## RURAL MUNICIPALITY OF ARLINGTON NO. 79 ## BYLAW 344 ## A BYLAW TO PROHIBIT OBSTRUCTIONS ADJACENT TO CERTAIN ROAD ALLOWANCES PURSUANT TO SECTION 8(1)(g) OF THE MUNICIPALITIES ACT. The Council of the Rural Municipality of Arlington No. 79 in the Province of Saskatchewan, enacts as follows: 1. For the purpose of this bylaw the expression: 2. (a) "municipality" means the Rural Municipality of Arlington No. 79 of Saskatchewan; 3. (b) "road" means any allowance within the municipality other than: 4. (i) a private road; or 5. (ii) a provincial highway. 2. (a) No person shall hereafter plant trees or shrubs or place stone, earth or gravel piles, sumps, pits, portable structures, machinery or other objects on private property within: - 90 metres from the intersection of the centre lines of any municipal roads, - 50 metres from the centre line of any municipal road. 9. (b) Properties within the boundaries of hamlets are exempted from this bylaw. These properties will be reviewed and decided upon by council on an individual basis. 3. Oil and gas well centres are to be set back a minimum of 60 metres from the edge of any municipal road allowance, and 90 meters from the centre of an intersection. All above ground structures shall be located as far from the road allowance as possible. 4. The council may, by order, direct those in contravention of the provisions of Sections 2 and 3 hereof, to remove the same within a time stated in such order and the provisions of Section 369 of The Municipalities Act, shall apply, mutatis mutandis, if the owner fails to comply with the order. 5. Any person who contravenes the provisions of Sections 2 and 3 hereof is guilty of an offense and liable on summary conviction to the penalties imposed in the general penalty bylaw of the municipality. 6. Bylaw No. 334 is hereby repealed.
