TOWN OF ESTERHAZY
BYLAW NO. 777-21
A BYLAW OF THE TOWN OF ESTERHAZY TO FIX THE RATES TO BE
CHARGED FOR THE USE AND CONSUMPTION OF WATER AND TO
FIX THE RATES TO BE CHARGED BY WAY OF RENT OR SERVICE CHARGE FOR THE USE OF THE SEWER.
WHEREAS the Council may regulate the distribution and use of water in the Municipality and may fix the
price for the use thereof and the times of payment; and
WHEREAS it is deemed necessary that the properties or premises drained or required by Bylaw to be
drained into the sanitary sewer system shall be charged a reasonable rent or service charge for the use
of the said sewer;
NOW THEREFORE, the Council of the Town of Esterhazy enacts as follows:

All persons desiring to be supplied with water from the Municipality's water supply system shall
make application to the officials of the Municipality. It will be at the discretion of the Town if
they want to charge a Refundable Meter Deposit in the sum of ONE HUNDRED ($100.00) for the
utility account.
Each utility account must stay in the name of the owner of the property according to the name
on the property title.
The Municipality may by Bylaw ration or limit the amount of water furnished to any and/or all
consumers should circumstances deem to warrant such action.
If the water supply is shut off from the premises of a user for infringement of the provisions of
this Bylaw, same shall not be turned on until all penalties, fees, rates, charges and arrears, if any,
have been paid. Further a FIFTY DOLLAR ($50.00) fee must be paid to cover the expenses of
turning the water off and turning it on again. If the Town is required to turn on the water service
outside the Town Employee's regular working hours, the fee shall be reflected in the overtime
hours for the employee.
Water meters shall be read quarterly except the January billing which may be an estimate.
The charges to be paid by the water consumer whose water service has been turned on shall be
those set forth in Schedule "A" hereto, or as amended from time to time, provided however,
that the minimum shall be payable in every case whether or not any water is consumed.
Persons who own or occupy premises drained or that are by Bylaw required to be drained into
the sewer shall pay for such services a rental rate or service charge in accordance with Schedule
"B" hereto, or as amended from time to time.
Accounts for water and/or sewer service shall cover a period of three successive months, and
shall be rendered no later than the end of the first month of said billing. Accounts shall be paid
within a period of NINETY (90) Days from the date which such billings are rendered. If an
account is not paid within the said period of NINETY (90) days they will be considered
outstanding and in arrears. Accounts outstanding at the end of the three-month period shall, in
addition to other collection procedures, also be subject to a FOUR PERCENT (4%) quarterly
interest rate to be applied to the outstanding balance.
Bylaw No. 619-08, 684-13, and 775-21 are hereby repealed.
THIS BYLAW shall come into force and take effect on the date of final passing thereof with approval
thereof being issued by the Local Government Board.
