## TOWN OF BROADVIEW BYLAW #96-04 ## A BYLAN OF THE TOWN OF BROADVIEW TO REGULATE THE OPERATION OF VEHICLES The Council of the Town of Broadview, in the Province of Saşkatchewan, enacts as follows: 1. INTERPRETATION 2. (a) "Administrator" means the Town Administrator of the Town of Broadview; 3. (b) "angle parking" means the parking of vehicles with the right front wheel drawn up to the curb on the right-hand side of the highway, or at a distance of not more than thirty (30) centimetres from such curb, the vehicle to be placed at an angle of forty-five (45) degrees with the curb; 4. (c) "coasting device" means any coaster, roller skates, skateboard, sled, skis, toy vehicle or similar device; 5. (d) "curb" means the lateral boundaries of a roadway, whether or not marked by curbing; 6. (e) "heavy vehicle" means a motor vehicle with or without load which alone or together with any trailer, semi-trailer or other vehicle being towed, weighs 4.5 tonnes or more; 7. (f) "highway" means any street or public highway within the Town of Broadview, but does not include a provincial highway therein as designated pursuant to the provisions of The Highway Act; 8. , (g) "lug vehicle" means any truck, portable engine or traction engine having metal spikes, lugs or cleats projecting from the face of the wheels or tires thereof, or having metal track tread; 9. (h) "parallel parking" means the parking of a vehicle with both right wheels thereof drawn up to the curb on the right-hand side of the highway, or at a distance of not more than thirty (30) centimetres from such curb; 10. (i) "park" and "parking" have the meanings ascribed thereto by The Vehicles Act; 11. (j) "place of public assembly" means schools, theatres, moving picture theatres, churches, skating and curling rinks, dance halls and public assembly halls; 12. (k) "power turn" means to manoeuvre a vehicle in such manner to cause the rear of the vehicle to depart from its ordinary line of progress by the sudden use of acceleration and/or braking; - (1) "speed zone" means any portion of a highway within the Town of Broadview, as designated herein and identified by a sign erected and maintained at each end thereof, indicating the maximum speed applicable thereto; 14. (m) "U-Turn" means the turning of a vehicle so as to cause it to proceed in the opposite direction from which ti was proceeding immediately prior to the commencement of such turn; 15. (n) "vehicle"means a vehicle or motor vehicle as ascribed to it by The Vehicles Act; and - (0) "loading zone" means that portion of a public highway adjacent to the curb designated by signs and/or markings for the exclusive use of vehicles loading and unloading passengers or goods. 17. (p) "public improvement" means a public improvement as ascribed to it by The Highways Act. Amendment n0. 2012-04 ## 2 SCOPE ## TOWN OF BROADVIEW BYLAW #96-04 - (a) "STOP" STREETS The highways as listed in Appendix 1 are designated as "Stop" streets. - (b) "YIELD" STREETS The highways as listed in Appendix 2 are designated as "Yield" streets. - (c) "NO U-TURN" INTERSECTIONS The intersections of the highways, approached from all four (1) directions, as listed in Appendix 3, are designated as "No U-Turn" intersections. - (d) "LOADING ZONES" The highway locations as listed in Appendix 11 are designated as "Loading Zones". ## 3. INFRACTIONS - (a) "STOP" STREETS The provisions of The Vehicles Act shall apply to all traffic approaching and facing a "Stop" sign erected and maintained in accordance with the provisions of Section 4(a) of this bylaw. - (b) The provisions of The Vehicles Act shall apply to all traffic approaching and facing a "Yield" sign erected and maintained in accordance with the provisions of Section 4(b) of this bylaw. - (c) MISCELLANEOUS SIGNS - (1) No person shall, except where authorized by resolution of Council or when duly authorized by law, erect upon or immediately adjacent to any highway, any sign, marker, signal or light or any advertising sign or device. - (2) No person shall deface, damage, destroy or remove any sign or marker erected pursuant to this bylaw. - (d) LUG VEHICLES - (1) No person shall propel, operate or drive any lug vehicle upon any highway within the Town of Broadview without first having obtained of the Administrator a permit in writing authorizing same. - (2) The Administrator is hereby authorized to issue permits in writing for the purpose of Section 3(d) (1) of this bylaw in any case where the applicant therefor has signed a written undertaking in Form 1, Appendix 5, provided that the Administrator shall not issue any such permit unless he is satisfied that with reasonable care in operation the lug vehicle may be propelled or driven over any highway without damage resulting thereto or to any bridge or culvert thereon. - (3) Nothing contained in Section 3(d) (1) shall be deemed to preclude the transport of a lug vehicle as herein defined over any highway where same is being carried by means of a rubber-tired trailer or other conveyance equipped with rubber tires. ## PARKING ## TOWN OF BROADVIEW BYLAW #96-04 - (1) Except as otherwise provided herein, the parking of vehicles is permitted on all highways within the Town of Broadview. - (2) (a) Subject to the provisions of subsection (b), no person shall park a vehicle in any lane, nor in any street so as to obstruct the entrance to any lane or to a driveway or approach leading to private premises. 3. (b) Notwithstanding the provisions of subsection (a), a farm truck or commercial vehicle may be parked in any lane for the purpose of taking on or discharging cargo, provided no such truck or vehicle shall be so parked for a period exceeding thirty (30) minutes at one time, unless written permission has first been obtained from the Administrator or a Police Officer of the Town of Broadview for an extension of such time limit. - (3) Every person parking a vehicle upon a highway within the Town of Broadview where parking is permitted, shall parallel park same. - (4) No person shall park a vehicle in any "No Parking" area as designated in Appendix 6 at any time whether such areas are marked on the curb or by signs erected and maintained in accordance with the provisions of Section 4(d) of this - (5) No person shall park a vehicle within five (5) metres of any street intersection or fire hydrant. - (6) No person shall park any vehicle in any private parking place or on any private property unless he is the owner, occupant, licensee or permittee of the parking place or private property, except with the consent of such owner, occupant, licensee or permittee. - (7) (a) Subject to subsection (b), no person shall park a vehicle on any highway at one place for any period of time exceeding twenty-four (24) consecutive hours. 9. (b) No person shall park a vehicle on the following highways at one place for any period of time exceeding two (2) consecutive hours 10. ii) along 6th Avenue, between Vernon Street and Calgary Street, excepting that portion paved behind the curbing in the vicinity of the RCMP barracks, - i) along 5th Avenue, between Vernon Street and Front Street; and - (8) (a) Subject to subsection (b), no person shall park any commercial vehicle designed for carrying or intended for the carrying of oil, gasoline or other inflammable, combustible or explosive material, within thirty (30) metres from any building in the Town of Broadview used or intended for use, in whole or in part, as a place of dwelling, a hotel or a place of public assembly; 13. (b) Nothing in subsection (a) shall be deemed to restrict the parking of any such vehicle for such period of time as may be necessary to take on or discharge cargo. - (9) No person shall park a truck with a manufacturer's rated capacity in excess of 5,500 kilograms on any highways designated in Appendix 7. - (10) No person shall park a vehicle: 16. (b) on any public highway, lane, or private driveway and leave the vehicle with the keys in the ignition. 17. (a) on any public highway with the engine running unless the vehicle remains in the charge of and under the control of the driver; or - (11) No person shall park a vehicle on a public highway within a School Zone identified within Appendix 4 for a period of more than 15 minutes at any time between 8:30 am and 4:00 pm on a school day. ## TOWN OF BROADVIEW BYLAW #96-04 - (. POWER TURNS The operator of a vehicle shall not execute "power turns" on any highway in the Town of Broadview. ## (g) - Under the proxisions of Section 21 of The Snowmobile Act, RSS, 1978, and subject to Section 3(g) (2) of this bylaw, it shall be lawful to operate a snowmobile between the hours of 8:00 a.m. and 9:00 p.m. on any public highway within the limits of the Town of Broadview, except the following: - (b) Main Street, from 4th Avenue to 8th Avenue; and - (a) Provincial Highway No. 1; - (c) 6th Avenue, from Front Street to Edmonton Street. - (2) Notwithstanding Section 3(g) (1) of this bylaw, it shall be lawful to operate a snowmobile on the portion of Provincial Highway No. 1 for the purpose of crossing said highway. ## (h) SPEED - (1) Subject to Subsection (2), no person shall operate a vehicle in the Town of Broadview at a speed greater than forty (40) kilometres per hour, excepting along the route of any provincial highway. - (2) No person shall operate a vehicle at a speed greater than thirty (30) kilometres per hour in the speed zones as set out in Appendix 8. - (3) The provisions of subsection (1) and (2) shall not apply to the operators of fire engines or fire department apparatus or to the operators of ambulances where these vehicles are being operated in emergency duty and employing the siren and flashing red lights. ## U-TURNS - No person shall cause a vehicle to make a U-Turn at the intersection of a street with a lane or an alley in the Town of Broadview. - (2) No person shall cause a vehicle to make a U-Turn at the intersections designated as "No U-Turn" intersections in Appendix 3. This shall apply to all traffic approaching and facing a "No U-Turn" sign erected and maintained in accordance with the provisions of Section 4(c) of this bylaw. ## (j) WEIGHT RESTRICTIONS - TRUCK ROUTES - (1) No person shall operate any vehicle weighing with or without its load more than 12,000 kilograms on or over any public highway in the Town of Broadview, subject to subsections (2) and (3). - (2) No person shall operate any vehicle weighing with or without its load more than 35 tonnes on the public highways designated as "Truck Routes" as listed in Appendix 9. - (3) (a) No person shall operate any vehicle weighing more than 6.5 kilograms per millimetre width of tire (350 pounds per inch) during that period of time Saskatchewan Highways is implementing its Road Weight Restrictions. 4. (b) Notwithstanding subsection (a), where a person desires to operate upon a public highway a motor vehicle having a weight in excess of that specified within subsection (a), he shall obtain from the Administrator a permit to do so. 5. (c) The Administrator shall, before issuing a permit under authority of subsection (b), obtain the approval of member or members of Council having responsibility for Public Works 6. (d) The person who has obtained a permit under this section shall, unless he has entered into a written agreement with the Town of Broadview to the contrary, be responsible for any damage that may be caused to a public building or public improvement, or to any person or property by reason of the driving, operating, or moving of said vehicle. - (4) The provisions of The Police Act and The Highways Act shall apply to the operators of vehicles referred to in subsection (1). ## (k) VEHICLES ON PUBLIC RESERVES, ETC - (1) No person may operate or park a vehicle on any area designated in Appendix 10 - (2) The provision of subsection (1) shall not apply to maintenance vehicles or vehicles using a designated parking area. ## (1) BICYCLES - (1) No person shall operate a bicycle without having at least one hand on the handle bar. - (2) (a) No person shall operate a bicycle on a sidewalk. 3. (b) Bicycles shall be operated on the right hand side of the street. - (3) No person or persons shall be carried upon the handlebars or any other part of the vehicle in front of the operator. - (4) No person shall leave a bicycle in a reclining position on any street or sidewalk. - (5) Every rider of a bicycle shall have attached to the said bicycle a white light or reflector when being operated at night, said light or reflector shall face to the front and a red light or reflector which shall be attached to the bicycle behind the operator and shall face to the rear. - (6) (a) Subject to subsection (b), no more than two (2) bicycles may be operated each beside the other on any highway in the Town of Broadview. - (7) No person shall ride upon a bicycle being towed by another bicycle or other type of vehicle. 9. (b) Notwithstanding subsection (a), bicycles must be operated in single file when being approached by a moving motor vehicle either from the front or from the rear. ## COASTING DEVICES - (1) No person shall operate a coasting device after sunset or before sunrise. - (2) (a) No person shall operate a coasting device on a sidewalk. 3. (b) Coasting devices shall be operated on the right hand side of the street. - (3) (a) Subject to subsection (b), no more than two (2) coasting devices may be operated each beside the other on any highway in the Town of Broadview. 5. (b) Notwithstanding subsection (a), coasting devices must be operated in single file when being approached by a moving motor vehicle either from the front or from the rear. - (4) No person shall ride upon any coasting device being towed by a bicycle or other type of vehicle. - (5) Persons riding upon any coasting device must be in a standing position. For the purposes of this section, coasting devices shall not include wagons. ## (n) LOADING ZONES - (1) No operator of a motor vehicle shall remain in a loading zone for a period exceeding two (2) minutes for the purpose of embarking or disembarking passengers, provided that on the expiration of the two minute period, the onus of proving the loading or unloading of goods shall rest with the driver of any vehicle found in such loading zone. - (2) No operator of a vehicle shall remain in a loading zone for a period exceeding ten (10) minutes for the purpose of loading or unloading goods. 3. (o) SPLASHING OF PEDESTRIANS when water, mud or slush is lying on any public highway, the driver of any motor vehicle shall reduce the speed of his motor vehicle to avoid splashing pedestrians using a sidewalk or normal area for walking. ## (p) PROTECTION OF FIRE APPARATUS - (1) No vehicle shall drive over any fire hose or any other fire apparatus. - (2) No vehicle shall be parked within one hundred fifty (150) metres of where any fire has occurred, after the arrival and before the departure of the fire fighting apparatus. ## (r) LITTERING - (1) No person shall throw or place or cause to be thrown or placed on any public highway, lane, sidewalk, public or private property any litter. - (2) For the purpose of this section, "litter" shall mean any glass or plastic bottle, box, paper, refuse, or garbage. ## SIGNS - (a) The Council of the Town of Broadview shall cause to be erected and maintained at all stop streets listed in Appendix 1, at a distance of approximately three (3) metres from the point of intersection, an appropriate sign containing the word "STOP", so placed to face traffic approaching the intersection. - (b) The Council of the Town of Broadview shall cause to be erected and maintained at all yield streets listed in Appendix 2, at a distance of approximately three (3) metres from the point of intersection, an appropriate sign containing the word "YIELD", so placed to face traffic approaching the intersection. ## TOWN OF BROADVIEW BYLAW #96-04 - (c) The Council of the Town of Broadview shall cause to be erected and maintained at all "No U-Turn" intersections, as listed in Appendix 3, at a distance of approximately three (3) metres from the point of intersection, an appropriate sign prohibiting U-Turns, so placed to face traffic approaching the intersection. - (d) The Council of the Town of Broadview shall cause to be erected and maintained at all "No Parking" areas, as listed in Appendix 7, appropriate signs and/or curb markings. Such signs or curb markings shall be visible from that part of the highway to which the restriction applies. - (e) The Council of the Town of Broadview shall cause to be erected and maintained at all "Loading Zones" as listed in Appendix 11, appropriate signs and/or curb markings. Such signs or curb markings shall be visible from that part of the highway to which the restriction applies. - (f) The Council of the Town of Broadview may by resolution provide for the erection and maintenance on any highway, and at any designated point or points thereon, of such signs as it may deem expedient for warning, guidance, directions or information ## 5. HEDGES AND TREES The Council of the Town of Broadview may, either on its own initiative, or upon the report of a Police Officer, that a hedge, shrub, or tree situated on a street corner is dangerous to traffic, by resolution order that such hedge, shrub or tree be removed or Topped to such height as it may direct. ## 6. TEMPORARY CLOSING - (a) Any portion of a public highway may be temporarily closed to vehicular traffic by the Council of the Town of Broadview in order that pedestrians may have the exclusive use thereof. - (b) Notwithstanding any other provisions of this bylaw, a Police Officer shall have authority to temporarily prevent parking public highway or portion thereof whenever, in his judgment, it may be necessary in order to avoid traffic congestion, danger, or accident. - (c) Notwithstanding any other provisions of this bylaw, the person appointed by Council to the position of Town Foreman shall have the authority to temporarily prevent parking and/or prohibit traffic on any public highway or portion thereof, excluding Provincial Highway No. 1, to allow any work to be carried out on behalf of the Town of Broadview, such works to include but not restricted to snow removal, cleaning, repairing or maintaining of such public highway. - (d) No person driving a vehicle shall drive through or enter upon any street or portion thereof which is roped, barricaded or indicated by notice or sign as being closed under the authority of subsections (a), (b), or (c). - (e) No person shall park a vehicle on any public highway or portion thereof on which parking has been temporarily prohibited under the authority of subsections (a), (b), or (c). ## 1. PENALTIES - (a) Subject to any other provisions in this bylaw, or to any provincial statute, any person who contravenes any of the provisions of this bylaw is guilty of an offence and liable on summary conviction to the penalties provided in the General Penalty Bylaw for the Town of Broadview. - (b) (1) Notwithstanding the provisions of section (a), any person who contravenes any of the provisions of the subsections, as listed in Appendix 12, or fails to comply therewith or with any notice or order given thereunder shall be guilty of an offence and upon summary conviction, shall be liable to penalties as listed in said Appendix 12. - (2) A violator of the sections of this bylaw, as set out in subsection (1) upon being served with a Notice of Violation, may, during regular office hours, voluntarily pay the penalty at the Broadview Town Administration office, and upon payment as so provided, that person shall not be liable to prosecution of the offence. - (3) The Notice of Violation shall be in Form "2", Appendix 13. - (c) (1) A person who contravenes the provision of subsection 3(j) (3) is guilty of an offence and liable on summary conviction to a penalty as specified in the General Penalty Bylaw for the Town of Broadview. - (2) A further penalty shall be imposed as follows: - three ($3.00) dollars for each 50 kilograms or fraction thereof for the first 1,000 kilograms in excess of the prescribed maximum gross weight allowable; and - (b) five ($5.00) dollars for each 50 kilograms or fraction thereof in excess of 1,000 kilograms that the actual gross weight exceeds the prescribed gross weight allowable, provided that in computing the further penalty, 500 kilograms or two (2%) per cent of the maximum gross weight fixed by this bylaw, whichever is the lesser, shall not be taken into account. - (3) In each instance, the total fine shall not exceed the maximum provided for in the General Penalty Bylaw of the Town of Broadview. - (d) The penalty for the contravention of subsections 3(1) (1) to 3(m) (5) is as follows: - for the second infraction in any one calendar year, impounding the coasting device or bicycle for a minimum period of seven (7) days, to be released after payment of a fine in the amount of Twenty-Five ($25.00) Dollars; and - for the first infraction, impounding the coasting device or bicycle for one (1) day; - for the third and subsequent infraction in any one calendar year, impounding the coasting device or bicycle for a minimum period of twenty-eight (28) days, to be released after payment of a fine in the amount of Fifty ($50.00) Dollars. b) ## TOWN OF BROADVIEW ## BYLAW #96-04 - a) Any member of the police force, special constable or other person appointed by the Council of the Town of Broadview may remove or cause to be removed any vehicle that is unlawfully placed, left or kept upon any street or lane, public parking place, or other public place, or on municipally owned property, and to impound or store such vehicle. ## IMPOUNDING - b) Any member of the police force, special constable or other person appointed by the Council of the Town of Broadview may remove or cause to be removed any bicycle or coasting device that is unlawfully placed, left or operated on any street or lane, or other public place, or on municipally owned property, and to impound such bicycle or coasting device. - c) Where such a vehicle has been impounded or stored after it has been removed under subsection (a), it may be retained at a place designated by the Council of the Town of Broadview for a period of thirty (30) days from date of removal unless the cost of removal, impounding and storage are sooner paid. Upon payment of the full costs herein, the vehicle may be released to the owner thereof. - d) If the costs of removal, impounding and storage are not paid within the period of thirty (30) days as specified in subsection (c), the Town of Broadview shall have the right to recover same from the owner of the vehicle by: - (2) sale by public auction on publication of a notice designating the time and place of sale at least ten (10) days prior to the sale in a newspaper circulation in the Town of Broadview and on sending such notice by registered mail to the owner at the address appearing at the last registration of the vehicle. - (1) legal action in a court of competent jurisdiction; or ## GENERAL Appendices 1 - 13 are appended hereto and form a part of this bylaw.
