TOWN OF MACKLIN BYLAW NO. 02/20 A BYLAW TO REGULATE THE OPERATION OF VEHICLES The Council of the Town of Macklin, in the Province of Saskatchewan enacts as follows: 1. INTERPRETATION: (1) a. "ACT" means the Highway Traffic Act, R.S.S. 1986 and amendments thereto; b. "ADMINISTRATOR" means the administrator of the Town of Macklin; c. "AGRICULTURAL IMPLEMENT" means a vehicle designed and adapted exclusively for agricultural- cultural, horticultural or livestock raising operations; d. "ALLEY" means the street intended primarily to give access to the rear of the property; e. "ANGLE PARKING" means the parking of vehicles with the front wheel drawn up to the curb on the right hand side of the highway, or at a distance of not more than thirty (30) centimeters from such curb, the vehicle to be placed at an angle of forty-five (45) degrees with the curb; f. "COUNCIL" means the council of the Town of Macklin; g. "CURB" means the lateral boundaries of a roadway, whether or not marked by curbing; h. "HIGHWAY" means a road, parkway, driveway, square or place designed and intended for or used by the general public for the passage of vehicles, but does not include any area, whether privately or publicly owned, that is primarily intended to be used for the parking of vehicles and the necessary passageways on that area; i. "LUG VEHICLE" means any truck, portable engine or traction engine having metal spikes, lugs or cleats projecting from the face of the wheels or tires thereof, or having metal track or tread; j. "MOTORCYCLE" means a vehicle that: (i) is propelled or driven by any means other than by muscular power; (ii) has two or three wheels; (iii) is designed for use on a highway and (iv) does not have a cab for the driver; but does not include: (v) industrial vehicles; (vi) agricultural implements; or (vii) all-terrain vehicles; k. "MOTOR VEHICLE" means a vehicle propelled or driven by any means other than by muscular power; l. "OWNER" means an owner as defined in The Vehicle Administration Act; m. "PARADE" means a procession or body of pedestrians numbering more than twenty-five (25), who are standing, marching, or walking on any street or sidewalk (except displays by armed forces) and means any organized procession of vehicles numbering ten (10) or more standing or moving on any street (except when in a funeral procession); n. "PARALLEL PARKING" means the parking of a vehicle with both right wheels thereof drawn up to the curb on the right hand side of the highway, or at a distance of not more than thirty (30) centimetres from such curb; o. "PARKING" means the standing of a vehicle, whether occupied or not, on a highway, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading or in obedience to traffic regulations, signs or signals; p. "PEACE OFFICER" means: (i) a member of a police force in Saskatchewan (ii) a person or class of persons designated by the Lieutenant Governor in Council as traffic officers; or (iii) any person appointed under the Police Act as a Special Constable or peace officer for the enforcement of this Act; q. "PERSON" includes any man, woman, child, partnership, aggregation of individuals, bodies corporate or politic; r. "PLACE OF PUBLIC ASSEMBLY" means schools, theaters, moving picture theaters, churches, hockey and skating rinks, dance halls and public assembly halls; s. "POWER TURN" means to maneuver a vehicle in such a manner to cause the rear of the vehicle to depart from its ordinary line of progress by the sudden use of acceleration and/or braking; t. "POWER UNIT" means a motor vehicle designed and used primarily for pulling a semi- trailer; u. "PRIVATE DRIVEWAY" means every road or driveway which is not to be used by member of the public at large for passage of vehicles or traffic and includes every road or driveway on private property; v. "PROPERTY LINE" means the line marking the boundary between lots or blocks according to a registered plan of survey and means the line making the boundary between any other real property how so ever described; w. "PROVINCIAL HIGHWAY" means a provincial highway as defined in the Highways and Transportation Act; x. "RECREATIONAL VEHICLE" means a self-propelled or towed vehicular type unit, primarily designed as temporary living quarters for recreational, camping or travel use and which is used solely as a family or personal conveyance and in no way used for commercial purpose. Without limiting the foregoing, recreational vehicles include: i) Travel Trailer; ii) Cabin Trailer, iii) Tent Trailer, iv) Truck Camper; v) Motor Home; vi) Park Trailer; vii) Fifth-wheel Travel Trailer; viii) Boat Trailer; or ix) Utility Trailer; y. "REGISTRATION PERMIT" means a valid and subsisting registration permit issued pursuant to The Vehicle Administration Act; z. "SEMI-TRAILER" means a vehicle that is at any time drawn on a highway by a motor vehicle and that is designed for the conveyance of goods or as living quarters for persons and so that its weight and the weight of its load is carried partly on its own axles and partly on another vehicle, but does not include: (i) an agricultural implement; (ii) timbers or metal beams with wheels attached used for the purpose of moving buildings; (iii) an asphalt distributor used for the construction or maintenance of bituminous surfaced highways; or (iv) an axle unit to convert a semi-trailer to a trailer; aa. "SIDEWALK" means that portion of the street or that area adjacent to the street which is used primarily by pedestrians; bb. "SIDEWALK CROSSING" means that portion of a sidewalk permanently improved and/or is designated for the passage of vehicular traffic; cc. "SPECIAL MOBILE MACHINE" means a vehicle (i) that is not designated or used for the transportation of passengers or goods and that only uses a highway incidentally to its basic purpose; (ii) that is designed and used exclusively for the moving of earth or construction materials on locations off highways or for general construction or industrial purposes and that only uses a highway incidentally to its basic purposes; or (iii) used for the purpose of highway construction and maintenance; but does not include a dump truck or a truck mounted transit mixer or any other similar mounted machine; dd. "SPEED ZONE" means any portion of a highway within the Town of Macklin as designated herein, and identified by a sign erected and maintained at each end thereof, indicating the maximum speed applicable thereto; ee. "STOP" means: (i) when required, a complete cessation from movement; and (ii) when prohibited, any stopping, even momentarily, of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a peace officer or in traffic-control signal; ff. "TOWN OFFICIAL" means and includes the town administrator, town foreman, fire chief, peace officer and every elected official and also includes the person or persons employed by the town or designated by the council to carry out the duties of the forehand persons on the absence; gg. "TRAFFIC" means pedestrians, animals, vehicles, buses, motor vehicles and all other conveyances upon any street, alley, or sidewalk; hh. "TRAFFIC LANE" means a longitudinal division of a highway of sufficient width to accommodate the passage of a single line of vehicles, all streets within the Town of Macklin shall be deemed to be single lane driving; ii. "TRAFFIC SIGN" means any signal, sign, marking or other device placed, painted or erected for the guidance, regulation, warning, direction or prohibition of traffic; jj. "TRAILER" means a vehicle other than a semi-trailer, that is at any time drawn on a highway by a motor vehicle and that is designated for the conveyance of goods or as living quarters for persons, but does not include: (i) a motor vehicle towed for sale, storage or repair purposes; (ii) an agricultural implement; (iii) an axle unit with fifth wheel assembly used to convert a semi-trailer to a trailer; (iv) a vehicle owned or used by, on behalf of or under the direction of a department of the Government of Saskatchewan or a municipality or rural municipality, and that is used exclusively as living quarters for the employees; (v) timbers or metal beams with wheels attached used for moving buildings; (vi) an asphalt distributor used for the construction or maintenance or bituminous surfaced highways; or (vii) a vehicle, other than a house trailer or boat trailer, camping trailer, drawn by a motor vehicle registered as a farm truck, if that motor vehicle is being used for a purpose for which a vehicle registered as a farm truck may be used; and a trailer is deemed to be a separate vehicle and not part of the motor vehicle by which it is drawn; kk. "TRUCK" means a motor vehicle that is: (i) designed for the conveyance of goods; (ii) equipped with a lifting device; or (iii) on which any machinery is permanently mounted; ll. "TRUCK ROUTE" means a highway marked with signs, designating certain highways as a truck route; mm. "VEHICLE" means a device in, on or by which a person or thing is or may be transported or drawn on a highway and includes special mobile machines and agricultural implements but does not include vehicles running only on rails or solely on railway company property. (2) Except where inconsistent with this bylaw, the words used in this bylaw shall have the same meaning as in the Act. (3) This bylaw and all matters referred to herein shall be interpreted as having application only to the territory within the limits of the Town of Macklin. 2. SCOPE: a. "STOP STREETS" The streets and avenues as listed in Appendix 1 are designated as "STOP" streets. b. "YIELD STREETS" The streets and avenues as listed in Appendix 2 are designated as "YIELD" streets. c. "NO U TURN INTERSECTIONS" The intersections of streets and avenues, approached from all four (4) directions as listed in Appendix 3 are designated as "No U TURN" intersections. d. "TRUCK ROUTES" The streets and avenues as listed in Appendix 10 are designated as "TRUCK ROUTES". e. "RIGHT TURN ONLY STREETS" The streets and avenues listed in Appendix 14 are designated as "RIGHT TURN ONLY" streets. 3. INFRACTIONS: a. The provisions of The Highway Traffic Act of Section 40 (4) (a) shall apply to all traffic approaching and facing a "STOP" sign erected and maintained in accordance with the provisions of Section 4 (a). b. The provisions of The Highway Traffic Act of Section 50 (5) shall apply to all traffic approaching and facing a "YIELD" sign erected and maintained in accordance with the provisions of Section 4 (b). c. Miscellaneous Signs: (1) No person shall, except where authorized by resolution of council or when duly authorized by law, erect upon or immediately adjacent to any highway, any sign, marker, signal or light or any advertising sign or device. (2) No person shall willfully deface, damage, destroy or remove any traffic sign, street sign, or marker erected pursuant to this bylaw or pursuant to the Act. (3) In the event of an emergency, any peace officer or town official may erect or authorize the erection of such traffic signs as he deems necessary or advisable for the direction or control of traffic. (4) The Town Administrator or any peace officer may authorize the placing of signs prohibiting parking in the vicinity of any funeral home or church when a funeral is taking place or is about to take place. (5) No person shall disobey or act in contravention of any instruction or direction provided by any peace officer or town official pursuant hereto or by warning or traffic sign erected or maintained by authority of the council or pursuant to this bylaw of the Act. d. Lug Vehicles: (1) No person shall propel, operate or drive any lug vehicle upon any highway within the municipality without first having obtained from the administrator, a permit in writing authorizing the same. (2) The administrator is hereby authorized to issue permits in writing for the purpose of Section d(1) of this bylaw in any case where the applicant therefore has signed a written undertaking in Form 1, Appendix 5. Provided that the clerk shall not issue any such permit unless he is satisfied that with reasonable care in operation, the lug vehicle may be propelled or driven, over any highway without damage resulting thereto or to any bridge or culvert thereon. (3) Nothing contained in Section e(1) shall be deemed to preclude the transport of a lug vehicle as herein defined over any highway where same is being carried by means of a rubber tired trailer or other conveyance equipped with rubber tires. e. Parking: (1) Except as otherwise provided herein, the parking of vehicles is permitted on all highways within the municipality. (2) Subject to the provisions of Subsection (b) no person shall park a vehicle in any lane nor in any street so as to obstruct the entrance to any lane or to a driveway or approach leading to private premises: (a) Notwithstanding the provisions of this subsection, a farm truck or commercial vehicle may be parked in any lane for the purpose of taking on or discharging cargo provided no such truck or vehicle shall be so parked for a period exceeding thirty (30) minutes at one time, unless written permission has first been obtained from the administrator or a peace officer of the municipality for an extension of such time limit. (3) (a) Subject to subsection (b), every person parking a vehicle upon a highway within the municipality where parking is permitted, shall parallel park same; (b) Every person parking a vehicle upon the highways listed in Appendix 6 shall angle park same. (4) No person shall park any unauthorized vehicle in any "Restricted Parking" area as designated in Appendix 7 and no person shall park a vehicle in a "No Parking" area as designated in Appendix 7, at any time whether such areas are marked on the curb or otherwise erected or mentioned in accordance with the provisions of Section 4, (d) to indicate that parking therein is prohibited or restricted. (5) No person shall park a vehicle within five (5) metres of any street intersection or fire hydrant. (6) (a) No person shall park a vehicle on any highway at one place for any period of time exceeding twenty-four (24) hours. (b) Subsection (a) shall only be enforced when the vehicle is creating a nuisance or hindrance. (7) No person shall park any vehicle in any private parking, place or any private property unless he is the owner, occupant, licensee or applicant of the parking place or private property, except with the consent of such owner, occupant, licensee or applicant. (8) (a) Subject to Subsection (b), no person shall park any commercial vehicle designed for carrying or intended for the carrying of oil, gasoline or other inflammable, combustible or explosive material, within thirty (30) metres from any building in the municipality used or intended for use, in whole or in part, as a place of dwelling, a hotel or place of public assembly. (b) Nothing in subsection (a) shall be deemed to restrict the parking of any such vehicle for such period of time as may be necessary to take on or discharge cargo. (9) No vehicle which does not display plates for the current year issued in accordance with the Act shall be parked upon any street. (10) No operator of a vehicle shall stand or park such vehicle up to a curb, except for the purpose of loading or unloading merchandise and for no longer than thirty (30) minutes. (11) (a) No person shall park any trailer or any size or of any type whatsoever and leave it unattached from a motor vehicle on any public street in the Town of Macklin for a period of time in excess of Forty-Eight (48) hours, with the exception of Town owned equipment. (b) No person shall park any recreational vehicle or trailer (attached or unattached) of any type whatsoever on any public street in the Town of Macklin for more than forty-eight (48) consecutive hours following which the owner or operator shall move the recreational vehicle or trailer to an off-street location for a period of not less than forty-eight (48) consecutive hours before the recreational vehicle or trailer may be parked again on a residential street. (c) No recreational vehicle shall have any slide extension opened while on any public street as outlined in Section 11(b) for a period longer than three (3) hours. (12) Any town official or peace officer upon being satisfied that it is necessary or advisable to issue a permit allowing an applicant to stop, stand, or park a vehicle in a place or places for such time and in any other manner otherwise prohibited by this bylaw upon such terms and conditions as council, town officials or peace officers may prescribe. f. Power Turns: The operator of a vehicle shall not execute "Power Turns" on any highway in the Municipality. g. Snowmobiles: (1) Under the provisions of Section 21 of the Snowmobile Act, R.S.S. 1978 (and subject to Section (g) (2) ), it shall be lawful to operate a snowmobile between the hours of 7:00 a.m. and 11:00 p.m. on any public highway except Provincial Highway No. 31 within the limits of the municipality solely for the purpose of travelling directly to ones place of residence. (2) Notwithstanding section (g) (1) of this bylaw, it shall be lawful to operate a snowmobile on the portion of Provincial Highway No. 31 for the purpose of crossing the Provincial highway. h. Speed: (1) Subject to subsection (2), no person shall operate a vehicle in the municipality at a speed greater than forty (40) km/hr (2) No person shall operate a vehicle at a speed greater than thirty (30) km/hr. in the speed zone as set out in Appendix 9. (3) The provisions of subsections (1) and (2) shall not apply to the operators of fire engines or fire department apparatus or to operators of ambulances where these vehicles are being operated in an emergency duty and employing the siren and flashing red lights. (4) The provisions of subsection (1) shall not apply to the Provincial highway routes maintained by the province within the municipality. i. U-Turns: (1) No person shall cause a vehicle to make a "U-Turn" at the intersection of a street with a lane or an alley in the municipality or between intersections. (2) No person shall cause a vehicle to make a "U-Turn" at the intersections designated as "No U-TURN" intersections in Appendix 3. This shall also apply to all traffic approaching and facing a "NO U-TURN" sign erected and maintained in accordance with the provisions of Section 4(c). j. Weight Restrictions - Truck Routes: (1) Truck Routes: No person shall operate a vehicle or combination of vehicles when the combined gross weight of the vehicles with or without its load exceeds 3500 kgs., except only highway within the municipality designated as a Heavy Vehicle Route as listed in Appendix 11. (2) No person shall operate a vehicle or combination of vehicles when the combined gross weight of the vehicle(s) with or without its load exceeds the Provincial limits on any highway within the municipality designated as a "Truck Route" as listed in Appendix 11. (3) No person shall operate a vehicle or combination of vehicles, when the combined gross weight of the vehicle(s) with or without its load exceeds 3500 kgs on Herald Street between Globe Avenue and Press Avenue. (4) No person shall park a vehicle or combination of vehicles, with or without its load when the combined gross weight exceeds 3500 kgs on any street as listed in Appendix 8. (5) Subject to subsection (3) and (4), shall not apply to recreational vehicles, that are used for recreational purpose only. (6) No person shall park any truck or other vehicle having a manufacturer's rated capacity of over one (1) ton or an overall length of over twenty-two (22) feet on any public street in the Town of Macklin for a period in excess of twenty-four (24) hours. (7) Subject to Subsection (4) shall not apply to school buses, that are registered to the School Unit and used solely for the transportation of students to and from school. (8) Subject to subsection (1) and subsection (2) shall not apply to vehicles making deliveries on any highway in the municipality provided that the operator of the vehicle(s) uses the most direct route to and from heavy vehicle routes as listed in Appendix 11. k. Vehicles on Public Reserves: (1) No person may operate or park a vehicle on any street or area designated in Appendix 12. (2) The provisions of subsection (1) shall not apply to maintenance vehicles or vehicles using a designated parking area. l. Bicycles: (1) No person shall operate a bicycle without having at least one hand on the handle bars. (2) No person shall operate a bicycle on a sidewalk or within any public park. (3) No person shall ride a bicycle abreast of any two (2) other persons riding bicycles on a highway except for the purpose of passing. (4) Every person riding a bicycle in town shall have a mechanical braking system. (5) It shall be unlawful to ride a bicycle after sunset without adequate lighting on the front and rear of the bicycle. 4. SIGNS: a. Council shall cause to be erected and maintained at all stop streets listed in Appendix 1, at a distance of approximately three (3) metres from point of intersection, an appropriate sign containing the word "STOP", so placed to face traffic approaching the intersection. b. Council shall cause to be erected and maintained at all yield streets in Appendix 2, at a distance of approximately three (3) metres from point of intersection, an appropriate "YIELD" sign, so placed to face the traffic approaching the intersection. c. Council shall cause to be erected and maintained at all No U-Turn intersections as listed in Appendix 3, at a distance of approximately three (3) metres from point of intersection, an appropriate sign PROHIBITING U-TURNS, so placed to face the traffic approaching the intersection. d. Council shall cause to be erected and maintained appropriate signs or curb markings to indicate "NO PARKING" areas and "RESTRICTED PARKING" areas as listed in Appendix 7. Such signs or curb markings shall be visible from the part of the highway, or area to which the restriction applies. e. Council may by resolution provide for the erection and maintenance on any highway, and at any designated point or points thereon, of such signs as it deems expedient for warning, guidance, directions, or information thereon. 5. AUTHORITY OF THE POLICE: a. Any peace officer is hereby authorized to direct traffic to conform with the provisions of this bylaw and of the Act. b. Any peace officer may direct traffic in any manner which he deems necessary in order to expedite the flow of traffic, to safeguard pedestrians, to prevent accidents, or to meet any emergency condition which has arisen or which he considers likely to arise. c. No person shall direct or attempt to direct traffic unless authorized to do so by a peace officer or town official except in the event of an emergency requiring the direction of traffic. d. (1) Any portion of a street may be temporarily closed to vehicular traffic by a peace officer in order that pedestrians may have exclusive use thereof. (2) Any peace officer or town official shall have the authority to temporarily prevent parking on any street or portion thereof when, in his judgment, it may be necessary in order to prevent traffic congestion, danger or accident. (3) Notwithstanding any other provisions of this bylaw, any peace officer or town official shall have the authority to prevent parking and to prohibit traffic on any street or portion thereof to allow any work to be carried out by or on behalf of the Town of Macklin and to erect or cause to be erected traffic signs indicating the exercise of such authority. 6. RULES OF OPERATION AND CONDITION OF VEHICLES: a. The driver of a vehicle entering an alley shall yield the right of way to vehicles using the alley. b. Notwithstanding any other provisions hereof to the contrary, no person shall drive, stand or park a vehicle upon any street, alley, sidewalk or sidewalk crossing in such manner as to block, obstruct, impede, or hinder traffic and the lawful movement of traffic thereon unless he is in possession of a permit from a town official or peace officer pursuant hereto permitting him to do so in the circumstances. c. No operator of a vehicle shall drive or park within any sidewalk area or upon any sidewalk except at a sidewalk crossing. d. No operator of a vehicle shall cause or permit the wheels or other mechanical part of such vehicle to pass over or come into contact with the hose of the fire department. e. No person shall push or cause a vehicle to be pushed in excess of forty (40) kilometres per hour. f. Whenever access can be had to an alley, all deliveries or collections of commodities to or from stores, restaurants, hotels and other commercial buildings shall be made therefrom. g. No person driving a vehicle shall cause it to cross a public highway within the town with the intent to park on the opposite side. h. No person operating a vehicle shall cause the wheels to spin unnecessarily. 7. POWERS OF COUNCIL: The Council may, upon the report of a peace officer that a hedge, shrub, tree or fence situated at an intersection is dangerous to traffic, by resolution order that such hedge, shrub, tree or fence be removed or shortened to such height as may be deemed necessary to overcome such danger. 8. IMPOUNDING: a. Any member of the police force, special constable or other person appointed by council may remove or cause to be removed any vehicle that is unlawfully placed, left, or kept on any street or lane, public parking place, or other public place, or on municipality owned property, and to impound or store such vehicle. b. Where a vehicle has been impounded or stored after it has been removed under subsection (a), it may be retained at a place designated by Council for a period of thirty (30) days from the date of removal unless the cost of removal, impounding and storage are sooner paid. Upon payment of the full costs herein, the vehicle may be released to the owner thereof. c. If the costs of removal, impounding, and storage are not paid within the period of thirty (30) days as specified in subsection (b), the municipality shall have the right to recover same from the owner of the vehicle by: (1) Legal action in court of competent jurisdiction; (2) By sale in public auction on publication of a notice designating the time and place of sale at least ten (10) days prior to the sale in a newspaper circulating the municipality and on sending such notice by registered mail to the owner at the address appearing on the last registration on the vehicle. 9. LITTERING: No person shall litter, nor shall any person cause or allow material (other than road building materials) to be thrown, placed, or spilled upon any street, alley, sidewalk or other person's property. Persons who violate this section shall in addition to any other penalty provided be responsible for the costs of removing such litter or materials from the street, alley, sidewalk or private property. 10. PENALTIES: a. The Summary Offence Procedure Act shall apply to penalties for the following in fractions: Speeding Section 3(h)(1), 3(h)(2), 3(h)(3) and 3(h)(4) Failing to Stop 3a. Failing to Yield 3b. Snowmobiles 3g.(1) b. Any person who contravenes any of the provisions of subsection 3c.(1) and 3c.(2), 3c.(5) of this bylaw is guilty of an offence or liable on summary conviction to the penalties provided in the General Penalty Bylaw of the Municipality. c. Any person who contravenes any of the provisions of the Sections listed below shall be liable on summary conviction to a penalty of: Section Minimum Maximum 3e. (1) $50.00 $500.00 d. (3) The Notice of Violation shall be in Form Z, Appendix 13, attached to and forming part of this bylaw. e. (1) A person who contravenes the provisions of subsections 3(j)(3) is guilty of an offence and liable on summary conviction to a penalty of $100.00 for the first offence and $ 200.00 for each subsequent offence. (2) A further penalty shall be imposed as follows: (i) Three dollars for each 50 kgs or fractions thereof for the first 1000 kgs in excess of the prescribed maximum gross weight allowable; and (ii) Five dollars for each 50 kgs or fraction thereof in excess of 1,000 kgs that the actual gross weight exceeds the prescribed gross weight allowable, provided that in computing the further penalty, 500 kgs, or two percent of the maximum gross weight fixed by this bylaw, whichever is the lesser, shall not be taken into account. (3) In each instance, the total fine shall not exceed the maximum provided for in the general penalty bylaw of the municipality. f. The penalty for the contravention of Section 3(l) (1), (2), (3), (4) and (5) is as follows: (1) For the first infraction impounding the bicycle for a minimum of 24 hours or a maximum of 7 days. (2) For the second or additional infractions, impounding the bicycle for a minimum of 72 hours or a maximum of 14 days. g. The penalty for operating snowmobiles before 7:00 a.m. or after 11:00 p.m., under Section 3(g)(1) shall be $100. 11. Bylaws No. 01/10, 03/11, 05/13, 11/14, 08/18 and 11/18 are hereby repealed. 12.
