A BYLAW OF THE TOWN OF KAMSACK, IN THE PROVINCE OF
SASKATCHEWAN, TO REGULATE THE OPERATION OF VEHICLES WITHIN
THE TOWN.

This Bylaw may be cited as the "Traffic Control Bylaw".
The Council of the Town of Kamsack enacts as follows:
1.
INTERPRETATION:
a. "bicycle" shall mean any vehicle which is propelled by muscular power having
two wheels, one behind the other, either of which is over fifteen (15) inches in
diameter, and including any device adapted from a bicycle by the addition of
one or more wheels:
b. "cargo" means a large or heavy quantity of goods or merchandise conveyed
or to be conveyed in a vehicle such as freight.
c. "clerk" means the Town Administrator or Bylaw Enforcement Officer:
d. "curb" shall mean the actual curb and if there be no curb in existence, shall
mean the dividing line between that part of a highway actually used for the
passage of vehicles and that part of a highway actually used either as a
boulevard or for the passage of pedestrians;
e. "dangerous goods" shall have the same meaning as defined under the
Transportation of Dangerous Goods Act (Canada);
f. "heavy vehicle" means a motor vehicle with the manufacturer's rated gross
vehicle weight, or together with any trailer, semi-trailer, or other vehicle being
towed, weighs 4.5 tonnes or more;
g. "highway" means a road, parkway, driveway, square or place within the Town
designed and intended for or used by the general public for the passage of
vehicles, but does not include any area whether privately or publicly owned that
is primarily intended to be used for the parking of vehicles and the necessary
passageways on the area;
h. "Traffic Safety Act" shall mean The Traffic Safety Act and amendments thereto,
or any The Traffic Safety Act Regulations which is in force during the duration
of this Bylaw;
i. "lane" shall mean that kind or type of highway intended primarily to give access
to the rear and/or side or real property and intended primarily for the use of
vehicles;

j. "loading zone" means that portion of a public highway adjacent to the curb
designated by signs and/or marking for the exclusive use of vehicles loading
and unloading passengers or goods;
k. "lug vehicle" means any truck, portable engine or traction engine having metal
spikes, lugs or cleats projecting from the face of the wheels or tires thereof, or
having metal track tread;
l. "manner of driving" shall be in accordance with provisions of The Traffic Safety
Act;
m. "manufacturer's rated gross vehicle weight" means a rating specified by the
manufacturer of a truck or tractor and trailer or any other vehicle equipment;
n. "parallel parking" means the parking of a vehicle with both right wheels hereof
drawn up to the curb on the right hand side of the highway, with the
said
wheels at a distance of not more than thirty (30) centimeters from such curb;
and with the front of the vehicle facing in the same direction as
the
direction of the flow of traffic in the said right lane.
o. "park", "parking" means the standing of a vehicle, whether occupied or not, on
a highway, otherwise than temporarily for the purpose of and while actually
engaged in loading or unloading or in obedience to traffic regulations, signs or
signals;
p. "pedestrian" shall mean any person on foot and shall include a baby carriage or
wheelchair;
q. "place of public assembly" means schools, theatres, moving picture theatres,
churches, hockey and skating rinks, dance halls and public assembly halls;
r. "provincial highway" means a provincial highway as defined in the Highways
and Transportation Act;
s. "recreational vehicle means any vehicle designed primarily for the conveyance
of passengers and not for carrying of goods or other commercial purpose;
t. "speed zone" means any portion of a highway within the Town of Kamsack, as
designated herein, and identified by a sign erected and maintained at each end
thereof, indicating the maximum speed applicable thereto;
u. "street" means that portion of every highway, public road, street, avenue, lane,
park, drive or public place in the Town of Kamsack intended for use by
vehicles;

v. "Superintendent of Public Works" means the Public Works Manager or
designated person;
w. "U-turn" means the turning of a vehicle so as to cause it to proceed in the
opposite direction from which it was proceeding immediately prior to the
commencement of such turn;
x. "vehicle" means a device, upon or by which the person or thing is or may be
transported or drawn upon a highway and includes special mobile machines
and agricultural implements;
2.
SCOPE:
a.
"STOP" STREETS
Every street or portion thereof as listed in Appendix No.1 attached hereto
and forming part of this Bylaw, are designated as "Stop" Streets and the
erection of appropriated signs on such streets by the Superintendent of
Public Works is hereby authorized.
b.
"YIELD" STREETS
All streets set out in Appendix No. 2 attached hereto and forming part of
this Bylaw are established as "Yield" Streets and the erection of Yield
signs in the said streets by the Superintendent of Public Works is hereby
authorized.
c.
"NO U-TURN" INTERSECTION
All intersection of the streets, approached from all four directions as listed
in Appendix No. 3 attached hereto and forming part of this Bylaw, are
designated as "No U-turn" intersections.
d.
"ONE-WAY" STREETS
The streets as listed in Appendix No. 11 attached hereto and forming
part of this Bylaw are designated as "One-Way" Streets and erection
of "One-Way" signs in said streets by the Superintendent of Public
Works is hereby authorized.
e.
"LOADING ZONES"
The street locations as listed in Appendix No. 12 attached hereto and
forming part of this Bylaw are designated as "Loading Zones" and erection
of appropriate signs in the said zones by the Superintendent of Public
Works is hereby authorized.
f.
"DISABLED PERSONS PARKING ZONE"
The street location indicated in clause 3(f)(13) designated as a Disabled
Persons Parking Zone and erection of appropriate signs marked the said
zone, by the Superintendent of Public Works, is hereby authorized.

"TEN-MINUTE PARKING ZONE"
(i) There shall be three (3) ten-minute parking stalls located directly in
front of the Canada Post Office Building at 334 Third Avenue South (Lots
4-6, Block 10, Plan N336), Monday through Friday between the hours of
8:00 a.m. and 5:00 p.m. with appropriate signs marking the said zone.
h.
"ONE-HOUR PARKING ZONE"
(i) There shall be three (3) one-hour parking stalls located directly in front of
the Royal Canadian Mounted Police Barracks at Kamsack, Saskatchewan,
Monday through Friday between the hours of 8:00 a.m. and 5:00 p.m. with
appropriate signs marking the said zone.

"QUEEN ELIZABETH BOULEVARD"
That portion of No. 5 Highway going through the Town of Kamsack and
named "Queen Elizabeth Boulevard East" and "Queen Elizabeth
Boulevard West", respectively, shall be designated as a single-lane
highway with the flow of traffic to be alongside the median of the
boulevard.

3.
INFRACTIONS:
a.
"STOP" STREETS
The provisions of The Traffic Safety Act shall apply to all traffic approaching
and facing a "Stop" sign erected and maintained in accordance with the
provisions of Sections 2(a) and 4(b).
b.
"YIELD" STREETS
The provisions of The Traffic Safety Act shall apply to all traffic approaching
and facing a "Yield" sign erected and maintained in accordance with the
provisions of Section 2(b) and 4(b).
c.
SIGNS
1.
No person shall, except where authorized by resolution of
Council or when duly authorized by law, erect upon or

immediately adjacent to any highway, any sign, marker,
signal or light or any advertising sign or device.
d.
SCHOOL BUS FLASHING LIGHTS
The operator of a school bus when operating a school bus on public
highways in the municipality shall not activate the safety lights.
e.
LUG VEHICLES
1.
No person shall propel, operate or drive any lug vehicle upon
any highway within the municipality without first having obtained
of the Clerk, a permit in writing authorizing same.
2.
The Clerk is hereby authorized to issue permits in writing for the
purpose of Subsection (e)(1) of this Bylaw in any case where the
applicant therefore has signed a written undertaking in Form 1,
Appendix 5. Provided that the clerk shall not issue any such
permit unless he is satisfied that with reasonable care in operation,
the lug vehicle may be propelled or driven over any highway
without damage resulting in thereto or to any bridge or culvert
thereon.
3.
Nothing contained in Subsection (e)(1) shall be deemed to
preclude the transport of a lug vehicle as herein defined over
any highway where same is being carried by means of a rubber-
tired trailer or other conveyance equipped with rubber tires.
f.
PARKING
1. Except as otherwise provided herein, the parking of vehicles displaying
proof of current valid licenses is permitted on all highways within the
municipality.
2.
i. Subject to the provisions of Subsection (ii), no person shall
park a vehicle in any lane, nor in any street so as to obstruct
the entrance to any lane, or to a driveway or approach leading
to private premises;
ii. Notwithstanding the provision of Subsection (i), a farm truck or
commercial vehicle may be parked in any lane for the purpose
of taking on or discharging cargo, provided no such truck or
vehicle shall be so parked for a period exceeding thirty (30)
minutes at one time, unless written permission has first been
obtained from the clerk or a police officer of the municipality for
an extension of such time limit.

i. Subject to Subsection (ii), every person parking a vehicle upon
a highway within the Town where parking is permitted, shall

park same.
ii. No person shall park on any highway in the Town where curbs
are specially painted with yellow paint or no parking is indicated
by signs.

4.
No person shall park a vehicle in any "No Parking" area as
designated in Appendix No. 6 at any time whether such areas
are marked on the curb or otherwise by signs erected and
maintained in accordance with the provisions of Section 4(d)
to indicate that parking therein is prohibited.
5.
No person shall park a vehicle within five (5) meters of any
street, intersection or fire hydrant.
6.
Subject to Paragraph 3(f)17, no person shall park a vehicle on
any highway at one place for any period of time exceeding
one hundred (100) consecutive hours unless otherwise given written
notice by the clerk.
7.
No person shall park any vehicle in any private parking place or
on any private property unless he is the owner, occupant, licensee
or permittee of the parking place or private property, except with
the consent of such owner, occupant, licensee or permittee.
8.
i. Subject to Subsection (ii), no person shall park any
commercial vehicle designed for carrying or intended for the
carrying of oil, gasoline or other inflammable, combustible
or explosive material within thirty (30) meters from any
building in the municipality used or intended for use, in whole
or in part, as a place of dwelling, a hotel or a place of public
assembly.
ii. Nothing in Subsection (i) shall be deemed to restrict the
parking of any such vehicle for such period of time as may be
necessary to take on or discharge cargo.
9.
i. No person shall park a truck with a manufacturer's rated
Gross Vehicle Weight in excess of 4.5 tonnes on any streets
or avenues designated in Appendix No. 7.
ii. Subsection (i) shall not apply to recreation vehicles.

10.
No person shall park any vehicle on any sidewalk or crosswalks or block
the use of a sidewalk or crosswalks.
11.
No person shall leave parked overnight on any street, any
machinery, farm truck, oil truck, unused car or any vehicle
that interferes with or is objectionable to the residents of the
locality, or is in any way a danger to traffic.
12.
OBSTRUCTING OF TRAFFIC
No person shall cause or permit any vehicle under his control to
stop on any street except for compliance with traffic regulations
and safety precautions unless such vehicles shall have been
properly parked in accordance with the provisions of this Bylaw.
13.
DISABLED PARKING STALLS
No person other than a disabled person or a person conveying a
disabled person shall park any vehicle in the Disabled Persons
Parking Zone established as follows:
i) Disabled Parking Zone situated on the west side of Third
Avenue at a point commencing at the south corner of Lot 1,
Block 9, Plan N336 to a point 11.1 meters north of the south
corner of Lot 1, Block 9, Plan N336.
14.
No person shall park a vehicle in a Five-Minute Parking Zone
for a longer period than five (5) minutes during designated times.
14.1
No person shall park a vehicle in a Ten Minute Parking Zone for a
period longer than ten (10) minutes during designated times.
15.
No person shall park a vehicle in a One-Hour Parking Zone
for a longer period than one (1) hour during designated times.
16.
No person shall park a vehicle in such a manner that the vehicle is facing
against the direction of the flow of traffic.
17.
No person shall park a vehicle on Third Avenue South between
Queen Elizabeth Boulevard and Nykolaishen Drive for a longer
period than two (2) hours between the hours of 8:00 a.m. and
6:00 p.m. from Monday through Saturday, inclusive.
18.
SERVICE VEHICLES
Service Vehicles may purchase a $5.00 yearly parking permit to
allow them to park in restricted parking areas. This permit is to
be displayed on the dash of the vehicle as per Appendix No.14.

No person shall be permitted to park any vehicle along the south
west side of Nykolaishen Drive (along the elevator and C.N.R.
properties) commencing from the intersection of Queen Elizabeth
Boulevard (No. 5 Highway) and Nykolaishen Drive and proceeding
eastward to the outer limits of the Town.

g.
LITTERING
No person shall put, place or leave, on any street or sidewalk, any
animal, vehicles, coal, lumber, building material, including gravel or sand,
firewood, boxes, ashes, garbage or waste, or any other article or thing of
such nature, size or quantity as to obstruct or interfere with the free
movement of traffic unless he shall first have obtained the approval of the Clerk
in writing and shall have provided and maintained in respect of such material,
article or thing, during the period from sunset to one hour before sunrise,
illumination adequate to give the users of the street or sidewalk so obstructed,
due warning of the location on such street or sidewalk of such material, article
or thing, or as directed by the Clerk.
i.
SPEED
1. Subject to Subsection (2) and (3), no person shall operate a vehicle on
any highway in the municipality except at a careful and prudent speed,
having due regard to all circumstances, at a speed greater than forty (40)
kilometers per hour except for Nykolaishen Drive which shall be fifty
(50) kilometers per hour;
2. No person shall operate a vehicle at a speed greater than thirty (30)
kilometers per hour in any School Zone or Playground Zone, as set out
in Appendix No.4, between the hours of 7:00 o'clock a.m. and 10:00
o'clock p.m.
3.
Subsection (1) does not apply to any public highway within the
Town limits upon which the Highway Traffic Board has pursuant
to The Traffic Safety Act, fixed a maximum speed.
4.
Any person contravening any of the provisions of Section 3 i.
shall be subject to a fine in accordance with The Traffic Safety Act.

U-TURNS
1. Removed
2.
No person shall cause a vehicle to make a U-turn at the
intersection designated as "No U-turn" intersections as
contained in Appendix No. 3. This shall apply to all traffic
approaching and facing a "No U-turn" sign erected and
maintained in accordance with the provisions of Section 2(c)
and 4(c) of this Bylaw.
k.
WEIGHT RESTRICTION/DANGEROUS GOODS - TRUCK ROUTES
1.
No person shall operate a vehicle or a combination of vehicles
when the manufacturer's rated gross vehicle weight exceeds
4.5 tonnes, except on a highway within the municipality
designated as a Heavy Vehicle Route as listed in Appendix No.
8 attached hereto and forming part of this Bylaw.
2.
Subject to Subsection (1), no person shall operate a vehicle or a
combination of vehicles when the combined gross weight of the
vehicle(s) with or without a load exceeds 35 tonnes on any
highway within the municipality.
3.
Subsection (1) and (2) shall not apply to vehicles making
delivery on any highway in the municipality provided that the
operator of vehicle(s) uses the most direct route from and to
the Heavy Vehicle Route, as listed in Appendix No. 8.
4.
The provisions of the Police Act and the Highways Act shall apply
to the operators of vehicles referred to in Subsections (1) and (2).
5.
Subsection (1) shall not apply to recreational vehicles.
6.
Notwithstanding Subsection (1), the weight restriction shall not
apply for the purpose of operating a vehicle at most direct route
for repair or service at a commercial garage or your choice within
the Town of Kamsack.
a. No person shall operate a vehicle transporting dangerous goods
in bulk other than on a dangerous goods transportation route as
listed in Appendix No.8 except while such vehicle:
i. is making collection or delivery, provided that the operator
proceeds by the most direct route to or from the point of
collection or delivery, as the case may be, to or from the

nearest dangerous goods transportation route.
l.
VEHICLES ON PUBLIC RESERVES, ETC.
1.
No person may operate or park a vehicle on any area
designated in Appendix No. 9 as a Public Reserve which said
appendix is attached hereto and forms part of this Bylaw.
2.
The provision of Subsection (1) shall not apply to maintenance
vehicles or vehicles using a designated parking area.
m.
BICYCLES
1.
No person shall operate a bicycle without having at least one
hand on the handle bar.
2.
No person shall operate a bicycle on a sidewalk.
3.
No person shall carry another nor shall any person ride with
another upon a bicycle unless the same be designated or specially
constructed to carry more than one person with a proper seat and
foot rest to accommodate each such person.
4.
No person riding a bicycle shall ride alongside or abreast of any
other vehicle except for the purpose of lawfully passing the same.
5.
No person shall cause or permit any bicycle to be left unattended or
parked upon a sidewalk or boulevard in the Town in a manner
which would cause an obstruction on the sidewalk, boulevard or
other public thoroughfare, provided that nothing herein contained
shall apply to the parking of any bicycle within a stall or rack
which may be erected by the Town on any sidewalk or boulevard
for that purpose.
6.
No person shall operate a bicycle on any street recklessly or at a
speed or in a manner which is dangerous to the public or to any
pedestrian or to the operator or any other vehicle, having regard to
all the circumstances of the case, including the nature, condition
and use of the street and the amount of traffic which actually is or
might reasonably be expected to be on the street.
7.
The Traffic Control Officer or any Police Officer who finds an
abandoned bicycle or any bicycle being operated in the Town in
violation of the provisions of this or any other relevant Bylaw of

the Town of Kamsack, including the Licensing Bylaw, may seize
such bicycle and retain same in accordance with Section 6(d).
Bicycles not claimed after the expiry of the period of impounding
shall be moved to the Town storage area and disposed of at the
discretion of the Town. Bicycles not claimed after the expiry of the
period of impounding shall be donated to the Kamsack R.C.M.P
Victim's Service Unit or alternate group as designated by the clerk.
8.
Operation of a bicycle in the Town of Kamsack shall conform to
the provisions of this Bylaw and to the provisions of The Traffic Safety
Act.
n.
ONE-WAY STREETS
All persons operating vehicles on One-Way Streets shall operate same in
the direction as indicated in the annexed Appendix No. 11 attached hereto
and forming part of this Bylaw.
o.
LOADING ZONES
1.
No person shall park a motor vehicle in a Loading Zone. Any
area designated as a Loading Zone may be used by any vehicle
when actually engaged in loading and unloading passengers or
merchandise.
2.
No operator of a vehicle shall remain in a Loading Zone for a
period exceeding two (2) minutes for the purpose of embarking or
disembarking passengers.
3.
No operator of a vehicle shall remain in a Loading Zone for a
period exceeding ten (10) minutes for the purpose of loading
or unloading goods.
4.
Notwithstanding Subsections (1) and (3), any truck or tractor
and trailer loading and unloading cargo on Third Avenue shall
be parked on the centre line of Third Avenue while loading and/or
unloading.
p.
SCHOOL BUS ROUTES
1.
No person shall operate a school bus except on a highway within
the municipality designated as a School Bus Route as listed in
Appendix No. 13 attached hereto and forming part of this Bylaw.

2.
Subsection (1) shall not apply to school buses requiring servicing
provided that the operator of the school bus(es) uses the most
direct route from and to the School Bus Route as listed in
Appendix No. 13.
q.
MAINTENANCE AND CONSTRUCTION EQUIPMENT
1.
Every operator of equipment that has its warning lights in
operation and is engaged in the maintenance or construction
of streets or highways may operate the equipment on any
portion of the said street or highway that may be necessary for
the direction of his duties.
2.
The driver of every motor vehicle in the Town of Kamsack shall
yield the right-of-way to all equipment engaged in the maintenance
or construction of streets or highways within the Town of Kamsack
r.
NOISE
1.
Every person who creates excessive or unusual noise in the operation of
a vehicle in or near a public place is guilty of an offense whether or not
the noise is caused by the mechanical state of the vehicle or the manner
in which the vehicle is operated and whether or not the vehicle is
stationery or moving at the time when the noise is created.
s.
ENGINE RETARDANT BRAKES
1.
No person operating a vehicle shall use engine retardant brakes within
Town limits, except to avoid or reduce the impact of a collision or in the
case of other such emergency.
4.
SIGNS:
a.
Council shall cause to be erected and maintained at all stop streets
listed in Appendix No. 1, at a distance of approximately three (3) meters
from point of intersection, an appropriate "Stop Sign" so placed to face
the traffic approaching the intersection.
b.
Council shall cause to be erected and maintained at all yield streets
listed in Appendix No. 2, at a distance of approximately three (3) meters
from point of intersection, an appropriate "Yield" sign, so placed to face
the traffic approaching the intersection.
c.
Council shall cause to be erected and maintained at all "No U-turn"
intersections as listed in Appendix No. 3, at a distance of approximately
three (3) meters from point of intersection, an appropriate sign prohibiting
U-turns, so placed to face the traffic approaching the intersection.

d.
Council shall cause to be erected and maintained at all "No Parking"
areas as listed in Appendix No. 7, appropriate signs and/or curb
markings. Such signs or curb markings shall be visible from that part
of the highway to which the restriction applies.
e.
Council may by resolution provide for the erection and maintenance on
any street or highway, and at any designated point or points thereon, of
such signs as it may deem it necessary for the proper control of traffic in
the Town of Kamsack and may authorize the Superintendent of Public
Works to erect or cause to be erected, such signs as it deems necessary
containing such warning, guidance, directions or information thereon as
required by Council.
5.
MISCELLANEOUS
a.
PARADES AND PROCESSIONS
1.
No parade shall be held without first obtaining a permit from the
Town Office, who shall designate or approve the hour and route
of the parade. Every person participating in a parade for which no
permit has been granted or who contravenes the provisions of the
permit shall be guilty of a breach of this Bylaw.
2.
Application for permit for a parade shall be made in writing to the
Town Office, giving the nature of the parade, and intended route,
the number of persons and vehicles expected to take part and the
time which it is expected will be required for the parade to pass
a given point.
3.
All applications or permits for conducting a parade or procession
shall be made to the Town Office at least twenty-four (24) hours
prior to the said parade or procession to enable the Superintendent
of Public Works ample time to arrange for policing the route.
b.
USE OF BARRICADED STREETS FORBIDDEN
1.
No person shall drive any vehicle through or over any barricade
or over any fire hose.
2.
The Superintendent of Public Works or Fire Chief and any person
designated by the said Superintendent of Public Works or Fire
Chief shall have the authority to barricade any Public Highway
within the Town of Kamsack when so is deemed necessary by
said Superintendent of Public Works or Fire Chief.

c.
MOVING OF BUILDINGS
No person shall move any building or other large object, which might
obstruct traffic, along any street or across any street without first obtaining a
special permit in writing from the Clerk designating the time for such moving
and the route to be followed and complying with such directions.
6.
PENALTIES:
a.
Any person who contravenes any Section of this Bylaw where no penalty
is provided, shall be subject to a fine of not less than $50.00 and not more
than $1,000.00.
b.
i.
Any person who contravenes any section of this Bylaw, listed
below in this subsection, or fails to comply therewith, shall be
guilty of an offence and shall be subject to the minimum penalties
as set forth below:

ii.
If within 72 hours of the commission of the offence, Saturdays,
Sundays and Holidays excepted, the minimum penalty of $50.00
as stipulated in Section 6(b)(i) has not been paid, the minimum
penalty payable shall be $100.00 and shall be paid forthwith
thereafter. If such minimum penalty of $100.00 is not paid within
240 hours of the commission of the offence, a summons shall be
issued thereafter.
iii.
Any person upon being served with Notice of Violation indicating
the minimum penalty set forth thereon, may, during the regular
office hours, voluntarily pay the minimum penalty at the Municipal
Office, prior to the return Court date and upon payment as so
provided, that person shall not be liable to further prosecution for
the offence.
iv.
The Notice of Violation shall be in Form "2", Appendix No. 10
attached to and forming part of this bylaw.
c.
i.
A person who contravenes the provisions of Sections 3(k)(1)
3(k)(2) is guilty of an offence and liable on summary conviction
to a penalty of not less than $50.00 nor more than $100.00 for
the first offence and not less than $100.00 nor more than $400.00
for each subsequent offence.
ii.
A further penalty for the violation of Section 3(k)(1) and 3(k)(2)
shall be imposed as follows:
a)
Three Dollars ($3.00) for each fifty (50) kilograms or
fraction thereof for the first one thousand (1,000)
kilograms in excess of the prescribed maximum gross
allowable; and

b)
Five Dollars ($5.00) for each fifty (50) kilograms or
fraction thereof in excess of one thousand (1,000)
kilograms that the actual gross weight exceeds the
prescribed gross weight allowable, provided that in
computing the further penalty, five hundred (500)
kilograms or two percent of the maximum gross weight
fixed by this bylaw, whichever is the lesser, shall not be
taken into account.
iii.
In each instance, the total fine shall not exceed the maximum
provided for in the General Penalty Bylaw of the municipality.
iv.
The provisions of the General Penalty Bylaw of the Town of
Kamsack shall apply in cases where the offence warrants a
penalty in excess of the minimum penalty as set forth in Section
6(b)(1) of this bylaw.
d.
The penalty for the contravention of Section 3(m) is as follows:
i.
For the first infraction, impounding the bicycle for seven (7)
days.
ii.
For the second or additional infractions, impounding the bicycle
for fourteen (14) days.
iii.
An abandoned, impounded or found bicycle shall be retained
for a period of sixty days and if not claimed shall be disposed of
as per section 3(m)(7) of this bylaw.
7.
IMPOUNDING:
a.
Any member of the police force, special constable or other person
appointed by Council may remove or cause to be removed a vehicle
that is unlawfully placed, left or kept on any street or lane, public
parking place, or other public place, or on municipally-owned property
and to impound or store such vehicle.
b.
Where a vehicle has been impounded or stored after it has been removed
under Subsection (a), it may be retained at a place designated by Council
for a period of thirty (30) days from the date of removal unless the cost of
removal, impounding and storage are sooner paid. Upon payment of the
full costs herein, the vehicle may be released to the owner thereof.

c.
If the costs of removal, impounding and storage are not paid within the
period of thirty days as specified in Subsection (b), the municipality shall
have the right to recover same from the owner of the vehicle by:
i.
Legal action in a court of competent jurisdiction;
ii.
Sale by public auction on publication of a notice designating the
time and place of sale at least ten (10) days prior to the sale in
a newspaper circulating in the municipality and on sending such
notice by registered mail to the owner at the address appearing
on the last registration of the vehicle.
d.
Voluntary payments as provided for in the Summary Offence and
Procedures Act shall apply to penalties imposed for speeding, failing to
yield, snowmobiles and one-way highways offences.
8.
Bylaw No.10-2016 of the Town of Kamsack is hereby repealed.
9.
This bylaw shall come into force and take effect on final passing thereof.

RECREATION COMPLEX:
There shall be "no parking" at any time in the main entrance to the Recreation Complex, said
area described as follows:
All that area bounded by a line joining the north corner of the Curling Store Room to
a lamp standard a distance of eighteen (18) meters in a north-easterly direction; on the
northeast by a line joining the said lamp standard to a point six (6) meters northeast of
the north corner of the lobby area; on the southeast by a line joining the
aforementioned point to the point of junction of the lobby area and the Curling Store
Room; and on the south west by the Curling Store Room wall running from the
aforementioned junction 7.62 meters to the north corner of the said store room, the
point of commencement. Provided however, this area may be used for pedestrian
traffic, ambulance service, police vehicle while the police are on police duty in the
complex, and for a vehicle parked to load or unload cargo. (See diagram).
NYKOLAISHEN DRIVE
There shall be "no parking" along the south west side of Nykolaishen Drive (along the elevator
and CNR properties) commencing from the intersection of Queen Elizabeth Boulevard (No.5
Highway) and Nykolaishen Drive and proceeding eastward to the outer limits of Town.
KAMSACK MALL
There shall be "no parking" on the northwesterly side of Fourth Avenue, from the northeast
corner of Lot 20, Block 6, Plan I1224, southwesterly along Lot 20 for a length of ten (10)
meters. This is to allow free access to the Recycling Hoppers belonging to Parkland Regional
Waste Management Authority Inc.
There shall be "no parking" on either side of the alley that separates Lot 13, Block 6, Plan
I1224 and Lot 20, Block 6, Plan I1224 from the northwest corner of Lot 26, Block 6, Plan
I1224, southeasterly along Lot 26 for a length of twenty-one (21) meters. This is to allow
