## A BYLAW TO PROVIDE FOR THE REMOVING AND CLEARING OF SNOW, ICE, DIRT AND OTHER OBSTRUCTIONS FROM SIDEWALKS AND THE MOWING OF BOULEVARDS
The Council of the Village of Abbey, in the Province of Saskatchewan, in an open meeting assembled, enacts as follows:

- a) "boulevard" the portion of land adjacent to a premises that is between the sidewalk and the street.
- b) "occupant" includes a person residing on or in land or buildings, the person entitled to its or their possession if there is no person residing on or in the land or buildings and a leaseholder;
- c) "owner" means a person who has any right, title, estate or interest in land other than that of a mere occupant, tenant or mortgagee and includes the person named as owner in the assessment records of the Village;
- "premises" includes any building, lot, or parcel of land.
- (1) Every occupant, or owner of any premises that lies within the boundaries of the Village of Abbey shall clearly remove and clear away all snow, ice, dirt, and other obstructions from the sidewalks adjoining the premises owned or occupied by them;
- (2) The occupants or owners of the premises described in subsection (1) of this section shall remove all accumulations of snowfall within forty-eight 48) hours after the fall thereof has ceased
No person shall permit any part of any vehicle or other obstruction to project onto any sidewalk or otherwise restrict the free use of any sidewalk by pedestrians.
Every, occupant, or owner of any premises that lies within the boundaries of the Village of Abbey shall mow and maintain the boulevard adjoining the premises owned or occupied by them, by keeping any grass, weeds on the boulevard cut to a reasonable length and removing any accumulation of fallen leaves or other debris
- (1) Where the owner or occupant of any premises fails to clear the sidewalks or mow the boulevard as provided for in the Bylaw, the Village Operator shall clear the sidewalks, or mow the boulevard and the expenses of such clearing or mowing shall be charged to the owner or occupant of such premises;
- (2) Where the owner or occupant fails to pay the expenses of the removal of snow, ice, dirt or mowing or other obstructions as provided for in subsection (1) of this section, the expenses of such removal shall be added to, and thereby form part of the taxes on the land with respect to which the work is done and the Village may recover the expenses of doing so with costs in the same manner
- No notice shall be given by the Village prior to the clearing of sidewalks as provided for in subsection (1) of this section.
## Fees:
- (1) Snow Removal - $1.00 per frontage and/or flankage foot
- (2) Other Obstructions - Custom Work Rates for applicable equipment
- (3) Mowing - $1.00 per frontage or flankage foot of boulevard

Bylaw 2010-1 is hereby repealed.
This Bylaw comes into force and effect upon the passage thereof.
