TOWN OF BIGGAR, SASKATCHEWAN BYLAW NO. 18-806 A BYLAW FOR THE PURPOSE OF REGULATING AND CONTROLLING SMOKING IN AND AROUND TOWN VEHICLES, BUILDINGS AND PROPERTY THE COUNCIL of the Town of Biggar, in the Province of Saskatchewan, enacts as follows: SHORT TITLE 1. This bylaw may be cited as The Smoking Bylaw. DEFINITIONS 2. In this Bylaw: a) "Town" shall mean the Town of Biggar b) "electronic cigarette" means a handheld device containing a liquid that is vaporized and inhaled, and includes but is not limited to electronic cigarettes, e- cigarettes, vaporizer cigarettes, personal vaporizers and electronic nicotine delivery systems. c) "Smoke or Smoking" shall mean and include the carrying of a lighted cigar, cigarette, pipe, or any other lighted tobacco-smoking equipment. d) "tobacco" means tobacco in any form in which it is used or consumed, and includes snuff and raw leaf tobacco, but does not include any food, drug or device that contains nicotine. e) "vape or vaping" means the utilization of an electronic cigarette or any other heated smoking equipment used to vaporize any tobacco or non-tobacco substance whether or not it contains nicotine. f) "Park" includes all lands used for picnic grounds, campgrounds, playgrounds, playing fields, or any other public open space, including walking trails, swimming pool, Spray Park, and any other public use area within the control and jurisdiction of the Town. SCOPE 3. No person shall hold lighted tobacco, smoke, or vape within 10 metres of any exit or entrance door in and around Town buildings or Town vehicles, or on any Town owned park or property. 4. The Town Chief Administrative Officer, Bylaw Enforcement Officer, Recreation Director or Town Foreman are hereby authorized to post a sign(s) in Schedule "A" attached to and forming part of this Bylaw, in and around the Town Buildings, Town Vehicles, Town Parks, or Town Property as deemed appropriate to inform members of the public and staff of any provisions of this Bylaw. 5. Any person who contravenes any provisions of this Bylaw is guilty of an offence and liable to a penalty of One Hundred Dollars ($100.00) 6. Where a person has committed or is alleged to have committed a breach of any provisions of this Bylaw, a ticket in Schedule "B" attached to and forming part of this Bylaw may be served on such a person by the Bylaw Enforcement Officer, Chief Administrative Officer or Recreation Director. If payment is received within ten (10) calendar days of the issue date, the Town will reduce the required payment to a sum of Twenty-Five Dollars ($25.00). if payment is received or postmarked within ten (10) calendar days from the date of issuance of the ticket, and accepted by the Town, then the person shall not be liable for further court action. REPEAL BYLAW 7. Bylaw No. 96-568 passed January 16, 1996 is hereby repealed. COMING INTO FORCE 8. This bylaw shall come into force and take effect on the date of final passing thereof.
