## RURAL MUNICIPALITY OF ABERDEEN NO. 373 BYLAW NO. 2026-03 ## A BYLAW TO MANAGE VEHICLE WEIGHTS WITHIN THE RURAL MUNICIPALITY OF ABERDOVERWEJGHN PERMUTHORIZE THE ISSUANCE OF The Council of the Rural Municipality of Aberdeen No. 373 in the Province of Saskatchewan enacts as follows: ## Part I- PURPOSE AND DEFINITIONS ## Purpose 1. The purpose of this bylaw is to establish or adopt a vehicle weight management system to regulate the weight of vehicles, or vehicles with their loads, using municipal highways or any particular municipal highways in the municipality. 2. Pursuant to section 21 of The Municipalities Act, the municipality shall adopt the following respecting the issuing of Municipal Overweight Transportation Permits; with the Chief Administrative Officer, or Designate, being authorized to issue these permits to persons that qualify for this permit. ## Definitions 3. Except as hereinafter provided, words used in this bylaw shall have the meanings ascribed to them in The Vehicle Weight and Dimension Regulations, 2010. 4. In this bylaw: - b) "Municipality" means The Rural Municipality of Aberdeen No. 373; - a) "Chief Administrative Officer" means the Chief Administrative Officer of the Municipality; - c) "Minister" means the member of the Executive Council to whom for the time being the administration of The Highways and Transportation Act, 1997, is assigned. - d) "Permit" means a Municipal Overweight Transportation Permit issued by the Municipality. ## PART II- VEHICLE WEIGHTS ## Weight Limits on Certain Roads 5. Unless otherwise provided for within this Bylaw, or unless otherwise posted by resolution of Council, the maximum allowable weight on all municipal roads shall be Primary Weight as defined in The Vehicle Weight and Dimension Regulations, 2010, as amended from time to time. 6. The following roads as shown in Appendix "A" of this bylaw shall be designated a road allowing primary weights year-round and shall not be subject to spring road weight restrictions: - a. Terminal Road, adjacent to the West of Section 4-39-02-W3, extending from Highway 27 to Neufeld Road. - b. The portion of Neufeld Road adjacent to the north of the NE 05-39-02-W3, extending from Highway 41 to the intersection at Terminal Road. - c. Korpan Cres, as constructed on the SW 05 and SE 06-39-02-W3, extending from Highway 41 to the limits of the Town of Aberdeen. - d. The portion of Cannon Road adjacent to the West of the SW 05-39-02-W3, extending from Grid 784 to Korpan Cres. 7. No person shall, without a permit issued: - a) pursuant to section 10 of this bylaw; or - b) by the Minister pursuant to section 36 of The Highways and Transportation Act, 1997; <!-- image --> operate or move or cause to be operated or moved a vehicle of which the gross vehicle weight exceeds the limit of 10 tonnes (22,046 pounds), on or over the municipal highways identified as "Bettker Road, Bergheim Road, Drews Road, and Old 27 Road" shown on Appendix "B" and described as follows: - a) Bettker Road- West of Sections 6, 7, 18, 19, and the SW of 30-37-03-W3 - b) Drews Road- East of Sections 6, 7, 18, 19, 30 and the SW of 32-37-03-3 - b) Bergheim Road- North of section 19-37-03-W3 - c) Old 27 Road- East of Sections 3, 10, 15, 22, 27, 34-37-03-W3 and East of Section 3 and the SW of 10-38-03-W3 8. The Municipality may allow persons operating within the Municipality to haul loads in excess of Section 7 of this bylaw, provided that a duly completed "Municipal Overweight Transportation Permit" is first obtained. ## Exemptions 9. The restrictions set out in this bylaw shall not apply to vehicles as exempted in section 3 of The Vehicle Weight and Dimension Regulations, 2010. ## Permits 10. (1) Notwithstanding section 3 of this bylaw, the Chief Administrative Officer may, if satisfied that the vehicle or combination of vehicles can be operated or moved upon a municipal highway without damage to the highway or other property, issue a permit to the registered owner of the vehicle or combination of vehicles to exceed the maximum gross vehicle weights fixed by this bylaw. - (2) The Chief Administrative Officer shall provide permits up to primary weights upon request of occupants residing on the weight restricted road and requiring up to primary weight vehicular access. - (3) The Chief Administrative Officer shall provide permits for primary weights upon request of agricultural land owners/lessees/renters requiring access for feed delivery, cattle or grain movement, or any reason considered legitimate by the Council. Permits are issued for the term requested but not exceeding the calendar year end of December 31 of any year. <!-- image --> (4) No vehicle shall be given a Municipal Overweight Permit for a weight greater than the vehicle's Registered Gross Vehicle Weight; as determined by the motor vehicle registration as issued by Saskatchewan Government Insurance. ## PART III - ENFORCEMENT ## Penalty 11. (1) A person who contravenes any provision of this bylaw is guilty of an offence. - (2) The penalty for breach of any provisions of this bylaw shall be those set out in the General Penalty Bylaw of the municipality. ## Repeal of Previous Bylaws 12. Bylaws 92, 2004-02, &amp; 2007-03 are hereby repealed. ## Coming into Force 13.
