INTERPRETATION - 3.1 In this Bylaw, unless the contest otherwise requires, the expression(s): - (a) Accessible Parking shall mean all that portion of any roadway or other public place or public parking lot that has been designated by sign or other marking for the exclusive use of accessible parking; - (b) Accessible Person's Vehicle shall mean any vehicle which displays a special license plate or placard depicting thereon the international symbol of the disabled issued by the Province of Saskatchewan or other competent governmental jurisdiction; - (c) Act shall mean The Traffic Safety Act, S.S. 2004, c. T-18.1 and amendments thereto, or any other Act enacted in its stead; - (d) Alley shall mean a public highway intended primarily to give access to the read of property; - (e) All Terrain Vehicle shall mean any vehicle intended for off-road recreational use, with respect to which a certificate of registration under The Traffic Safety Act of Saskatchewan cannot be issued, and which is propelled or driven by any other means than muscular power; - (f) Angle Parking shall mean the parking of vehicles with the right front wheel drawn up on the right-hand side of the roadway, or a distance of not more than thirty (30) centimeters from such curb, the vehicle to be placed at an angle of forty-five (45) degrees with the curb; - (g) Bicycle shall mean any muscular propelled, chain-driven wheeled device in, on, or by which a person or persons may be transported or drawn and shall include: - (i) any device adapted from a bicycle by the addition of one (1) or more wheels; - (ii) a unicycle; - (iii) a motorized bicycle that is propelled by a combined muscular and electrical-assisted power, fitted with pedals that are operable to propel it, weighing no more than 35 kilograms and does not have sufficient electrical power to attain a speed greater than 34 km/h on level ground within a distance of two km from a standing start which a person may ride, regardless of the number of wheels it may have; - (h) Boulevard shall mean that portion of property located between the curb lines or the lateral lines of a roadway and the adjoining property line exclusive of the sidewalk, also the portion of a street between the curb lines or lateral lines of a divided highway; - (i) Central Park shall mean all that area of the Town of Nipawin described as Block H, Plan No. BR 820, Block L and X, Plan No. BL 1454, Lot 1, Block L, Plan 73PA05762; Block R22, Plan No. 73PA05068, and Blocks N and O, Plan No. 76PA24894; - Chief Administrative Officer (CAO) shall mean the Chief Administrative Officer of the Town of Nipawin; - (k) Chief Of Police shall mean the Officer in charge of the Royal Canadian Mounted Police for the Town of Nipawin and anyone authorized to act on the Officer's behalf of the Chief Administrative Officer of the Town of Nipawin or anyone authorized to act on the Chief Administrative Officer's behalf; - 11) Council shall mean the Council of the Town of Nipawin; 2. (m) Contractor shall mean a person who contracts, sub-contracts, constructs, alters, maintains, repairs or removes buildings or structures, installs heating, plumbing or other fixtures, painting and/or allied trades including journeyman and shall include those businesses or persons engaged, under contract, in any municipal works; 3. (n) Contractor Vehicle shall mean trucks, vans, utility/cargo trailers or other such vehicles owned, leased, used and/or operated by contractors while carrying out work associated with the contractors business; - 10) Curb shall mean the dividing line of the roadway between the part of the roadway intended for the use of vehicles and that part of the roadway not so intended, whether marked with a curb or not; 5. (p) Dangerous Goods shall mean any product, substance or organism included by its nature or by the regulations in the schedule to The Dangerous Goods Transportation Act, SS 1984-85-86, c D-1.2., or any other Act enacted in its stead; 6. (a) Delivery Vehicle shall mean any commercial or public service vehicle used for the delivery or collection of commodities and/or people to and from stores, restaurants, hotels, and commercial buildings; 7. (r) Designated Officer shall mean any member of the Royal Canadian Mounted Police or any employee of the Town of Nipawin designated with responsibility for enforcing this bylaw, including, but not limited to, the Chief Administrative Officer, the Bylaw Enforcement Officer, the Fire Chief, and/or any other person designated by the CAO; 8. (s) Designated Parking Areas shall mean an area reserved for the parking of motor vehicles and marked as such by billboard or sign erected by or on the authorization of the Town in the care of a school ground, by the appropriate school authority for that purpose; 9. (t) Double Parking shall mean the parking of a vehicle on a street parallel to a vehicle parked beside the curb in a parking area, or parking to the rear of any vehicle that is angle parked at the curb in a parking area. 10. (u) Driver (passengers excluded) includes a person leading, riding, or driving one or more horses, the rider of a bicycle or motorcycle, and also the operator of any vehicle; - (v) Emergency Vehicle shall mean fire engines, fire department apparatus, ambulances and police motor vehicles when on emergency duty only, as well as private vehicles operated by members of the Nipawin Fire Department but only whilst being used as a conveyance to answer a fire alarm, whilst parked at or near the scene of a fire, or parked in the block in which the Fire Hall is situated, shall be deemed to be emergency vehicles; - (w) Fire Lane shall mean that area designated by signs or markings as a fire lane; - (x) Garage shall mean any building or part of a building where motor vehicles are store or repaired, and includes an automobile sales room or automobile showroom; - (y) Heavy Vehicle shall mean a vehicle with a trailer attached, having a maximum gross vehicle weight (GVW) of 5,500 kg or more, or exceeding 10.7 m in total length, recreation vehicles excepted; - (z) Highway means a public highway as defined in The Highways and Transportation Act, R.R.S. c. H-3, within the corporate boundaries of the Town of Nipawin, and includes an alley or lane; - (aa) Impound shall mean and includes the seizure, removal and detention of a vehicle; - (bb) Intersection shall mean the area where two or more roadways meet or cross each other but does not include a lane intersection; - (cc) Keeper shall mean any person who owns or keeps a taxicab for hire; - (dd) Lane shall mean a public roadway intended primarily to give access to the rear of real property; - (ee) Lane Crossing shall mean that portion of a sidewalk within the boundaries of the lane projected; - (ff) Lane Intersection shall mean that area where a lane meets a roadway; - (gg) License Inspector shall mean the officer appoint by Council who shall be directly responsible for the supervision and control of the issue of taxicab licenses. - (hh) Loading Zone shall mean the portion of a roadway adjacent to the curb designated by signs and/or markings for the exclusive use of vehicle loading or unloading passengers or goods; - (ii) Lug Vehicle shall mean any truck, portable engine or traction engine having metal spikes, lugs or cleats projecting from the face of the wheels or tires thereof or having a metal track tread; - (ji) L.P. Miller Comprehensive School Grounds shall mean Blocks 4 and 5, Plan No. 70PA02362, in the Town of Nipawin; - (kk) Mobility Scooter shall mean a motorized vehicle designed to be ridden by one person, which is principally for the purpose of transportation of handicapped, disabled, or elderly people; - (1I) Motorcycle shall mean a licensable motor vehicle, other than a tractor, that: - (i) is designed to travel on not more than three wheels on the ground; - (ii) is a motor scooter; and/or - (iii) has a seat or saddle for use of the rider sitting astride thereof and includes a bicycle with a motor attached by which it is driven; - (mm) Motor Vehicle shall be as defined by The Traffic Safety Act of Saskatchewan; - (nn) One-Way Street shall mean a street or land designated as one upon which vehicles shall move only in the direction indicated. - (00) Operator shall mean a person who drives, operates, or is in charge of a vehicle on a public roadway and shall also include: - (i) a person leading, riding, or driving one or more horses; and - (ii) a person who owns or keeps a taxicab for hire; - (pp) Owner shall mean the Owner as defined by The Traffic Safety Act of Saskatchewan and shall also include: - (i) a person who is in possession of a snowmobile under a contract by which they may become the owner of the snowmobile upon fill compliance with the terms of the contract; and - (ii) any persons who owns or keeps a taxicab for hire; - (99) Parade shall mean any procession or body of pedestrians (excepting the Armed Forces or a bona fide Veterans Association) numbering more than fifty, standing, marching or walking on any roadway or sidewalk, or any group of vehicles numbering ten or more (except Funeral Processions) standing or moving on any roadway, proceeding under a common leadership; - Parallel Parking shall mean the parking of a vehicle with both right wheels thereof drawn up to the curb on the right hand side of the roadway or at a distance of not more than thirty (30) centimetres from such curb and shall also include, in the case of one-way roadways and other roadways that allow a vehicle with both left wheels thereof drawn up to the curb on the left hand side of the roadway; - (ss) Parking shall mean the standing of a vehicle whether occupied or not, upon a roadway, otherwise than temporarily in obedience to traffic regulations or traffic signs or signals; - (tt) Parking Area shall mean a portion of a roadway or an area indicated by signs or markings or parking meters as a place to park; - (uu) Pedestrian shall mean a person traveling on foot or confined to a wheelchair, whether powered by human power or by motor, and shall include a baby carriage or an invalid's chair; - (vv) Pedestrian Crosswalks shall mean: - (i) that portion of a public roadway designated by signs, signals, and/or pavement markings, or combination thereof, for the use of pedestrians to cross a public roadway; - (ii) where there are no signs or pavement markings, that portion of a public roadway within the prolongation of the lateral boundary lines of the adjacent or intersecting sidewalk at the end of a block; or - (iii) where there are no signs or pavement markings, that portion of the roadway measured five metres back from the street intersection and parallel across the public roadway; - (ww) Person shall mean a firm, company, corporation, or partnership as well as a man, woman or child; - Power Unit shall mean a motor vehicle designed and used primarily for pulling a semi-trailer: - (yy) Public Place shall mean any place within the corporate boundaries of the Town to which the public has access as of right or by invitation, expressed or implied, and for greater certainty but not to restrict the meaning thereof, shall include dance halls, theatres, skating and hockey rinks, curling rinks, churches, church halls, meeting halls, restaurants, beer parlors, bowling alleys, poolrooms, hotels, motels, motor hotels, stores malls, L.P. Miller Comprehensive School grounds, Wagner Elementary School grounds, Central Park, and all other school grounds, parks, playgrounds and public reserves. - (zz) Public School Zone shall mean a school, public as defined in the Town Zoning Bylaw; - (aaa) Recreational Vehicle shall mean a self-propelled or towed vehicular type unit, primarily designed as temporary living quarters for recreational, camping or travel use and which is used solely as a family or personal conveyance and in no way used for commercial purpose. Without limiting the foregoing, recreational vehicles include: - (i) Travel trailer; - (ii) Cabin trailer; - (111) Tent trailer; - (iv) Truck camper; - (v) Motor home; - (vi) Park trailer; - (vii) Fifth-wheel travel trailer; - (viii) Boat Trailer; or - (ix) Utility trailer; - (bbb) Roadway shall mean a road, parkway, driveway, square or place designated and intended for or used by the general public for the passage of vehicles, but does not include any area whether privately owned that is primarily intended to be used for the parking of vehicles and the necessary passageways on that area, and does not include a provincial highway within the municipalities as designated pursuant to the provisions of The Highways and Transportation Act, RSS 1978, c H-3, or any other Act enacted in its stead; - (ccc) School Bus shall mean a motor vehicle designed for the conveyance of school children and other people. For the purpose of this Bylaw where the term Truck is used, it shall be deemed to include School Bus; - (ddd) School Patroller shall mean any person designated by the North East School Division, or the principal of any school within the Town, as a School Patroller; - (eee) Semi-Trailer shall mean a vehicle that is at any time drawn on a highway by a motor vehicle and that is designed for the conveyance of goods or as living quarters for persons and so that its weight and the weight of its load is carried partly on its own axles and partly on another vehicle, but does not include: - (i) a farm implement; - (ii) a timber or metal beam with wheels attached used for the purpose of moving buildings; - (iii) an asphalt distributor used for the construction or maintenance of bituminous surfaced highways; or - (iv) an axle unit with a fifth wheel assembly used to convert a semi-trailer to a trailer; - Short-term Permit means a permit not exceeding 7 calendar days, which has been approved by the Chief Administrative Officer; - (8gg) Sidewalk shall mean that portion of a roadway intended primarily for use by pedestrians, including walking trails; - (hh) Sidewin Crossor seal men thathortir tof sidewalk permanently improved - (iii) Sight Triangle shall mean the triangular area formed, on corner sites, by the intersecting front and side site lines at a street intersection and the straight line joining said lines at points which are 6.0 metres distant from the point of intersection, measured along said site lines; - (ji) Skateboard shall mean to include skateboards, longboards, and other similar sport equipment; - (kkk) Skateboarding shall mean to include the act of using a skateboard, longboard, and other similar sport equipment; - Sound Truck shall mean any vehicle from which the advertising of any commodity or thing, or of any entertainment or sporting or other event is emitted, or form which a public address is made; - (mmm) Snowmobile shall mean a snowmobile as defined by The Snowmobiles Act, R.S.S. c. S-52; - (nnn) Stop shall be as defined by The Traffic Safety Act of Saskatchewan; - (000) Street Or Avenue shall mean that portion of every highway, public road, street, avenue, alley, bridge, park drive or public place in the Town intended for use by vehicles; - (ppp) Taxicab means a vehicle which is employed in the conveyance of passengers for hire except: - (i) an ambulance; - (ii) a bus; - (iii) a vehicle especially designed to transport, for hire, persons confined to wheelchairs along with the said wheelchairs, and which does not carry for compensation any other type of passenger; - (iv) a vehicle known as a U-Drive vehicle which is rented without a driver; - (v) a vehicle approved for use as a limousine by the License Inspector; - (vi) A vehicle approved for use as a transportation depot limousine by the License Inspector; and - (vii) Vehicles restrictively licensed by a valid and subsisting Operating Authority Certificate issued pursuant to The Traffic Safety Act, and/or The Motor Vehicles Transportation Act (Canada, 1987), to provide specialized non-emergency transportation for hire for medically stable passengers and for medical purposes; - (999) Tractor Trailer means a transport vehicle consisting of a semi-tractor and attached trailer.; - (rrr) Traffic shall mean pedestrians, ridden or herded animals, vehicles, buses, and/or other conveyances either singly or together while using any roadways; - (ssS) Traffic Sign shall mean any sign, signal (other than traffic signals), marking, or other device placed, painted, or erected for the guidance, regulation, warning, direction, or prohibition of traffic, parking, or stopping; - (ttt) Traffic Signal shall mean a device whether manually, electrically, or mechanically operated for the purpose of directing, warning or regulating traffic by ways of an illuminated signal; - (uuu) Truck Route shall mean the established route to be followed by trucks when traversing streets within the Town As outlined in Schedule CE; - (vvv) Town shall mean the Town of Nipawin in the Province of Saskatchewan; - (www) U-Turn shall mean the turning of a vehicle so as to cause it to proceed in the opposite direction from which it was proceeding immediately prior to the commencement of such turn; - (xxx) Vehicle shall be as defined by The Traffic Safety Act of Saskatchewan; - (yyy) Wagner Elementary School Grounds shall mean all the area in the Town of Nipawin, described as Block RIZ, Plan No. BY 6799, Block R12A, Plan No. CH 640; Lot 13, Block 16, Plan CH 640 as amended by Master of Titles Order No. 72PA13624; and Lot 14, Block 16, Plan CH 640 as amended by Master of Titles Order No. 72PA13624. ## DEFINITION - 4.1 Other words and expressions used in this Bylaw shall have the same meaning as given them in the Act. ## GENDER - 5.1 Except where the context otherwise requires, all references to any gender shall be deemed to include all genders. ## 6. VALIDITY - 6.1 If any section, clause or provision of this Bylaw is for any reason declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the Bylaw as a whole or any part thereof, other than the section, clause, or provision so declared to be invalid. ## SECTION II: STOPPING AND PARKING ## 7. NO STOPPING - 7.1 No operator of a vehicle shall stop such vehicle in any of the following places, except when necessary to avoid collision or conflict with other traffic or in compliance with the directions of a Designated Officer or traffic sign or signal: - (a) On the driving lane of any roadway; - (b) Within an intersection; - (c) On a pedestrian crosswalk; - (d) On a sidewalk or sidewalk crossing; - (e) Within eight (8m) metres (26 feet) of the driveway entrance to any fire station; - (f) With its left-hand side to the curb of any street, except on any one-way streets; - (g) On a boulevard or sidewalk or the area set aside for a boulevard or sidewalk; or - (h) On any street as set out in Schedule HH attached to and hereby forming a part of this Bylaw. ## 8. ANGLE PARKING - 8.1 Upon all the undermentioned streets all vehicle shall be parked at an angle, with the curb, of between forty (40) and fifty (50) degrees, between the pavement markings, and with the right front wheel not more than thirty (30) centimeters from the edge of the curb: - (a) First Avenue West from Centre Street to Third Street West; - (b) On the Northwesterly side of First Avenue East from Centre Street to the Southwesterly boundary of Lot 22, Block 17, Plan CD 1465, and on the Southeasterly side of First Avenue East from Centre Street to Third A Street East; and - (c) Centre Street from Railway Avenue to Second Avenue. - 8.2 No vehicles shall be parked at such an angle that the rear thereof shall not extend more than six (6) metres (20 feet) from the curb. - 8.3 No portion of any vehicle may protrude over a "No Parking" area. ## METHOD OF PARKING - 9.1 Except when necessary in obeying traffic regulations or traffic signs or signals, unless otherwise authorized by order of the Town, except as further provided in this Bylaw, no operator of a vehicle shall stop, stand, or park such vehicle in a roadway other than parallel with the curb and with the right side wheels of the vehicle not more than thirty (30cm) centimeters from the curb and within the limits of the designated parking stall, and where there is no curb, with the right side wheels as near to the right hand limit of the roadway as is practical. ## 10. PARKING ON PUBLIC PARKING LOTS - 10.1 Parking on public parking lots shall be limited to use only by patrons of the attached public facility or at the discretion of the Town. ## 11. NO PARKING - 11.1 No operator or owner of a vehicle shall park, or cause, or permit the parking of said vehicle: - (a) at locations where designated signage prohibits parking; - (b) at locations as set out in Schedule GG attached to and forming part of this Bylaw; - (c) at locations where signed Resident Only parking, unless a resident placard is placed face up on the dashboard of the said vehicle; - (d) anywhere within a fire lane; - (e) within three (3) metres (10 feet) of the entrance of any lane; - (f) within six (6) metres (20 feet) of a corner; - (g) within five (5) metres (16 feet) of a fire hydrant; - (h) On a boulevard or sidewalk or the area set aside for a boulevard or sidewalk; - (i) next to a curb that has been painted yellow; - (i) next to a curb that is painted blue, unless said vehicle is displaying the International sign of the disabled with license plates or placards; - (k) so that any portion of the vehicle extends over a sidewalk or sidewalk crossing; - 11) on any Municipal property where parking is specifically reserved for: - (i) Fire, Police or Ambulance vehicles, as designated by signs; - (ii) Staff only as designated by signs; or - (ili) Vehicles with license plates or placards displaying the International sign of the disabled. ## 12. ACCESSIBLE PARKING - 12.1 No person shall stop, stand, or park any vehicle in a space designated for accessible parking unless the said vehicle displays an accessible parking stick on its license plate or window as the same are provided by the Canadian Paraplegic Association. The locations of accessible parking stalls are shown in Schedule !! attached to and forming part of this Bylaw. - 12.2 Private property owners may apply to Council for approval authorizing a Designated Officer to enforce accessible parking spots on private property. ## 13. UNATTENDED VEHICLE ON JACKS - 13.1 No person shall leave a vehicle unattended on a jack or jacks with one or more wheels removed or part of the vehicle has been raised for more than three (3) hours on any roadway or on Municipal property. ## 14. INOPERATIVE VEHICLE (UNATTENDED VEHICLE) - 14.1 No person shall stand or park a vehicle or recreational vehicle on any roadway or public property for the purpose of vehicle repairs, with the exception of emergency repairs limited to three (3) hours. ## 15. DOUBLE PARKING - 15.1 No person shall double park a vehicle upon any roadway in the Town. ## 16. CONTRACTOR PARKING - 16.1 Contractor vehicles used by contractors while carrying out work inside buildings or other places of work shall be exempt from the hourly restricted parking provisions of this Bylaw, providing that any such contractor vehicle is parked adjacent to the building or place where the contractor is carrying out the work, and providing that it is carrying equipment or material necessary to the work which cannot be conveniently unloaded and kept otherwise than on or in the contractor vehicle in question. ## OPENING OF VEHICLE DOORS 17. - 17.1 No person shall open the door of a vehicle on the side available to moving traffic unless and until it is reasonably safe to do so, nor shall any person leave a door open upon the side of a vehicle available to moving traffic, for a period of time longer than necessary to load and unload passengers. ## 18. 48-HOUR PARKING - 18.1 Unless specifically stated by designated signage, no vehicle shall be parked on any street continuously for any period of time longer than forty-eight (48) hours. ## PARKING WHILE ADVERTISED FOR SALE 19. - 19.1 No operator or owner shall park or stand any vehicle displayed for sale upon any street or roadway within the Town. ## UNREGISTERED VEHICLES 20. - 20.1 No motor vehicle, which requires a license plate, shall be parked on a roadway unless it displays license plates valid for the current year or a valid permit in lieu thereof. - 20.2 No operator or owner shall park of stand any vehicle, trailer, to semi-trailer, which is not registered under the provisions of the Traffic Safety Act of Saskatchewan upon any street or roadway within the Town. ## 21. MACHINERY PARKING - 21.1 No operator or owner of a vehicle shall park or leave standing any machinery or equipment or other things not being a vehicle, on any street or roadway within the Town. ## 22. LOADING ZONE - 22.1 During the hours specified, no operator of a vehicle shall remain in a loading zone for a longer period than allowed by the designated loading zone sign for the purpose of loading or unloading passengers, merchandise, and/or goods; ## 23. HEAVY TRUCK PARKING - 23.1 No person shall park any heavy vehicle or any type of construction or farming machine or equipment on: - (a) any roadway in the Town, in an area designated in the Town of Nipawin Zoning Bylaw as a residential district to which abuts a residential development; or - (b) in a public parking lot not accessible through the designated truck rote outlined in Schedule CE of this Bylaw. - 23.2 Section 23.1 shall not apply to: - (a) Recreation vehicles; - Commercial vehicles while actively loading or unloading goods; - (c) Construction equipment being used during construction or improvement of property, provided that such equipment is parked adjacent to the property where such work is being done; - (d) Public Utility vehicles being operated for the purpose of installing, servings, or repairing public utilities; or - (e) any vehicle in which the owner or operator applies for and receives from the Town a Heavy Vehicles Parking Permit referred to in Schedule F, attached and forming part of this Bylaw: - (i) An owner or operator who is issued a Heavy Vehicle Parking Permit pursuant to this Bylaw shall clearly display the permit by fixing the permit to the vehicle in such a way so that the permit is clearly visible from the outside of the vehicle. - 23.3 No person shall leave a semi-trailer unattached from a power unit parked in a public roadway. - 23.4 No power unit attached or unattached to a semi-trailer shall be parked on a roadway or lane in any residential district at any time, unless actually engaged in loading or unloading furniture, goods, or merchandise. - 23.5 No power unit attached or unattached to a semi-trailer shall be parked on any lane in any commercial or industrial district at any time, unless actually engaged in loading or unloading furniture, goods, or merchandise. - No person shall park any semi-trailer upon any roadway unless the said semi-trailer is attached to a power unit and when so attached the semi-trailer shall be deemed part of the power unit and subject to the regulation pertaining to power units unless otherwise authorized by order of the Town. ## 24. PARKING TRUCKS AND TRAILERS - 24.1 The North side of Railway Avenue West from Centre Street to Second Street West, and the North side of Railway Avenue East from Centre Street to Second Street East shall be for the parking of such vehicles as are prohibited from parking on street where angle parking is permitted. Nothing in this section shall prohibit the parking of other vehicles in the area designated. ## 25. RECREATIONAL VEHICLE PARKING - 25.1 No operator of a Recreational Vehicle, whether attached or unattached to any towing vehicle, shall park said vehicle(s) on any roadway or alley for a period beyond forty-right (48) hours unless the operator applies for and receives a Recreational Vehicle Parking Permit referred to in Schedule BB attached and forming part of this Bylaw. - 25.2 An operator who is issued a Recreational Vehicle Parking Permit pursuant to this Bylaw shall clearly display the permit by fixing the permit to the Recreational Vehicle in such a way so that the permit is clearly visible from the outside of the vehicle. ## 26. BICYCLE PARKING - 26.1 In any block where bicycle parking racks are provided no person shall park a bicycle at any place except in such rack. ## 27. PARKING PROHIBITED IN DESIGNATED SNOW ROUTE AREAS - 27.1 No person shall park or stop a vehicle on any roadway identified for snow clearing or removal. This can be identified by snow route signage (sandwich boards) or through other designated signage or maps. - 27.2 Any vehicles parked on designated snow routes may be moved, without notice, for such distance as is necessary, or impounded by the Town at the expense of the registered owner of the vehicle. ## 28. PARKING PROHIBITED IN DESIGNATED ROADWAY MAINTENANCE AREAS - 28.1 Roadway maintenance may include, but not limited to, street cleaning, snow removal, line painting, roadway repair and other similar activities. - 28.2 No person shall park or stop on any roadway identified for maintenance. This can be identified by maintenance signage (sandwich boards) or through other designated signage or maps. - 28.3 Any vehicles parked on designated roadways where maintenance is scheduled may be moved, without notice, for such distance as is necessary, or impounded by the Town at the expense of the registered owner of the vehicle. ## CHALKING TIRES 29. - 29.1 In order to determine the time which a vehicle or recreational vehicle has been parked in a location where parking is restricted to a specific time, any Designated Officer, may place an erasable chalk mark on the tread base of the tire of the parked or stopped vehicle or recreational vehicle without such person or the Town incurring any liability for doing so. - 29.2 No person shall remove an erasable chalk mark placed under Section 29.1 above while the vehicle or recreational vehicle remains parked in the location where it was marked. ## 30. WARNING NOTICE - 30.1 In order to determine the time which a vehicle or recreational vehicle has been parked in a location where parking is restricted to a specific time any Designated Officer may place a Warning Notice as specified in Schedule N on the parked or stopped vehicle or recreational vehicle. ## SECTION III: RULES FOR OPERATION AND CONDITION OF VEHICLE ## 31. SLOW VEHICLES KEEP RIGHT - 31.1 The operator of a slow moving vehicle shall drive such vehicle as closely as possible to the right have edge of the curb unless it is impractical to travel on such side of the roadway and except when overtaking and passing other vehicles. ## 32. KEEP RIGHT ON DIVIDED HIGHWAY - 32.1 On a street or roadway divided longitudinally by a parkway, sidewalk, sunken way, viaduct, or boulevard, all vehicles shall keep to the right of such division. ## 33. NO U-TURNS - 33.1 No operator shall turn the vehicle so as to proceed in the opposite direction at any place on a street except at the intersection of a street and avenue, unless otherwise prohibited. - 33.2 No operator shall turn the vehicle so as to proceed in the opposite direction of the any street and avenue set out in Schedule J. - 33.3 The driver of a vehicle when making a legal turn at an intersection shall not proceed to do so until it shall be safe to do so. ## 34. AT LEAST ONE HAND ON THE WHEEL - 34.1 No person shall simultaneously remove both hands from the steering apparatus of any vehicle in motion. ## 35. SPACE BETWEEN MOVING VEHICLES - 35.1 A person driving a vehicle behind other moving vehicles on any street shall preserve a sufficient interval to be able to stop without accident in the event of a stop on the part of the leading vehicle. ## 36. STARTING, STOPPING OR TURNING - 36.1 Any person operating a motor vehicle on any street, shall before starting, stopping or turning from a direct line, first see that such movement can be made in safety. ## 37. ENTERING TRAFFIC STREAM - 37.1 The driver of a vehicle entering the flow of traffic from a standing position at the curb, shall yield the right-of-way to the other vehicles using the street. ## 38. CROSSING EXCEPT AT INTERSECTIONS - 38.1 Except as otherwise specifically provided in this Bylaw or allowed by traffic signs, no operator of a vehicle shall cross a roadway except at an intersection or an alley. ## 39. DRIVING FROM ALLEY DRIVEWAY OR GARAGE - 39.1 The operator of a vehicle emerging from a driveway or garage shall yield right-of-way prior to driving onto a sidewalk or onto the sidewalk area extending across any such driveway or garage entrance. ## 40. PERMITTED LEFT TURNS - 40.1 Left hand turns may be made in driving into or emerging from any alley, driveway, or garage, where turns are not prohibited by signs. ## YIELD BEFORE ENTERING STREET OR ALLEY 41. - 41.1 The operator of a vehicle entering a street or alley from private property shall yield the right-of-way prior to entering the street or alley. ## 42. ONE-WAY STREET SIGNS - 42.1 All streets as set out in Schedule O attached to and forming a part of this bylaw are established as One-Way Streets, and the erection of One-Way Signs for the said streets is hereby authorized. ## 43. AUTOMATIC TRAFFIC CONTROL LIGHTS - 43.1 Automatic Traffic Control Lights shall be erected at the locations set out in Schedule MAA attached to and forming a part of this Bylaw. ## RESPONSIBILITY OF OWNER 44. - 44.1 The owner of a motor vehicle as defined by The Traffic Safety Act of Saskatchewan shall be liable for violation of any of the provisions of this Bylaw in connection with the operation of the motor vehicle unless such owner proves to the satisfaction of the Court trying the case that at the time of the offence, the vehicle was not being operated by the owner nor by any person with the owner's consent expressed or implied. ## 45. PUBLIC RESERVES, SCHOOL GROUNDS, AND CENTRAL PARK - 45.1 No person shall operate a motor vehicle in any public reserve, school ground, or Central Park unless so authorized by the Town. - 45.2 Section 45.1 shall not apply to Town of Nipawin maintenance vehicles, North East School Division maintenance vehicles, or vehicles using a designated parking area within Central Park. ## 46. RIDING OR DRIVING ON SIDEWALKS - 46.1 No person shall ride, drive, lead or back any vehicle along or across any sidewalk except at a regular crossing unless with written permission of a Designated Official, such permission only to be granted when the Designated Official is satisfied that due precautions have been or will be taken by the applicant to protect the sidewalk from injury and that the use thereof for such purposes will not cause an unwarranted obstruction to pedestrians. ## 47. PUSHCARTS AND ANIMALS - 47.1 Every person propelling any pushcart or riding an animal upon roadway, and every person driving any animal shall be subject to the provisions of this bylaw applicable to the driver of any vehicle, except those provisions of this Bylaw which by their very nature can have no application. ## 48. HORSES OR CATTLE AT LARGE - 48.1 No person shall suffer or permit any horses or cattle to run at large on any street. ## 49. OBEY SIGNS - 49.1 No operator of a vehicle and no pedestrian shall disobey the instructions of any traffic sign or traffic signal, unless otherwise directed by a Designated Officer. ## 50. STOP SIGNS - 50.1 At a junction where two or more traffic directions are controlled by stop signs, the driver who arrives and stops first continues first. If two or more drivers in different directions stop simultaneously at a junction controlled by stop signs, the driver on the left must yield the right-of-way to the driver on the far right. - 50.2 At any three, four, or five-way stop, the first vehicle to come to a complete stop has the right-of-way. - 50.3 Stop signs shall be erected at the locations set out in Schedule Kk attached to and forming part of this Bylaw. ## 51. YIELD SIGNS - 51.1 At any intersection where a yield sign is present, driver facing the sign must yield the right of way to any other motorist approaching the intersection. - 51.2 Yield signs shall be erected at the locations set out in Schedule Lt attached to and forming part of this Bylaw. ## 52. MISCELLANEOUS SIGNS - 52.1 No person shall, except where authorized in writing by the Town or when duly authorized by law, erect upon any roadway any sign, marker, signal or light or any advertising sign or device. - 52.2 No person shall, except where authorized by the Town's current zoning bylaw or sign bylaw, erect upon any property adjacent to any roadway, any sign, marker, signal or light, or any advertising sign or device. - 52.3 No person shall place or maintain or display upon or in view of any street, any sign, signal, or device which purports to be or is an imitation of or resembles a traffic sign or signal, or which attempts to direct the movement of traffic, or which hides from view any traffic sign or signal. A Designated Officer is empowered to remove or cause to be removed without notice, any such prohibited sign, signal, or device. - 52.4 All signs shall be removed within forty-eight (48) hours following the event being advertised. ## 53. TRAFFIC OBSTRUCTION - 53.1 No vehicle operator shall drive, stop or park a vehicle upon any roadway in such a manner as to block, obstruct, impede, or hinder traffic thereon. Where the obstruction is unavoidable due to mechanical failure, the operator will not be in breach of this section provided they promptly takes measures to clear the faulty vehicle from the roadway. ## 54. STOPPING WHEN TRAFFIC OBSTRUCTED - 54.1 Notwithstanding any traffic signal indication to proceed, no driver of a vehicle shall enter an intersection unless there is sufficient space on the other side of the intersection to accommodate the vehicle without obstructing the passage of pedestrians or other traffic. ## 55. TOWING VEHICLES - 55.1 No person shall tow a vehicle on a street in an unsafe manner or with an unsafe tow rope, tow chain or other connecting device. - 55.2 No person shall tow any vehicle upon any roadway unless connection is so arranged that the towing vehicle and the vehicle being towed are separated by more than two and one-half (2.5m) meters. ## 56. MAXIMUM SPEED - 56.1 No person shall drive any vehicle at a speed greater than 50 km/h unless otherwise posted by designated signage. ## 57. VEHICLE NOT TO BE DRIVEN ON SIDEWALK - 57.1 No operator shall drive, park, or operate a vehicle within, upon, across or over any sidewalk area, except at a permanent or temporary driveway, nor upon any pedestrian path in a public park, unless under the direction of the Town. - 57.2 Any person who damages any sidewalk by crossing or driving on it with a vehicle contrary to this Bylaw shall be responsible for the cost of repairing any damage caused to the sidewalk. - 57.3 No person shall build, construct, or install any type of access road, path, or driveway for the purpose of access from any private property to any roadway or sidewalk without first having obtained the written approval of the Town. ## 58. BACKING-UP OF VEHICLES - 58.1 An operator of a vehicle, prior to driving a vehicle in reverse on any roadway, shall give ample warning of intention to do so, and shall not reverse unless such movement can be made without interfering with other traffic and can be made without injury to person or property. - 58.2 No person shall drive a vehicle in reverse around the corner of any roadway at any time or along any street except when reasonably necessary in entering or leaving a parking area. ## 59. FOLLOWING EMERGENCY VEHICLES - 59.1 When any emergency vehicle, including a fire truck, has emergency lights and/or sirens engaged, no vehicle shall follow at a distance of less than fifty (50m) metres. - 59.2 No person driving or operating a vehicle shall cause the said vehicle to pass over or interfere with a fire hose. ## 60. DRIVING ON PLAYGROUNDS AND PARKS - 60.1 No person shall drive a vehicle upon or across a public playground, park, or green space without written permission of a Designated Officer or other authorized person. ## 61. SPLASHING OF PEDESTRIANS - 61.1 When water, mud, or slush is lying on any roadway, the driver of every vehicle shall drive on the roadway so as to avoid splashing any pedestrian. ## 62. UNNECESSARY NOISE, THROWING GRAVEL - 62.1 No person shall drive a vehicle on any roadway or parking lot in such a manner as to cause the tires to make excessive, unusual, or unnecessary noise. - 62.2 No person driving a vehicle on any roadway or parking lot shall accelerate the vehicle to such an extent so as to cause the tires to slide, spin, or throw gravel or other substances. - 62.3 This Section of the Bylaw shall not apply to any Designated Officer while engaged in the performance of assigned duties, not any other emergency vehicle in the performance of duty. ## 63. SCHOOL BUS ROUTE - 63.1 The public school division shall designate, subject to the approval of the Town, school bus routes and shall notify the Town in writing of any changes in the said routes. ## 64. SCHOOL PATROL - Any driver approaching and facing a stop sign being displayed by a School Patroller shall bring their vehicle to a complete stop, and shall not proceed or permit their vehicle to enter the pedestrian crosswalk until the stop sign is no longer being displayed by the School Patroller. ## 65. COMPRESSION RELEASE ENGINE BRAKES - 65.1 No person shall operate, apply, or use compression release engine brakes, except in the case of an emergency, when the operation of such brakes is necessary to avoid the possibility of a collision or dangerous situation. ## 66. MOBILITY SCOOTER - 66.1 Mobility scooters operating on any public roadway are strongly encouraged to display a red, yellow or orange flag with a total surface area not less than 500 cm2 (77.5 inches2) at a height of not less than 1.5 metres (4.92 feet) from the ground. ## SECTION IV: VEHICLE WEIGHTS AND REGULATIONS ## 67. GENERAL - 67.1 Council may by resolution, from time to time designate certain public roadways within the boundaries of the Town as truck routes. ## 68. HEAVY VEHICLE ROUTE - No person shall, without a permit, operate a heavy vehicle on any roadway within the Town, except on a roadway designated as a truck route as set out in Schedule CE attached to and forming a part of this Bylaw. ## 69. DAMAGE TO ROADWAYS - 69.1 No person shall use a vehicle on a roadway if the vehicle would cause damage to the roadway surface. ## 70. MAXIMUM LENGTH/OVERSIZED AND WEIGHT RESTRICTIONS - 70.1 On all public highways designated as truck routes, the maximum gross vehicle weight (GVW) permitted, including the weight of the vehicle, on the road surface shall be those weights as established by Sask. Highways and Transportation for primary roadways and shown on Schedule C€ attached to and forming a part of this Bylaw. - 70.2 Notwithstanding Section 70.1, the maximum gross vehicle weight is subject to any lower weight restrictions imposed pursuant to The Highways and Transportation Act or The Municipalities Act of Saskatchewan. - A Person shall not Park any of the following for more than 1 consecutive hour on a Roadway in an area designated as a Residential Zone or Public School Zone: - (a) a Motor Vehicle in excess of seven meters, excluding the length of an attached trailer; - (b) a trailer not attached to a Motor Vehicle, which is not actively being loaded or being unloaded; or - (c) a Tractor Trailer, in whole or in part, unless it is actively engaged in loading or unloading. ## 71. EXEMPTIONS TO VEHICLE WEIGHTS - 71.1 The maximum gross vehicle weights shall not apply to: - (a) motor vehicles designed specifically to convey garbage; - (b) buses used for public transportation; or - (c) emergency vehicles. - 71.2 Notwithstanding the provisions of Section IV herein, the following heavy vehicles are hereby authorized to be operated on roadways other than truck routes: - (a) tow trucks, while being operated for the purpose of servicing disabled vehicles; - (b) Public passenger vehicles being operated for the purpose of receiving or delivering passengers; - (c) Public Utility vehicles being operated for the purpose of installing, servicing, or repairing public utilities; - (d) Town-owned vehicles being operated in the service of the Town; - (e) Commercial vehicles delivering or collecting goods, provided that the most direct route to or from the nearest truck route is used, and if such deliveries or collections are made to a residential area, only between the hours of 7:00 a.m. and 11:00 p.m. on any date; or - (f) Sightseeing or tour buses. ## 72. SINGLE TRIP PERMIT - 72.1 Whenever it shall be necessary to transport a single article which cannot be divided, and which exceeds the weight restrictions set out in Section 70.1 or exceeds 20 metres total length, over the streets or alleys of the Town, the same shall be done only after issuance of a special permit for a single trip with the load to be transported. A Designated Officer is hereby authorized upon application to grant such special permit found at Schedule EE in writing for the moving of any such heavy single article which cannot be divided, provided that the person, film or corporation making such application may be required to furnish a bond or an amount to be fixed by the Chief Administrative Officer of the Town of Nipawin. Such bond shall be payable to the Town and shall save the Town harmless from any claim, loss or damage that may result from the granting of such permit, or that may arise from or on account of any work done thereunder. The grantee shall restore at their own cost to a condition satisfactory to a Designated Officer any pavement, subway, tunnel, sewer pipe, conduit, or other property that may be injured by reason of the transportation of such article under such permit and the Designated Officer in granting such permit shall, whenever it may appear necessary to do so in order to protect the pavement of the Town or to prevent obstruction to traffic, limit the said permit as to time and particular street or streets to be used, and impose such other special condition as may be deemed necessary to prevent injury or damage to the Town or the Town's property - 72.2 Whenever a freight-carrying vehicle passing over any street or alley of the Town is found to be operating in violation of the provisions of Section IV, such vehicle shall not be permitted to proceed further until the excess load is reduced or permit occurred to comply with the provisions of this Section. ## 73. DELIVERIES WITHIN TOWN - 73.1 The driver of every heavy vehicle exceeding the weight restrictions outlined in Section 70.1 shall follow the marked Heavy Vehicle Route. The driver of any heavy vehicle or other vehicle in excess of the weight restrictions outlined Section 70.1 found travelling on any street or avenue other than those designated as the Heavy Vehicle Route shall be in violation of the Bylaw excepting in those cases where a heavy vehicle or other vehicle is required to leave the Heavy Vehicle Route for the purpose of pick-up or delivery, in which case the driver shall do so by the most direct route to the consignee or shipper and shall return to the Heavy Vehicle Route by the most direct route. ## 74. MEASUREMENT OF WEIGHT - 74.1 A Designated Officer having reason to believe that the gross weight of a vehicle and its load is in excess of the maximum gross weight prescribed by this Bylaw may weigh the same by means of a portable or stationary scale and may require the person in charge of the vehicle to take the vehicle to the nearest scale. - 74.2 In any prosecution for a violation of the provisions of this section the onus of proof shall be on the accused. - 74.3 Where a vehicle is weighed using a portable weigh scale approved by the Minister of Highways, a Designated Officer shall immediately advise the operator of the vehicle that in lieu of having the weight determined using the portable weigh scale, the operator has the right to immediately take the vehicle to the nearest weigh scales certified by an inspector within the meaning of the Weights and Measures Act (Canada) that are capable of weighing the vehicle. - 74.4 Where the operator of the vehicle decides to have the vehicle weighed at the nearest weigh scales, a Designated Officer has the power to take any steps that the operator considers necessary to ensure that no alteration in the weight of the vehicle or the distribution of the weight of the load occurs during transit to the weigh scales. - 74.5 No operator of a vehicle shall take any action to alter the weight of the vehicle or the distribution of the weight of the load during transit to the weigh scales. ## 75. TOWN VEHICLE EXEMPTION - 75.1 The provisions of Section IV shall not apply to any persons operating a heavy vehicle owned by the Town while in use in the service of the Town. - 75.2 This Section shall not apply in the case of any vehicle owned or hired by the Town, or which is owned or hired by any person who is carrying out a contract or contracts within the Town for the purpose of any Public Works or works of the Town provided however, that in the latter case such vehicle must be actively used in connection with such Public Works or works. ## 76. SIZE OF LOADS - 76.1 No loads exceeding in width 2.6 metres, in height 4.15 metres, in length 20.0 metres shall be moved over any street or alley unless authorized by a special permit issued by a Designated Officer in accordance to this or any other Bylaw of the Town, except loose hay, straw or fodder, carried on vehicles other than a motor vehicle which may have a width of three 3.0 metres. ## 77. COVERING OF LOAD - 77.1 No person shall operate any vehicle transporting ashes, garbage, trade waste, refuse, or debris of any kind or description whatsoever, along or over any roadway unless the load is covered with appropriate materials to sufficiently cover all waste, refuse or debris and securely fastened in order to prevent any material from being ejected or blown onto roadways during transportation. ## 78. SPILLING MATERIAL - 78.1 Should any material being transported be spilled on roadways, it shall immediately be removed by the responsible party. The area shall be left in as clean and usable state as prior to the incident. The Town may recover any costs, from the responsible party, if personnel or designates of the Town are required to complete the necessary cleanup. - 78.2 If the material described in subsection (1) is a dangerous good as described under The Dangerous Goods Transportation Act, then the spill response procedure contained in The Dangerous Goods Transportation Act must be strictly followed. ## 79. METAL SPIKES, LUGS, OR CLEATS AND STUDDED TIRES: - 79.1 No person shall propel, operate, or drive on any roadway: - (a) a vehicle or trailer having metal spikes, lugs or cleats or bands projecting from the surface of the wheel or tire of such vehicle; or - (b) any vehicle or trailer having skids or tracks. - 79.2 The provisions of this section shall not apply to vehicles: - (a) equipped with studded tires that are designed for, and being used to, increase traction on ice or packed snow; or - (b) who have obtained the required permit found in Schedule DD. ## SECTION V: BICYCLES, MOTORCYCLES, AND ALL TERRAIN VEHICLES ## 80. GENERAL PROHIBITION - 80.1 No person shall operate an All-Terrain Vehicle in any public place whether or not such public place is marked by a sign prohibiting or restricting the operation of All Terrain Vehicles ## 81. TWO ABREAST - 81.1 All persons shall ride a bicycle or operate a motorcycle on a roadway with said operators in single or double file, and at no time shall a bicycle or motorcycle be operated more than two abreast except for the purpose of passing. ## 82. PASSENGERS - 82.1 No person shall operate a bicycle, except a tandem bicycle, with more than one person unless such bicycle is equipped with a passenger carrier mounted in accordance with manufacturers' instructions and the passenger is mounted behind the operator of the bicycle. ## 83. USING THE HANDLEBARS - 83.1 No person shall operate a motorcycle or ride a bicycle without having at least one hand on the handlebars and at least one foot on the pedals. ## RECKLESS RIDING AND ACROBATICS 84. - 84.1 No person shall operate a bicycle or motorcycle on a street recklessly or negligently or at a speed or in a manner dangerous to the rider or to the public. Riders shall at all times operate their bicycle or motorcycle with due care and attention to the nature and condition of the street and the traffic thereon and no such rider shall engage in any acrobatic feats or any fancy riding on any street. For the purpose of this section acrobatics and/or fancy riding may include, but shall be not limited to: - (a) removing both hands from the handlebars or feet from the pedals - (b) riding a two-wheeled bicycle on one wheel; - (c) towing or drawing any person on roller skates, skis, toboggan, skates, coaster, sled, child's wagon, or any other toy vehicle; - (d) wheeling roller skates, skis, toboggan, skates, coaster, sled, child's wagon, or any other toy vehicle alongside the vehicle so operated; - (e) jumping curbs or medians; or - (f) stunting ## 85. RIGHT HAND SIDE - 85.1 Every person riding a bicycle shall ride as close as possible to the right hand curb or to any person who may be riding a bicycle on their right side, but this shall not apply when the rider is approaching an intersection and indicates his intention to turn from a direct line by giving a visible signal. ## 86. ON SIDEWALK - 86.1 No person shall ride a bicycle or drive a motorcycle upon any sidewalk or boulevard in the Town, but may ride over an approach or sidewalk crossing. ## 87. MOVING VEHICLE - 87.1 No person riding upon a bicycle shall attach their person or the bicycle to any moving vehicle. ## 88. RULES OF THE ROAD - 88.1 Every person riding a bicycle on a roadway in the Town shall conform to The Traffic Safety Act. ## 89. ADEQUATE BRAKING EQUIPMENT - 89.1 Every bicycle, when operated upon a roadway shall be equipped with a brake adequate to control the movement of and to stop such vehicle whenever necessary. Such brake shall be maintained in efficient working condition at all times. ## CARRYING RESTRICTIONS 90. - 90.1 No person shall carry on a bicycle a load of greater than twenty (20kg) Kilograms, nor shall such load extend to a greater width than forty-five (45 cm) centimetres on either side of the centre line of the bicycle nor to such height as to obstruct the clear vision in all directions of the operator of the bicycle when seating on the seat of the bicycle. ## BICYCLES ON STREETS 91. - 91.1 No person shall leave a bicycle in a reclining position on a street, sidewalk or public place in the Town. On those streets on which there is a curb, bicycles when left at the curb shall be left in an upright position. When bicycle stands are provided, no person shall chain or secure by any means whatsoever a bicycle to a pole, tree or any structure on a street, sidewalk or boulevard other than designated bicycle stands. ## 92. SEIZURE OF BICYCLES AND MOTORCYCLE - 92.1 Notwithstanding the Penalty provisions of Section XIlI, a Designated Officer may, without warrant, seize any bicycle or motorcycle that, in their opinion, is being operated in an unsafe manner or deemed abandoned and may retain the same in their possession for any period up to seven (7) days. - 92.2 Where a bicycle or motorcycle has been seized as herein provided, no persons shall remove it from the place in which it has been stored without the written consent of a Designated Officer. - 92.3 Any bicycle impounded and unclaimed for ninety (90) days or more shall be dealt with as lost or unclaimed personal property and sold as per Section 128, Seizure, Removal and Impounding of Vehicles. ## SECTION VI: SKATEBOARDS, LONGBOARDS, ROLLERBLADES AND OTHER MEANS OF CONVEYANCE ## 93. INTERPRETATION OF PART - 93.1 In this Part, "vehicle" includes a skateboard, rollerblades, and other similar means of conveyance, but does not include a wheelchair. ## 94. STUNTING - 94.1 Except as provided in Subsection (2), no person operating or using a vehicle shall perform or engage in any stunt or activity on a sidewalk or other public place that is likely to distract, startle or otherwise interfere with other users of the sidewalk or other public place. - 94.2 Stunting is permitted only within designated skate parks. ## 95. DAMAGING PROPERTY - 95.1 No person skateboarding, longboarding or roller-blading shall do so in a manner which causes damage to roadway or other public place designed and intended for or used by pedestrians or any Town property affixed or placed on a street, sidewalk or other public place designed and intended for or used by pedestrians. ## , SECTION VII: SNOWMOBILES ## 96. SNOWMOBILE BY - PASS ROUTE - 96.1 A Snowmobile By-Pass Route shall be maintained by the Town and available upon request at the Town Office. This By-Pass Route can be changed and/or modified from time to time by the Council through resolution. - 96.2 Subject to the provisions of Section 97 of this Bylaw, it shall be lawful to operate a snowmobile on any highway or portion of a highway within the corporate area of the Town, but only for the purpose of operating the snowmobile from a point of origin within the corporate boundaries of the Town to a point outside the corporate boundaries of the Town, or for the purpose of returning to the said point of origin from a point outside the said corporate boundaries; provided that the corporate boundaries of the Town are entered or exited, as the case may be, via the Snowmobile By-Pass Route, at the nearest possible point to the point of origin and that the most direct and practical route possible between the point of entry or exit and the point of origin is taken. - 96.3 No person shall operate a snowmobile on the By-Pass Route at a speed greater than fifty (50km/hr) kilometres per hour. ## 97. OPERATING A SNOWMOBILE - 97.1 No person shall operate a snowmobile: - (a) on highways or any portion thereof outlined on the By-Pass Route, except only for the purpose of crossing the said highways; - (b) in any public place, whether or not marked by a sign prohibiting or restricting the operation of snowmobiles; - (c) between the hours of 11:00 p.m. and 7:00 a.m. - 97.2 Notwithstanding Section 97.1 it shall be lawful to operate a snowmobile on a highway during an emergency when all other vehicular traffic is unable to travel on said highway due to snow or weather conditions. ## 98. LIABILITY OF OWNER - 98.1 The owner of a snowmobile is liable for a contravention of any provision of this bylaw in connection with the operation of the snowmobile unless they prove that at the time of the offence the snowmobile was not being operated by them nor by any other person with their consent. ## SECTION VIII: LICENSING AND OPERATION OF TAXICABS ## 99. APPLICATIONS FOR THE ISSUANCE OF LICENSES - 99.1 An Application to Operate a Taxicab in the Town of Nipawin shall be taken out by every person who owns or keeps for hire or profit a taxicab or taxicabs as per the current Business Licensing Bylaw. - 99.2 Taxicab licenses shall not be transferable, nor leased or assigned in any manner, except with the written permission of the Council of the Town of Nipawin, and, if permission has not been given, the taxicab licenses on expiration shall be returned to the Town of Nipawin for disposition. - 99.3 Every taxicab license shall have either a bona fide place of business in an area delineated as a Commercial District under the Zoning Bylaw of the Town of Nipawin or classified as a general contractor occupation under discretionary use by the Council of the Town of Nipawin. ## 100. DUTIES OF THE LICENSEES - 100.1 Every person who owns or keeps for hire or profit a taxicab or taxicabs shall produce to the Designated Officer: - (a) Within 24 hours of a demand by the Designated Officer, adequate proof that each vehicle being operated as a taxicab is duly licensed under The Traffic Safety Act for the Province of Saskatchewan and the regulations there under; - (b) By no later than the expiry date of each taxicab's vehicle registration under The Traffic Safety Act and the regulations there under, proof of the renewal of the vehicle registration for the upcoming year; - (c) Within 24 hours upon demand of the Designated Officer, a valid and current light vehicle safety inspection certificate obtained from an inspection station certified by SaskAuto in respect of the taxicab or taxicabs; and - (d) By no later than the expiry date of each taxicab's safety inspection certificate, proof of the renewal of the safety inspection certificate for the upcoming registration year. - 100.2 In the event that any person who owns or keeps for hire or profit a taxicab or taxicabs shall fail to produce any proof required by section 100.1 above, then the taxicab license issued pursuant to section 99 of this Bylaw shall be subject to immediate revocation, whereupon the owner shall immediately return same to the Designated Officer to be held for a period not to exceed 30 days: - (a) Upon the Designated Officer being satisfied within the said timeframe, in the Designated Officer's discretion, that the required registration or certificate is current and in effect, the taxicab license will be reinstated and returned to the owner until its expiration or until it is otherwise revoked. - (b) In the event that the required proof is not filed by the owner of the taxicab within the 30-day period, the taxicab license for the taxicab and all privileges flowing therefrom shall be forfeited by the owner. - 100.3 Every person who owns or keeps for hire or profit a taxicab or taxicabs shall at all times carry in the taxicab or taxicabs, and display conspicuously upon the vehicle: - (a) The taxicab license issued by the Town of Nipawin pursuant to the current Business License Bylaw; and - (b) The taxicab inspection certificate. - 100.4 Every owner or operator of a taxicab shall, when required, submit each and every taxicab owned or operated by them to inspection by the Designated Officer. - 100.5 No person or owner shall operate or permit to be operated any taxicab unless it is: - (a) equipped with an extra tire and wheel ready for use; - (b) clean and in good repair as to its interior; - (c) clean, dry and in good repair as to its exterior; and - (d) free from mechanical defects. - 100.6 Owners and drivers shall treat all clients with respect. Harassment or inappropriate behaviour or communication of any sort will not be tolerated and will result in immediate revocation of license. - 100.7 All drivers will be required to carry, for the customers' inspection, a photo identification card and a Class 4 license. - 100.8 Every vehicle used for conveyance of passengers shall have on it either a lighted display sign or detailed by the use of decals showing its permitted use. - 100.9 Any person who violates any of the provisions of this bylaw shall be subject to prosecution and to the penalties provided for in Schedule AA. ## SECTION IX: PARADES AND ROADWAY CLOSURE ## 101. PARADE PERMIT - 101.1 No parade shall be held without first obtaining written permission from the Council who shall designate and approve the hour and route of the parade. - 101.2 Application for approval for a parade shall be made in writing to the Council, stating: - (a) the nature of the parade; - (b) the intended route; - (c) the number of persons and vehicles expected to take part; and - (d) the time in which it is expected will be required for the parade complete the intended route. - 101.3 No parade shall be held without first obtaining approval from Council for a Road Closure. - 101.4 No person shall participate in a parade for which Road Closure has not been granted by Council. - 101.5 All applications for a Road Closure approval for a parade shall be made to the Town at least thirty (30) days prior to the day of the parade to allow the Town ample time to arrange for policing the route. ## 102. PERMIT CANCELLED - 102.1 The Mayor, CAO, Designated Officer, or Chief of Police shall have the right at any time to cancel approval for a parade upon violation of any of the terms set out in the approval or for other just case. ## 103. LIABILITY RE: PROHIBITED PARADES - 103.1 Any person taking part in or adhering to any parade or procession held or conducted in violation of this Bylaw shall be guilty of an offence and liable to the penalties provided in the same manner as if such person had been in charge of the parade or procession. ## 104. DIVERSION OF TRAFFIC FOR PARADES - 104.1 A Designated Officer is hereby empowered to close whatever streets as deemed necessary during the passage of any procession and to divert traffic to whatever street is deemed advisable. During any parade or procession all pedestrians not taking part therein shall be restricted to the use of the sidewalk. - 104.2 Except with permission in writing by the Chief of Police, all parades must proceed on the right side of the street and not interfere with traffic proceeding from the opposite direction. ## 105. VEHICLE OR PEDESTRIAN CROSSING - 105.1 No vehicle and/or pedestrians shall interfere, obstruct or cross through any roadway of a parade route. ## 106. FUNERAL PROCESSIONS - 106.1 All vehicles in a funeral procession shall have headlights on irrespective of the time of day. ## 107. CLOSING ROADWAYS - 107.1 The Town may close any roadway or sidewalk for the purpose of carrying out road, sewer line or water line construction, repair or improvement or any other work where the Town believes it is necessary to close the roadway or sidewalk to the public. - 107.2 Where the Town has closed a roadway or sidewalk, no person shall enter or attempt to enter the roadway or sidewalk without authorization from the Town. - 107.3 The Town may temporarily close any roadway or sidewalk where in the Town's opinion an emergency exists which requires that the roadway be closed. - 107.4 Individuals and organizations must request and obtain prior approval of any road or sidewalk closure from Council. ## SECTION X: HEDGES, TREES AND OBSTRUCTIONS ## 108. NEAR INTERSECTIONS - 108.1 No person shall plant trees, hedges or shrubs, exceeding one (1) metre (3 feet) in height, within so as to create a visual obstruction in an established intersection sight triangle. ## 109. DANGEROUS TO TRAFFIC OR OBSTRUCTION OF ROADWAYS OR SIDEWALKS - 109.1 No person shall maintain any trees, hedges or shrubs on private land in such a manner as to cause an obstruction on any sidewalk or street and preventing free passage thereon, or the entire use thereof, by vehicles or pedestrians. - 109.2 No person shall place any electrical cord, lumber, tree branch or any other material across any roadway or sidewalk in such a manner that it obstructs or provides an unsafe situation for pedestrian or vehicular traffic. - 109.3 No persons shall place or cause to be placed or keep or maintain on any sidewalk or street within the Town of Nipawin any article or thing that obstructs free passage thereon, or the entire use thereof, by vehicles or pedestrians. - 109.4 Where any person commits or is alleged to have committed an infraction of this section, the Council or an authorized municipal employee is hereby empowered to enforce a remedy of the infraction in the same manner as provided by the Town's Property Maintenance and Nuisance Abatement Bylaw and/or The Municipalities Act for the control of untidy and unsightly lands or buildings. - 109.5 The provisions of the Property Maintenance and Nuisance Abatement Bylaw and/or The Municipalities Act for untidy and unsightly lands or buildings shall be applied. - 109.6 The Designated Officer may order that any hedge, shrub or tree or other obstruction be removed, trimmed, or cut down, for the safety of pedestrians or drivers on a roadway, where a visual obstruction is present. ## 110. DAMAGE TO ROADWAYS - 110.1 No person shall willfully excavate or trench any roadway without written approval from the Town. - 110.2 No person shall operate a vehicle on a roadway if the vehicle would tear, gouge, scar, or otherwise cause damage to the roadway. ## SECTION XI: TRAFFIC SIGNS AND SIGNALS ## 111. AUTHORITY FOR SIGNS - 111.1 The Council may, as specified by Bylaw or Resolution, authorize the erection of traffic signs, traffic signals, or devices; ## 112. STOP SIGNAGE - 112.1 All stop signs shall be erected and maintained at a distance of approximately three (3) metres from the curb at a 90-degree angle to the traffic approaching the intersection. ## 113. YIELD SIGNAGE - 113.1 All yield signs shall be erected and maintained at a distance of approximately three (3) metres from the curb at a 90-degree angle to the traffic approaching the intersection. ## 114. NO PARKING - 114.1 The Town shall maintain and/or erect any signage or curb markings to indicate No Parking areas. Such signs or curb markings shall be visible from that part of the roadway to which the restriction applies. ## 115. GENERAL SIGNS - 115.1 The Town may maintain and/or erect any signage as it may deem relevant for warning, guidance, directions or information purposes. General signage as referred to in the Traffic Bylaw is exempt from conditions and/or specifications set forth in the current Town Zoning Bylaw. ## SECTION XII: PEDESTRIANS RIGHTS AND DUTIES ## 116. SOLICITING RIDES - 116.1 No personal shall stand in a street for the purpose of soliciting a ride from the operator of any private vehicle ## 117. OBSTRUCTING SIDEWALKS OR STREET - 117.1 No person shall obstruct the free passage of traffic on any sidewalk or street. If a Designated Officer determines a person is obstructing the free passage of traffic on any sidewalk or street, the Designated Officer may request such person to move so as to not obstruct the traffic. - 117.2 Nothing in the preceding paragraph shall be construed as prohibiting the congregation of individuals to attend and listen to street preaching on any street approved in writing by the Designated Officer so long as the proceedings are preachable and orderly, and sufficient space is left both on the sidewalks and roadway to accommodate the ordinary traffic of the sidewalks and roadway upon which such preaching takes placed, provided however, that the preacher and all persons congregated shall, upon being requested by a Designated Officer to do so, move from such street. ## 118. RUNNING - 118.1 No person shall race on the streets or sidewalks, or crowd or jostle other pedestrians so as to create discomfort or confusion. ## 119. PEDESTRIAN TO YIELD AT OTHER THAN PEDESTRIAN CROSSWALK - 119.1 A pedestrian crossing or walking on a street at a point other than within a pedestrian crosswalk shall yield the right-of-way to all vehicles upon the street. ## SECTION XIII ENFORCEMENT AND PENALTIES ## 120. EMERGENCY TRAFFIC - 120.1 A Designated Officer is hereby authorized to direct traffic in conformity with this Bylaw and the Act. - 120.2 Notwithstanding any other provisions of this Bylaw, a Designated Officer is hereby authorized to direct or prohibit traffic on any public roadway in any manner they deem necessary to expedite traffic, safeguard pedestrians, prevent accidents or meet any unforeseen conditions and public convenience, whether or not in conformity with this Bylaw or the Act, in the event of a fire, traffic accident, traffic signal light malfunction or other emergency. - 120.3 Every person shall comply with any traffic signal or direction of a Designated Officer given pursuant to this section. ## 121. ALL TO COMPLY - 121.1 Any person who contravenes any of the provisions of this Bylaw or fails to comply therewith or with any notice given thereunder is guilty of an offence and be liable to the penalties as hereinafter provided. Said offence and penalties shall be listed on Schedule AA, or where applicable Summary Offences Traffic Information as set out by the Province of Saskatchewan, and provided to the said person. - 121.2 Any Police Officer responsible for policing the Town, the Designated Officer or any other person specifically appointed by the Town are hereby designated to enforce all Sections of this Bylaw. ## 122. OWNER OF VEHICLE - 122.1 The Owner of a vehicle shall be liable for violation of any of the provisions of this Bylaw in connection with the operation of a vehicle, unless such owner proves to the satisfaction of the Designated Officer, that at the time of the offence the vehicle was not being operated by the owner nor by any person with the owner's consent, express or implied. ## 123. PLACING TICKETS - 123.1 No person, other than a Designated Officer may place a Notice of Violation or Warning Notice on any vehicle. - 123.2 No person, other than the owner or operator of the vehicle, shall remove a Notice of Violation or a Warning Notice from any vehicle. ## 124. CANCELLATION OF TICKETS - 124.1 The CAO or Designated Officer of the Town may only cancel a Notice of Violation where, in their opinion, that Notice of Violation was issued improperly or in error. ## 125. REMOVAL OF OBSTRUCTION, ENCUMBRANCE OR ENCROACHMENT - 125.1 No owner or occupant of any adjoining property shall permit debris to be place, deposited, or moved onto any Roadway or Sidewalk adjacent to the adjoining property without prior written permission from the CAO. - 125.2 Such obstruction shall be removed in accordance with the current Obstructions to Streets, Roads &amp; Property Bylaw. ## 126. ADDITIONAL PENALTIES - 126.1 The owner, driver or operator of a vehicle that is unlawfully placed, parked or kept on any street, parking place or other public place where the length of time parking is allowed is controlled is subject to an additional violation tag each time the allowed time has elapsed. ## 127. PROSECUTION FOR DAMAGES - 127.1 Nothing in this Bylaw shall be construed to curtail or abridge the right of the Town to prosecute an action for damages by reason of damage suffered to any municipal property resulting from the contravention of any of the provisions of this Bylaw. ## 128. SEIZURE, REMOVAL, AND IMPOUNDING OF VEHICLES - 128.1 In addition to, and notwithstanding any penalties provided herein, any Designated Officer, or other person authorized by the Town through resolution, may remove or cause to be removed any vehicle that contravenes any section of the Bylaw and may include, but is not limited to: - (a) any vehicle that is unlawfully placed, left or kept on any roadway, other public place, or on Municipal property; - (b) any vehicle that is placed, left, or kept on any roadway for more than forty eight (48) hours; - any vehicle unlawfully placed, left or kept in contravention of Section 12, Accessible Parking; - (d) any vehicle unlawfully placed, left or kept on a yellow curb; or - (e) any vehicle that is unlawfully parked pursuant to Section I, Stopping and Parking; and may seize, impound or store such vehicle. - 128.2 The Town may retain a vehicle which has been impounded or stored after it has been removed under Section 128.1 until the amount of outstanding fines, if any, and the costs incurred in removing and impounding or storing the vehicle have been paid, and upon payment of said outstanding fines and cost the vehicle shall be released to the Owner. The costs mentioned in this subsection shall include, but are not limited to, the following: - (a) The actual cost of removal. - (b) Administration fee of fifty ($50.00) dollars. - (c) The cost of storage at current SGI rates. - (d) Actual cost of any legal action. - 128.3 Following full payment of any fines, seizure, removal, and impounding fees of the vehicle, the vehicle will be released to the Owner. The Owner must remove the vehicle within forty-eight (48) hours. - 128.4 If the fines and costs described in Section 128.2 have not been paid within a period of thirty (30) days from the date of seizure, the Town shall have the right to recover same from the Owner of the vehicle by: - (a) legal action in court of competent jurisdiction; - (b) sale through public auction; or - (c) by private sale of the vehicle. - 128.5 Prior to the sale of a vehicle which has been impounded or stored under this section, the Town shall provide notice designating the time and place of the sale at least fourteen (14) days prior to the sale by: - (a) publishing a notice on the Town website; - sending a copy of said notice by regular mail to the Owner at the address last appearing on the vehicle registration; and - (c) by any other means which Council may consider appropriate. - 128.6 The proceeds from such sale shall be applied firstly on the fines and costs described in subsection (2) and the balance remaining, if any, shall be paid to the Owner. - 128.7 If the proceeds from such sale are insufficient to satisfy the fines and costs described in subsection (2), the amount of the shortfall shall be a debt due and owing from the Owner and enforceable by the Town in any manner allowed by law. ## 129. FALSE STATEMENT - 129.1 No person shall in any verbal information, report or document for purposes of this Bylaw, make a statement false in any material particular. ## 130. EXCEPTIONS - 130.1 Town employees are exempt from this Bylaw while in the execution of their assigned duties. - 130.2 Notwithstanding any other section of this bylaw, the Chief Administrative Officer may issue a Short-term Permit authorizing parking on a roadway, which shall also include the allowance of overtime parking, as long as the following provisions are met: - (a) An application for parking has been submitted in writing or by email from the operator of the vehicle or motor vehicle; - (b) There is no inherent visibility or hazardous issues identified by the Town; - (c) The Permit has been approved by the Chief Administrative Officer. - 130.3 Where this bylaw requires an application to be made for a Permit or other approval, the Chief Administrative Officer may establish the form and content of the application, the fee to be paid, the documentation required to be submitted with the application and the requirements that must be met to approve the application. ## 131. PENALTIES - 131.1 Any person convicted of a breach of the provisions of this bylaw shall forfeit and pay the ticket, summary, or notice of violation as set out in Schedule A. ## 132. PAYMENT OF FINES - 132.1 Where any person has committed or is alleged to have committed a breach of any of the provisions of this Bylaw, a ticket, summary, or notice may be served on such person by a Designated Officer, or any person duly authorized by Council. Such person served with a ticket or notice may pay same at the Nipawin Town Office between the hours of 8:30 a.m. to 12:00 noon and 1:00 p.m. to 4:30 p.m., excepting Saturdays, Sundays, and public holidays, provided that payment must be made within a period of fifteen (15) days from the service of the said ticket or notice. If payment is made within such time and accepted, then that person shall not be liable to prosecution for the offense. - 132.2 Service of such ticket or notice may be made by attaching the ticket, summary or notice to the vehicle in respect of which an offense has been committed or by mailing such ticket, summary or notice addressed to the registered owner of the vehicle. - 132.3 If the person given such ticket, summary or notice fails to pay the specified ticket, summary or notice within fifteen (15) days of issue date of ticket, summary or notice, the dollar amount doubles as set out in Schedule A. ## 133. NOTICE OF VIOLATION FORMS - 133.1 All violations and associated notices will be given in accordance to the current General Penalty Bylaw. ## 134. RECOVERY OF UNPAID EXPENSES AND COSTS - 134.1 Any unpaid expenses and costs incurred by the Town in remedying a contravention of this Bylaw may be recovered either: - (a) by civil action for debt in a court of competent jurisdiction in accordance with Section 368 of The Municipalities Act; - (b) by collection agency; or - (c) by adding the amount to the taxes on the property on which the work is done in accordance with Section 369 of The Municipalities Act. ## 135. SEVERABILITY - 135.1 In the event that any portion of this Bylaw is declared to be ultra vires by a Court of competent jurisdiction, then such portion shall be deemed to be severed from the Bylaw to that extent and the remainder of the Bylaw shall continue in force and effect. ## SECTION XIV: REPEAL OF FORMER BYLAWS ## 136. REPEAL - 136.1 Bylaw No. 1097/20and all amendments thereto are hereby repealed. ## 137. That Bylaw No. 1135/21 be amended as follows: - a) Add to Schedule G: No Parking the following after point 20.: 3. "21. At the intersection of First Avenue West and Third Street West, - i) 2 parking spaces be removed from the angled parking on the south-east side of First Avenue West, and; 5. ii) 2 parking spaces be removed from the angled parking on the north-west side of First Avenue West" - b) Section IX: Parades and Roadway Closure, 101. Parade Permit have the struck through text replaced with the following bold text: ## 101.
