A BYLAW OF THE CITY OF LLOYDMINSTER IN THE PROVINCES OF ALBERTA AND
SASKATCHEWAN TO PROVIDE FOR THE ESTABLISHMENT OF AN ANIMAL CONTROL
BYLAW
WHEREAS the Council of the City of Lloydminster deems it necessary to establish a
Bylaw to deal with the safety, health and welfare of people and the protection of
people and property.
AND WHEREAS The Lloydminster Charter provides authority to City Council to pass
bylaws for municipal purposes;
AND WHEREAS The Lloydminster Charter provides authority to the City to pass
bylaws respecting the enforcement of bylaws.
NOW THEREFORE the Council of the City of Lloydminster deems it necessary to establish
a Bylaw to control and regulate Domestic Animals within the City of Lloydminster; and
NOW THEREFORE, the Council of the City of Lloydminster, pursuant to the authority
granted in Section 15 of The Lloydminster Charter, enacts as follows:
1.
SHORT TITLE
1.1. This Bylaw may be cited as the Animal Control Bylaw.
2.
DEFINITIONS
2.1. The definitions listed in Schedule "A" attached to this Bylaw shall apply,
unless context otherwise requires.
3.
APPOINTMENT, AUTHORITY AND DUTIES OF THE CITY MANAGER
3.1. Except where authority is expressly reserved to Council, the administration
and enforcement of this Bylaw is delegated to the City Manager.
3.2. The City Manager may take any action necessary to administer and enforce
this Bylaw, including but not limited to the authority to:
3.2.1. delegate any power, duty or function under this Bylaw to a Designated
Officer or other employee of the City;
3.2.2. carry out, or cause to be carried out, inspections reasonably
required to determine compliance with this Bylaw; and
3.2.3. establish any forms, notices, or procedures required for the
administration of this Bylaw.
4.
DOG AND CAT IDENTIFICATION PROVISIONS
4.1. Every Owner of a Dog or a Cat within the City shall ensure that any Dog or
Cat over the age of six (6) months is identified by a Tag.
4.2. The Tag must be securely affixed to the Dog's or Cat's collar or other
restraining device and must display a legible and operational phone number
for the Owner or another contact person.
4.3. A Dog or Cat is not considered properly identified unless it is wearing the Tag
while off the Owner's Property.

4.4. An Owner who fails to comply with this section commits an offence and is
liable to the applicable fine set out in Schedule "B".
4.5. A Person(s) who requires the assistance of a Service Dog shall ensure it is
identified as a Service Dog through a government-issued identification card
or is wearing a Tag to identify it as a Service Dog.
5.
CONTROL OF DOMESTIC ANIMALS
5.1. Every Owner shall Keep their Domestic Animal under Physical Control at all
times.
5.2. No Owner shall permit their Domestic Animal to Run at Large within the City.
5.3. The City may designate areas under its control where a Dog, while in the
presence of its Owner, may be unleashed.
5.4. No Kennel shall operate on residential property within the City.
5.5. An Owner shall ensure that their Domestic Animal does not:
5.5.1. bite, scratch, attack, or injure any Person; or
5.5.2. bite, scratch, attack, injure, or cause the death of another animal.
5.6. Subsection 5.5 does not apply where a Dog's actions are the direct result of
provocation.
5.7. In addition to any penalty imposed under this Bylaw, where a Dog
contravenes subsection 5.5, a Judge may, upon hearing of a complaint, order
one or more of the following:
5.7.1. that the Owner pay damages suffered by the complainant;
5.7.2. that the Owner confine or muzzle the Dog for a period determined by
the Judge;
5.7.3. that the Owner deliver the Dog to the City for humane destruction;
or
5.7.4. that the Owner remove the Dog from the City.
6.
CARE OF DOMESTIC ANIMALS
6.1. No Person shall inadvertently or through negligence, injure, hurt, or otherwise
harm an animal.
6.2. No Person shall deliberately injure, hurt or otherwise harm any animal.
6.3. Where a Bylaw Enforcement Officer is required to enter a vehicle or take other
reasonable action to release an animal in Distress, all costs associated with that
action shall be paid by:
6.3.1. the Owner of the animal; or
6.3.2. the Owner of the vehicle, if the vehicle owner is not the Owner of the
animal.
6.4. No Person may abandon an animal within the City.

6.5. Any Person convicted of an offence under subsection 6.4 shall pay all costs
incurred by the City for the intake, care, and handling of an Abandoned Animal.
7.
NUISANCE ANIMALS
7.1. The Owner of a female Domestic Animal In Heat shall ensure that the animal is
confined so as not to attract other animals.
7.2. Where a Domestic Animal defecates on any public or private property other than
the property of its Owner, the Owner must immediately remove and properly
dispose of the defecation.
7.3. No Owner shall permit their Domestic Animal to damage public or private
property. Where damage occurs, the Owner commits an offence and must make
restitution to the owner of the damaged property, in addition to any fine imposed
under this Bylaw.
7.4. No Owner shall permit their Domestic Animal to bark, howl, or otherwise make
noise excessively, as determined by a Bylaw Enforcement Officer.
7.5. No Owner shall permit their Domestic Animal to disturb the peace of any Person,
as determined by a Bylaw Enforcement Officer.
7.6. An Owner shall ensure that their Domestic Animal does not become a nuisance
and, without limiting the generality of the foregoing, does not:
7.6.1. chase, threaten, or harass any Person or animal
7.6.2. chase bicycles, automobiles or other vehicles; or
7.6.3. overturn garbage receptacles or scatter their contents.
7.7. Nothing in this section applies to Domestic Animals used in law enforcement
operations, training, or duties by an accredited police service.
8.
POUND OPERATION
8.1. The City Manager shall establish, appoint, or otherwise authorize an authority to
operate a Pound for the purpose of impounding Domestic Animals at one or more
locations approved by the City Manager.
8.2. The City Manager may establish rules and procedures governing:
8.2.1. the administration of the Pound; and
8.2.2. the conduct and responsibilities of the Pound Keeper.
8.3. The Pound Keeper shall hold all impounded Domestic Animals for a minimum of
seventy-two (72) hours, excluding the day of impoundment, Sundays and
statutory holidays.
8.4. During the holding period, a healthy Domestic Animal may be reclaimed by its
Owner upon:
8.4.1. providing proof of identity and residency.
8.5. If a Domestic Animal is not redeemed within the required holding period, the
Pound Keeper may arrange for the animal to be:

8.5.1. donated,
8.5.2. sold; or
8.5.3. euthanized.
8.6. The Pound Keeper may, at their discretion, provide veterinary care to any
Domestic Animal that, upon or during impoundment, requires such care. All costs
associated with veterinary care shall be paid by the Owner and are recoverable
by the City.
8.7. A Bylaw Enforcement Officer is authorized to capture and impound:
8.7.1. any Domestic Animal found in contravention of this Bylaw; and
8.7.2. any Domestic Animal that is wounded, Distressed, abandoned, or
diseased.
8.8. Any Owner who utilizes the services of the Pound Keeper shall pay the fees, such
as costs associated with collection, boarding, feeding and veterinary care, as
outlined in this Bylaw or the Fees and Charges Bylaw, as amended from time to
time.
8.9. With written approval from the City, the Pound Keeper may offer programs or
services, including licensing initiatives or voluntary donations to offset any costs
or penalties incurred through this Bylaw.
8.10. Any Owner who intentionally surrenders a Domestic Animal within the City for
the purpose of utilizing Pound services shall pay the applicable fees contained
within this Bylaw or set out in the Fees and Charges Bylaw, as amended from
time to time.
8.11. Any impounded Domestic Animal that appears to be suffering from any
disease shall be managed in accordance with the requirements of the
province in which the animal is impounded and the authority responsible for
animal health and disease control.
9.
SPECIAL PROVISIONS FOR RESTRICTED DOGS
9.1. A Dog that has demonstrated vicious behaviour, as determined through an
investigation following a complaint, by observation of a Bylaw Enforcement
Officer, or following two (2) confirmed Unprovoked Attacks within a twelve
(12) month period, shall be declared a Restricted Dog by a Designated
Officer.
9.2. Upon declaring a Dog to be a Restricted Dog, the Designated Officer shall:
9.2.1. notify the Owner of the designation
9.2.2. require the Owner to Keep the Dog in accordance with this section;
and
9.2.3. inform the Owner that failure to comply with these requirements
may result in penalties prescribed in Schedule "B".
9.2.4. Create a written notice for properties in proximity to the Restricted
Dogs' primary address.

9.3. While on the premises of its Owner, the Restricted Dog shall be:
9.3.1. kept indoors; or
9.3.2. confined in a securely enclosed or locked pen or structure designed
to prevent the escape and prevent entry by any person other than
the Owner.
9.4. Any exterior enclosure used to confine a Restricted Dog shall:
9.4.1. have secure sides and a secure top; and
9.4.2. if the enclosure has no bottom attached to the sides, be embedded
into the ground to a depth of not less than 0.3 meters.
9.5. When a Restricted Dog is off the premises of its Owner, the Owner shall:
9.5.1. securely muzzle the Dog; and
9.5.2. harness or leash the Dog so as to maintain immediate Physical
Control and prevent the Dog from attacking any Person or animal.
9.6. An Owner of a Restricted Dog shall ensure that the Dog does not attack any
Person anywhere in the City.
9.7. In addition to any penalty imposed under this Bylaw, a Judge may order one
or more of the following:
9.7.1. that the Owner pay damages suffered by a complainant;
9.7.2. that the Owner deliver the Restricted Dog to the Pound Keeper for
humane destruction; and
9.7.3. that the Owner remove the Restricted Dog from the City.
10. LIVESTOCK AND EXOTIC ANIMALS
10.1. An Owner may Keep Exotic Animals within the City only in accordance with
this Bylaw, and all applicable provincial or federal legislation.
10.2. No Person may Keep an Exotic Animal within the City if possession of that
animal is prohibited by provincial or federal legislation.
10.3. No Person shall Keep pigeons, guinea pigs, or rabbits in numbers greater
than three (3).
10.4. No Person shall Keep Livestock within the City.
10.5. Despite subsection 10.4, Livestock may be kept or present within the City for
the following purposes:
10.5.1. events conducted by the Lloydminster Agriculture Exhibition
Association; or
10.5.2. events or activities for which written permission has been granted by
the City.
10.6. Despite subsection 10.4, a Person may ride or drive a horse within the City
for the following purposes:

10.6.1. parades authorized under the City of Lloydminster Traffic Bylaw;
10.6.2. events conducted by the Lloydminster Agriculture Exhibition
Association; or
10.6.3. circumstances where written permission has been provided by the
City.
11. GENERAL PROVISIONS
11.1. No residential household within the City shall Keep more than:
11.1.1. five (5) Dogs, or
11.1.2. five (5) Cats, or
11.1.3. one (1) Restricted Dog or
11.1.4. a combination of Domestic Animals exceeding a total of five (5).
11.2. A Service Dog, when accompanied by its Owner, must be permitted to enter
public premises unless otherwise prohibited by municipal, provincial, or
federal legislation, including but not limited to the Public Health Act
(Saskatchewan) or the Public Health Act (Alberta).
11.3. If a Designated Officer believes that any animal poses an immediate risk to
any Person, a Bylaw Enforcement Officer may immediately seize and
impound the animal.
11.4. Any animal seized under subsection 11.3 shall remain impounded until the
Designated Officer is satisfied that it no longer poses a threat to any person.
11.5. Any fees incurred in accordance with sections 11.3. and 11.4 shall be at the
sole expense of the Owner of said animal.
12. DISEASE CONTROL
12.1. If Council has reason to believe that there is an outbreak or a threatened
outbreak of rabies or any disease that may be transmitted to humans, Council
may Order all Owners to securely confine and quarantine every Domestic
Animal under their control.
12.2. Any Domestic Animal found Running at Large in contravention of an Order
made under subsection 12.1 shall be impounded, quarantined, and examined
by a veterinarian.
12.3. Where a Domestic Animal under quarantine is diagnosed or suspected by a
licensed veterinarian as being rabid and dies while under observation, the
Pound Keeper shall:
12.3.1. direct the Owner to surrender the animal for pathological
examination by the appropriate health authority; and
12.3.2. notify the Public Health Authority of the diagnosis and any known
human that was in contact with the animal.
12.4. During a rabies quarantine period, every Domestic Animal bitten by an animal

confirmed to be rabid must be humanely euthanized, unless the Owner
elects, at their own expense, to:
12.4.1. have the animal treated by a licensed veterinarian; or
12.4.2. Have the animal confined and quarantined by a licensed veterinarian
in accordance with applicable standards.
12.5. Except as otherwise permitted under this Bylaw or applicable legislation, no
Person shall:
12.5.1. kill, or cause death of a rabid animal or suspected rabid animal; or
12.5.2. remove such an animal from the City without written permission of
the Pound Keeper.
12.6. Upon request, the carcass of any Domestic Animal exposed to rabies shall be
surrendered to the Pound Keeper, who shall direct its disposition.
12.7. Where, in the judgment of a licensed veterinarian, an impounded Domestic
Animal should be euthanized for humane reasons, the animal shall be
euthanized.
12.8. No Person shall knowingly bring into or Keep within the City a Domestic
Animal that has an infectious disease posing a serious risk to other animals
or humans.
12.9. Where a Domestic Animal within the City shows symptoms of disease, the
City Manager or his Designated Officer may require the Keeper of the animal,
in writing, to:
12.9.1. produce a veterinarian's statement confirming the animal is not
contagious; or
12.9.2. in the case of a Dog or a Cat, produce proof of vaccination against rabies,
distemper, or parvovirus.
12.10. An Owner who fails to comply with a written requirement under
subsection 12.9 within ninety-six (96) hours commits an offence and is
liable to the penalties set out in Schedule "B".
13. PENALTIES
13.1. Any person who contravenes this Bylaw is guilty of an offence.
13.2. Persons having contravened certain sections of this Bylaw shall be liable for
the penalties set out in such section or set out in Schedule "B" hereto.
13.3. A notice or form commonly called a Notice of Violation having printed wording
approved by the City Manager, may be issued by a Bylaw Enforcement Officer
or a Designated Officer to any person alleged to have breached any provision
of this Bylaw, and the said notice shall require the payment of the City of
Lloydminster in the amount specified in Schedule "B" hereto.
13.4. A Summary Offence Ticket or a Violation Ticket shall be deemed to be
sufficiently served:

13.4.1. if served personally on the accused; or
13.4.2. if mailed to the address of the person accused by regular mail.
13.5. The amounts specified in Schedule "B" hereto shall be the specified penalties
for the purposes of the Provincial Offences Procedures Act (Alberta) or the
Summary Offences Procedure Act 1990 (Saskatchewan).
14. NUMBER AND GENDER REFERENCES
14.1. All references in this Bylaw will be read with such changes in number and
gender as may be appropriate according to whether the reference is to a
male or female person, or a corporation or partnership.
15. SEVERABILITY
15.1. Every provision of this Bylaw is independent of all other provisions and if any
provision of this Bylaw is declared invalid for any reason by a court of
competent jurisdiction, all other provisions of this Bylaw shall remain valid
and enforceable.
This Bylaw shall come into force and effect upon the final passing thereof.
The following bylaws and all amendments thereto are hereby repealed:

SCHEDULE "A"
Definitions
Abandoned Animal
An animal having been left without care and control by an
owner with no intent to return.
Bylaw Enforcement Officer
Any Person who has been appointed a Bylaw Enforcement
Officer, pursuant to Bylaw 02-2025, a Peace Officer appointed
pursuant to the Peace Officer Act S.A. 2006, c P-3.5, or a
member of the RCMP.
Cat
A Domestic Animal of the Felidae family.
Charter
Refers to The Lloydminster Charter.
City
The City of Lloydminster and the area contained within the
corporate boundaries of the City.
City Manager
The Commissioner of the City of Lloydminster as appointed
by Council or designate.
Commercially Zoned
As described within Bylaw 05-2025 Land Use Bylaw, as
amended.
Council
The Municipal Council of the City of Lloydminster.
Designated Officer
A person designated through Council by the Designated
Offices Bylaw, as amended from time to time.
Distress
A condition in which an animal is deprived of adequate food,
water, care, or shelter, is injured, sick or in pain, or is
subjected to abuse or neglect.
Dog
A Domestic animal of the Canidae family.
Domestic Animal
An animal that has been domesticated by humans and
depend on humans for care or survival and does not include
Livestock.
Exotic Animal
An animal that is not native to Canada and is not commonly
domesticated, including animals regulated under provincial
or federal legislation.
In Heat
The period of time when an animal is fertile.
Keep
To own, harbour or have control or custody of a Domestic
Animal or other animal.
Kennel
A facility used for commercial breeding or keeping of Dogs or
Cats.
Livestock
Cattle, horses, sheep, pigs, goats, chickens or other
animals commonly kept on a farm and/or for agricultural
purposes.
Order
Any written notice or letter that requires a Person to remedy
a contravention of this Bylaw or The Lloydminster Charter.
Owner
Any Keeper of a Dog or Cat or other Domestic Animal.
Person
Any individual, a group of individuals, a corporation, firm,
partnership, proprietorship, association, society or co-
operative organization.

Physical Control
In respect of a Domestic Animal, the animal is:
- under the immediate and effective control of a Person and
restrained by a leash not exceeding three (3) metres in
length; or
- confined within a container, enclosure, or motor vehicle; or
- in the case of a Dog, under the immediate control of its
Owner in an area designated by the City for off-leash use.
Pound
Such a place as may, from time to time, be established by
the City Manager for the impounding and keeping of
Domestic Animals.
Pound Keeper
A Person appointed by the City Manager for the purpose
of Administrating the Pound.
Restricted Dog
Any Dog declared to be a Restricted Dog by a Designated
Officer in accordance with this Bylaw.
Run at Large
Any Dog, Cat or other Domestic Animal not under the
Physical Control of a responsible and competent person
when off the property of the Owner.
Service Dog
A type of assistance dog specifically trained to do tasks that
mitigate the disability of their person, including but not
limited to:
i.
visual difficulties; or
ii.
hearing impairment; or
iii.
medical conditions.
Summary Offence Ticket
As defined by the Summary Offences Procedures Act
(Saskatchewan), as amended from time to time.
Tag
A disc or other shape of metal or plastic which is securely
affixed to a Dog or Cat's collar or other restraining device,
and which contains, at a minimum, a legible and operational
phone number of the Owner or where the Owner can be
contacted.
Unprovoked Attack
i.
Any Incident in which, without provocation, any
Dog while not on the property of its Owner bites
any Person; or
ii.
Any incident in which, without provocation any
Dog, while on the property of its Owner bites any
Person who should reasonably expect safe and
lawful entry to that property.
Violation Ticket
As defined by the Provincial Offences Procedure Act
(Alberta), as amended from time to time.
