## TOWN OF ELROSE
## BYLAW No. 2020-04
A bylaw regulating traffic upon the public streets of the Town of Elrose and for the preservation of order therein.
## The Council of the Town of Elrose enacts as follows:
## 1 In this Bylaw:
- (1) Town means the Town of Elrose.
- (2) Operator means any person who drives or operates à vehicle upon any street.
- (3) Pedestrian means any person afoot.
- (4) Police Officer means a member of the Royal Canadian Mounted Police.
- (6) "U Turn" means the turning of a vehicle at an intersection in such a manner that the vehicle at the end of the turning movement is travelling in a direction directly opposite to the direction that the vehicle was travelling immediately prior to the making of the turning movement.
- (5) Peace Officer means the Bylaw Enforcement Officer appointed by the Town of Elrose.
- (7) Alley means a street which does not exceed 20 feet in width.
- (8) Private Driveway means a road or driveway not open to the use of the public for the purpose of vehicular travel.
- (9) Intersection means the area embraced within the prolongation of the lateral curb lines or, if none, then the lateral boundary lines of two or more streets or highways which join one another at an angle, whether or not one such street or highway crosses the other.
- (10) Crosswalks shall have the same meaning as given in the Vehicles Act of the Province of Saskatchewan.
- (11) Sidewalk means that portion of the street set aside for the exclusive use of pedestrians.
- (12) Fire Cistern means a reservoir containing a quantity of water to be used exclusively for the purpose of combating fire.
- (13) Hydrant means a device connected with a water main, which device is used to assist in combating fire.
- (14) Right-of-Way shall have the same meaning as in the Vehicles Acto fo the Province of Saskatchewan.
- (15) Vehicle shall have the same meaning as in the Vehicles Act of the Province of Saskatchewan.
- (16) Traffic Sign means all signs, signals and marking heretofore or hereafter placed or erected for the purpose of regulating or directing traffic.
- (17) Street means every way set apart for public vehicular traffic.
## 2 SPEED
- (1) No person shall drive a vehicle at a greater rate of speed than 30 kilometers per hour within the Town.
- (2) The speed limit in the school zone on 4th Avenue East from Main Street East to 1st Street East shall be designated at a 30 Kilometer per hour zone effective Monday to Friday from 8:00 am to 5:00 pm.
- (3) That the speed limit on the Saskatchewan Provincial Highway No. 4 is reduced first to 80 kilometers per hour and then further reduced to 60 kilometers per hour as indicated by the Provincial Speed Limit signs on the North and South ends of the Town boundaries.
- (4) This section does not apply to Police Officers or to Emergency Vehicles when engaged in the performance of their duties.
- (5) A vehicle travelling behind other traffic shall preserve sufficient interval to enable the vehicle to stop without accident in the event of a stop on the part of the leading traffic.
- (6) When water, mush or slush is lying on any street, the driver of every motor vehicle thereon shall so reduce the speed of his motor vehicle to avoid splashing any pedestrian using the sidewalk or within the boundary of a marked or unmarked
- (7) Anyone violating the provisions of this section is guilty of an offence and is liable to a fine of not less than $50.00 and not more than $100.00.
## 3 PARKING
- (1) Parking shall have the same definition as in the Vehicles Act of Saskatchewan and shall be regulated by the Town Authorities.
2. All vehicles parked on a street or avenue must be parked parallel with the curb except with the follwing exceptions:
3. (a) All vehicles shall be angle parked on both sides of Main Street extending from the the intersection of Railway Avenue and Main Street to the intersection of 2nd Avenue and Main Street and all vehicles shall be parallel parked on both sides of Main Street between the intersection of 2nd Avenue and Main Street and the intersection of 4th Avenue and Main Street.
4. (b) All vehicles shall be angle parked on both sides of 1st. Avenue West from the intersection of Main Street and Ist Avenue West to the intersection of 1st Avenue West the the first alley west of Main Street.
- c) Angle parking shall mean vehicles parked at an angle of 45 degrees to the curb.
- (2) No operator of a vehicle shall park the said vehicle in any of the following places:
- a) In an alley
- b) In front of a private driveway.
- c) Within an intersection.
- d) On a crosswalk.
- e) On a sidewalk
- f) Within ten (10) feet of block corners at intersections except at alleys.
- g) Within fifteen (15) feet of the driveway entrance to any fire station.
- h) Within five (5) feet of the entrance to any alley.
- i) Within fifteen (15) feet of the entrance to a fire cistern or hydrant.
- j) With it's left hand side to the curb, except on one way streets.
- k) With rear wheels to the curb.
- (3) No operator of a vehicle shall park such vehicle at any place where traffic signs have been placed prohibiting parking.
- (4) Privately owned and properly licensed recreation vehicles and camper trailers may be parked on the street shoulder in residential areas from May 1 to September 15 of each year provided that they are parked adjacent to the owner's property.
- (5) No person shall park any vehicle, excepting private passenger automobiles and recreation camper trailers, with a manufacturer's rated capacity in excess of 8,000 kg or exceeding 6.10 meters (20 feet) in length on any highway, street or alley within the Town.
- (6) A vehicle may be parked in the lane for the purpose of taking on or discharging cargo, provided no such vehicle shall be so parked for a period exceeding 120 minutes at one time, unless written permission has first been obtained from the Administrator.
- (7) No operator of a vehicle shall park such vehicle in any one parking place on any street continuously for any period exceeding forty-eight (48) hours.
- (8) Any vehicle parked, place or left in any street contrary to subsection (4) above or to Police signs, may be removed by any town official or town employee and such removal shall be at the expense and risk of the owner of such vehicle.
- (9) No person shall park upon a street any vehicle displayed for sale.
- (10) No vehicle shall be parked on a street unless it has displayed license plates for the current year.
- (11) Every person who contravenes any of the provisions of this section is liable to a fine of not less than $50.00 and not more than $100.00 for each offence and for any subsequent offence to a fine of not less than $100.00 and not more than $250.00.
## 4 STOPPING VEHICLES
- (1) No operator of a vehicle shall stop such vehicle in any of the following places, except where necessary to avoid conflict with other traffic or in compliance with the directions of a Police Officer, Peace Office, or a Traffic Signal:
- a) Within an intersection
- b) On a crosswalk
- c) On a sidewalk
- d) Within ten (10) feet of block corners at intersection except at alleys.
- f) Within five (5) feet of the entrance to any alley.
- e) Within fifteen (15) feet of the driveway entrance to any Fire Station.
- g) Within fifteen (15) feet of the entrance to a fire cistern or hydrant. ·
- (2) Every person who contravenes any of the provisions of this section is liable to a fine of not less than $50.00 and not more than $100.00 for each offence and for any subsequent offence to a fine of not less than $100.00 and not more than $250.00.
## 5 PEDESTRIANS
- (1) Every pedestian crossing a street at any point, other than at a crosswalk, shall yield the right-of-way to vehicles upon the street, provided that this provision shall not relieve the operator of a vehicle from the duty to exercise due care for the safety of pedestrians.
- (2) Pedestrians shall move, whenever practicable, upon the right half of crosswalks.
- (3) No person shall stand on a street for the purpose of soliciting a ride from the operator of any private vehicle.
- (4) Every person who contravenes any of the provisions of this section is liable to a fine of not less than $50.00 and not more than $100.00 for each offence and for any subsequent offence to a fine of not less than $100.00 and not more than $250.00.
## 6 OBSTRUCTING TRAFFIC
- (1) No person shall park or leave standing, any vehicle whether attended or unattended on a street or sidewalk in such a manner as to interfere with the movement of other traffic or the clearing of snow from the street or sidewalk.
- (2) Whenever a Police Officer or a Peace Officer finds a vehicle on a street or sidewalk in contravention of the provisions of this section, he may move the vehicle or require the driver or operator or other person in charge of the vehicle to move it.
- (3) Every person who contravenes any of the provisions of this section is liable to a fine of not less than $50.00 and not more than $100.00 for each offence and for any subsequent offence to a fine of not less than $100.00 and not more than $250.00.
## 7 REFUSE ON STREETS OR SIDEWALKS
- (1) Every person who throws or deposits or causes to be deposited any scraps of metal or any rubbish, refuse, waste or litter upon any street or sidewalk is guilty of an offence and is liable to a fine of not less than $50.00 and not more than $250.00 for each offence.
## 8 LAWFUL OBSTRUCTIONS
- (1) Every person who removes, defaces or in any manner interferes with any notice or obstruction lawfully placed on a street or sidewalk is liable to a fine of not less than $50.00 and not more than $250.00 for each offence.
## 9 OBSTRUCTIONS
- (1) Any person who, without lawful authority places or causes to be placed upon a street or sidewalk, any thing which causes an obstruction to the unimpeded movement of pedestrian or vehicular traffic is guilty of an offence and is liable to a fine of not less than $50.00 and not more than $250.00 for each offence.
- (1) The Town Authorities may make regulations providing for the erection of signs, signals, markings, and devices within the Town.
- (2) All signs, signals, markings, and devices placed or erected on a public highway for the purpose of regulating, warning or guiding traffic shall conform to the standards and specifications set out in the manual on Uniform Traffic Control Devices of Canada.
- (3) Every person who removes, defaces or in any manner interferes with a any sign or obstruction so lawfully placed is guilty of an offence and is liable to a fine of not less than $50.00 and not more than $250.00 for each offence.
## 11 AUTHORITY OF POLICE AND PEACE OFFICERS
- (1) Police Officers and Peace Officers are authorized to direct all traffic in accordance with the provisions of this bylaw, or in emergencies as public safety or convenience may require, and no person shall neglect or refuse to comply with any order, signal, or direction of a Police Officer or a Peace Officer.
- (2) The provisions of this section also apply to the parking of vehicles on any street within the Town.
- (3) Anyone failing to comply with the provisions in this section is guilty of an offence and is liable to a fine of not less than $50.00 and not more than $250.00 for each offence.
## 12 BICYCLES
- (1) No person riding on a bicycle designed for carrying one person only, shall carry any other person thereon.
- (2) All persons riding on a bicycle shall wear a CSA approved bicycle helmet and any other protective clothing necessary for the safe conveyance of the person riding the bicycle.
- (3) No person over the age of twelve (12) years, shall ride a bicycle on the sidewalks of the Town.
- (4) No person riding a bicycle shall perform stunts or aerobatics on any street or sidewalk in the Town if it impedes or restricts the movement of pedestrian or vehicular traffic or undermines the safety of the person riding the bicycle.
- (5) Anyone failing to comply with the provisions of this section is guilty of an offence is liable to impoundment of the bicycle for a period not exceeding 30 days.
## 13 VEHICLE WEIGHTS
- (1) No person shall operate upon any street or alley within the Town, a vehicle having a weight or carrying on any axle or wheel thereof a gross weight in excess of the maximum gross weight prescribed by the Vehicle Weight and Dimension Regulations, 2010.
- (2) Every person who contravenes the provisions of Subsection (1) is liable to a fine of not less than $50.00 and not more than $250.00.
- (3) The Town Authorities may, upon receiving a written request, issue a permit to a vehicle that is in excess of the gross maximum weight to allow for the delivery of goods to businesses or of construction materials.
- (4) The owner, driver, operator or mover of any such vehicle, object or contrivance who has obtained the permit mentioned in this section, is nevertheless responsible for all damages that may be caused to the street or sidewalks by reason of driving, operating, parking, or moving of any such vehicle, object or contrivance.
- (5) Such permit may be general or may limit the time and/or direct the route that may be used, and may contain special conditions or provisions to prevent injury or damage to the street, and the Town Authorities may require a bond sufficient to cover the cost of repairing such possible injury to the street, alley or sidewalk.
- (6) Every person to whom a permit has been issued under Subsection (3) who operates or permits the operation of a vehicle contrary to any of the conditions of the permit is liable to a fine of not less than $50.00 and not more than $250.00.
## 14 DRIVING ON SIDEWALKS
- (1) No person shall drive or park any vehicle or contrivance on or along or across any concrete, wood, ash or cinder sidewalks except at regular crossing places without the written permission of the Town Authorities, and then only if due care and precautions have been or will be taken to protect the sidewalks from injury and that the use thereof for such purpose will not cause any unwarranted obstruction to pedestrians.
- (2) The owner, driver, operator or mover of any such vehicle or contrivance who has received written permission or a permit is nevertheless responsible for all damages that may be caused to the sidewalks by reason of driving, operating, parking, or moving of any such vehicle or contrivance.
## 15 DAMAGE TO SIDEWALKS
- (1) Any person who causes damage to any sidewalk(s) in the Town shall be responsible for such damage and shall also be guilty of an offence and liable to a fine of not less than $50.00 and not more than $100.00.
## 16 DAMAGE TO STREETS
- (1) Any person who causes damage to any streets) in the Town shall be responsible for such damage and shall also be guilty of an offence and liable to a fine of not less than $100.00 and not more than $250.00.
## 17 LINE OF SIGHT
- (1) The Town Authorities may determine that a hedge, shrub, bush or tree situated on a street corner is blocking the line of sight of owners, drivers, operators, and movers of vehicles, contrivances, and pedestrians causing danger to traffic and may, by resolution of Council, order that such hedge, shrub, bush or tree be removed or trimmed so as to remove the danger.
## 18 PLACING UNLAWFUL TRAFFIC SIGNS
- (1) No person shall place, maintain or display upon or in view of any street any sign, signal or device which purports to be or is an imitation of or resembles a traffic sign or signal, or which attempts to direct the movement of traffic or which hides from view any traffic sign or signal, and any person doing so is guilty of an offence and liable to a fine of not less than $50.00 and not more than $250.00.
- (2) Any Peace Officer or Town Authority is hereby empowered to remove or cause to be removed, without notice, every such prohibited sign, signal or device.
## 19 SIZE OF LOADS
- (1) No load exceeding in width eight (8) feet, in height thirteen and one-half (13 1/2) feet and in length sixty (60) feet, shall be moved over any street or alley unless by special permit issued in pursuance to this or any other bylaw of the Town.
- (2) Anyone found guilty of contravening this section is guilty of an offence and is liable to a fine of not less than $50.00 and not more than $250.00.
## 20 OPENING VEHICLE DOORS
- (1) No person shall:
- a) open the door of a vehicle on a street without first taking due precautions to ensure that his act will not interfere with the movement of, or endanger any other vehicle; or
- b) leave a door of a vehicle on a street open on the side of the vehicle available to moving traffic for a period of time longer than is necessary to load or unload passengers.
- (2) Every person who contravenes any of the provisions of this section is liable to a fine of not less than $50.00 and not more than $250.00 for each offence.
## 21 U TURNS AND BACKING OF VEHICLES
- (1) No person shall make a U Turn on any street other than at an intersection.
- (2) No person riding or driving a vehicle shall make a U Turn at any of the following intersections:
- a) Any intersection at which a traffic sign has been erected bearing the words "No U Turn" or works to that effect, provided that this clause shall be deemed to apply only to traffic approaching an intersection from the direction in which such sign faces.
- (3) No person shall back any vehicle around a corner at any time, or back any vehicle along any street, except when reasonable necessary in entering or leaving a parking space.
- (4) Any person who contravenes any of the provisions of this section is liable to a fine of not less than $50.00 and not more than $250.00.
## 22 VEHICLES DAMAGING STREET
- (1) No person shall operate or drive on any street:
- a) A vehicle having metal lugs or cleats projecting from the face of the wheels or tires thereof, or any of them, or
- b) A vehicle having a caterpillar tread, unless the cleats or lugs have been removed therefrom so as to leave a completely smooth surface to the tread thereof, or
- c) A vehicle having rubber tires, whether solid or pheumatic, unless such tires are in place and in such repair and condition as not likely to cause damage to the street.
- (2) Any person who contravenes any of the provisions of this section is responsible for the repairs to the street and is liable to a fine of not less than $50.00 and not more than $250.00.
## 23 RULES FOR OPERATION AND CONDITION OF VEHICLES
- (1) Fishtailing. No person shall operate a vehicle in such a manner as to cause the rear of the vehicle to depart from its ordinary line of progress.
- (2) Skidding and Spinning Wheels. No person shall operate a vehicle in a manner as to skid or spin the wheels or tires of the vehicle unnecessarily.
- (3) Unnecessary Noise. No person, by a vehicle or by use of any other mechanical device shall make any unnecessary noise on a street, sidewalk, alley or in any public place.
- (4) Any person who contravenes any of the provisions of this section is liable to a fine of not less than $50.00 and not more than $250.00.
## 24 SNOWMOBILES AND ALL TERRAIN VEHICLES
- (1) Notwithstanding legisiation from othe Acts and Regulations, it shall be lawful to operate a snowmobile or an all terrain vehicle between the hours of 8:00 am and 9:00 pm.
- (2) Snowmobiles may only be operated on the streets or alleys of the Town in order to exit the Town boundaries and may be crossed at intersections only.
- (3) All Terrain Vehicles may be operated on Town streets and alleys as if it is any other type of motor vehicle.
- (4) For recreational uses such as rallys, racing, or similar activities, All Terrain Vehicles may only be operated on the streets or alleys of the Town in order to exit the Town
- (5) Notwithstanding legislation from othe Acts and Regulations, it shall be lawful to operate a snowmobile or an all terrain vehicle on the portions of Provincial Highway No. 4 only for the purpose of crossing said highway.
- (6) Every person who contravenes any of the provisions of this section is liable to a fine of not less than $50.00 and not more than $100.00 for each offence and for any subsequent offence to a fine of not less than $100.00 and not more than $250.00.
## 25 PENALTIES
- (1) Where any person commits, or is alleged to have committed, an infraction of any of the provisions of this bylaw, the following procedures may be followed in respect thereto by the Peace Officer or by the Town Authorities to wit:
- a) A "Notice of Violation" may be given to a person who commits or is alleged to have committed an infraction of any of the provisions of this bylaw and this person may appear at the Town of Elrose office within five (5) business days from the date of the notice and pay a voluntary payment for the specific infraction described in such notice. Compliance with such notice within the period of time prescribed therein, shall relieve such person from liability to prosecution in respect to such infraction.
- b) Non-compliance with any such notice shall not in any way affect or prejudice the right of the person named therein to defend any charge which may subsequently be laid against him in respect to the infraction described in such notice.
Bylaw Numbers 147-1990. 170-1975, 173-1976, 182-1978, 266-1998, 4-2012, 5-2012, and 4-2015 are hereby repealed.
