## TOWN OF CORONACH BYLAW NO 7.2026 A BYLAW TO LICENSE AND REGULATE ANIMALS The Council of the Town of Coronach, in the Province of Saskatchewan, enacts as follows: ## 1. TITLE This bylaw shall be cited as "The Animal Control Bylaw". ## 2. PURPOSE The purpose of this Bylaw is as follows: - a) To provide for licensing of cats and dogs; - b) To control and regulate cats and dogs; - c) To provide for the impounding of cats and dogs that are at large; and - d) To control and regulate other animals including exotic and wild animals. ## 3. EXEMPTIONS FOR POLICE SERVICE DOGS This Bylaw does not apply to police service dogs under the control and supervision of their handler that are either on active duty or engaged in training. ## PART 1- DEFINITIONS ## 4. DEFINITIONS In this Bylaw: - b) "At large" means, with respect to an animal, not being on the premises of its owner, unless the animal is on a leash not exceeding two (2) metres in length and under proper control; - a) "Animal Warden" or "Bylaw Enforcement Officer" is any corporation, person or persons engaged by or appointed by the Town of Coronach for the purposes of checking for licenses, capturing and impounding animals under the provisions of this bylaw; - c) "Bee" means any of certain insects which store up the pollen of flowers for food or that makes honey and wax; - d) "CAO" is the person appointed as the Chief Administrative Officer for the Town of Coronach or his/her duly authorized representative or designate; - e) "Cat" is every cat of either sex or neutered; - f) "Council" means the Council of the Town of Coronach; - g) "Dog" is every dog of either sex or neutered; - h) "Dog Run" shall mean a permanent structure outside of a residential dwelling unit, used for the containment of a dog. - i) "Judge" shall mean a provincial court judge or a justice of the peace. - j) "MJHS" means the Moose Jaw Humane Society. - k) "Municipality" shall mean the Town of Coronach; - 1) "Owner" includes: - i) A person owns or who has possession of, or control over, an animal; and 14. ii) The person responsible for the custody of a minor where the minor is the owner of the animal. but does not include: - ili) A veterinarian registered pursuant to The Veterinarians Act, 1987 who has possession of or control over an animal for the purposes of preventing, diagnosing, or treating a disease of or injury to the animal; or, - iv) An animal shelter or pound operated by the MJHS; - m) "Peace Officer" means any member of the Royal Canadian Mounted Police, and any person appointed as the Bylaw Officer as per The Municipalities Act; - n) "Police service dog" means a dog that: - i) Is owned by the RCMP or other public law enforcement agency; - ii) Has been specially trained for the performance of police work; and, - ili) Is under the control and supervision of a member of the RCMP or other public law enforcement agency; - o) "Pound" means the premises designated by the Town of Coronach as the municipality's impoundment facility; - p) "Poundkeeper" means a person, corporation, society, or organization as may from time to time be appointed by the municipality for the purpose of retaining impounded animals pursuant to this Bylaw; ## TOWN OF CORONACH BYLAW NO 7.2026 A BYLAW TO LICENSE AND REGULATE ANIMALS q) "Premises of its owner" means property that is owned or rented by the owner that the owner has a legal right to occupy. r) "Public playground" means the area containing playground equipment in any park or Municipal Reserve owned by the Town or under the management and control of the Town; s) "Service animal" means an animal that is designated to have been legitimately trained and certified to help a person with a disability that relates to that person's disability; ## PART I/ - GENERAL ## 5. LICENSES AND LICENSE FEES 5.1. Every person within the municipality who owns or keeps a dog over six months old shall obtain an animal license from the CAO of the Municipality; - 5.2. Every person within the municipality who owns or keeps a cat over six months old shall obtain an animal license from the CAO of the Municipality; - 5.3. The license fees are set out in Schedule "A" attached; - 5.4. A registration form for the animal shall be completed as set out in Schedule "B" attached; - 5.5. The license is in effect for one fiscal year or until the animal is deceased or permanently removed from the Municipality and is not transferable from one animal to another. A license shall be purchased each fiscal year; 5.6. Every person to whom an animal license has been issued under this bylaw shall cause the animal to wear a collar to which the license tag issued by the Municipality - 5.7. A person residing in the Municipality, who owns, possesses, or harbours an animal and neglects or refuses to take out a license shall be deemed guilty of an infraction of this bylaw. ## 6. DOGS BARKING OR HOWLING 6.1. No person who owns or keeps a dog or allows it to stay in the owner's premises shall allow such dog to bark excessively or howl excessively. No person shall allow the dog to bark or howl so as to create a nuisance; 6.1.1 For the purposes of section 6.1, the factors for determining whether the barking or howling of a dog has become a nuisance are as follows: - i) the proximity of the barking or howling to sleeping facilities; 2. ii) the land use, nature and zoning of the area from which the barking or howling emanates and the area where it is received or perceived; 3. ill) the time of day or night the barking or howling occurs; 4. iv) the duration of the barking or howling; - v) whether the barking or howling is the result of provocation; 6. vi) the volume of barking or howling; and, 7. vii) whether the barking or howling is recurrent, intermittent, or constant. 6.2 Barking or howling in a residential area is deemed to be a nuisance if the barking or howling: - i) Occurs between the hours of: - 1) 10:00 p.m. and 6:00 a.m. on a day other than a Sunday or holiday; or, 2) 10:00p.m. and 8:00 a.m. on a Sunday or holiday; and/or, 3. ii) Persists for a period of: - 1) Fifteen (15) consecutive minutes or longer; or, - 2) 1 hour or longer, intermittently. 6.3. Any person who allows a dog to bark or howl excessively as per sections 6.1.1 and 6.2 shall be deemed guilty of an infraction of this bylaw; 6.4. Any person who hears a dog barking or howling excessively and can positively identify the animal, can file a written complaint at the Municipality. Written complaints must include information as set out in Schedule "E" attached to this bylaw. A video shall be sent with the complaint as proof to the CAO; 6.5. The Municipality may issue a written order if there is anything in the physical environment where the dog is being kept that can be remedied that would prevent said dog from barking or howling; ## TOWN OF CORONACH BYLAW NO 7.2026 ## A BYLAW TO LICENSE AND REGULATE ANIMALS 6.6. The Municipality may apply to a Judge to have a dog that barks or howls excessively, at the owner's expense, muzzled, fitted with a collar or device that deters barking or permanently removed from the Municipality; and, 6.7. The Municipality may issue a written infraction notice, under Schedule "E", under - this or the Municipal Noise Bylaw. ## 7. RUNNING AT LARGE AND PROHIBITED AREAS 7.1. No Owner of a cat or dog shall permit the animal to be At large in the Municipality; - 7.2. If a dog or cat is found to be running At large the Owner shall be deemed to have permitted the cat or dog to be At large unless the Owner proves to the satisfaction of the court that at the time of the offence, the Owner did all that was reasonable to prevent the cat or dog from being At large; - 7.3. Any person who sees a cat or dog running At large, and can positively identify the animal, can file a written complaint at the Town Office. Written complaints must include information as set out in Schedule "E" attached to this bylaw; - 7.4. The Animal Warden or Bylaw Enforcement Officer or any other person designated by the Municipality will attempt to capture any animals found running At large and place them in the Pound; and, - 7.5. Any animal found running At large that attacks or bites a person shall be dealt with under the Dangerous Dogs Act, 2002, at the Owner's expense; 7.5.1. Destroyed in accordance with any order or recommendation by a medical health officer; or, - 7.5.2. Permanently removed from the Municipality. - 7.6. No person shall permit a dog or cat to be: - 7.6.1. On any Public playground; - 7.6.2. On Public ball diamonds or soccer fields; - 7.6.3. This section does not apply to a person who owns and is physically reliant on a guide dog trained and used to assist such person. No person shall permit a dog to be in any cemetery in the Municipality, unless: - 7.6.4. The dog is present in the cemetery with its Owner for a funeral service or interment; and the Owner complies with all provisions of this bylaw. - 7.7. This section shall not apply to a person who owns and is physically reliant on a service animal trained and used to assist such a person. ## 8. PROHIBITED ANIMALS - 8.1. No person shall own or harbour any animal, or hybrid of any animal, of the kind listed in Schedule D for any purpose, or, - 8.2 Operate a pet store that owns, buys, trades, exhibits, harbours, rents, or sells an animal or hybrid of an animal listed in Schedule "D". ## 9. EXCEPTIONS TO SECTION 8 Section 8 does not apply: - 9.1. When the animal is: - i. In the possession of the MJHS or on the premises of the Poundkeeper; - ii) On the premises of the MJHS; or, - iii) In a veterinary hospital under the care of a licensed veterinarian; or, ## 9.2 To any person who: - i) Holds a license under any statute of the Legislative of Saskatchewan or the Government of Canada which permits the keeping of animals under stated conditions. ## 10. DANGEROUS ANIMALS Control of dangerous dogs in Saskatchewan is governed by provincial legislation and all owners must comply with this statute or any orders under this statute. ## TOWN OF CORONACH BYLAW NO 7.2026 A BYLAW TO LICENSE AND REGULATE ANIMALS ## 11. OWNING and HARBOURING OF DOGS 11.1. Where an Owner possesses a dog that displays outward signs of aggression such as threatening, barking, growling, snapping, lunging, frothing at the mouth, etc., such Owner shall ensure that the dog is properly restrained or contained whether it is on or off its own Premises of its owner; and, 11.2. Where a dog displays aggressive behavior as described in subsection 11.1, the Owner shall ensure that proper precautions have been taken to prevent the dog from escaping from its harboured property and that children of tender age cannot gain access to the Premises of its owner or the dog; 11.4. An order written under subsection 11.3 is not limited to the following but may contain any or all of the following requirements: 11.3. Where a Municipality believes an Owner has not taken the necessary precautions to contain an aggressive dog as required in subsection 11.2, the Municipality may issue a written order requiring the Premises of the Owner to remedy any lack of physical containment as identified by the Municipality; 11.4.1. Repair or construction of a property line fence; 11.4.2. Repair or construction of a dog run; 11.4.3. Physically moving the dog run or containment area of the dog from one area of the property to a more suitable area on the property; 11.4.4. Locking of perimeter fences or dog runs; and, 11.4.5. Posting warning signs on the perimeter of the property advising the public of the presence of a dog of an aggressive nature. ## 12. LITTER CLEAN UP 12.1. If an animal defecates on any public or private property other than the Premises of the owner of the pet, the Owner of the cat or dog shall remove the defecation 12.2. Any person who owns, possesses, or harbours an animal and fails to remove the defecation as set out in Subsection 12.1 shall be deemed guilty of an infraction of this ## 13. ACCUMULATION OF ANIMAL FECES 13.1. A Premises of the owner must not allow animal feces to accumulate on the property to create a health hazard or a nuisance. i) For the purposes of section 13.1, an accumulation of feces becomes a nuisance if it is unsightly, odorous or of a quantity that is likely to annoy or aggravate others. 13.2. Any person who owns, possesses, or harbours an animal and fails to clean up as set out in Subsection 13.1 shall be deemed guilty of an infraction of this bylaw; 13.3. The Animal Warden, Bylaw Enforcement Officer, or the CAO may serve a Premises of the owner with a written order to remove all animal feces from the property within seventy-two (72) hours of service of notice. 13.4 If a notice under section 13.3 is not served personally on a Premises of the owner, then a copy of the notice shall be sent by registered mail to the Owner of the property at the mailing address shown on the last revised assessment roll of the Municipality. 13.5 A notice served by registered mail is deemed to have been received on the fifteenth (15) day following the date of mailing. 13.6. The Municipality may remove the feces from the property if: 13.6.1. The person to whom the notice is made fails to remove the feces within seventy-two (72) hours; or, 13.6.2. After reasonable inquiry, the whereabouts of the Premises of the owner cannot be determined. 13.7 If the Municipality carries out the work under section 13.6, the costs and expenses incurred are a debt due to the Municipality and the Municipality may recover the costs and expenses: 13.7.1 by action in a court of competent jurisdiction; 13.7.2 in the same manner as municipal taxes; or, 13.7.3 by adding the costs and expenses to, and thereby they form part of, the taxes on the land on which the work was done. ## 14. NUISANCES BY CATS AND DOGS No owner of a cat or dog shall permit or allow the cat or dog to become a nuisance ## TOWN OF CORONACH BYLAW NO 7.2026 A BYLAW TO LICENSE AND REGULATE ANIMALS to other persons or animals. For the purposes of this section, the behaviour of a cat or dog which constitutes a nuisance includes, but is not limited to, the following: - 14.1 doing any act that injuries a person or another animal; - 14.2 chasing or otherwise threatening a person or another animal; - 14.3 biting, barking at, or chasing livestock, bicycles or motor vehicles; - 14.4 causing damage to property. ## 15. LIMITATION ON ANIMALS There is a limit of three (3) domestic animals permitted per household within the Municipality. ## PART III- IMPOUNDING OF CATS AND DOGS ## 16. IMPOUNDING OF ANIMALS 16.1 An Animal Warden, Bylaw Enforcement Officer, Poundkeeper or Peace Officer may seize and impound any cat or dog that is At large. 16.2 An Animal Warden, Bylaw Enforcement Officer, Poundkeeper, or Peace Officer may enter onto the land surrounding any building in pursuit of any cat or dog which is found At large within the Municipality. ## 17. INTERFERENCE WITH ENFORCEMENT No person, including the person who is the Owner of a cat or dog which is being impounded or has been impounded, shall interfere with an Animal Warden, Bylaw Enforcement Officer, Poundkeeper, or Peace Officer who is impounding any cat or dog in accordance with provisions of this bylaw. ## 18. IMPOUNDED CATS AND DOGS 18.1. The Animal Warden, Bylaw Enforcement Officer, Poundkeeper, or Peace Officer may take any animal found running At large, contrary to the provisions of this bylaw, to the Pound where it shall be kept for seventy-two (72) hours (excluding the day of impounding). Statutory holidays shall not be included in the computation of the seventy-two (72) hour period 18.2 During the period mentioned in section 18.1, the Owner may reclaim the cat or dog from the Pound upon payment to the Animal Warden, Bylaw Enforcement Officer, Poundkeeper, Peace Officer, or the CAO, of the fees set out in Schedule "C", including all related fines assessed against the animal; and, in the case of a dog or cat over the age of six months being impounded, a dog or cat license fee if one has not yet been purchased for that fiscal year. 18.3. If a cat or dog is not reclaimed within the period set out in section 18.1, or if the Owner of a cat or dog fails or refuses to comply within this period of conditions set out in section 18.2 and 18.3, the Animal Warden, Bylaw Enforcement Officer, Poundkeeper, Peace Officer, or CAO, can rehome the animal. ## PART V- OFFENCES AND PENALTIES ## 19. GENERAL PENALTY 19.1. Except as otherwise provided for in this bylaw, every person who contravenes any of the provisions of this bylaw is guilty of an offense and liable on summary conviction to a fine of at least the minimum amount set out in the General Penalty and Fines Bylaw, Bylaw 11.2018 and: - i) In the case of an individual, not more than $2,000.00; and, 2. ii) In the case of a corporation, not more than $5,000.00. A person who is guilty of an offence for which a minimum amount is not set out in the General Penalty and Fines Bylaw, Bylaw 11.2018: - i) In the case of an individual, not more than $2,000.00; and, 2. ii) In the case of a corporation, not more than $5,000.00. Notwithstanding section 19.1, if no Notice of Violation has been issued for a period of three (3) years or more in relation to a contravention, than a subsequent contravention of that section of the bylaw is deemed a first offence. ## TOWN OF CORONACH BYLAW NO 7.2026 A BYLAW TO LICENSE AND REGULATE ANIMALS 19.2 Any person convicted of an offense under Part V of this bylaw shall, within ten (10) days thereafter, deliver all animals of the kind listed in Schedule "D" owned, kept or harbored, by that person to the Animal Warden, Bylaw Enforcement Officer, Poundkeeper, or Peace Officer and they shall become the property of the Municipality and shall be donated to an approved agency. 19.3 Any person who fails to deliver an animal as required by section 19.2 is guilty of an offence and liable on summary conviction to the penalty contained in 19.1(i). 19.4 The Judge may, in default of payment of a fine imposed under this bylaw, order imprisonment of an individual for a term not exceeding one year. ## 20. VOLUNTARY PAYMENT TO AVOID PROSECUTION 20.1. Notwithstanding section 9, a person who contravenes Sections (5, 6, 7, 12, 13) upon being served with an Order to Remedy letter may voluntarily pay the prescribed penalty in Schedule "A" to: Town of Coronach, P.O. Box 90, Coronach, SK, SOH OZO, email: [email protected]. i) For the purpose of determining the prescribed penalty required by Section 20.1, the number of prior offences shall be determined by the number of prior Order to Remedies issued in relation to the specified contravention, except for those which have been cancelled or dismissed by the Judge. - ii) If the Municipality receives voluntary payment of the prescribed penalty within the time limit specified on the Order to Remedy, the person receiving the Order to Remedy shall not be liable to prosecution for the alleged contravention. - ill) Nothing in this section shall be construed to prevent any person from exercising their right to defend a charge for a contravention in the bylaw. iv) An Order to Remedy may be issued by a Peace Officer, Animal Warden, Pound Keeper, Bylaw Enforcement Officer, or CAO - 20.2 Inspections to determine if a written order should be issued under this Bylaw shall be carried out in accordance with The Municipalities Act. - 20.3 Orders given under this Bylaw shall comply with The Municipalities Act. - 20.4 Orders given under this Bylaw shall be served in accordance with The Municipalities Act. - 20.5 A person may appeal an order given under this Bylaw in accordance with the procedure set forth in The Municipalities Act. - 20.6 The Municipality may, in accordance with The Municipalities Act, take whatever actions or measures necessary to ensure that an order given under this bylaw is fully complied with. - 20.7 In an emergency, the Municipality may take whatever actions or measures are necessary to eliminate the emergency in accordance with The Municipalities - 20.8 Any unpaid expenses and costs incurred by the Municipality that an order given under this bylaw is fully complied with may be recovered either: 20.8.1. By civil action for debt in a court of competent jurisdiction in accordance with The Municipalities Act; or, 20.8.2. By adding the amount to the taxes on the property on which the work is done in accordance with The Municipalities Act. ## 21. FAILURE TO PROVIDE IDENTIFICATION No Person shall fail to provide proof of their name, address, and date of birth upon request by an Animal Warden, Bylaw Enforcement Officer, Peace Officer, or Pound ## 22. SEVERABILITY If any section, subsection, sentence, clause, phrase or other portion of this bylaw is for any reason held invalid or unconstitutional by a court of competent jurisdiction, that portion shall be deemed a separate, distinct and independent provision and the holding of the court shall not affect the validity of the remaining portions of the bylaw. ## PART VI- MISCELLANEOUS 23. DESIGNATED POUNDKEEPER AND ANIMAL CONTROL AGENCY ## TOWN OF CORONACH BYLAW NO 7.2026 ## A BYLAW TO LICENSE AND REGULATE ANIMALS 23.1 The MJHS is designated as the Poundkeeper and Animal Warden. 23.2 The MJHS are authorized to delegate the enforcement of this bylaw to their employees. ## 24. REPEAL Bylaw 3.2017 Animal Control Bylaw is hereby repealed ## 25.
