## Bylaw No. 223/02 ## A BYLAW TO PROHIBIT OBSTRUCTIONS ADJACENT TO ROAD ALLOWANCES Pursuant to the Rural Municipality Act, 1989, Sec. 206 (j)n) The Council of the Rural Municipality of Indian Head No.156, in the Province of Saskatchewan, enacts as follows: 1. For the purposes of this bylaw the expression; - b) "road" means any road allowance within the municipality other than: - a) "municipality" means the Rural Municipality of Indian Head No.156 1. a private road; or 2. a provincial highway; or - c) "other object" does not include fence lines 2. No person shall hereafter place stones, earth, gravel piles, portable structures, machinery or other objects on private property within: - b) Forty-six (46) metres from the centre line of any road. - a) Ninety (90) meters from the intersection of the centre lines of any municipal roads; 3. The council may by order, direct the owner of any private property upon which stones, earth, gravel pile, portable structure, machinery or other object has been placed in contravention of the provisions of section 2 hereof, to remove the same within a time stated in such an order and the provisions of Section 173 of The Rural Municipality Act, 1982, shall apply if the owner fails to comply with the order. 4. Council may at their discretion, and by resolution provide for the removal of the items mentioned pursuant to section 3, at the expense of the municipality, any items which are: - b) Forty-six (46) meters from the centre line of any municipal road. - a) Ninety (90) meters from the intersection of the centre lines of any municipal roads. 5. Any person who contravenes the provisions of Section 2 to 4 hereof, is guilty of an offence and liable on summary conviction to the penalties imposed in the general penalties bylaw of this municipality. 6.
