Plan 776), Water Lot
Opposite of Lot 19, Concession 8 and Part of Road Allowance
Between Lots 18 & 19, Concession 8 described as Parts 5 - 7 on
Reference Plan 51R-36018;
7.
"Municipality" means The Corporation of the Township of Tiny;
8.
"Occupant" when used in relation to property, means:
(a)
the tenant of the property or part thereof whose consent
shall extend only to the control of the land of which he is
tenant and any parking spaces allotted to him under his
lease or tenancy agreement;

(b)
the spouse of a tenant;
(c)
a person or The Corporation of the Township of Tiny, or a
local board thereof, having an interest in the property
under an easement or right of way granted to or
expropriated by the person, the Corporation or local board
whose consent shall extend only to the part of the property
that is subject to the easement or right of way; or
(d)
a person authorized by an occupant as defined above in
paragraph (a), (b) or (c), to act on the occupant's behalf for
requesting the enforcement of this section.
9.
"Owner", when used in relation to property means:
(a)
the registered owner of the property;
(b)
the spouse of a person described in (a);
(c)
a person authorized by the property owner as defined
above in paragraph (a) or (b), to act on the owner's behalf
for requesting the enforcement of this by-law.
10.
"Park or Parking" means when prohibited, the standing of a
vehicle, whether occupied or not, except when standing
temporarily for the purpose of and while actually engaged in
loading or unloading merchandise or passengers;
11.
"Parking Area" shall mean those lands owned by or in the
jurisdiction of the municipality and identified as controlled
parking areas for motor vehicles owned by the general public;
12.
"Parking Space" means a portion of the surface of a highway or
parking area as indicated by the lines marked out on the surface
for the parking of vehicles;
13.
"Parking Machine" means a device that when payment is
deposited, a timing mechanism shall indicate the actual time to
which parking is allowed and will dispense a Validation Receipt
which will indicate the date, amount deposited and time to which
use of a parking space has been paid for;
14.
"Private Property" is property other than that owned by the
municipality, but shall include property owned by public
authorities and local boards;
15.
"Rate Plate" means the plate attached to the parking machine
specifying the rates and times applicable;
16.
"Vehicle" includes a motor vehicle, motorcycle, motor-assisted
bicycle, trailer, traction engine, farm tractor, tractor, road-building
machine, all-terrain vehicle, off-road vehicle and any vehicle
drawn, propelled or driven by any kind of power, including
muscular power, but does not include a motorized snow vehicle
or a street car;

17.
"Sign" includes any sign, marking or other device erected or
placed on a highway, private or municipal property for the
purpose of regulating or guiding traffic and as may be specified
in the Ontario Traffic Manual, the Highway Traffic Act or as
authorized by the municipality;
18.
"Stop" or "Stopping" when prohibited, means the halting of a
vehicle, even momentarily, whether occupied or not, except when
necessary to avoid conflict with other traffic or in compliance with
the directions of a police officer or of a traffic control sign or
signal;
19.
"Parking Permit" shall mean a document issued by the Township
of Tiny that is displayed from a vehicle, and authorizes parking in
specified areas;
20.
"Validation Receipt" shall mean a receipt issued by a Parking
Machine which indicates the date, amount deposited and time to
which use of a Parking Space has been paid for;
21.
"Loading Zone" shall mean a portion of a roadway established
for the exclusive purpose of and while actually engaged in the
loading or unloading of passengers or goods;
22.
"Parent Park Parking Lot" is legally described as Parent Road,
Plan 958 Lot 44 to Lot 45;
B.
METHOD OF PARKING
1.
No person shall park any vehicle on any highway or portion
thereof, except as follows:
(a)
Where there is a raised curb or rolled curb, parking shall be
limited to the right side of the roadway, having regard to
the direction which the vehicle had been proceeding, and
with its right front and right rear wheels or runners parallel
to and distant respectively not more than fifteen (15)
centimetres from such curb;
(b)
Where there is no curb or rolled curb, parking shall be
limited to the right side of the roadway having regard to
the direction which the vehicle had been proceeding, and
with its right front and right rear wheels or runners parallel
to and near to the right hand limit of the highway as is
practical without parking on the sidewalk or boulevard.
C.
PROHIBITED PARKING
1.
In Specified Places: No person shall park a vehicle on a highway:
(a)
in such a manner as to obstruct a sidewalk;
(b)
on any portion of a boulevard;

(c)
within three (3) metres of a point on the curb or edge of the
highway adjacent to a fire hydrant;
(d)
within an intersection;
(e)
within nine (9) metres of an intersection unless otherwise
indicated by a sign;
(f)
or parking area for the purpose of displaying the vehicle for
sale;
(g)
and obstruct or in front of any portion of a public or private
driveway or laneway;
(h)
a heavy vehicle on any highway or parking area, except for
the purpose of and while actually engaged in loading or
unloading, but not to obstruct traffic;
(i)
or stand or stop a vehicle in such a manner as to interfere
with the movement of traffic or the clearing of snow from a
highway;
(j)
or parking area or stop a vehicle stopping is prohibited;
(k)
or parking area where parking is prohibited;
(I)
where signs regarding prohibited parking have been
erected and are on display, no person shall park a vehicle
in any parking area or on any portion of any highway listed
in Schedule "A" attached hereto and forming part of this
by-law between the hours of 10:00 p.m. to 8:00 a.m. local
time;
(m)
where signs regarding prohibited parking have been
erected and are on display, no person shall park a vehicle
in any parking area or on any portion of any highway listed
in Schedule "A" attached hereto and forming part of this
by-law between the hours of 10:00 p.m. to 5:00 a.m. local
time;
(n)
or leave any vehicle on the municipality's property where
parking by the public is not authorized.
(o)
where signs regarding prohibited parking have been
erected and are on display, no person shall park a vehicle in
any parking area or on any portion of any highway listed in
Schedule "A" attached hereto and forming part of this
by-law between the hours of 1:30 a.m. to 5:00 a.m.;
(p)
No person shall park a vehicle on any portion of a highway
listed in Schedule "B", attached hereto, where signs have
been erected at the entrance to each highway prohibiting
parking "on this street at any time".

2.
(a)
Where signs regarding Tow-Away Zones have been
erected and are on display, no person shall park a vehicle
in any parking area or on any portion of any highway listed
in Schedule "A" attached hereto and forming part of this
by-law.
(b)
Where signs regarding Fire Access Routes have been
erected and are on display, no person shall park a vehicle
in any parking area or on any portion of any highway listed
in Schedule "A" attached hereto and forming part of this
by-law.
(c)
Where signs regarding Disabled Parking have been erected
and are on display, no person shall park, stand or stop a
vehicle in any parking area, on any private property or on
any portion of any highway listed in Schedule "A" attached
hereto and forming part of this by-law, unless they display
a valid Disabled Parking Permit.
D.
RESTRICTIVE PARKING
1.
(a)
Between the 15" day of May through to the 15111 day of
September each year and between the hours of 8:00 a.m. to
10:00 p.m., no person shall park a vehicle, on a highway or
part of a highway as listed below, unless the driver of such
vehicle pays the required fee as set out in the Townships
Fee Schedule By-Law, for each day, for each parking space
used, into the Parking Machine which will issue a Validation
Receipt.
(i)
Concession Road 2 West (north side) from Tiny
Beaches Road South westerly to the limit of the
roadway.
(ii)
Rue
Lafontaine
Road
West
(south
side)
from
Marchand Road westerly to Tiny Beaches Road North.
(b)
Between the 15th day of May through to the 15111 day of
September each year and between the hours of 5:00 a.m. to
10:00 p.m., no person shall park a vehicle, on a highway or
part of a highway as listed below, unless the driver of such
vehicle pays the required fee as set out in the Townships
Fee Schedule By-Law, for each day, for each parking space
used, into the Parking Machine which will issue a Validation
Receipt.
(i)
Balm Beach Road West (northwest side) from Tiny
Beaches Road North to Boblyn Road.
(c)
Between the 15" day of May through to the 15th day of
September each year and between the hours of 5:00 a.m. to
10:00 p.m. on Saturdays and Sundays and Holidays, and
between the hours of 9:00 a.m. to 5:00 p.m. on Monday
through Friday, no person shall park a vehicle, on a
highway or part of a highway as listed below, unless the
driver of such vehicle pays the required fee as set out in the
Townships Fee Schedule By-Law, for each day, for each
parking space used, into the Parking Machine which will
issue a Validation Receipt.

(i)
Tiny Beaches Road North (southwest side) from Balm
Beach Road West to #18 Tiny Beaches Road North.
(ii)
Oliver Drive (northwest side) in front of #2 Oliver
Drive
2.
(a)
Between the 15`" day of May through to the 15th day of
September each year and between the hours of 5:00 a.m. to
10:00 p.m., no person shall park any vehicle in the
"JACKSON PARK PARKING LOT" or at "PARENT PARK
PARKING LOT" unless the driver of such vehicle pays the
required fee as set out in the Townships Fee Schedule By-
law, each day, for each parking space used, into the Parking
Machine which will issue a Validation Receipt.
(b)
Between the 15t" day of May through to the 15th day of
September each year and between the hours of 5:00 a.m. to
10:00 p.m. on Saturdays and Sundays and Holidays, and
between the hours of 9:00 a.m. to 5:00 p.m. on Monday
through Friday, no person shall park any vehicle in the "#18
TINY BEACHES ROAD NORTH" or at "#5 PARKSIDE DRIVE"
unless the driver of such vehicle pays the required fee as
set out in the Townships Fee Schedule By-law, each day,
for each parking space used, into the Parking Machine
which will issue a Validation Receipt.
(c)
Between the 15th day of May through to the 15th day of
September each year and between the hours of 8:00 a.m. to
10:00 p.m., no person shall park any vehicle at the parking
lot at "#2020 TINY BEACHES ROAD SOUTH" or at "775
RUE LAFONTAINE ROAD WEST" unless the driver of such
vehicle pays the required fee as set out in the Townships
Fee Schedule By-law, each day, for each parking space
used, into the Parking Machine which will issue a Validation
Receipt.
3.
No person shall park a vehicle on a highway or in any municipal
parking area unless the Validation Receipt issued by the Parking
Machine is placed on the dashboard of the vehicle, face up, on
the driver's side, so as to be visible from the outside of the
vehicle and left there for the duration of the time paid for.
4.
No driver of a vehicle shall allow such vehicle to remain parked
on a highway described in Section D.1. or Section D.2. unless said
vehicle is displaying an unexpired Validation Receipt issued by
the Parking Machine.
5.
No driver of a vehicle shall allow such vehicle to remain in a
parking space for a longer period than the time stated on the rate
plate.
6.
No person shall deposit or cause to be deposited in any parking
machine any slug, object or other substance for a twenty-five (25)
cent, one dollar ($1.00) or two dollar ($2.00) coin of Canada or the
United States of America.

7.
No person shall park any vehicle in such a manner that said
vehicle is not completely within one parking space as indicated
by the lines marked out on the surface of the parking area or
highway.
8.
No person shall without lawful authority attempt to or in fact
alter, deface, injure, knock down, or remove any official parking
machine.
9.
No person shall without lawful authority repair, service or paint a
vehicle parked in any municipal parking area or on any portion of
any highway.
10.
Notwithstanding the definition of vehicle in Section A.11. of this
by-law, and notwithstanding any other section of this by-law,
no person shall park an unlicenced vehicle, trailer, object or other
thing in any municipal parking area or on any highway, unless
specifically authorized by the Municipal Law Enforcement Officer.
11.
Where signs are displayed, no person shall park a vehicle in any
parking area or on any portion of any highway listed in Schedule
"A" attached hereto and forming part of this by-law for a
continuous period greater than thirty (30) minutes.
12.
The provisions of Section D.1. and D.2., requiring parking fee
payment does not apply to vehicles displaying a disabled parking
permit.
13.
No person shall park a vehicle in any Loading Zone except while
actually engaged in the loading or unloading of passengers or
goods.
14.
Where a Validation Receipt is issued by a Parking Machine,
it shall be transferable throughout the Township anywhere paid
parking is in place.
15.
Where signs are displayed, no person shall park a vehicle in any
parking area or on any portion of any highway listed in Schedule
"A" attached hereto and forming part of this by-law for a
continuous period greater than two (2) hours.
E.
PERMIT PARKING
1.
Where signs regarding Permit Parking have been erected and are
on display, no person shall park a vehicle in any parking area or
on any portion of any highway listed in Schedule "A" attached
hereto and forming part of this by-law without displaying a
parking permit.
2.
No person shall park a vehicle on any highway listed in Schedule
"C", attached hereto, where signs requiring Permit Parking have
been erected at the entrance to a group of highways prohibiting
parking "no parking beyond this point except by permit or where
otherwise posted" without displaying a Parking Permit.

3.
Notwithstanding Section E, 2. above, where signs have been
otherwise posted on a highway listed in Schedule "C" prohibiting
parking, those signs shall take priority and supersede the Permit
Parking permission.
4.
Where a parking permit has been obtained under this by-law,
no person shall fail to comply with the terms and conditions of
the said permit.
The terms and conditions on which a parking permit is issued are
as follows:
(a)
That a maximum of two (2) parking permits shall be issued
to any one residence;
(b)
That the registered owner of a property must, in writing,
authorize the occupant to obtain the resident parking
permit for the property instead of the owner receiving the
permit;
(c)
A parking permit issued to a non-resident shall have the
licence number inscribed on the parking permit;
(d)
Where a parking permit has the license number inscribed
on it, No person shall display said parking permit in a
vehicle other than the one with the matching license
number;
(e)
Permit parking spaces are on an as available basis and not
guaranteed;
(f)
That the fee for obtaining a parking permit shall be set out
in the Townships Fee Schedule By-law, as amended;
(g)
That parking permit shall be valid from the 15th day of May
until the 15th day of September for the year of issue;
(h)
The parking permit must be hanging on the rear-view
mirror or placed on the driver's side of the dashboard only.
The entire parking permit must be clearly visible from the
outside of the vehicle to read the parking permit number
and licence plate number;
(i)
Parking signs with a yellow background denotes permit
parking areas;
(j)
Parking permits are the property of the Township of Tiny
and shall not be sold for profit or gain;
(k)
All other provisions of this by-law shall be complied with.
(I)
Parking Permits are exempt from Sections D.1. and D.2. of
this by-law.
5.
A Municipal Law Enforcement Officer is authorized to cancel a
parking permit as necessary.

F.
PARKING ON PRIVATE PROPERTY
1.
No person shall park or leave a vehicle:
(a)
on private property without the consent of the owner or
occupant of the property;
(b)
on property owned or occupied by a public authority or any
local board without the consent of the public authority or
local board, as the case may be;
(c)
If a parking space has been designated by lines painted on
the surface of the parking area on private property, no
person shall park any vehicle in such a manner that is not
wholly within the area designated as a parking area space.
2.
Where signs have been posted, stating conditions on which a
vehicle may be parked or left on the property, or prohibiting the
parking or leaving of a vehicle on the property, a vehicle parked
or left on the property contrary to such conditions or prohibitions
shall be deemed to have been parked or left without consent.
3.
(a)
If it is alleged in a proceeding that this section has been
contravened, the oral or written evidence of a Municipal
Law Enforcement Officer is receivable in evidence as proof,
in the absence of evidence to the contrary, of the facts
stated therein in respect of:
(i)
the ownership or occupancy of the property;
(ii)
the absence of the consent of the owner or occupant;
(iii)
whether any person is an owner under paragraph (c)
of the definition of "owner" in Section A.9. or an
occupant under paragraph (d) of the definition of
"occupant" in Section A. 8.
(b)
A document offered as evidence under Section F.3.(a) shall
be admitted without notice under the Evidence Act.
(c)
A Municipal Law Enforcement Officer, upon discovery of
any vehicle parked or standing in contravention of the
provisions of
this section may cause it to be moved or
taken to and placed or stored in a suitable place, at the
owner's expense, and all costs and charges for removing,
care and storage thereof, if any, are a lien upon the vehicle
which may be enforced in the manner provided by the
Repair and Storage Liens Act.
G.
PENALTIES
1.
Where a vehicle is found parked in contravention of the
provisions of the by-law, the Municipal Law Enforcement Officer
so finding the vehicle may attach to the vehicle a ticket in the
form of a numbered notice saying:

(a)
The licence number of the vehicle;
(b)
That the vehicle has violated the provisions of the by-law;
(c)
The date, time, place and nature of the alleged offences;
(d)
That the owner or operator thereof may report to the
Municipal Office of the Township of Tiny within seven (7)
days after the date the ticket was issued to make voluntary
payment of the penalty indicated on the ticket.
2.
The ticket shall be prepared in duplicate and the Municipal Law
Enforcement Officer shall attach one copy to the vehicle and
deliver the other copy to the Municipal Office.
3.
Should a violation of this by-law continue in excess of three (3)
hours, the Municipal Law Enforcement Officer may charge the
violator with a second offence, and subsequently charge further
offences every three (3) hours thereafter until the violation
ceases.
4.
The Municipal Law Enforcement Officer, upon finding a vehicle
violating any section of the by-law, may in his sole discretion,
order the removal of the vehicle violating the by-law when
deemed necessary.
5.
(a).(i).
Every person who contravenes any of the provision of
this By-law and every Director or Officer of a
Corporation,
who
knowingly
concurs
in
the
contravention by the Corporation, is guilty of an offence
under the provisions of the Municipal Act, 2001, S.O.
2001, c. 25, as amended.
(a).(ii).
Every person who contravenes the provisions of this
by-law and every Director or Officer of a Corporation,
who knowingly concurs in the contraventions by the
corporation, is guilty of an offence and liable on
conviction to a penalty where the minimum fine shall
not be less than $500 and the maximum shall not
exceed $100,000 exclusive of costs under the provisions
of the Municipal Act, 2001, S.O. 2001, c. 25, as amended.
(a).(iii).
For the purpose of continuous offences, every person
who contravenes any provision of this by-law and every
Director or Officer of a Corporation who knowingly
concurs in the contravention of a by-law of the
Corporation is guilty of an offence and liable on
conviction to a penalty not exceeding $10,000, exclusive
of costs under the provisions of the Municipal Act, 2001,
S.O. 2001, c. 25, as amended.
5.
(a).(iii).
(A). Despite section 5.(a).(iii). and the provisions of the
Municipal Act, 2001, S.O. 2001, c. 25, as amended,
the total of all daily fines for the offence is not
limited to $100,000.

(a).(iv).
For the purpose of multiple offences, every person who
contravenes any provision of this by-law and every
Director or Officer of a Corporation who knowingly
concurs in the contravention of a by-law of the
Corporation is guilty of an offence and liable on
conviction to a penalty not exceeding $10,000, exclusive
of costs under the provisions of the Municipal Act, 2001,
S.O. 2001, c. 25, as amended.
5.
(a).(iv).
(A). Despite section 5.(a).(iv). and the provisions of the
Municipal Act, 2001, S.O. 2001, c. 25, as amended,
the total of all daily fines for the offence is not
limited to $100,000.
(b)
Any person who contravenes any section of this by-law,
except Sections C.1.(p), C.2., E.1. or E.2., and is charged by
way of Part II of the Provincial Offences Act, may, within
seven (7) days of the date the ticket was issued, report to
the Municipal Office and make voluntary payment in the
amount of Twenty ($20.00) Dollars in full satisfaction of the
alleged offence;
(c)
Any person who contravenes Sections C.1.(p), E.1. or E.2.
of this by-law, and is charged by way of Part II of The
Provincial Offences Act, may within seven (7) days of the
date the ticket was issued, report to the Municipal Office
and make voluntary payment in the amount of Fifty
($50.00) Dollars in full satisfaction of the alleged offences;
(d)
Any person who contravenes Sections C.2.(a). or C.2.(b) of
this by-law, and is charged by way of Part II of The
Provincial Offences Act, may within seven (7) days of the
date the ticket was issued, report to the Municipal Office
and make voluntary payment in the amount of Seventy
Five ($75.00) Dollars in full satisfaction of the alleged
offences;
(e)
Any person who contravenes Section C.2.(c) of this by-law
is guilty of an offence and upon conviction, shall be liable
to a fine of not less than Three Hundred ($300.00) Dollars,
as provided for in the Municipal Act, 2001, S.O. 2001, c.
M.25, as amended.
H.
OBSTRUCT
1.
No person shall hinder or obstruct, or attempt to hinder or
obstruct, any person exercising a power or performing a duty
under this by-law.
2.
Any person who has been alleged to contravene any section of
this by-law and who fails to identify themselves is deemed to
hinder or obstruct a person exercising a power or performing a
duty under this by-law.

I.
VALIDITY
1.
Should any section, subsection, clause, paragraph, or provision
of this by-law, including any section or part of Schedule "A"
attached to this by-law, be declared by a Court of competent
jurisdiction to be invalid or illegal for any other reason, such as
offending section or part shall be deemed to have severed from
this by-law and the remaining sections or parts shall continue in
full force and effect and shall remain valid and binding.
J.
REPEAL OF PREVIOUS BY-LAWS
1.
That By-laws 09-025, 12-025, 12-055, 16-026, 16-041, 16-046,
17-034 and 19-010 are hereby repealed.
K.
EFFECTIVE DATE OF BY-LAW
1.
That this by-law shall come into full force and take effect on the
date of passing.
READ A FIRST AND SECOND TIME THIS 10th DAY OF FEBRUARY 2020.
READ A THIRD TIME AND FINALLY PASSED THIS 10th DAY OF
