## A BYLAW TO REGULATE THE OPERATION OF VEHICLES AND THE USE OF THE HIGHWAYS WITHIN THE RURAL MUNICIPALITY OF PRAIRIE ROSE No. 309 The council for the R.M. of Prairie Rose No. 309 in the Province of Saskatchewan enacts as follows: 1. This bylaw may be referred to as the Traffic Bylaw. ## Definitions - For the purpose of this policy, the following terms and words shall have the following meanings: - (b) "council" means the council of the Rural Municipality of Prairie Rose No. 309; - (a) "administrator" means the administrator of the municipality; - (C) "highway" means a road, parkway, driveway, square, or place designated and intended for or used by the general public for the passage of vehicles, but does not include any area, whether privately or publicly owned, that is primarily intended to be used for the parking of vehicles and the necessary passageways on that area and does not include a provincial highway within the municipality as designated pursuant to the provision of The Highways and Transportation Act, 1997; - (e) "designated officer" means the Administrator, Royal Canadian Mounted Police, or any other person appointed to enforce municipal bylaws; - (d) "municipality" means the Rural Municipality of Prairie Rose No. 309; - (f) "Speed zone" means any portion of a highway within the Rural Municipality of Prairie Rose No. 309, as designated herein, and identified by a sign erected and maintained at each end thereof, indicating the maximum speed applicable thereto; - (g) "vehicle" means a vehicle, trailer or semi-trailer or a motor vehicle as ascribed to by The Traffic Safety Act. ## infractions 3. (a) Miscellaneous Signs: - i. No person shall, except where authorized by resolution of Council, or when duly authorized by law, erect upon or immediately adjacent to any highway, any sign, marker, signal or light or any advertising sign or device. 3. (b) Speed: - ii. No person shall deface, damage, destroy or remove any sign or marker erected pursuant to this bylaw. 5. No person shall operate a vehicle at a speed greater than forty (40) km per hour on that portion of a public highway within the Hamlet of Esk, as set out in Appendix 1. 6. No person shall operate a vehicle at a speed greater than ninety (90) km per hour on that portion of a public highway described as North of sections 19-, 20-, 21-, 22-, NW-23-, NE-24- all in Township 33; Range 21 and North of sections 19-, 20- and 21all in Township 33; Range 20; west of the second meridian, as set out in Appendix 1. - i. No person shall operate a vehicle at a speed greater than sixty (60) km per hour on that portion of a public highway described as North of NE-23-33-21-2 and NW-24-3321-2, as set out in Appendix 1. ## Penalties 4. (a) Signs: Any person who contravenes any of the provision of clauses 3(a)(i) and 3(a)(ii) of this bylaw is guilty of an offence and liable on summary conviction to the penalties provided in the General Penalty Bylaw of the municipality as enforced by the designated officer. The penalties for these and other traffic vioiations shall be liable to the penalties imposed by the Summary Offence Procedure Act and/or any other applicable legislation. - (b) Speed, etc.: ## Repeal of Bylaws 5. Bylaw #5/79 is hereby repealed 6. Bylaw #1/2000 is hereby repealed. ## Coming into Force 7.
