## RURAL MUNICIPALITY of PRINCE ALBERT No. 461 Bylaw No. 4 of 2010 ## A BYLAW TO PROVIDE FOR THE DISPOSAL OF SNOW WITHIN THE MUNICIPALITY WHEREAS The Municipalities Act, 2005 Statutes of Saskatchewan, c. M-36.1 as amended (hereinafter, "the Municipalities Act") provides that Municipalities may exercise their power to provide peace, order and good government of the Municipality; WHEREAS it is deemed expedient by the council of the Rural Municipality of Prince Albert #461 to provide for and regulate the dumping, placing or depositing of snow on private property, or upon any public property in order to reduce or eliminate the incidence of water runoff and the danger, hazard, and nuisance caused thereby within the boundaries of the Rural Municipality of Prince Albert #461; WHEREAS the Council of the Rural Municipality of Prince Albert #461 deems it necessary to enact a Bylaw for the said purpose; NOW THEREFORE the Council of the Rural Municipality of Prince Albert #461 in open meeting assembled, enact as follows: 1. This Bylaw shall be known as "The Snow Dumping Bylaw". ## 2. DEFINITIONS: In this Bylaw the Term: - a) "Administrator" means the Administrator of the Rural Municipality of Prince Albert #461 or a person authorized to act on this behalf; - b) "Council" means the Council of the Rural Municipality of Prince Albert #461; - c) "Municipality" means the Rural Municipality of Prince Albert #461; - d) "Snow" means snow, ice, or other frozen precipitation not originating from the land on which it is dumped; - e) "Owner" includes an occupant, lessee, tenant, mortgagee in possession and the person in charge of the property, including an agent or contractor, but excludes the Municipality; - f) "Person" means any person or corporation, but excludes the Municipality, or an agent or contractor acting under the authority of the Council or the Administrator; - g) "Property" means any grounds, yard or vacant lot, or land but excludes Public Property or Municipal Property; - h) "Public Property" means any land which a member of the public is lawfully entitled to use without permission. ## APPLICATION: The provisions of the Bylaw shall apply to the entire area of the Rural Municipality of Prince Albert #461 as circumscribed by the Boundaries of the Municipality. ## 4. PROHIBITION: - a) No person shall throw, dump, place, deposit or cause or permit to be thrown, dumped, placed or deposited snow on any Municipal property, road allowance or on any public property within the Municipality. - b) No person shall throw, dump, place, deposit or cause or permit to be thrown, dumped, placed or deposited snow on property unless the Owner of the property has given written permission to do so and obtained proper approval from the Municipality. ## PENALTIES: Any person who commits a breach of any of the provisions of this Bylaw shall be guilty of an offence and shall be liable on summary conviction to the penalties provided by the general penalty Bylaw of the Municipality. ## 6. EXCEPTIONS AND EXEMPTIONS: Exceptions and exemptions to this Bylaw may be made as deemed advisable in the discretion of the Council, made by Resolution.
