## RM of Edenwold No. 158
## A Bylaw Regulating Vehicle Weights and Dimensions
Whereas, pursuant to Clause 18(1) of The Municipalities Act, 2005, a municipality may establish a system relating to vehicle weights or route designation in the municipality.
The Council of the Rural Municipality of Edenwold No. 158, in the Province of Saskatchewan, enacts as follows:
## 1. DEFINITIONS
In this Bylaw, including this section:
- 1.1 Administrator shall mean the employee or representative of the Municipality tasked with enforcing this Bylaw, or their delegate.
- 1.2 Council shall mean the Council of the Municipality.
- 1.3 Designated Officer shall mean an employee or representative of the Municipality, a member of the Royal Canadian Mounted Police, a Bylaw Enforcement Officer, Community Safety Officer, Development Officer, Chief Operating Officer, or Administrator.
- 1.4 Municipality shall mean the Rural Municipality of Edenwold No. 158.
- 1.5 Over-Dimension Route shall mean a public highway that is designed for overdimension vehicles and includes, but is not limited to:
- a. Township Road 170 from the eastern to western boundary of the Municipality;
- b. Township Road 190 from the eastern to western boundary of the Municipality; and
- Range Road 2190 from Township Road 170 in the north, to Township Road 162 in the south.
- 1.6 Over-Dimension Vehicle shall mean a vehicle that is greater than 2.6 metres in width, 4.15 metres in height, or:
- a. 12.5 metres in length for a single vehicle; and
- b. 23 metres in length for any combination of vehicles and semi-trailers.
- 1.7 Over-Dimension Vehicle Permit shall mean a permit issued by the Ministry of Highways and Infrastructure allowing a person to operate an over-dimension vehicle on over-dimension routes and select public and provincial highways.
- 1.8 Overweight Vehicle Permit shall mean a permit allowing a person to operate a vehicle with a registered gross weight or load in excess of the maximum gross weight permitted by this Bylaw on select public highways.
- 1.9 Primary Weight shall mean primary weight as established in The Vehicle Weight and Dimensions Regulations, 2010, as repealed and replaced from time to time.
- 1.10 Primary Weight Vehicle Permit shall mean a permit allowing a person to operate a vehicle with registered gross weight or load equal to or lesser than primary weight on select public highways.
- 1.11 Public Highway shall mean a road allowance, road, street, or lane as defined by The Highways and Transportation Act, 1997, as repealed and replaced from time to time, within the Municipality, and shall include the shoulder of the roadway, bridge, culvert, drain, or other public improvement erected upon or in connection with a a

public highway, but shall not include provincial highways designated by The Provincial Highway Designation Regulations, 1990, as repealed and replaced from time to time.
- 1.12 Registered Gross Weight shall mean the gross weight specified in a vehicle's certificate of registration issued pursuant to The Traffic Safety Act, 2004, as repealed and replaced from time to time.
- 1.13 Secondary Weight shall mean secondary weight as established in The Vehicle Weight and Dimension Regulations, 2010, as repealed and replaced from time to time.
- 1.14 Vehicle shall include a vehicle, trailer, truck, semi-trailer, or motor vehicle as defined in The Traffic Safety Act, 2004, as repealed and replaced from time to time.
## 2. GENERAL REGULATIONS
- 2.1 This Bylaw may be referred to as the Vehicle Weight and Dimension Bylaw'.
- 2.2 No person shall operate a vehicle with a registered gross weight or load greater than secondary weight on any public highway unless otherwise restricted or permitted pursuant to Sections 3 or 4.
- 2.3 The public highways listed in 3.1 and 4.2 (excluding 4.2.d) shall be illustrated in Appendix A: Map of Vehicle Weight Restrictions, included and forming part of this Bylaw.
## 3. 10 TONNE LIMIT
- 3.1 No person shall operate a vehicle with a registered gross weight or load greater than 10 tonnes on the following public highways:
- a. Zatylny Crescent, Park Meadows Road, Jaxon Road, and Hunter Bay in Park Meadows Estates and Meadow Ridge Estates (SE and SW 13-17-18-W2);
- b. Range Road 2185 (also known as Gravel Pit Road) east of NE 30-17-18-W2 and Section 31-17-18-W2;
- c. South Service Road (also known as Bohach and Bridlewood Service Road) north of portions of NW and NE 19-17-17-W2 and south of Highway 1; and
- d. Bohach Bay, Canterwood Trail, Willowview Bay, and Poplar Trail in Bohach and Bridlewood Estates (portions of NW 19-17-17-W2 and NE 19-17-17-W2).
- 3.2 Pursuant to 3.1, the Administrator may, if satisfied that the vehicle will not damage the public highway:
- a. allow a person to operate a vehicle that provides service to the municipality (for example, a garbage or sewage truck) with a registered gross weight or load greater than 10 tonnes on the public highways listed in 3.1;
- b. issue a one-time Overweight Vehicle Permit to allow a person to operate a vehicle with a registered gross weight or load greater than 10 tonnes providing service to a resident on the public highways listed in 3.1; or
- issue a yearly Overweight Vehicle Permit to allow a resident to operate a vehicle with a registered gross weight or load up to 15 tonnes on the public highways listed in 3.1.
- 3.3 Public highways with 10 tonne weight restrictions shall have signs posted at the beginning and end of each public highway.
## 4. PRIMARY WEIGHT
- 4.1 Pursuant to 2.2 and 3.1, the Administrator may issue a Primary Weight Vehicle Permit if they are satisfied that a vehicle will not damage the public highway.
- 4.2 Pursuant to 2.2, a person may operate a vehicle with a registered gross weight or load equal to or lesser than primary weight on the following public highways without requiring a Primary Weight Vehicle Permit:
- a. Percival Drive, McLeod Road, Industrial Drive, Industrial Drive West, Innovation Drive, portions of South Plains Road, South Plains Road West, Great Plains Industrial Drive, and portions of Great Plains Road in Great Plains Industrial Park (SE 21-17-18-W2, SW 22-17-18-W2, and portions of SE 22-17-18-W2);
- b. Carson Avenue, Carson Crescent, and Carson Road in Carson Business Park (NW 22-17-18-W2);
- c. Spruce Creek Drive, Spruce Creek Crescent, Spruce Creek Road, Spruce Creek Gate, Spruce Creek Lane, Spruce Creek Street, and Spruce Creek Way in Spruce Creek Estates (SW 27-17-18-W2);
- d. Range Road 2172 (also known as Grid 640) north of Township Road 194 to the municipal boundary;
- e. Range Road 2175 east of SE 6-18-17-W2 north of the CP rail line;
- f. Range Road 2181 (also known as Frankslake Road) east of NE 23-17-18-W2, east of Section 26-17-18-W2 and 35-17-18-W2, and SE 2-18-18-W2;
- g. Range Road 2183 (also known as Grid 624) east of SE 21-17-18-W2, Section 1617-18-W2, and NE 9-17-18-W2 north of the CN rail line;
- h. Range Road 2183 (also known as Butte Road) east of NE 21-17-18-W2 and SE 2817-18-W2;
- i. Range Road 2184 east of Sections 5-18-18-W2 and 8-18-18-W2; and
- j. Range Road 2185 east of Section 6-18-18-W2.
- 4.3 Pursuant to 2.2, 3.1, and 4.2, the Administrator may, if satisfied that a vehicle with a registered gross weight or load exceeding primary weight will not damage the public highway:
- a. allow a person to operate a vehicle with a registered gross weight or load exceeding primary weight that provides service to the municipality (for example, a garbage or sewage truck) on a public highway; or
- b. issue an Overweight Vehicle Permit to allow a person to operate a vehicle with a registered gross weight or load exceeding primary weight on a public highway.
- 4.4 Public highways that allow primary weight shall have signs posted at the beginning and end of each public highway.

## 5. OVER-DIMENSION VEHICLE
- 5.1 No person shall operate an over-dimension vehicle on any public highway not listed as an over-dimension route.
- Notwithstanding 5.1, a person may operate an over-dimension vehicle on any public highway if issued an over-dimension vehicle permit.
## 6. INSPECTION, ENFORCEMENT, AND PENALTIES
- 6.1 The administration and enforcement of this Bylaw is hereby delegated to the Administrator.
- 6.2 This Bylaw may be enforced by a Designated Officer.
- 6.3 Any person contravening any provision of Sections 2, 3, or 4 of this Bylaw shall be guilty of an offence and is liable to a penalty of $0.25 per kilogram over the maximum

gross weight permitted by this Bylaw plus any applicable surcharge imposed pursuant to The Victims of Crime Act.
- 6.4 Any person contravening any provision of Section 5 of this Bylaw shall be guilty of an offence and is liable to a penalty of $500 plus any applicable surcharge imposed pursuant to The Victims of Crime Act.
- A person contravening any provision of this Bylaw with four or more offences shall be guilty of an offence and liable on summary conviction to the penalties provided in the General Penalty Bylaw No. 2013-10, as amended or repealed and replaced from time to time.
- 6.6 Where any person makes payment within 14 days of the offence, the fine shall be 50% of the penalty amount.
- 6.7 All disputes arising from the administration of this Bylaw shall be referred to Council, and Council shall be the final authority in all cases.
## 7. SEVERABILITY
- 7.1 This Bylaw shall not be construed to hold the Municipality or its agents responsible or liable for any damage to persons or property caused by the administration of the Bylaw.
- If a court of competent jurisdiction should declare any part, section, sentence, clause, phrase, or other portion of this Bylaw to be invalid, that portion shall not be construed as having persuaded or influenced Council to pass the remainder of this Bylaw. The part, section, sentence, clause, phrase, or other portion of this Bylaw is to be deemed a separate, distinct, and independent provision, and the holding of the Court shall not affect the validity of the remaining portions of this Bylaw.
## 8. REPEAL
- 8.1 Bylaws No. 2019-26, No. 2020-34, and all subsequent amendments are hereby repealed.
## 9. COMING INTO FORCE
- 9.1 This Bylaw shall come into force and take effect on the final passing thereaf
