TOWN OF RADVILLE BYLAW NO. 2018-03 A BYLAW OF THE TOWN OF RADVILLE TO FIX THE RATES TO BE CHARGED FOR THE USE AND CONSUMPTION OF WATER AND TO FIX THE RATES TO BE CHARGED BY WAY OF RENT OR THE USE OF SEWER. Whereas it is expedient to fix rates, the Council of the Town of Radville, in the Province of Saskatchewan, enacts as follows: This Bylaw may be cited as The Utility Service Charge Bylaw. The purpose of this bylaw is to govern charges for water and sewer services within the Town of Radville. The charges to be paid by the water consumer whose water service has been turned on shall be those set out in Schedule "A" attached; provided, however that the minimum shall be payable in every case whether or not any water is consumed. Persons who own or occupy premises drained or that are by bylaw required to be drained into the sewer shall pay for such services a rental rate or service charges in accordance with Schedule "B" attached. Accounts for water service and/or sewer service shall cover a period of three successive months as set out in Schedule "C" attached, and shall be rendered on or before the first day of the month next following such period. Accounts shall be paid within a period of thirty days from the date on which such accounts are rendered. If an account is not paid within the period of thirty (30) days the water may be cut off. When the water service is cut off, it shall not be turned on until all arrears have been paid, together with a fee of one hundred and fifty dollars ($150.00) to cover the expenses of turning off the water and turning it on again (seventy-five dollars - $75.00 to turn on and seventy-five dollars - $75.00 to turn it off); provided that, if it is required to turn on the water service outside the employees' regular hours, the fee shall be an additional fifty dollars ($50.00). If an account is not paid in full by the due date as indicated on the invoice, a Final Warning Notice will be sent to the consumer stating that the arrears and any accumulated interest are to be paid within fifteen (15) days. At the expiration of the date on the Final Warning Notice, if no payment has been received, the order for disconnection will be prepared by the Town Administrator and issued to the Public Works Department. The only method of stopping the Final Warning process or actual disconnection of the water service is payment of the arrears in full. Consumers may make arrangements for payment of utility arrears prior to the disconnection of service with the Town Administrator which will satisfactory cover the costs of the areas within a period as set by the Town Administrator. Where services are discontinued or commenced part way through a billing period, the minimum and overage charge shall be prorated to the minimum portion of one month. The sewage service charges imposed by this Bylaw shall commence at and from the time the premises are occupied. No sewer charges will be levied during any period when the premises are vacant and the water services have been disconnected. All applications for water service in the Town of Radville shall be required to pay a deposit of one hundred dollars ($100.00) upon application for service. The said deposit, which shall remain with the Town, shall be returned to the applicant upon cessation of water service, provided that the utility account has been paid up to date. The Town shall have the right to ration or limit the amount of water furnished to any/or all consumers, should circumstances seem to warrant such action. When water is to be drawn by the tank load, the applicant will be required to take delivery from the Water Treatment Plant and the fee shall be fifteen dollars ($15.00) per 1,000 gallons of water. All water rates hereby established or established by resolution of Town Council under the provisions hereof are hereby constituted as a lien on real property and may be levied and collected in the same manner as taxes from the owner if not paid by a tenant or occupant. A penalty of 2% per month shall be charged on all water and sewer rates and charges unpaid on and after the 30th day of the month following in which they become due. The cost of a new installation of water and/or sewer lines from the Town of Radville's water and/or sewer main to the premises, including sidewalks/curb replacement and pavement recapping shall be borne by the Property Owner. The cost of subsequent repairs and/or replacement of an existing water service line from the curb stop, up to and within the premises, shall be borne by the Property Owner. The cost of subsequent repairs and/or replacement of an existing sewer service line from the Town of Radville's sewer main line, up to and within the premises, shall be borne by the Property Owner. Bylaw No. 2015-02 is hereby repealed. THE rates, charges, tolls or rents contained in this bylaw shall come into force and take effect on January 1st, 2019 with approval being issued by the Saskatchewan Municipal Board. _______________________ ______________________ Mayor Administrator/Clerk READ a first time this 25th day of June, A.D., 2018. Non-metered flat rate for mobile homes - thirty dollars ($30.00) An infrastructure surcharge of ten dollars ($10.00) for each user. SCHEDULE "B" TO BYLAW NO. 2018-03 MONTHLY SEWER SERVICE CHARGES: 1.
