## BY-LAW # 2024-38
## A BY-LAW TO ESTABLISH THE RATES AND OTHER SERVICE CHARGES FOR USE OF THE WATER AND WASTEWATER SYSTEMS FOR THE YEAR 2025
WHEREAS pursuant to Section 391(1) of the Municipal Act, 2001 as amended, a municipality may impose fees and charges on any class of persons for services or activities provided or done by or on behalf of the it, and
WHEREAS Section 12 of Ontario Regulation 244/02 establishes the terms and conditions under which a municipality may impose fees or charges for the use of a water system or the consumption of water, and use of a wastewater system, and
WHEREAS the municipality has met all the conditions listed in Section 12 of Ontario Regulation 244/02,
WHEREAS the Municipal Act, 2001 as amended provides for the imposition of interest charges and other penalties, including collection costs for fees and charges that are due and unpaid; discounts for early payment; fees and charges that vary on any basis the municipality considers appropriate and specifies in the by-law; the establishment of different classes of persons and gives authority to deal with each class in a different way; and the exemption in whole or in part of any class of persons from all or any part of the by-law, and
WHEREAS Section 398(2) the Municipal Act, 2001 as amended allows the municipality to add unpaid fees and charges to the taxes for the property and collect them as if they were outstanding taxes, and
## NOW THEREFORE the Council of the Village of Westport ENACTS as follows:
1. That the Village of Westport hereby adopts the attached Schedule "A" as the rates to be charged for the supply of water and use of the wastewater system to the residents of the Village.
3. That Schedule "A" attached hereto shall form a part of this By-law.
2. Bylaw 2023-63 shall be hereby rescinded.
4. That this by-law shall come into force and effect as of January 1, 2025.

## SCHEDULE "A" TO BY-LAW # 2024-38
## VILLAGE OF WESTPORT RATES AND CHARGES RESPECTING THE SUPPLY OF WATER AND THE TREATMENT OF WASTEWATER
## MONTHLY BASE SERVICE CHARGE - RESIDENTIAL METERED
The following charges are hereby imposed upon owners or occupants of lands which are supplied with water and wastewater services within the boundaries of the Village of Westport. The charges are presented as a schedule of rates for a one-year period for 2024 and remain in force until such time that the Council of the Village of Westport may choose to revise them as a consequence of a rate review process carried out under the conditions of Ontario Regulation 244/02. Council will carry out a water and wastewater rate review at least every three (3) years.
The rates will consist of a base service charge component, a variable consumption component, and a set capital component. All charges will be billed on a monthly basis.

## NOTES:
1. The above charges apply to all water service customers within the Village of Westport and are effective January 1st, 2025.
2. The Net Bill is the total of the appropriate base service charges and consumption charges, if paid or post marked on or before the Due Date specified on the bill.
3. A late payment charge of 1.5% of the Net Bill will be added if paid after the Due Date.
4. The Minimum Bill shall be the Total of the Base Service Charges.
