## SNOW REMOVAL ## VILLAGE OF ANNAHEIM BYLAW NO. 1, 2023 ## A BYLAW TO CONTROL THE REMOVAL OF SNOW FROM PRIVATE PROPERTY The Council of the Village of Annaheim in the Province of Saskatchewan enacts as follows: ## 1. SHORT TITLE This bylaw shall be known and may be cited as the Snow Removal Bylaw. ## 2. PURPOSE The purpose of this Bylaw is to regulate the removal and/or placement of snow on private property and to prohibit the placement of such snow on roadways, public drainage ditches and public property. ## 3. DEFINITIONS - b) "Council" shall mean the council of the municipality; and - a) "Administrator" shall mean the administrator of the municipality; - c) "Municipality" shall mean the Village of Annaheim; - e) "Debris" shall mean loose dirt, mud, or organic mater likely to interfere with pedestrian traffic; - d) "Adjourning Property" shall means a parcel of land next to another property; - f) "Occupant" means an occupant as defined in the Municipalities Act; - h) "Roadway" shall mean that part of a street adapted to the use of or ordinarily used by vehicles; - g) "Public Place" shall mean all or any part of a street as defined by the Municipalities Act, a park, a municipal reserve, environmental reserve, buffer strip, drainage ditch or other property of the Village of Annaheim; - i) "Approved property" shall mean property for which there is a written agreement for access between the contractor performing snow removal services and the property owner requesting those services. ## 4. REGULATIONS - a) No person shall push, blade, shovel, blow, place or deposit snow that has accumulated onto any street or public place. - b) No person shall push, blade, shovel, blow, place or deposit accumulated snow onto private property other than their own. - c) The owner or occupier of property shall ensure that when clearing or removing snow or ice or other loose debris, that he or she shall refrain from causing injury or unduly interfering with any person lawfully using the street or public place and shall refrain from causing damage to the streets or public places. - d) The owner or occupier of property shall ensure that snow disposal be undertaken in such a manner that it does not create a hazard or interfere with the use of streets or public places. - e) Subcontractors performing any type of snow removal service(s) shall be responsible for depositing snow on approved property; must also comply with the policies, procedures and Bylaws of the Village of Annaheim. - f) Residential property owners and sub-contractors performing snow removal services(s) must ensure that deposited snow piles do not exceed the heights of signage, impede or obscure visibility on corners, intersections or otherwise. <!-- image --> ## 5. ENFORCEMENT - a) In the event that the Bylaw is Contravened, The Village may, by written order require the owner or occupant to remove the snow or ice or other accumulation from the street or public place. Failing to do so the Village may take whatever action or measures are necessary to remedy a contravention of the Bylaw, including removal of accumulation. - b) A person who contravenes the provisions of the Bylaw is guilty of an offence and upon conviction shall be liable to the penalty provided by the General Penalty Bylaw of the Municipality of the Village of Annaheim. - c) In addition to any fines, the cost of removing snow from the public place or street will be added to the property taxes of the individual. 6.
