COMMUNITY OF O'LEARY
SMOKING BYLAW # 7
Made pursuant to the Municipalities Act, R.S.P.E.I. 1988, cap. M-13, ss. 57 and 64 (a)(ii).
BE IT ENACTED by the Council of the Community of O'Leary as follows:
1.
This bylaw shall be known and may be cited as the Smoking Bylaw # 7 for the O'Leary
Community Complex.
2.
In this bylaw:
(a)
"designated area" means an area of the municipal facility designated by the posting
of signs as a smoking area;
(b)
"municipality" means the Community of O'Leary;
(c)
"municipal facility" means community complex;
(d)
"smoke" or "smoking" includes the carrying a a lighted cigarette, cigar, pipe, or
any other lighted smoking equipment.
3.
No person shall smoke in the municipal facility, other than in a designated area.
4.
There shall be posted in a municipal facility at least two signs indicating "No Smoking".
5.
Any person who violates any provision of this bylaw is guilty of an offence and liable upon
summary conviction to a fine not exceeding $25.00.
