Consolidated Operation of Vehicles & Parking
Bylaw
2023-012
1.
INTRODUCTION
The Council of the Town of Churchbridge, in the Province of Saskatchewan, enacts as follows:

DEFINITIONS
2.1
ACT
The Traffic Safety Act
2.2
ALLEY
Means the street intended primarily to give access to the rear of the property.
2.3
ANGLE PARKING
Means the parking of vehicles with the right front wheel drawn up to the curb on the right hand side of the
highway, or at a distance of not much more than thirty (30) centimeters from such curb, the vehicle to be placed
at an angle of (45) forty -five degrees with the curb.
2.4
ADMINISTRATOR
Means the administrator for the Town of Churchbridge.
2.5
BICYCLE
Means a vehicle for the carriage of persons, which is propelled by human power, having two tandem wheels,
and including any device adapted from a bicycle by the addition of one or more wheels.
2.6
COUNCIL
Means the Council of the Town of Churchbridge.
2.7
CURB
Means the dividing line of the street between that part of the street intended for use of vehicles and
that intended for pedestrians whether marked with a curbstone or not;
2.8
DISABLED PARKING AREA
Means all that portion of any street or public place or shopping center parking lot that has been designated by
sign or other marking for the exclusive parking of disabled persons vehicles.
2.9
DISABLED PERSONS VEHICLE
Means any vehicle which displays a special license plate or placard depicting thereon the symbol of the disabled
issued by the Province of Saskatchewan or other competent governmental jurisdiction;
2.10 FIRE LANE
Means that area designated by signs or markings as a fire lane;
2.11 HIGHWAY
Means a road, parkway, driveway, square, square or place designated and intended for or used by the general
public for the passage of vehicles, but does not include any area, whether privately or publicly owned, that is
primarily intended to be used for the parking of vehicles and the necessary passageways on that area;
2.12 HEAVY VEHICLE
Means a motor vehicle with or without load which alone or together with any trailer, semi-trailer or other
vehicle being towed, weighs 4.5 tonnes or more.
2.13 LUG VEHICLE
Means any vehicle with a portable engine or tractor engine having metal spikes, lugs or cleats projecting from
the face of the wheel or tires thereof, or having a metal track head.
2.14 MARKING
Means any pavement marking installed on the street for guidance, regulation, warning, direction or prohibition
of traffic,
2.15 MUNICIPALITY
Means the Town of Churchbridge.
2.16 PARADE
Means any procession or body of pedestrians, except members of the Armed Forces, numbering more
than 25 who are standing, marching or walking on any street or sidewalk and means any organized
procession of vehicles numbering 10 or more, except funeral processions, standing or moving on any
street;
2.17 PARALLEL PARKING
Means parking of a vehicle with both right wheels thereof drawn up to the curb on the right-hand side of the
highway, or at a distance of not more than thirty (300 centimeters from the curb;
2.18 PARKING STALL
Means a portion of public highway or an area indicated by signs and/or markings and /or physical barrier as a
parking space for one vehicle only;
2.19 PARK, PARKING
Has the meaning ascribed thereto by The Traffic Safety Act;
2.20 PEDESTRIAN
Means any person afoot and shall include baby stroller's or a disabled person's chair.
2.21 PEDESTRIAN CROSS-WALK
Means that portion of a public highway designated by signs and/or markings for the use of pedestrians to cross a
public highway as where there are no signs or marking's shall mean that portion of a public highway within the
prolongation of lateral boundary;
2.22 PERSON
Includes any man, woman, child, partnership, aggregation of individuals;
2.23 PLAYGROUND SPEED ZONE
Means that portion of a street designated by a sign or signs for the control of traffic adjacent to or in close
proximity to a playground.
2.24 POLICE OFFICER OR CONSTABLE
Shall mean a member of the Royal Canadian Mounted Police responsible for the policing of the Town of
Churchbridge or any person specifically appointed by the Town of Churchbridge to be a Police Officer or
Constable;
2.25 POWER TURN
Means to maneuver a vehicle in such a manner to cause part of the vehicle to depart from its ordinary line of
progress by sudden use of acceleration and/or braking;
2.26 PRIVATE DRIVEWAY
Means every road or driveway which is not open to be used by members of the public at large for passage of
vehicles or traffic and includes every road or driveway on private property;
2.27 PROPERTY LINE
Means the line marking the boundary between lots or blocks according to a registered plan of survey and means
the line marking the boundary between any other lots or blocks or other real property howsoever described;
2.28 PLACE OF PUBLIC ASSEMBLY
Means schools, theatres, churches, hockey, skating and curling rinks, community centers.
2.29 SCHOOL SPEED ZONE
Means that portion of a street designated by a sign or signs for the control of traffic adjacent to or in the close
proximity to a school.
2.30 SCHOOL CROSSWALK
Means that portion of a public highway designated by signs and/or markings for the use of pedestrians to cross a
public highway;
2.31 SIDEWALK
Means that portion of the right-of-way designed and intended for or used primarily by pedestrians;
2.32 SIDEWALK CROSSING
Means that portion of a sidewalk permanently improved or designed for the passage of vehicular traffic;
2.33 SPEED ZONE
Means any portion of a highway within the Town of Churchbridge as designated herein, and indentified by a sign
erected and maintained at each end thereof, indicating the maximum speed applicable thereto;
2.34 STREET
Means a road , alley or other place designated and intended for or used by the general public for the passage of
vehicles and pedestrians, but does include a parking lot, whether privately owned or publicly owned;
2.35 TOWN
Means the Town of Churchbridge.
2.36 TOWN OFFICIAL
Includes the Town Administrator, Town Foreman or Public Works Manager, Fire Chief, Police Chief, Elected
Officials and includes the person or persons employed by the Town or designated by the Council to carry out the
duties of the aforementioned persons in their absence;
2.37 TRAFFIC
Means the movement of pedestrians, vehicles and all other conveyances upon any street, alley or sidewalk.
2.38 TRAFFIC SIGN
Means any sign or marking and installed for the guidance, regulation, warning, direction or prohibition of traffic.
2.39 U TURN
Means the turning of a vehicle so as to cause it to proceed in the opposite direction from which it was
proceeding immediately prior to the commencement of such turn.
2.40 VEHICLE
Means a device in, on or by which a person or thing is or may be transported or drawn on a highway and
includes special mobile machines, farm implements and towed mobile equipment but does not include vehicles
running only on rails or solely on railway company property;
NOTE
Except where inconsistent with this bylaw, the words used in the bylaw shall have the same meaning as in The
Traffic Safety Act.
3.
AUTHORITY OF THE POLICE
1. A Police Officer is hereby authorized to direct traffic in conformity with the provisions of this bylaw and The
Traffic Safety Act.
2. In the case of fire or other emergency or in order to expedite traffic or safeguard pedestrians or prevent
accidents or meet any unforeseen conditions, a Police Officer is hereby authorized to direct traffic in such
manner as he may deem necessary whether or not in conformity with the provisions of this Bylaw or The Traffic
Safety Act.
3. Every person shall comply with any traffic signal or direction of a Police Officer given pursuant to this section.
4. No person shall direct traffic or attempt to direct traffic unless authorized to do so by a Police Officer or Town
Official except in the event of emergency requiring the direction of traffic.
5. Any portion of a street may be temporally closed to vehicular traffic by a Police Officer in order that pedestrians
may have exclusive use thereof.
6. Any Police Officer or Town Official shall have the authority to temporarily prevent parking on any street or
portion thereof when, in his judgement, it may be necessary in order to prevent traffic congestion, danger, or
accident.
7. Notwithstanding any other provisions of this bylaw, any Police Officer or Town Official shall have the authority
to prevent parking and to prohibit traffic on any street or portion thereof to allow any work to be carried out by
or on behalf of the town and to erect or cause to be erected traffic signs indicating the exercise of such
authority.
4.
STOP AND YIELD STREETS AND NO U-TURN INTERSECTIONS
4.1
STOP STREETS
The streets and avenues as listed in Schedule 1 are designated as 'STOP STREETS".
4.2
YIELD STREETS
The streets and avenues as listed in Schedule 2 are designated as "YIELD STREETS"
4.3
NO U-TURN INTERSECTION
The intersections of streets and avenues approached from all four (4) directions, or three (3) directions as listed
in Schedule 3 are designated as "NO U-TURN" intersections.
4.4
"STOP" STREETS
The provisions of The Traffic Safety Act shall apply to all traffic approaching and facing a "stop" sign on
all streets set out in Schedule 1 attached hereto and forming part of this Bylaw are established as stop
streets and the erection of stop signs for the said streets is hereby authorized.
4.5
"YIELD" STREETS
The provisions of The Traffic Safety Act shall apply to all traffic approaching and facing a "yield" sign on
all streets set out in Schedule 2 attached hereto and forming part of this Bylaw are established as yield
streets and the erection of yield signs for the said streets is hereby authorized.
5.
SIGNS
1. Council shall cause to be erected and maintained at all stop streets listed in Schedule 1 at the distance of
approximately three (3) metres from the point of the intersection an appropriate sign containing the word
"stop", so placed to face traffic approaching the intersection.
2. Council shall cause to be erected and maintained at all yield streets listed in Schedule 2, at a distance of
approximately three (3) meters from point of intersection an appropriate "Yield" sign, so placed to face the
traffic approaching the intersection.
3. Council shall cause to be erected and maintained at all intersections listed in Schedule 3 appropriate signs
prohibiting U-Turns, so placed to face the traffic approaching the intersections.
4. Council shall cause to be erected and maintained appropriate signs or curb markings to indicate "No Parking"
areas, and "Restricted Parking" areas as listed in Schedule 4 .Such signs or curb markings shall be visible from
that part of the highway, or area to which the restriction applies.
5. Council may by resolution provide for the erection and maintenance on any highway and at any designated
point or points thereon, of such signs as it may deem expedient for warning, guidance, direction or information
thereon.
6. Council may by resolution provide for the erection and maintenance of a sign: Prohibit Use of Engine Retarder
Brakes erected on Highway #16 - Whereas from the beginning and ending where the speed is limited by 60
kilometres, signs for "the use of engine retarder brakes shall be prohibited."
7. In the event of an emergency, any police officer or town official may erect or authorize the erection of such
traffic signs as he deems necessary or advisable for the direction or control of traffic.
8. The town administrator or any police officer may authorize the placing of signs prohibiting parking in the vicinity
of any funeral home or church when a funeral is taking place or is about to take place.
9. No person shall willfully deface, injure, knock down, remove, obscure, or interfere in any way with any warning
sign, traffic signs, or street sign erected or maintained by council pursuant to this bylaw.
10. No person shall, except where authorized by resolution of council or when duly authorized by law, erect upon or
immediately adjacent to any highway any sign, marker, signal or light or any advertising sign or device.
11. No person shall disobey or act in contravention of any instruction or direction provided by any police officer or
town official pursuant hereto or by warning or traffic sign erected or maintained by authority of council or
pursuant to this bylaw.
6.
FLASHING LIGHTS - SCHOOL BUSES
The operator of a school bus when operating a school bus on public highways within the municipality shall:
1. Activate the flashing signals when stopped for the purpose of loading and unloading school children, at least
three hundred and fifty (350) feet or at least one hundred (100) meters before the point of loading and
unloading.
2. Maintain the operation of flashing signals while stopped to load or unload school children; and,
3. When unloading school children, discontinue the operation of the flashing signals after the school children have
reached a place of safety before continuing along the public highway.
7.
LUG VEHICLES
1. No person shall propel, operate or drive any lug vehicle upon any highway within the Town of Churchbridge
without obtaining from the Town Administrator, a permit in writing authorizing same.
2. The Town Administrator is hereby authorized to issue permits in writing for the purpose of Section 7.1 of this
Bylaw in any case where the applicant therefore has signed a written undertaking in Form 1 Schedule 8.
Provided that the administrator shall not issue such permit unless he/she is satisfied that with reasonable care in
the operation of the lug vehicle, it may be propelled or driven over any highway without damage resulting there
from or to any bridge or culvert thereon.
8.
PARKING
Except as otherwise provided herein, the parking of vehicles is permitted on all highways within the municipality.
1. (a) Subject to the provisions of subsection 8.1
(b) No person shall park a vehicle in any lane, nor in any street so as to obstruct the entrance to any lane or to
any driveway or approach leading to a private premises;
(c) Notwithstanding the provisions of subsection 8.1
(d) a farm truck or commercial vehicle may be parked in any lane for the purpose of taking on or discharging
cargo, provided that no such truck or vehicle shall be so parked for a period exceeding thirty (30) minutes at one
time, unless written permission has first been obtained from the administrator of the municipality for an
extension of such time limit.
2. (a) Subject to subsection 8.2
(b) every person parking a vehicle upon a highway within the municipality where is permitted, shall parallel park
same;
(c) Every person parking a vehicle upon the highways listed in Schedule 6 shall angle park same.
3. No person shall park any unauthorized vehicle in any "Restricted Parking" Area as designated in Schedule 4 and
no person shall park a vehicle in any "No Parking" area as designated in Schedule 4 at any time whether such
areas are marked on the curb or otherwise erected or mentioned in accordance with the provisions of section
5.4 to indicate that parking therein is prohibited or restricted.
4. No person shall park a vehicle within five (5) meters of any street intersection or fire hydrant.
5. (a) No vehicle shall be parked on any street, lane or alley for a continuous period of time in excess of twenty-
four (24) hours.
(b) Subsection 8.5(a)shall only be enforced when the vehicle is creating a nuisance or hindrance.
6. No person shall park a vehicle in any private parking place or any private property unless he is the owner,
occupant, licensee, or permittee of the parking place or private property, except with the consent of the owner,
occupant, licensee or permittee;
7. (a) Subject to subsection 8.7
(b) No person shall park any vehicle carrying oil, gasoline, or other inflammable, combustible or explosive
material within thirty (30) meters from any building in the municipality used or intended to be used, in whole or
part, as a place of dwelling, or a hotel or a place of public assembly.
(c) Nothing in subsection 8.7
(d) Shall be deemed to restrict the parking of such vehicle for such a period of time as may be necessary to take
on or discharge cargo.
8. No person shall park a truck with a manufacturer's rated capacity in excess of 3,000 Kg on any street or avenue.
9. No vehicle that does not display plates for the current year issued in accordance with the act shall be parked
upon any street.
10. No operator of a vehicle shall stand or park such vehicle backed up to the curb, except for the purpose of
loading or loading merchandise and for no longer than thirty(30) minutes.
11. No person shall leave an unattached trailer including utility trailers, garden trailers, boat trailers, livestock
trailers, semi-trailers or recreational trailers parked on or directly parallel to a street for a continuous period of
time in excess of twenty-four (24) hours.
12. Any Town Official or Police Officer upon being satisfied that it is necessary or advisable in the circumstances, is
hereby authorized to issue a permit allowing an applicant or applicants to stop, stand or park a vehicle or
vehicles in a place or places for such time and in any other manner otherwise prohibited by this bylaw upon such
terms and conditions as council town officials or police officers may prescribe.
13. No parking of semi- trailer or power units shall be allowed in residential areas.
14. No person shall park on streets or portions of them designated as snow routes in order to assist in efficient and
effective snow clearing operations. When the Municipality determines that a street or a portion of a street is no
longer required to de designated as a snow route, he or she may remove its designation. The snow routes are
set out in Schedule 7.
9.
SNOW ROUTES
1. Snow Routes will be declared when:
a) snowfall has reached a minimum of five centimetres of snow;
b) by 3 p.m. the day before parking bans come into affect; and,
c) any day of the week
2. When a snow route is declared (given pursuant to Public Notice Policy), there will be no parking for a 24-hour
period. Vehicles that remain on the snow route during the temporary ban will be ticketed. Residents and
businesses are free to return the following morning if there has been no notification before 3 p.m. the day
before, no matter what the weather brings. For example, when a snow route is declared at 3p.m. on Tuesday,
that means there is no parking on the route starting at 6 a.m. Wednesday until 6a.m. Thursday.
10.
POWER TURNS
The operator of a vehicle shall not execute "power turns" on any street or highway in within the municipality.
11.
RULES OF OPERATION AND CONDITION OF VEHICLES
1. The driver of a vehicle entering an alley shall yield the right of-way to vehicles using the alley
2. Notwithstanding any other provision hereof to the contrary, no person shall drive, stand or park a vehicle upon
any street, alley, sidewalk, or sidewalk crossing in such a manner as to block, obstruct, impede, or hinder traffic
and the lawful movement of traffic thereon unless he is in possession of a permit from a town official or police
officer issued pursuant hereto permitting him to do so in the circumstances.
3. No operator of a vehicle shall drive within any sidewalk area or upon and sidewalk except at a sidewalk crossing.
4. No operator of a vehicle shall cause or permit the wheels or other mechanical part of such vehicle to pass over
or come into contact with a hose of the fire department.
5. No person shall push or cause a vehicle to be pushed in excess of forty (40) kilometres per hour.
6. Whenever access can be had to an alley, all deliveries or collections of commodities to or from stores,
restaurants, hotels and other commercial building shall be made there from.
7. No person driving a vehicle shall cause it to cross a public highway within the town with the intent to park on the
opposite side.
8. No person operating a vehicle shall cause the wheels to spin unnecessarily

PEDESTRIANS
1. No parade shall be held on street, alley or lane unless written permission has first been granted therefore by a
town official. Every person participating in a parade for which written permission from a town official has not
been obtained is guilty of a breach of this section.
2. No person shall walk abreast of any two (2) other persons while walking on any street or lane. Persons walking
on a street or lane shall walk on the left hand side of the said street or lane facing oncoming traffic.
3. No person shall suffer or permit any horse, cow or hog to run at large.
13. SPEED
1. Subject to Section 13.2, no person shall operate a vehicle in the municipality at a speed greater that forty (40)
kilometres per hour, excluding routes of provincial highways.
2. No person shall operate a vehicle at a speed greater that thirty (30) km in the speed zones set out in Schedule 5.
3. The provisions of subsection 13.1 and 13.2 shall apply to the operators of fire engine or fire department
apparatus or to vehicles being operated by law enforcement officers or to operators of ambulance where these
vehicles are being operated in emergency duty and employing the siren and flashing lights.
4. No operator of a vehicle shall follow another vehicle more closely than is reasonable and prudent having due
regard for the speed of the vehicle and the amount and nature of traffic upon, and the condition of the streets.
5. Every operator of a vehicle shall reduce the speed of a vehicle which he or she is operating and take such
precautions as are necessary to avoid splashing any pedestrian with water, mud or slush.
14.
U-TURNS
1. No person shall cause a vehicle to make a U-turn at the intersection of a street with a lane or an alley in the
municipality,
2. No persons shall cause a vehicle to make a U-turn at the intersections designated as "No-U-turn" Schedule 3
intersections. This shall apply to all traffic approaching and facing a No-U-turn sign erected and maintained in
accordance with the provisions of Section 5.3.
15.
WEIGHT RESTRICTIONS- TRUCK ROUTES AND DANGEROUS GOOD ROUTES
1. No person shall operate any vehicle weighing with or without its load more than thirty - five (35) tonnes over the
public highways within the Municipality.
2. The Dangerous Goods Route shall be as designated in Schedule 9.
3. The provisions of The Highways and Transportation Act shall apply to all operators of vehicles referred to in
subsections 15.1 and 15.2.
16.
VEHICLES ON PUBLIC RESERVES AND PARKS
1. No person shall operate or park a vehicle on any of the park or public reserve areas.
2. The provisions of subsection 16.1 shall not apply to maintenance vehicles or vehicles using a designated parking
area
17.
BICYCLES
1. No person shall operate a bicycle without having at least one hand on the handlebar.
2. No person shall operate a bicycle on a sidewalk or within any public park.
3. No person shall ride a bicycle abreast of any two (2) other persons riding bicycles on a street except for the
purpose of passing.
4. Every person riding a bicycle in town shall have a mechanical braking system.
5. It shall be unlawful to ride a bicycle after sunset without adequate lighting on the front and rear of the bicycle.
18.
POWERS OF COUNCIL
The council may, upon the report of a police officer that a hedge, shrub, tree or fence situated at an intersection
is dangerous to traffic, by resolution order that such hedge, shrub, tree or fence be removed or shortened to
such a height as may be deemed to be necessary to overcome such danger.
19.
IMPOUNDING
1. Any member of the police or other person appointed by council may remove or cause to be removed any vehicle
that is unlawfully placed, left or kept on any street or lane, public parking place, or other public place, or on a
municipally owned property, and to impound or store such a vehicle.
2. Where a vehicle has been impounded or stored after it has been removed under subsection 19.1, it may be
retained at a place designated by the Council for a period of thirty (30) days from the date of removal unless the
cost of removal, impounding and storage are sooner paid. Upon payment of full costs herein, the vehicle may be
released to the owner.
3. If the costs of removal, impounding or storage are not paid within the period of thirty (30) days as specified in
subsection19.2, the municipality shall have the right to recover same from the owner of the vehicle by:
a. Legal action in a court of competent jurisdiction;
b. Sale by public auction on publications of a notice designating the time and place of the sale at least ten
(10) days prior to the sale in a newspaper circulating in the municipality and on sending the notice by
registered mail to the owner at the address appearing on the last registration of vehicle.
20.
LITTERING
No person shall litter, nor shall any person cause or allow material (other than road building material) which
constitutes or which may constitute a threat, hazard, danger or obstruction to persons or property or traffic to
be thrown, placed or spilled upon any street, alley sidewalk or other person's property. Persons who violate this
section shall, in addition to any other penalty provided therefore be responsible for the costs of removing such
litter or materials from the street, alley ,sidewalk or private property.
21.
PENALTIES
1. Any person who contravenes any of the provisions of Section 5.8-5.10 of this bylaw is guilty of an offence or
liable on summary conviction to the penalties provided in the General Penalty Bylaw of the Municipality.
2. Any person who contravenes any of the provisions of the Sections listed below shall be liable on summary
conviction of penalty of:

3. Where the driver of a motor vehicle exceeds the maximum speed indicated by signs, the penalty shall be as
follows:
$50.00 plus $1.00 for each kilometre in excess of the limit.
Any person who contravenes any of the provisions of Sections listed below or fails to comply therewith or with
any notice or order given there under shall be guilty of an offense and upon conviction, shall be liable to
penalties as follows:

A violator of the Sections of this bylaw as set out in Section 21.3, upon being served a notice of violations, may,
during the regular office hours, voluntarily pay the penalty at the Municipal office, and upon payment as so provided
that person shall not be liable for prosecution of the offence.
4. The notice of violation shall be in Form 2 Schedule 10 attached and forming part of this bylaw
5. (a) A person who contravenes the provisions of sections 15.1 and 15.2 is guilty of an offence and liable on
summary conviction to a penalty of not less than twenty-five ($25.00) dollars, not more than one hundred
($100.00) dollars for the first offence and not less than twenty-five ($25.00) dollars and not more than two
hundred ($200.00) dollars for each subsequent offence.
(b) A further penalty shall be imposed as follows:
(1) Three ($3.00) dollars for each 50kg or fraction thereof for the first 1,000 Kg in excess of the
prescribed maximum gross weight allowable: and
(2) Five ($5.00) dollars for each 50kg. Or fraction thereof in excess of 1,000 kg that the actual gross
weight exceeds the prescribed gross weight allowable, provided that in computing the further penalty,
500 kg or two percent of the maximum gross weight fixed by this bylaw, whichever is the lesser, shall not
be taken into account.
6. The penalty for contravention of Section 17.1,17.2,17.3,17.4 and 17.5 is as follows:
(1) For the first infraction-impounding the bicycle for a minimum of 24 hours or a maximum of seven (7) days.
(2) For the second or additional infractions, impounding the bicycle for a minimum of seventy -two (72) hours
or a maximum of fourteen (14) days.
22.
COMING INTO FORCE
This Bylaw shall come into effect on the date of the final passing.

1. I will use reasonable care in propelling, operating or driving such lug vehicle over the highway to prevent any
damage resulting to the highway.
2. I will, when operating such a lug vehicle over any bridge or culvert on any highway or on any specified bridge or
culvert thereon, first lay down on such bridge or culvert planks or timbers of not less that 5cm. In thickness of
not less than 4meters in length, such plank or timbers to be laid lengthwise across the bridge or culvert in the
directions in which the vehicle is proceeding in such a manner that they will support the wheels or tread of the
lug vehicle on both sides thereof throughout its entire passage over such bridge or culvert.
3. I will pay for all damages caused to such highway or to any bridge or culvert thereon as a result of propelling,
operating or driving such lug vehicle.
