## RURAL MUNICIPALITY OF MONTROSE NO. 315 BYLAW 2022-05 ## A BYLAW TO REGULATE THE SPEED OF VEHICLES AND ROAD WEIGHT RESTRICTIONS IN THE RURAL MUNICIPALITY OF MONTROSE #315 ## 1. Short Title This Bylaw may be referred to as Traffic Control Bylaw. ## 2. Purpose and Intent This bylaw is intended to: - a) Regulate the speed and weights of vehicles within the municipality - b) Identify areas within the municipality where speed is reduced for vehicles 10 tonne and over; - c) Set out penalties and/or fines for those persons who violate road restrictions and exceed the speed limit on public highways. ## 3. Definitions In this Bylaw: - a) "Highway" means a road, parkway, driveway, square or place designated and intended for or used by the general public for the passage of vehicles, but does not include any area, whether privately or publicly owned, that is primarily intended to be used for the parking of vehicles and the necessary passageways on that area does not include a provincial highway within the municipality as designated pursuant to the provision of The Highway and Transportation Act, 1997; - b) "Vehicle" means a vehicle, trailer or semi-trailer or a motor vehicle as described to by The Traffic Safety Act. ## 4. Provisions - a) No person shall drive a motor vehicle at a greater speed than twenty-five (25) kilometers per hour in any hamlet located within the municipality. (See Appendix "A" Provisional Maps for Drawing) - b) No person shall operate a vehicle at a greater speed than fifty (50) kilometers per hour on roadway known as Buffalo Springs Road and Buffalo Ridge Road located East of O'Malley Road within Section 16-33-06 W3 and Section 20-33-06 W3. (See Appendix "A" Provisional Maps for Drawing) - c) No person shall operate a vehicle at a greater speed than fifty (50) kilometers per hour East of O'Malley on TWP 334 between Range Road 3065 and Range Road 3064. (See Appendix "A" Provisional Maps for Drawing) 4. No person shall operate a vehicle at a greater speed than fifty (50) kilometers per hour East of O'Malley on TWP 332 between Range Road 3065 and Range Road 3062 on the North side of Sections 8, 9 and 10-33-06 W3 and the South side of Sections 15, 16 and 17-33-06-W3. (See Appendix "A" Provisional Maps for Drawing) 5. No person shall operate a vehicle at a greater speed than sixty (60) kilometers per hour with a gross weight in excess of ten (10) tonnes (10, 000 kilograms) within the municipality. - f) Signs indicating the maximum speed and weight allowed will be erected throughout the municipality as required. - g) All other vehicles and roadways not regulated in this bylaw shall be 80 kilometers per hour. - h) This bylaw shall not apply to operators of fire engines or fire department apparatus and shall not apply to operators of ambulances; provided that when such exemptions are being exercised, the provision of The Motor Vehicles Act applies with respect to the use of sirens and red lights, and the vehicles employed are equipped accordingly. The operators must be engaged in emergency duty at the time. - i) This bylaw does not apply to school buses or other exempt vehicles. ## 5. Enforcement - a) Enforcement of the bylaw may be made by a Bylaw Enforcement Officer and/or Peace Officer duly appointed for the enforcement of the municipal bylaws thorough a resolution of council. ## Offences and Penalties - See Appendix B Notice of Violation - a) No person shall: 2. fail to comply with an order made pursuant to this bylaw; - ii. obstruct or interfere with any Designated Officer or any other person acting under the authority of this bylaw: 4. fail to comply with any other provision of this bylaw. - b) A Designated officer who has reason to believe that a person has contravened any provision of this bylaw way serve on that person a Notice of Violation, which Notice of Violation shall indicate that the municipality will accept voluntary payment in the amount of $150.00 to be paid to the municipality within thirty (30) days of the issuance of this violation. - c) Voluntary payment within ten (15) working days of the issuance of a Notice of Violation for a payment levied under this bylaw will reduce the penalty to 50% of the original amount. - d) Where the municipality receives voluntary payment of the amount prescribed under subsection 6(b) or 6(c) within the specified time, the person receiving the Notice of Violation shall not be liable for prosecution of the alleged contravention. - e) Every person who contravenes any provision of subsection 6(a) is guilty of an offence and liable on summary conviction: 9. in the case of an individual, to a fine no more than $150 - ii. in the case of a corporation, to a fine of not more than $150 ## 7. Coming into Force This bylaw shall come into force on the day of its final passing. ## 8. Repeal Upon this bylaw coming into effect, Bylaw 2021-04 is hereby repealed.
