## By-law 2025-002
## Consolidated Traffic Bylaw to Regulate the Operation
## Village of Mortlach, Saskatchewan of Vehicles
Pursuant to Part IlI, Division 3 of the Municipalities Act, the Council of the Village of Mortlach, in the Province of Saskatchewan, enacts as follows:
## 1. DEFINITIONS
- (1) In this bylaw, except where otherwise required, words shall be given the same meaning as may be defined by The Traffic Safety Act, including the definition in that Act of the following words:
- highway;
- median;
4. motor vehicle;
5. parking;
- peace officer;
- pedestrian;
8. snowmobile;
9. stop;
- traffic control device;
- traffic lane;
- vehicle.
- (2) In this bylaw, the following words shall be given the meaning stated below:
- a. "Administrator" means the person authorized by Council to occupy that position, and shall have the same meaning as contained in the Municipalities Act;
- b. "All-Terrain Vehicles (ATV)" shall have the same meaning as provided in the All-Terrain Vehicles Act, Chapter A-18.02
- c. "Angle parking" means the parking of vehicles with the right front wheel drawn up to the curb on the right-hand side of the highway, or at a distance of not more than 30 centimeters from such curb, the vehicle to be place at an angle of 45 degrees with the curb;
- d. "Chief Administrative Officer (CAO)" has the same meaning as Administrator;
- e. "'Chief of Police" shall be deemed to be the Senior RCMP Officer responsible for the Mortlach area, or designee;
- f. "Curb" means the lateral boundaries of a highway, whether or not marked by solid barrier;
- g. "Dangerous good" means a dangerous good within the meaning of The Dangerous Goods Transportation Act and any regulations pursuant to that Act;
- h. "Dangerous Goods Vehicle" means any vehicle designed to haul dangerous goods and required to have a dangerous goods placard, including a vehicle pulling a trailer with such dangerous goods
- i. "Heavy vehicle" means:

1. a motor vehicle with a gross weight registration exceeding 12,000 kilograms;
- ii. any vehicle, including any combination of motor vehicle, trailer and load, with a weight exceeding 12,000 kilograms; or
- ili. any vehicle, including any combination of vehicle and trailer, which exceeds ten metres in length;
4. "Loading zone" means that portion of a public highway adjacent to the curb designated by signs and/or markings for the loading /unloading of passengers or goods
- k. "Lug vehicle" means any truck, portable engine or traction engine having metal spikes, lugs, or cleats projecting from the face of the wheels or tires thereof, or having metal track thread. This does not include commercially available winter studded tires;
1. "Parallel parking" means the parking of a vehicle with both right wheels thereof drawn up to the curb on the right side of the highway, or at a distance of no more than 30 centimeters from such curb;
- m. "Place of public assembly" means schools, theatres, moving picture theatres (cinemas), churches, arenas, dance halls, and public assembly halls;
- n. "Playground zone" means the zone so identified as an area where children can be expected to be playing;
- o. Public Works Manager" means the individual appointed by the Village to manage all water, waste water, roads, parks & facilities controlled by the Village;
- p. "School zone" means the area between:
- i. the traffic control device or official sign identifying an area as a school zone; and
12. the traffic control device or official sign indicating a greater rate of speed or the end of the school zone;
- q. "Snowmobiles" shall have the same meaning as defined in the Snowmobile Act, C-52. 2021
- r. "Speed zone" means any portion of the highway within the village of Mortlach as designated herein, and identified by a speed sign erected and maintained at each end thereof, indicating the maximum permissible travel speed thereto;
- S. "U-turn" means the turning of a vehicle so as to cause it to proceed in the opposite direction of travel from which it was proceeding immediately prior to the commencement of such turns;

2. SCOPE
- a. "STOP" streets
- i. Where regulatory signs are posted, the streets and avenues listed k) in APPENDIX A are designated as "STOP" streets,
- b. "YIELD" streets
5. Where regulatory signs are posted, the streets and highways listed in APPENDIX B are designated as "YIELD" streets,
6. с. "SPEED" Restrictions
7. The maximum travel speed on all roads in the Municipality is 40 km/h, unless otherwise posted
- ii. Roadways with maximum travel speeds other than 40km/h are shown in APPENDIX D.
3. INFRACTIONS
- a. The provisions of subsections 3(d), and 3(k) shall not apply to vehicles being operated by municipal employees in the conduct of their

- i. The provisions of the Traffic Safety Act, Chapter T- 18.1 shall apply to all traffic approaching and facing a "Stop" sign erected and maintained in accordance with the provisions of Section 4(a)
13. с. "YIELD" Streets
- i. The provisions of the Traffic Safety Act, Chapter T- 18.1 shall apply to all traffic approaching and facing a "YIELD" sign erected and maintained in accordance with the provisions of Section 4(a)
- d. "NO PARKING"
No motorist shall park a motor vehicle:
- i. Where "No Parking" signs are posted, as shown in APPENDIX C;
- ii. Within five (5) metres of a fire hydrant, any laneway or intersection;
- ill. Where the right wheels are greater than 30 cm from the curb
- iv. Other than parallel to the curb
- v. So as to block, or impede the travel of another motorist in any laneway or highway, unless actively engaged in loading or unloading of persons or goods, in which case the blocking vehicle shall not rest for a period exceed thirty (30) minutes;
- vi. So as to block the driveway or entrance of a residence, business, or institutional facility;
- vii. On any highway at one place for a period of time exceeding seventy-two (72) hours;
- vili. In excess of 4,500 kgs on any residential street;
- ix. On private property without the express approval of the property owner or designated occupant;
- x. That is designed for carrying of Dangerous Goods within thirty (30) metres, or in accordance with the Transportation of Dangerous Goods, whichever is the greater, from any building in the municipality used or intended for use, in whole or part, as a place of dwelling, a hotel, or place of public assembly;
- xi. Nothing in Sub-section (i) 7 shall be deemed to restrict the parking of such vehicle for such period of time as may be necessary to take on or discharge cargo.

## e. "MISCELLANEOUS" signs
- No person shall, except where authorized by a resolution of Council or where duly authorized by law, erect upon or immediately adjacent to any highway, any sign, marker signal or light, or any advertising sign or device
- ii. No person shall deface, damage, destroy or remove any sign or marker erected pursuant to this by-law.
- f. "'SPEED RESTRICTIONS"
- i. No person shall drive at a rate of speed in excess of the maximum speed, posted or otherwise, on any road in the Village.
- g. "HEAVY TRUCKS"
- No person shall operate a Heavy Truck as defined in this By-law on a roadway within the Village of Mortlach unless such travel is for the express purpose of delivery or collection of goods.
- ii. Operators of Heavy trucks shall utilize the approved TRUCK ROUTE as shown in APPENDIX E.
- h. "BICYCLES"
- i. Bicycles are to be ridden on the right side of the highway, with the flow of traffic.
- ii. All persons under the age of 14 years are required to wear a helmet approved by the Canadian Standards Association.
- i. "SCHOOL ZONE"
- i. When approved signs are posted, the area adjacent to a school shall be designated as a SCHOOL ZONE.

- No person shall propel, operate, or drive any lug vehicle upon a highway within the municipality without first having obtained from the Administrator, a permit in writing authorizing the same.
- її. The Administrator is hereby authorized to issue permits in writing for the purpose of section (i)(I) of this bylaw in any case where the applicant therefore has signed a written undertaking in Form 1, Appendix I provided that the Administrator shall not issue any such permit unless he is satisfied that with reasonable care in operation the lug vehicle may be propelled or driven over any highway without damage resulting thereto or any bridge or culvert thereon.
- iii. Nothing contained in section (I) (I) shall be deemed to preclude the transport of a lug vehicle as herein defined over any highway where the same is carried by means of a rubber-tired trailer or other conveyance equipped with rubber tires.
- k. "U"TURNS
- i. The operator of a vehicle shall not execute "U" turns on 1st Avenue East, between Rose Street and Damon Street, from 07:00 until 18:00 (7am to 6 pm) on weekdays between September 1st and June 30 of the following year.
- I. "SNOWMOBILES"
- i. Under the provisions of the Snowmobile Act C-52, and All Terrain Vehicles Act, Chapter-A-18.02, and subject to Bylaw 2025-001 us of snowmobile and ATV is unlawful within the Village of Mortlach.

- m. "SIGNS" i. Council shall cause to be erected and maintained at all Regulatory signs in support of traffic control approved and shown in the body and appendices of this bylaw. Council may bey resolution provide for the erection and maintenance on any highway, and at any designated point or points thereon, of such signs as it may deemed expedient for warning, guidance, directions or information thereon. n. "TURN RESTRICTIONS" i.
2. No motorists shall perform a manoeuvre at an intersection which is prohibited as shown in SCHEDULE G, attached to this bylaw.
4. PENALTIES
- a. Any person who contravenes any of the provisions of subsection 3 (d) (I) and 3 (c)(II) of this Bylaw is guilty of an offence or liable on summary conviction to the penalties provided in the General Penalty By-law 2022-005 (as amended) of the municipality.
5. NOTICE OF VIOLATION
- a. Penalties for moving violations shall be as approved and designated by the province of Saskatchewan and enforced by the Chief of Police.
- b. The Chief of Police may:
- i. approve a form for use as a notice of violation which may be issued by authorized persons to vehicles found in violation of designated offences for which voluntary payment as provided in Schedule "H" to this Bylaw
- il. authorize any person to issue notice of violation to any vehicle which appears to be in violation of a provision of this Bylaw.
- c. Any person who receives a notice of violation for a designated offence may avoid prosecution by making voluntary payment at the Village Office:
11. ¡. At the rate set out in Column "D" of Schedule "H" within fifteen days of issuance of the notice of violation;
- ii. At the rate set out in Column "C" of Schedule "H" after fifteen days of issuance, but within thirty days of issuance; and
- ili. At the rate set out in Column "B" of Schedule "H" after thirty days of issuance.
6. REMOVAL OF VEHICLE OR OBSTRUCTION FROM HIGHWAY
- a. The Police may move or remove or cause to be moved or removed any:
- i. vehicle that is unlawfully parked or left on any highway or other property;
- ii. vehicle owned by a person against whom fines for parking offences are unpaid and due;
- ill. obstruction, encumbrance or encroachment created or left on any street, sidewalk or boulevard
- b. Any costs incurred due to Subsection (a) (i), and (ii) shall be at the cost of the owner of the vehicle
- c. Any costs incurred due to Subsection (iii) shall be assigned to the person who created or left the obstruction, encumbrance or

encroachment and may destroy or otherwise dispose of the object without further notice.
## 7. IMPOUNDMENT
- i. Where a vehicle is removed under authority of this Bylaw, the vehicle shall be impounded and stored for a period of up to thirty days during which the owner, on providing proof of ownership, may recover the vehicle by paying the cost of removal, storage fees and any unpaid parking fines.
- ii. Any impounded vehicle not redeemed within thirty days may be sold or otherwise disposed of and the proceeds from such sale or disposal applied to the cost of removal and storage fees or to any unpaid fines imposed on the owner under this Bylaw.
## 8. SEVERABILITY
If any section, subsection, clause or other portion of this Bylaw is for any reason found to be invalid, that portion shall be deemed a separate, distinct and independent provision and shall not affect the validity of the remaining portions of the Bylaw.
## 9. ADOPTION AND REPEAL
- Effective Date of Bylaw
1. This Consolidated Traffic Bylaw #2024-007 comes into effect upon passing of third reading or, where required, upon approval of The Highway Traffic Board.
- li. The following Bylaws are Repealed
- Bylaw 40(1) being the Consolidated Traffic Bylaw,
- By-law 41 being a Stop Street Bylaw
- Bylaw 65 being a common 40 km/h speed limit within the Village
- Bylaw No. 2016-002, being Regulate and control the Operations of Snowmobiles/ATV's within the Village of Mortlach
- Bylaw 2024-007 Consolidated Traffic Bylaw
