BYLAW NO. 374
A BYLAW OF THE TOWN OF BREDENBURY
TREES AND HEDGES
The Council of the Town of Bredenbury, in the Province of Saskatchewan, enacts as
follows:
1. This bylaw shall be referred to as the TREES AND HEDGES BYLAW
2. DEFINITIONS:
a. Resident - A resident of Town of Bredenbury
b. Municipality - Town of Bredenbury
c. Tree - a woody perennial plant, typically having a single stem or trunk
growing to a considerable height and bearing lateral branches at some
distance from the ground.
d. Hedge -a fence or boundary formed by closely growing bushes or shrubs.
e. Leaves -a flattened structure of a higher plant, typically green and
bladelike, that is attached to a stem directly or via a stalk. Leaves are the
main organs of photosynthesis and transpiration.
f. Pinecones and Pine needles -the conical or rounded woody fruit of a pine
tree, with scales that open to release the seeds.
g. Neighbour - resident that resides on either side of your property
h. Roots - the part of a plant that attaches it to the ground or to a support,
typically underground, conveying water and nourishment to the rest of the
plant via numerous branches and fibers.
3. No resident may trim or cut down a tree that is on municipal property
4. A resident may trim a tree or hedge that is a municipality tree or hedge that is
overhanging onto resident's property with permission of municipality.
5. A resident may trim a tree branch or roots of a tree that is overhanging on their
property as long as doing so does not cause the tree to die; and as long as you
do not trespass on neighbours property.
a. All costs would be payable by the resident that cut them unless a prior
arrangement is made with owner of the tree.
b. Permission from neighbour is recommended when applicable; however not
required if there is an estranged relationship.
6. Any leaves, pine needles, pine cones that falls from a neighbours tree onto your
property is not the owner of the trees responsibility; as the neighbour cannot
come onto your property to remove them. This is not considered a danger or
impediment to property.
a. You may speak with neighbour about removal of the tree but the owner of
tree would have to agree.
7. When the tree or hedge is right on property line and there is no distinction on
who owns the said tree or hedge, then both residents are considered owners of
the tree.
