## RURAL MUNICIPALITY OF DUFFERIN NO. 190 BYLAW NO 05-2022
## A BYLAW TO MANAGE VEHICLE WEIGHTS
The Council of the Rural Municipality of Dufferin No. 190 in the Province of Saskatchewan enacts as follows:
1. That pursuant to Section 21 of The Municipalities Act, the municipality of Dufferin NO. 190 shall adopt the following policy respecting the issuing of overweight permits with the Administrator being authorized to issue overweight permits to persons that, in Council's opinion, qualify for an overweight permit.
2. All vehicles operating in the municipality (unless otherwise exempted) shall not exceed the prescribed or ordered "Secondary Highway" weights as determined by Saskatchewan Highways and Transportation and its regulations.
3. The restrictions set out in this bylaw shall not apply to those vehicles described in section 3 of The Vehicle Weight and Dimension Regulations, 2010. or Vehicles registered with an F designation operated by rate payers of the RM of Dufferin No 190
4. The municipality may allow persons operating within the municipality to haul loads in excess of Section 2 of this bylaw, provided that a duly completed "Municipal Overweight Permit" is first completed.
5. Subject to Section 6 of this bylaw, no vehicle shall be given a municipal overweight permit for a weight greater than the vehicle's Registered Gross Vehicle Weight; as determined by the motor vehicle registration, as issued by Saskatchewan Government Insurance.
6. Persons wishing to haul loads above "Secondary" weights, shall make application for permit to the municipal office. Conditions of the permit shall include:
- a) The permit shall be on a Single Trip.
- b) The permittee shall provide to the municipality the registered license plate number of the vehicle, in addition to the vehicle's Gross Vehicle Weight, as determined by the motor vehicle registration as issued by Saskatchewan Government Insurance.
- c) Applicable charges payable to the RM of Dufferin No. 190 for issuance of a permit shall include:
- i) $50 per vehicle for a Single Trip Permit except during Spring road bans; or
11. ii) $100 per vehicle for a Single Trip Permit during Spring road bans.
7. Upon the payment of the above fee the permittee shall receive a copy of the permit for the purpose of the permit to be present in the vehicle for the duration of the Single Trip the permit was approved for.
8. Pursuant to Section 22 of The Municipalities Act, any person who wishes to use a municipal road for the purpose of transporting quantities of goods or materials that, in the opinion of Council, are significant in nature, must first enter into an agreement with the RM of Dufferin No. 190 for the maintenance of any municipal road. Vehicles used in connection with "bulk haul" operations will not be eligible for an overweight permit unless they have first entered into an agreement pursuant to Section 22 of The Municipalities Act.
9. The issuance or non-issuance of an "Overweight Permit" does, in no way, limit the liability of any hauler who may cause damage to the municipal road structure, bridges, and/or culverts and such hauler shall be responsible for the restoration of any road, bridge and/or culvert, should any damage occur.
10. Provincial Road Bans supersede these permits.
